Triangle South Workforce Development Board Carolyn Blue and Russell Hieb were reappointed to serve on this board for two-year terms expiring June 30, 2022. Assistant County Manager Brian Haney and Hamett County Information Technology Director Ira Hall provided a brief background and update on broadband efforts in the county. Mr. Hall noted that to date the County had not been able to get any momentum for the project because Internet Service Providers (ISP) had not been interested in partnering with the County. ECC has recently mapped and inventoried services available in the County as well as surveyed citizens regarding their needs. Staff announced that the Growing Rural Economies with Access to Technology (GREAT) Grant, through the NC Department oflnformation Technology 's Broadband Infrastructure Office, has been opened up to Tier 2 counties. This program provides grants to private providers of broadband services to facilitate the deployment of broadband service to unserved areas of North Carolina. Mr. Hall said an RFP will be released soon with the hopes of generating interest from various entities wishing to use the County's assets, to develop and implement new broadband services or enhance existing services, and who is willing to partner with the County to start July 6, 2020 Regular Meeting Minutes Hamett County Board of Commissioners Page 3 of 4 072020a HCBOC Page 6 providing service to our citizens. He said they are asking the ISP to provide the minimum standard of broadband, as well as an overall plan for as much coverage to the entire county, as quickly as possible within three years. Mr. Hall said the County must fund part of the project that will hopefully start in 2021. He responded to questions from commissioners. Jon A. Matthews, Ed.D., Hamett County Provost, who participated remotely, presented Central Carolina Community College 's (CCCC) request to waive the Hamett Promise credit-hour requirement for graduating high school students who were on schedule to meet the requirement pre-pandemic. Mr. Matthews explained that due to COVID-19 some high school students enrolled in college courses experienced challenges that prohibited them from completing those courses. He said some of these students were successfully progressing towards earning the required college credits to be eligible for CCCC's Promise Program. Mr. Matthews said the College would like to extend credit-requirement exceptions to the graduating high school students whose academic records demonstrate that they were on schedule to complete the required course credits for eligibility pre-COVID-19. He noted without this type of exception, between 20 and 40 students, who could truly benefit from the Promise Program, might technically be ineligible due solely to pandemic-related issues. Mr. Matthews responded to questions. Vice Chairman Miller's moved to give CCCC the right to investigate each and every claim and do what they deem necessary. The motion was seconded by Commissioner Springle and approved unanimously. Chairman Penny moved to designate Commissioner Gordon Springle as the Voting Delegate for the upcoming NCACC 113th Annual Conference. Commissioner McKoy seconded the motion that passed unanimously. Mrs. Stewart polled commissioners on who would be participating in the upcoming virtual NCACC 113th Annual Conference. Mrs. Stewart presented the DSS Monthly Report for May 2020. She also announced that the total collections in the Hamett County Department of Social Services, Child Support Enforcement Services Division, totaled over $1 M in March 2020 for the first time this year. Mrs. Stewart provided a brief update on COVID-19 in Hamett County. There was no new business. There was no need for closed session. Vice Chairman Miller moved to adjourn the meeting at 9:34 am. Commissioner Springle seconded the motion which passed unanimously. He explained that the Hamett Regional Water Debt Service Fund, the Workers Compensation Internal Service Fund and the Workforce Development Special Revenue Fund were included in the budget however due to a software error they were not listed in the previous document. He also noted corrections had been made to include positions in the grade tables that were previously excluded. Commissioner Springle moved to approve the corrected FY2020- 202 l Budget Ordinance and Budget as presented. Commissioner Johnson seconded the motion, which passed 4-0. Commissioner Johnson moved to approve the Resolution to Adopt the Interlocal Agreement for a Group Self-Insurance Fund for Risk Sharing or Group Purchase of Coverage between the County of Hamett and the North Carolina Association of County Commissioners and to Join the NCACC Risk Management Pool. Commissioner McKoy seconded the motion that passed 4 -0. (Attachment 1) Director of Hamett County Parks and Recreation Carl Davis provided an update on the government complex park and shared the process that resulted in the recommendation of the new park name. Commissioner Springle moved to accept the recommended name of "Cape Fear Shiner County Park". Commissioner Johnson seconded the motion, which passed 4 -0. Hamett County Natural