HomeMy WebLinkAbout082106m Harnett County Board of Commissioners Minutes of Regular Meeting August 21, 2006 The Harnett County Board of Commissioners met in regular session on Monday, August 21, 2006, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett Boulevard, Lillington, North Carolina. Members present: Teddy J. Byrd, Chairman Beatrice B. Hill, Vice Chairman Dan B. Andrews Walt Titchener Tim McNeill Staff present: Neil Emory, County Manager Wm. A. (Tony) Wilder, Assistant County Manager Dwight W. Snow, County Attorney Kay S. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Andrews led the pledge of allegiance and prayer. Commissioner Andrews moved to approve the agenda as published with the following changes: - add to consent agenda: corrections to March 20, 2006 minutes - add to regular agenda: award of new construction contract regarding Lockhart Shawtown CDBG Project. Vice Chairman Hill seconded the motion and it passed unanimously. Upon motion by Commissioner McNeill and seconded by Commissioner Titchener, the Board unanimously approved the following items on the consent agenda: 1. Minutes: Regular Meeting, August 7, 2006 2. Tax refunds & releases (Attachment 1) 4. Grant Project Ordinance for Single Family Rehabilitation Program (Attachment 2) 5. Harnett Regional Jetport - Grant Agreement number 36244.35.3.1 in the amount of $180,000 to fund the RSA Extension & Glide Slope Site preparation work to be performed by Barnhill Contracting Company. Local match is the in-kind contribution work performed by the military. 6. Harnett Regional Jetport – Vision 100 Grant Project number 36237.25.5.1 for the RSA Extension and Glide Slope Preparation. Local match is the in-kind contribution work performed by the military. 7. Harnett Regional Jetport – Work Authorization No. 05-03, TBI Project No. 2701-0503 (Amendment 1) to provide engineering services for the RSA Grading and Glide Slope Preparation. The cost of these services is $28,760. This includes construction quality control testing and full-time on-site construction observation. No new funds are needed due to falling within current grants. 8. Harnett Regional Jetport – Award of contract to Barnhill Contracting Company in the amount of $279,167.50 for RSA Extension & Glide Slope Preparation. 9. Designation of Standard Status for the Work First Program for 2007-2009 SFY. 10. Harnett-Fuquay Wastewater Project – increasing change order in the amount of $2,489.40 for Park Construction Contract A1. This change order is needed to adjust the quantities of construction materials needed for a certain portion of the Harnett-Fuquay Wastewater Project. 11. Harnett-Fuquay Wastewater Project – increasing change order in the amount of $7,824.00 for Park Constructions Contract A2. This change order is needed to adjust the quantities of construction materials needed for a certain portion of the Harnett-Fuquay Wastewater Project. 12. Authorization for Retired Senior Volunteer Program (RSVP) to submit a grant application to the North Carolina Department of Insurance - Seniors Health Insurance Information Program. The grant funds are designated to assist with expenses incurred by RSVP staff and volunteers participating in Medicare counseling. The focus of the counseling during the grant period, July 1, 2006 – June 30, 2007, will be Medicare Part D-Prescription Drug Plans. Free Medicare counseling will be marketed and available to all Medicare beneficiaries and their families. No matching funds are required from the County. 13. Correction to March 20, 2006 Board of Commissioners meeting minutes to clarify a matter regarding an amendment to the Harnett County Subdivision Regulations: Minute Book 24, page 1016, paragraph 4, substitute “Subdivision Regulations” for “Zoning Ordinance”, and replace existing attachment 12 with revised attachment 12. Revised attachment 12 is copied in Book 24, page_____. Jimmy Matthews, 4375 U.S. 401 N., expressed his concerns with deferred taxes. Vice Chairman Hill moved for the appointment listed below. Commissioner Andrews seconded the motion and it passed unanimously. Adult Care Home Community Advisory Committee Kim Kolosky re-appointed for a 3-year term to expire 8-31-09 Nominated by Commissioner Titchener Mark Locklear, Manager of Planning Services, presented a zoning change request for Edward Scribner, from RA20M to Commercial Zoning District, .86 acre, Hwy 24, Johnsonville Township. The Planning Board recommended approval of the request. Chairman Byrd called to order a public hearing on the matter and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve the zoning change request from RA20M to Commercial as requested. Commissioner Andrews seconded the motion and it passed unanimously. Mark Locklear, Manager of Planning Services, presented a zoning change request for South River Electric Membership Corporation, from RA-20M to Commercial Zoning District, 2.754 acres including R/W of NC Hwy 210, Anderson Creek Township. The Planning Board recommended approval of the request. Chairman Byrd called to order a public hearing on the matter and opened the meeting for comments from the public. Bob Jones, 102 West Pope St., Dunn, attorney representing the applicant, was present to answer questions. No further comments were offered and Chairman Byrd closed the public hearing. Commissioner Titchener moved to approve the zoning change request from RA-20M to Commercial as requested. Commissioner McNeill seconded the motion and it passed unanimously. Joseph Jeffries, Planning Director, presented a proposed resolution amending the Harnett County Zoning Ordinance text. The proposed text recognizes the difference between a licensed and unlicensed massage therapist. The Planning Board recommended approval of the proposed amendment. Chairman Byrd called to order a public hearing on the matter and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Vice Chairman Hill moved to adopt the resolution as presented. Commissioner McNeill seconded the motion and it passed unanimously. (Attachment 3) Commissioner Titchener moved to table the item regarding a proposed Ordinance to Establish a Historic Properties Commission for Harnett County. Commissioner Andrews seconded the motion and it passed unanimously. The proposed ordinance will be discussed at a work session prior to consideration by the Board. Patt Crissman, The Wooten Company, presented the Discussion of Bids for new award of a construction contract for the Lockhart/Shawtown Revitalization Project. On April 3, 2006 the Board of Commissioners awarded a contract to Eberhart Construction, but due to construction delays and Eberhart Construction’s wish to be released from the initial contract, it was requested that a new contract be awarded to Temple Grading and Construction. Commissioner Andrews moved to award the contract to Temple Grading and Construction contingent upon details being worked out regarding land acquisition. Vice Chairman Hill seconded the motion and it passed unanimously. (Attachment 4) Departmental reports were filed with the Board from Planning Services, Animal Control, Emergency Medical Services, Sheriff’s Department, and Finance Department. (Attachment 5) Mr. Emory noted that the North Carolina Department of Transportation’s Litter Sweep Roadside cleanup project is scheduled for September 16-30, 2006. Commissioner McNeill move that the Board go into closed session for the following purpose: To consult with the County staff regarding the handling or settlement of certain litigation, namely the workers compensation claim of Kako Ledbetter in N.C. Industrial Commission claim No. 455432. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3). Commissioner Andrews seconded the motion and it passed unanimously. Commissioner McNeill moved for the Board to come out of closed session. Commissioner Titchener seconded the motion and it passed unanimously. There being no further business, Commissioner McNeill moved to adjourn. Commissioner Andrews seconded the motion and it passed unanimously.
