Minutes of Special Session
March 15, 2011
The Harnett County Board of Commissioners met in special session on Tuesday,March 15,
2011, in the Commissioners Meeting Room, County Administrative Building, 102 East Front
Street, Lillington,North Carolina.
Members present: Timothy B. McNeill, Chairman
Beatrice B. Hill,Vice-Chairman
Dan B. Andrews, Commissioner
Gary House, Commissioner
Jim Burgin, Commissioner
Staff present: Scott Sauer, County Manager
Tony Wilder,Deputy County Manager
Dwight W. Snow, County Attorney

Gina Wheeler, Clerk
Vice Chairman Hill called the meeting to order at 8:00 am and led the pledge of allegiance and
invocation. Both Commissioners House and McNeill arrived around 8:15 am.
The following agenda was before the Board:
1. Presentation of proposed financial policies, strategies and response to the NC Local
Government Commission, Davenport
2. Group Health Insurance Broker Recommendation,Human Resources
3. Census and Redistricting Study,Dwight Snow
4. Vehicle Assignment Review,Planning and Public Utilities
5. Review of 2011 Community Waste Reduction and Recycling Grant application,NC
DEAO,for the Dunn Erwin Landfill Recycling Center, General Services
6. Review of proposed Zoning Ordinance text amendment of a rewrite of the Planned
Unit Development(PUD) regulations,Planning
7. Review of proposed Hazard Mitigation Plan update,Planning
8. Finance Officer's Report
9. Legal Report and Phase 2 Budget Amendment
10. County Manager's Update
11. Closed Session

Chairman McNeill moved to appoint Mark III Brokerage, Inc. as Harnett County's Broker of
Record. Commissioner Andrews seconded the motion. Chairman Burgin moved to table this
until they could look at others. Commissioner House seconded the motion to table which failed
2 to 3. The original motion to appoint Mark III Brokerage, Inc. as Harnett County's Broker of
Record passed 3 to 2.
County Attorney Snow recommended that the County go with Tharrington Smith Law Firm,to
redraw commissioner's district lines as required by law due to the recent census. Commissioner
Andrews moved to endorse Tharrington Smith Law Firm. Commissioner Burgin seconded the
motion which passed unanimously.
General Services requested approval to apply for the 2011 Community Waste Reduction and
Recycling Grant through NC DEAD for the Dunn Erwin Landfill Recycling Center.
Commissioner Andrews moved to approve the application as presented. Vice Chairman Hill
seconded the motion that passed unanimously.
Commissioner Burgin moved that the Board go into closed session for the following purposes:
(1) To consider and give instructions to the County legal staff concerning the handling of the
following legal actions:
a) "County of Harnett vs Colon R. Collins and Allene B. Collins",File No. 10 CVS
1499;
b) "Melody Lee vs County of Harnett and Town of Erwin",File No. 11 CVD440; and
c) "Randy David Rogers Vs County of Harnett"File No. 11CVD330.
(2) To discuss certain personnel matters.
This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3)&(6).
Commissioner Andrews seconded the motion which passed unanimously.
Commissioner Andrews moved that the Board come out of closed session. Vice Chairman Hill
seconded the motion that passed unanimously.
Commissioner Andrews moved to approve the following budget amendments:
285 Legal Services Department
Code 110-4155-410.30-04 Professional Services $40,000 increase
110-0000-389.50-00 Interfund Transfer—HCDPU $40,000 increase
284 Public Utilities Fund
Code 531-9000-431.90-10 Interfund Transfer—General Fund $40,000 increase
531-0000-399.00-00 Fund Balance Appropriated $40,000 increase

Vice Chairman Hill seconded the motion. Commissioner House offered an amendment to the
motion. He said since there is no defined scope of work to be performed by the attorney firm,
before we pay them this $40,000,he would like to have a scope and would like it to include:
1) any criminal or illegal or unethical activity involving any employees, former
employees or commissioners be reported to the Harnett County Board of
Commissioners;
2) and any criminal or illegal activity involving any employees, former employees or
commissioners be turned over to the Sheriff;
3) also any violation of state and federal law regarding installing lines, false reports to
government agencies, false information on permit applications, covered up sewer
spills be reported as well, and also requiring employees to perform work the
contractors have been asked to complete and also anything to do with illegal bidding
practices.
The amendment was seconded by Commissioner Burgin and failed 3 to 2. The original motion
to approve the budget amendments passed 3 to 2.
Commissioner Andrews moved to adjourn the meeting at 12:39 pm. Commissioner Burgin
seconded the motion that passed unanimously.