Resources Director/Conservation Education Coordinator Lynn Lambert presented Hamett County Soil and Water's request, in cooperation with Emergency Management, for approval to accept Emergency Watershed Protection funding in the amounts of $3,202,970 in Federal Assistance (USDA, NRCS) and $1 ,067,057 (NCDA, S&W) to clear storm debris from the Upper Little River, Lower Little River, and Anderson Creek. Mrs. Lambert said the County will have to spend the money first as project costs are reimbursable up to 75% from Federal funding and 25% from State funding upon submission of approved proof of expenditures. She said staff will have the contractor bill monthly so they can issue requests for payment monthly and not wait until project completion. The project is anticipated to take a year to complete. Mrs. Honeycutt responded that the County has sufficient reserves to pay these invoices until reimbursed. Staff noted that this is the first opportunity that the County has ever had for something like this ; a unique opportunity to gain federal and state assistance in debris removal through the Emergency Watershed Program. Mrs. Lambert said clearing out some of the debris would give the flood waters the opportunity to flow freely through which will save properties and lives. Hamett June 30, 2020 Special Session Minutes Hamett County Board of Commissioners Page 2 of 5 072020a HCBOC Page 9 County Emergency Services Director Larry Smith was also present. Discussions continued and staff responded to questions. Commissioner McKoy moved to approve Hamett County Soil and Water 's request for approval to accept Emergency Watershed Protection funding in the amounts of$3,202,970 in Federal Assistance (USDA, NRCS) and $1 ,067 ,057 (NCDA, S&W) to clear storm debris from the Upper Little River, Lower Little River, and Anderson Creek. Commissioner Johnson seconded the motion, which passed 4 -0. Jean Souliere, BusPatrol CEO, presented BusPatrol software and proposed installing BusPatrol equipment on 250 Harnett County school buses at no expense to the county or schools ; saying the program is funded by violators. He said the County would need to pass a local ordinance to allow this. Mr. Souliere reviewed the process used by BusPatrol to cite individuals for illegally passing school buses, which he said could net the County $200,000 a month. Harnett County Senior Staff Attorney Christopher Appel offered some clarifying points and shared concerns. Mr. Souliere responded to questions from commissioners. He noted BusPatrol gets paid 60% of the revenues and the County could cancel the five-year contract at any time without penalty. Tax Administrator Bill Tyson sought direction regarding exemptions, exclusions, late listing penalties as affected by the pandemic. First, Mr. Tyson said June 1 is the statutory deadline for receiving applications for tax relief for taxpayers who qualify for elderly, disabled , and disabled veterans exclusions. He requested approval to extend the deadline to August 1 this year. Mr Tyson said this would allow any taxpayer who would have otherwise qualified for tax relief, and submits the paperwork by August 1, to be approved and the 2020 tax bill adjusted. He noted tax bills become due September 1. Commissioner Springle moved to authorize the Tax Department to extend the application deadline for tax relief for taxpayers who qualify for elderly, disabled, and disabled veterans exclusions to August 1, 2020. Commissioner Johnson seconded the motion that passed 4 -0. Second, Mr. Tyson said the Tax Department has not been doing a good job of auditing exemptions however they have now done a review of a the recommended number of taxpayers , out of approximately 4,800, receiving tax relief through the exclusions previously discussed. He said staff has identified a number of deceased taxpayers whose exemptions have expired, some going back a number of years. Mr. Tyson noted that NC GS 105-312 provides a way to recover taxes for inappropriately applied exclusions, including penalties associated with discovery, with a five-year limitation for looking back. He also noted the Board can waive the penalties if desired. Staff sought direction from the Board on whether they prefer that the Tax Department do discovery and try to collect these amounts including penalties, waive the penalties and collect taxes only, or just correct things going forward. Staff said taxpayers should let them know when these exemptions no longer apply. Commissioner Springle moved to follow procedures and correct issues going forward, as opposed to backwards, and to not try to collect past revenues. Discussions continued and Commissioner Springle withdrew his motion. Staff will provide additional information for discussion during the upcoming July 14th work session. June 30, 2020 Special Session Minutes Hamett County Board of Commissioners Page 3 of 5 072020a HCBOC Page 10 Last, Mr. Tyson said the listing period for Business Personal Property ended January 31 , 2020. If filed before the end of the regular listing period, a filing Extension can be granted until April 15th. He noted the County had more than 500 businesses to