Minutes of Regular Meeting
December 7, 2015
The Harnett County Board of Commissioners met in regular session on Monday, December 7,
2015, in the Commissioners Meeting Room, County Administration Building, 102 East Front
Street, Lillington, North Carolina.

Chairman Burgin called the meeting to order at 9:00 am. Vice Chairman Springle led the pledge
of allegiance and invocation.
Chairman Burgin presented Emergency Services Director Gary L. Pope with a resolution by the
Board. Chairman Burgin also presented Mr. Pope with the Order of the Long Leaf Pine Award.
Mr. Pope addressed the group and group pictures were taken.
Chairman Burgin called for additions and deletions to the published agenda. Staff requested the
addition of the Resolution to Honor Gary L. Pope. Commissioner Elmore moved to approve the
agenda as amended. Vice Chairman Springle seconded the motion which passed unanimously.

4) Sheriff's Office requested approval to accept the donation of a Segway from Batteries of
NC & S.W.S. LLC in Angier. The equipment is valued at $3,900.
5) Sheriff's Office requested approval of resolution to award Deputy Jonathan Overby his
service weapon upon his retirement. (Attachment 2)
6) Sheriff's Office requested approval to accept the donation of a 13 month old silver and
tan Bloodhound name "Memphis". This K9 is being donated by the Bergen County
Animal Shelter in Teterboro, New Jersey and its estimated valued is $1,000.

7) Resolution to cancel the December 21, 2015 Regular Meeting of the Harnett County
Board of Commissioners (Attachment 3)
8) Harnett County General Services requested approval of a waiver/fee forgiveness for
Tanner Aviation's past unpaid Special Aviation Service Organization (SASO) fees but
not waiving any lease fees due upon lease execution.
9) Public Utilities requested approval to reclassify an Office Aid position, Salary Grade 51,
to an Office Assistant, Salary Grade 58, due to an increase in duties. Also it has become
challenging to fill the position at the current level. Public Utilities will absorb this cost in
their current budget.
10) Resolution to Sell Real Property: a .062 acre tract to Mrs. and Mrs. Dusty J. Fortin
(Attachment 4)
11) Resolution to Honor Gary L. Pope (Attachment 5)
Chairman Burgin called on Margaret Regina Wheeler, Clerk to the Board, to reorganize the
board. NC General Statute 153A-39 requires the Board of Commissioners to reorganize at its
first regular meeting in December of each year. Ms. Wheeler opened the floor for nominations
for chairman. Commissioner Springle nominated Commissioner Burgin for Chairman.
Commissioner Elmore seconded the nomination. Commissioner Miller moved to close the
nominations. Commissioner Springle seconded the motion which passed unanimously.
Commissioner Burgin was unanimously elected Chairman of the Board.
Chairman Burgin opened the floor for nominations for vice chairman. Commissioner Miller
nominated Commissioner Springle for Vice Chairman. Commissioner Elmore seconded the
nomination. Commissioner Elmore moved to close the nominations. Commissioner Springle
seconded the motion which passed unanimously. Commissioner Springle was unanimously
elected Vice Chairman of the Board.
Chairman Burgin opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
- Cris Nystrom of 391 Center Lane in Bunnlevel addressed the group.
Commissioner Miller moved to approve the appointments listed below. Vice Chairman Springle
seconded the motion which passed unanimously.

Mrs. Honeycutt presented the Harnett County Board of Education's Quality School Construction
Bond (QSCB) applications for discussion. She noted all but approximately $2.2 Million of the
2012 QSCB allocation had been issued. The Board of Education has renew the allocation twice
but now must formally apply for those funds again. The Board of Education is requesting a total
of $2,475,000 for estimated repairs to selected school facilities which are QSCB eligible
projects. Mrs. Honeycutt said the Board of Commissioners would still have to approve the
issuance of debt if the QSCB applications are approved. Commissioner Elmore moved to
approve the Board of Education's applications to reapply for QSCB funding. Commissioner
McKoy seconded the motion which passed unanimously.
Mr. Jeffries presented the following reports:
- Harnett County Financial Summary Report - October, 2015
- Harnett County Sales Tax Analysis by Article — August 2015
- Veteran Affairs Activities Reporting — November 2015
- Sandhills Center Financial Statements and Independent Auditor's Report
Mr. Jeffries reminded the group of their upcoming tour of Shearon Harris on Thursday and the
Annual Employee Appreciation Luncheon on Friday. He also noted the Dunn Chamber is
holding a Government Update Luncheon on Monday, December 14, 2015 at noon.
Chairman Burgin called for any new business. Chairman Burgin said he recently received an
inquiry regarding water availability on Mitchell Road and asked staff to follow up on this.
Commissioner McKoy moved that the Board go into closed session for the following purposes:
(1) To consult with the County's legal staff in order to preserve the attorney-client privilege
concerning the handling of certain claims and litigation including the following cases:
a. "Dollie Griggs, as Administrator of the Estate of Christian Griggs, Plantiff vs
William Pat Chisenhall and Katie Griggs, Defendants" Harnett County File No.:
15 CVS 779; and
b. "Kent Jeffries, et al vs County of Harnett, respondent and Drake Landing, LLC,
intervening respondents" Harnett County File No.: 11 CVS 1187; and
(2) To instruct the County staff concerning the position to be taken by the County in
negotiating the terms of a contract for the acquisition of real property; and
(3) To discuss matters relating to economic development in Harnett County
This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3)&(4)&(5)
Commissioner Elmore seconded the motion which passed unanimously.
Commissioner Elmore moved that the board come out of closed session. Commissioner McKoy
seconded the motion which passed unanimously.
Commissioner Elmore moved to adjourn the meeting at 10:20 am. Commissioner Miller

