Jay,
The Harnett CTP is mutually adopted by the county, municipalities, CAMPO and NC Board of Transportation. The plan is endorsed by the Mid-Carolina RPO. So this is an official legal document.
If the County/ Municipality’s Land Development/ Zoning Code requires a developer to build recommended Bike/Ped facilities based on the adopted plan, then yes you can use the CTP as a
regulatory tool.

the link above references the Town of Cornelius Land Use Plan. Page 7-6 lists that developers should provide Bike and Ped facilities in accordance with specific plans.
I have seen the generalize statement like: developer provides the bike/ped facilities proposed in the adopted plan.

Hey Darius…. I have another question on the CTP & its content. This is probably a silly question, but w/in our amended CTP from 2016 we have several “needs improvement” & “recommended”
locations for new on-road bike lanes and a few multi-use paths. We can use this as a regulatory tool to require the developers to build these, correct?

Jay,
The CTP does not provide guidance requiring the reservation or dedication of right-of-way. While the CTP does provide right-of-way data for roads that are within the CTP study area,
the State considers the reservation or dedication of right-of-way to be a local issue. Counties and municipalities are responsible for establishing and enforcing requirements that
are specific to their local areas.

Darius….can we, as a County, require the reservation or dedication of right of way via the CTP? Our UDO has some very loosely worded info that pertains to the CTP, but “reservation
or dedication” isn’t specifically stated. I know municipalities can since they maintain their own streets, etc.