file for extensions by January 31 however at least 200 of those businesses did not meet the April 15 , 2020 listing date which means that there will be late listing penalties (10%) added to those tax bills which taxpayers can then appeal. Believing that most of these 200 or so businesses, or their accountants, will try to say that the pandemic caused them to actually list later than the extension date, the Tax Department asked the Board to consider allowing them to accept listings through the end of fiscal year (June 30) as though they were on time; and not assess late list penalties. Mr. Tyson said any taxpayers filing later than that would be subject to late listing penalties. Commissioner Johnson moved to extend the listing period for Business Personal Property through June 30 , 2020 without late list penalties. Commissioner Springle seconded the motion that passed 4 -0. Chairman Penny asked about impact on DMV receipts. Staff will provide commissioners with information about how the five month DMV extension has affected collections for that period. Hamett County Health Director John Rouse and Hamett County Emergency Services Director Larry Smith provided and update on COVID-19 in Hamett County. Mr. Smith talked about a mass distribution of facemasks to citizens throughout the County. Mr. Haney reviewed the County departments and facilities already open to the public with precautions and safeguards are in place. Mr. Price, noting the Planning Board would be meeting virtually soon, sought direction from the Board on the upcoming Board of Adjustment meeting that needs to meet in person. It was the consensus of the Board to allow the Board of Adjustment to meet in person the Commons area. Commissioners will discuss the process for upcoming rezoning public hearings during their July 6 , 2020 regular meeting. Mr. Haney responded to questions about the Coronavirus Relief Fund allocation. Commissioners requested regular updates regarding how the monies are distributed. Mr. Haney noted that municipalities are required to develop their own plans for the funds. Mr. Appel presented for consideration a proposed Face Covering Emergency Proclamation if commissioners wish to extend the certain face covering requirements of Executive Order No. 147 to all Hamett County buildings and facilities. He stated that local government buildings are exempt from the Governor's Executive Order regarding face coverings requirements and the county manager is not authorized to require the public to wear face masks in county buildings. Chairman Penny read the proclamation aloud. Mr. Appel said it would be up to staff to ask folks to put on face mask or leave the building. He stressed that staff will try to serve the citizen regardless however citizens could be trespassed if individual becomes very disruptive. Commissioners discussed the proposed Face Covering Emergency Proclamation presented by staff and approved the proclamation by consensus. Commissioners review applications to serve on Boards and Committees. Staff also reviewed invitations and upcoming meetings. There was no need for closed session. In the alternative, the parties may agree that Recipient will replace, with like kind and quality as determined by Provider, Provider's materials and supplies used or damaged in a reasonable time. If such an agreement is made, it shall be reduced to writing and transmitted to the North Carolina Division of Emergency Management. D. It is mutually understood that Recipient and Provider shall be responsible for payment of such workers' compensation benefits only to their own respective employees. Further, it is mutually understood that Provider will be entirely responsible for PAG E 7 OF 11 072020a HCBOC Page 49 NORTH CAROLINA STATEWIDE EMERGENCY MANAGEMENT MUTUAL AID AND ASS ISTANCE AGREEMENT REVIS ION 2020 the payment of workers' compensation benefits to its own respective employees pursuant to G.S. 97-51. SECTION X. IMMUNITY Pursuant to G.S. 166A-19.60 all activities performed under this Agreement are hereby declared to be governmental functions. SECTION XI. PARTIES MUTUALLY AGREE TO HOLD EACH OTHER HARMLESS FROM LIABILITY To the extent allowed by applicable law, each party (as indemnitor) agrees to protect, defend, indemnify, and hold the other party (as indemnitee), and its officers, employees and agents, free and harmless from and against any and all losses, penalties, damages, assessments, costs, charges, professional fees, and other expenses or liabilities of every kind and arising out of or relating to any and all claims, liens, demands, obligations, actions, proceedings, or causes of action of every kind in connection with or arising out of indemnitor's negligent acts, errors and/or omissions. lndemnitor further agrees to investigate, handle, respond to, provide defense for, and defend any such claims, etc. at indemnitor's sole expense and agrees to bear all other costs and expenses related thereto. To the extent that immunity does not apply, each party shall bear the risk of its own actions, as it does with its day-to-day operations, and determine for itself what kinds of insurance, and in what