THAT, WHEREAS, Jonathan Bryant Overby, began his Harnett
County Law Enforcement career on August 4th 2005; and
WHEREAS, after ten years of distinguished service to Harnett
County, Jonathan Bryant Overby will retire; and
WHEREAS, according to North Carolina General Statute 14-402
and 14-409.1, proper permits have been obtained (as attached) in
order to receive the side arm.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that Jonathan Bryant Overby be awarded the following

A RESOLUTION TO CANCEL THE
DECEMBER 21, 2015 REGULAR MEETING OF THE
HARNETT COUNTY BOARD OF COMMISSIONERS

THAT WHEREAS, the Harnett County Board of Commissioners adopted on September
19, 1994 certain Rules of Procedure by which the Board would conduct its meetings; and
WHEREAS, Rule 6 of the Rules of Procedure concerning "Regular and Special
Meetings" states that the Board may cancel the place or time of a particular regular meeting by
resolution: that the Board has determined that it will not meet at its regular scheduled evening
meeting of Monday, December 21, 2015.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett
County that its regular meeting scheduled for Monday, December 21, 2015 at 7:00 p.m. is hereby
canceled; that this Resolution shall be filed with the Clerk to the Board, posed at the regular
meeting place and forwarded to all parties on the County's Sunshine List.
Adopted by the Harnett County Board of Commissioners in regular session, this 7th day
of December, 2015.

ATTACHMENT 4
RESOLUTION TO SELL REAL PROPERTY
THAT WHEREAS, Harnett County is the owner of a 0.062 acre real property tract
located at 228 Alpine Drive, Sanford, NC 27332 in the Barbecue Township of Harnett County;
this tract is a portion of that 2.259 acre tract conveyed to Harnett County in that Deed recorded in
Book 1078, Page 161, Harnett County Registry with Parcel ID No. 03958701002027; and
WHEREAS, Dusty J. Fortin and wife, Kala L. Fortin have made an offer to Harnett
County to purchase said 0.062 real property tract for the purchase price of $1,115.00 pursuant to
the negotiated offer, advertisement and upset bid procedure set forth in N.C. Gen. Stat. § 160A-
269; that the Harnett County Board of Commissioners has considered this offer and said Board
desires through this Resolution to propose to accept the Fortin offer on the condition that the
Fortins pay a 5% deposit ($55.75) and the cost of initial publication, and that the further
requirements of N.C. Gen. Stat. § 160A-269 are met.
NOW THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners pursuant to the provisions of N.C. Gen. Stat. § 160A-269 do hereby propose to
accept the offer by Dusty J. Fortin and wife, Kala L. Fortin of $1,115.00 to purchase that 0.062
acre real property tract upon their deposit of 5% of the offered price ($55.75) and subject to any
upset bids received after publication of the Fortins' offer pursuant to the aforementioned statute.
BE IT FURTHER RESOLVED that the County legal staff will insure the compliance
with N.C. Gen. Stat. § 160A-269 and will provide to the Board a proposed deed at such time that
a final bid has been received for said real property.

RESOLUTION TO HONOR GARY L. POPE
THAT WHEREAS, Gary Lynn Pope began his service with Harnett County on December 1, 1992, and was
appointed Emergency Services Director on August 21, 1995; and
WHEREAS, Gary's tenure as Emergency Services Director has moved Harnett County's emergency response
capability forward as he has built partnerships with emergency agencies and organizations inside and outside of the
County, seeking every possible training opportunity for emergency responders and creating an emergency services
network that other agencies seek to emulate; and
WHEREAS, Gary has spearheaded the creation of numerous county -wide emergency management plans and
committees including an Emergency Management Strategic Plan for the county, an "all hazards" emergency
operations plan, a continuity of operations plan for Harnett County and each of its municipalities, a comprehensive
crisis response plan for Harnett County Schools, a Clandestine Drug Lab Response Plan and a Bio Terrorism Plan,
among others, as well as specialty teams within Harnett County Emergency Services including a dive team, search
and rescue team, and a confined space team, all of which are crucial to local and mutual aid response; and
WHEREAS, Gary has demonstrated a passion for making sure Harnett County's emergency responders are
prepared for any disaster. He has led Harnett County through drills to prepare for many different types of disasters
including natural disasters, terrorism and bio terrorism, Avian flu, school emergencies and nuclear disasters. The
result of these efforts has been evidenced by the County's response to numerous incidents over the years including
search and rescue operations, inclement weather, Hurricane Fran in 1996 and the deadly tornadoes of 2011; and
WHEREAS, Gary has secured more than $1 million in critical equipment and training for area first responders
through U.S. Department of Homeland Security grants; and
WHEREAS, Gary has worked to save the taxpayers of Harnett County money through realignment of the County's
fire tax districts and strategic placement of emergency response equipment and personnel.
WHEREAS, Gary has built strong relationships with emergency response agencies in other counties, as well as
with local, state and federal partners. He never hesitates to offer assistance to surrounding counties and to counties
across North Carolina and the United States, and Harnett County has reaped the benefits of these partnerships when
it has needed assistance; and
WHEREAS, Gary has worked tirelessly to establish Harnett County as a leader in the field of emergency services
and has been recognized with numerous awards for his efforts including the Colonel Nicholas Waters Award, the
North Carolina Public Health Partners Award, North Carolina Society of Fire Rescue Instructors Instructor of the
Year and Erwin Man of the Year.
NOW, THEREFORE, BE IT RESOLVED, by the Harnett County Board of Commissioners that Gary Pope is
hereby commended and honored on behalf of all the citizens of Harnett County for his exemplary service and
contributions to Harnett County. The Board does hereby express its appreciation of Gary for his outstanding
leadership, integrity and dedication given in his service as Emergency Services Director and it further gives its best
wishes to Gary and his family in his retirement.