amounts, it should carry. Each party understands and agrees that any insurance protection obtained shall in no way limit the responsibility to indemnify, keep, and save harmless the other parties to this Agreement. Notwithstanding the foregoing, to the extent that each party does not purchase insurance, it shall not be deemed to have waived its governmental immunity by law. SECTION XII. ROLE OF THE DIVISION OF EMERGENCY MANAGEMENT Pursuant to GS 166A-19.12(19) and under this agreement, the responsibilities of the North Carolina Division of Emergency Management are: (1) to serve as the central depository for executed Agreements, to maintain a current listing of entities with their authorized representatives and contact information, and to provide this listing to each of the entities on an annual basis; (2) to coordinate the provision of mutual aid and assistance to a requesting party, pursuant to the provisions of this Agreement; (3) to keep a record of all requests for assistance and acknowledgments; ( 4) to report on the status of ongoing emergency or disaster-related mutual aid and assistance as appropriate; and (5) if the parties so designate, to serve as the eligible entity for requesting reimbursement of eligible costs from FEMA and provide information, directions, and assistance for record keeping pursuant thereto. Thereafter, this Agreement shall continue to be binding upon the parties in subsequent years, unless canceled by written notification served personally or by registered mail upon the Director of North Carolina Division of Emergency Management, which shall provide copies to all other parties. The withdrawal shall not be effective until sixty (60) days after notice thereof has been sent by the Director of the North Carolina Division of Emergency Management to all other parties. A party's withdrawal from this Agreement shall not affect a party's reimbursement obligations or any other liability or obligation under the terms of this Agreement incurred prior to withdrawal hereunder. Once the withdrawal is effective, the withdrawing entity shall no longer be a party to this Agreement, but this Agreement shall continue to exist among the remaining parties. SECTION XV. HEADINGS The headings of various sections and subsections of this Agreement have been inserted for convenient reference only and shall not be construed as modifying, amending, or affecting in any way the express terms and provisions of this Agreement. SECTION XVI. Accordingly, it is the intention of the parties that the remaining portions of this Agreement shall remain in full force and effect without regard to the clause(s), sentence(s), provision(s), paragraph(s), or other part(s) invalidated. In the event that parties to this Agreement have entered into other mutual aid and assistance contracts, for example pursuant to Chapter 160A of the North Carolina General Statutes, those parties agree that to the extent a request for mutual assistance is made pursuant to this Agreement, those other mutual aid and assistance contracts are superseded by this Agreement. REASONING: The impact to the surrounding commun i ty is reasonable, as the requested zoning district is same as adjacent properties. The requested zoning district is COMPATIBLE w ith the existing Land Use Classification. REASONING: The requested zoning is compatible with the overall land use classification of Medium Density Residential. MDR could have a mixed residential base with average l ot sizes where public utilities are planned and utilized. The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested zoning to RA -20M would maintain the public health, safety and general welfare due to the existing residential uses within the area. The request is for a SMALL SCALE REZONING and should be evaluated for reasonableness. REASONING: Due to the size of the tract, this application does not have to be evaluated for Small Scale Rezoning . Suggested Statement-of-Consistency (Staff concludes that...) As stated in the evaluation, the requested rezoning to RA-20M is compatible with the County's Land Use and would not harm the surrounding community based on the existing residential uses. Therefore, it is recommended that this rezoning request be APPROVED. Explanation of why the zoni ng change is requested , addressing applicable portions of Article XII of the Zoning Ordinance We, as the family of the late Arlene Buchanan Crissman and now owners of Parcel 11286 (14.5 acres of farmland with a dilapidated farmhouse) propose that the rear 5.26 ac res (that section away from Highway 421 N) be rezoned from Commercial to Residential (R 30) so o ur youngest sister, Audrey Michelle C ris sman, may build a home there. We believe that our request is pursuant to ARTICLE XII AMENDMENTS, HEARING PROCEDURES, APPEALS, & VARIANCES because a) the change would not affect the composition of the community - the surrounding properties arc zoned both commercial and residential, b) it would be in the public interest to maintain a single family residence there , c) the use of the land for a single-famil)' home would be appropriate, d) the character o f the neighborhood would not be altered so no adverse effects arc anticipated , and d) the change proposed repre sen ts sound planning. Our property is located in an area with both commercial and residential -zoned properties (please sec Zoning Map A below). There are several homes in our neighborhood, but currently no adjoining commercial businesses . The rear 5 .26 acres, as you see from the a ttached Zoning Map (ple ase sec Zoning Map 8 below), is contiguous Lo the su rrounding residential areas and complements the Holly Springs C hurch communi ty. My family has lived on thi s farm and in the o ld farmhouse since 1953. C urrently, our two sisters, both public school librarians live in the farmhouse. Our siste r, Audrey, has se lected a modular home and can have the project completed in nine months. We appreciate the guidance provided hy the Planning Department and would be grateful for the Commission's appro\'al of our zoning change request. Thank you for your consideration. (d) an Installment Financing Contract dated as of August I, 2015 (the "2015 First Bank Contract ") between the County and First Bank, the proceeds of which were used to (i) refinance the acquisition, construction, renovation, equipping and furnishing of the County's Agricultural Center and Animal Control Center, (ii) finance various improvements to the County's Public Works Facility, and (iii) finance the acquisition of land; (e) an Installment Financing Contract dated as of April 21 , 2016 (the "2016 Contract " and, together with the 2010 Contract, the 2011 Contract, the 2015 Contract and the 2015 First Bank Contract, the "Prior Contracts "), between the County and Regions Capital Advantage, Inc., the proceeds of which were used to refinance (i) the construction, furnishing and equipping of Boone Trail Elementary School and (ii) the construction, furnishing and equipping of additions to Hamett Central High School, Johnsonville Elementary School and Highland Elementary School; (f) the County's Enterprise Systems Revenue Refunding Bond, Series 2015 (the "Revenue Bond "), issued pursuant to a General Trust Indenture dated as of May 15 , 2007 and Series Indenture, Number 3 dated as of April 1, 2015, the proceeds of which were used to refinance various water and sewer system improvements ; (g) the County's Special Obligation Bond, Series 2013 (the "Special Obligalion Bond") issued pursuant to a bond order duly adopted by the Board of the County on December 17 , 2012 and a bond resolution duly adopted by the Board on December 17 , 2012, the proceeds of which were used to (1) acquire, construct and install a leachate collection system at the Dunn Erwin Landfill facility and (2) make certain improvements to the facility 's convenience center and transfer station ; and (h) three revolving loans with the State of North Carolina (together with the Prior Contracts, the Revenue Bond and the Special Obligation Bond, the "Prior Obligations "), the proceeds of which were applied to finance various water and sewer system improvements; WHEREAS, in order to accomplish the refinancing of the Prior Obligations, the County proposes to (1) execute and deliver an installment financing contract (the "Contract ") in an amount not to exceed $90,000,000 and (2) enter into a deed of trust, security agreement and fixture filing (the "Deed of Trust") related to the County's fee simple interest in one or more of the school facilities that were financed or refinanced with the proceeds of the Prior Contracts, together with the improvements thereon; WHEREAS, the Board hereby determines that the refinancing of the Prior Obligations is essential to the County 's proper, efficient, and economic operation and to the general health and welfare of its inhabitants and will provide an essential use and permit the County to carry out public functions that it is authorized by law to perform; WHEREAS, the Board hereby determines that entering into the Contract is necessary and expedient for the County by virtue of the findings presented herein; PPAB 570 7546 v l 072020a HCBOC Page 107 WHEREAS, the County hereby determines that the Contract will allow the County to refinance the Prior Obligations at a favorable interest rate currently available in the financial marketplace and on terms advantageous to the County; WHEREAS, the County hereby determines that the estimated cost of refinancing the Prior Obligations exceeds the amount that can be prudently raised from currently available appropriations, unappropriated fund balances and non-voted bonds that could be issued by the County in the current fiscal year pursuant to Article V, Section 4 of the Constitution of the State; WHEREAS, although the cost of refinancing the Prior Obligations pursuant to the Contract is expected to exceed the cost of refinancing the Prior Obligations pursuant to a bond financing for the same undertaking, the County hereby determines that the cost of refinancing the Prior Obligations pursuant to the Contract and the obligations of the County thereunder are preferable to a general obligation bond financing or revenue bond financing for several reasons, including but not limited to the following: ( 1) the cost of a special election necessary to approve a general obligation bond financing, as required by the laws of the State, would result in the expenditure of significant funds; (2) the time required for a general obligation bond election would cause an unnecessary delay which would thereby decrease the financial benefits of refinancing the Prior Obligations; and (3) insufficient revenues are produced by the facilities financed by the Prior Obligations so as to permit a revenue bond financing; WHEREAS, the County has determined and hereby determines that the estimated cost of refinancing the Prior Obligations pursuant to the Contract reasonably compares with an estimate of similar costs under a bond financing for the same undertaking as a result of the findings delineated in the above preambles; WHEREAS, the County does not anticipate a future property tax increase to pay Installment Payments falling due under the Contract; WHEREAS, the sums to fall due under the Contract will be adequate but not excessive for its proposed purpose; WHEREAS, Parker Poe Adams & Bernstein LLP, as special counsel, will render an opinion to the effect that entering into the Contract and the transactions contemplated thereby are authorized by law; WHEREAS, no deficiency judgment may be rendered against the County in any action for its breach of the Contract, and the taxing power of the County is not and may not be pledged in any way directly or indirectly or contingently to secure any moneys due under the Contract; WHEREAS, the County is not in default under any of its debt service obligations; WHEREAS, the County's budget process and Annual Budget Ordinance are in compliance with the Local Government Budget and Fiscal Control Act, and external auditors have determined that the County has conformed with generally accepted accounting principles as applied to governmental units in preparing its Annual Budget ordinance; WHEREAS, past audit reports of the County indicate that its debt management and contract obligation payment policies have been carried out in strict compliance with the law , and the County has not been censured by the North Carolina Local Government Commission (the "Commission"), external auditors or any other regulatory agencies in connection with such debt management and contract obligation payment policies; WHEREAS, the County must obtain the Commission 's approval to enter into the Contract; PP AB 570 75 46 v l 072020a HCBOC Page 108 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF HARNETT, NORTH CAROLINA, AS FOLLOWS: Section 1. This legislation was created to control the practice of "pension spiking," in which a member's compensation substantially increases, resulting in a monthly retirement benefit that is significantly greater than the member and employer contributions would fund. The Contribution-Based Benefit Cap (CBBC) approach was created to protect each system for current and future retirees and to prevent all employers in the Retirement Systems from absorbing the additional liabilities caused by compensation decisions made by other employers. This legislation applies to members who retire on and after January 1, 2015, with an average final compensation of $100,000 or higher (adjusted annually for inflation), and will directly impact only a small number of those individuals. It requires the member's last employer to pay the additional contribution required to fund the member's benefit in excess of the cap. [G.S. 135 -5(a3); 135-4(jj); 128-27(a3); and 128-26(y)] In order to assist employing agencies with planning and budgeting to comply with the CBBC provisions, we are r e quire d to r eport monthly to e ach employer a list of those members for whom the employer made a contribution to the Retirement System in the preceding month that are most likely to require an additional employer contribution should they elect to retire in the following 12 months . This letter and the attached report serve as our required monthly notification to your agency under this provision. [G.S. 135-8(f)(2)(f) and G.S.128-30(g)(2)(b)] The chief financial office r of your agency i s required to provide a copy of the attached report to the chief executive of your agency, as well as to the governing body, including any board which exercises financial oversight. Additionally, the chief financial office r of a public school syste m is required to provide a copy of the report to the local board of education and notify the board of county commissioners of the county in which the local adminis trative unit i s located that the report was receive d and how many employees w ere lis ted in the r e port. [G.S. 115C-436(c); 135- 8(j); and 128-30(j)] For the purpose of d e termining the employees of your agency that are likely to require an additional employer contribution should they elect to retire in the following 12 months , the Retirement System modified the criteria used in the CBBC calculation. This allows for a broad lis t of potential e mploye es, including those whose compensation average may appro ach the threshold and a ttempts to provide your a gency with prior notification of a potential cost.
