Minutes of Regular Meeting
February 18, 2008
The Harnett County Board of Commissioners met in regular session on Monday,
February 18, 2008, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner House led the
pledge of allegiance and prayer.
Commissioner McNeill moved to approve the agenda as published with deletion of item
7. request to address the board, and addition to the consent agenda of a salary adjustment
for the building code administrator. Commissioner Andrews seconded the motion and it
passed unanimously.
Upon motion by Commissioner McNeill and seconded by Vice Chairman Hill, the Board
unanimously approved the following items on the consent agenda:

• 5. March 3rd Board of Commissioners meeting canceled.
6. Resolution recognizing Eagle Scout Alvis Bryant Wood (Attachment 3)
7. Contract with Cherry, Bekaert &Holland to audit the County's accounts for the year
ending June 30, 2008. The fee for these services will be $95,000. This is approximately
a 10% increase over last year's fees. Regulations have changed and more time will be
required regarding internal control testing.

8. Resolution Celebrating 100 Years of County Unity in Recognition of the North
Carolina Association of County Commissioners' Centennial (Attachment 4)
9. Block Grant Agreement-Vision 100 with the NC Department of Transportation for
the Harnett Regional Jetport to be used to update the airport layout plan, expand the
apron area, rehabilitate the taxiway and relocate the beacon according to the master plan.
A ten percent local match is the in-kind contribution work performed by the military.
The amount of the grant is $150,000.
10. Lease Agreement with Raul Aguirre Berduzco for a lot in Upper Little River •
Township to be used as the Mamers Container Site. The lease of the property is for one
year with rent amount of$1,900.
11. Authorization for the Sheriffs Department to accept the gift of a 3 year old female
bloodhound, K-9 Justice
12. Authorization for Cooperative Extension to submit a grant application to the NC 4-H
Youth Development Fund, 4-H Innovative Project Grant. If awarded the grant amount
will not exceed $1,000 and will be used to start a Harnett County 4-H Target Shooting
Sports Program.
13. Authorization for creation of a new part-time/temporary position for the Teens As
Parents Grant Program. Salary for this position is 100% funded by the Governor's Crime
Commission and is currently in contracted services line item. With the new position
Cooperative Extension will employ a part-time social worker to facilitate the program.
14. Resolution Regarding Military Impact Funds (Attachment 5)
15. Authorization for Library to submit an application for a Strengthening Collection
Grant from the State Library FY 2008-2009. The request is for$10,000 to be used for
the purchase of juvenile titles,both fiction and nonfiction, for preschool and school-aged
children in the Coats Branch of the Harnett County Library system. There is a match of 4 •
to one and the current book budget will meet those requirements.
16. Resolution authorizing Coats-Grove Fire &Rescue, Inc. to refinance building and
property(Attachment 6)
17. Resolution to approve Coats-Grove Fire &Rescue, Inc. financing up to $400,000.00
for the purchase of a rescue/pumper truck(Attachment 7)
18. Authorization for Sheriff's Depaitiiient to use sole source method to purchase a
Police Priority Dispatch System for the 911 Center. This equipment will establish a
uniform system of dispatching law enforcement and Emergency Medical Services calls.
19. Resolution allowing South Central Water and Sewer District to reimburse itself for
capital expenditures incurred in connection with the construction of wastewater collection
system improvements (Attachments 8)
20. Authorization for Vanessa W. Young, Finance Officer and Judy Strickland,
Purchasing Agent to finalize financing with RBC Centura Bank for amount of
$213,908.00 for the lease-purchase of two ambulances for the Harnett County Emergency
Medical Services Department. The purchase was approved in the FY 2007-2008.
21. Resolution of support for Campbell University's plans to install a roundabout at the •
intersection of SR2084, SR1532 and SR2054 (Attachment 9)
22. Authorized a 5% special salary adjustment for the Building Code Administrator.
During the informal comment period Jim Burgin and Ricky Temple provided general
comments on various issues.

Commissioner Andrews moved to re-appoint Tonya Gray to the Harnett County Council
for Women. Vice Chairman Hill seconded the motion and it passed unanimously. Ms.
Gray is appointed for a 3-year term to expire February 28, 2011.
Sue Zislis, Chairman, Harnett County Recycling Task Force,presented the findings and
recommendations from in-depth study regarding recycling in Harnett County. Jerry
Blanchard, Solid Waste Director, thanked the Task Force for the thorough job of the
study. He noted that improved signage and general site improvements had already
begun. A new recycling site will be opened at.Campbell University April 1st. Comments
• were also made by Dr. Mike Larsen,biology professor at CU and Jim Hickman, local
government assistance team leader, DPPEA.
Mark Locklear, Manager, Planning Services,presented a zoning change request for Pat
Cameron, applicant and JEDA, LLC, landowner- 8.99 acres, from RA-20R to
Commercial, located at 17 Buffalo Lake Road, Barbecue Township. The Planning Board
voted unanimously to recommend approval of the request. Chairman Byrd called to
order a public hearing and opened the meeting for comments from the public. No
comments were offered and Chairman Byrd closed the public hearing. Commissioner
McNeill moved to approve the zoning change as presented. Commissioner Andrews
seconded the motion and it passed unanimously.
Mark Locklear, Manager, Planning Services, presented proposed Zoning Ordinance text
amendments which had been discussed at a recent Commissioners work session. Mr.
Locklear noted that some of the revisions involve sign requirements including university
and college sign requirements. The Planning Department is currently working towards a
Unified Development Ordinance and other revisions are necessary to correct
typographical errors,update internal references, reorganize information, clarify
regulations and convert lists to tables. The Planning Board voted unanimously to
recommend adoption of the text amendments. Chairman Byrd called to order a public
hearing and opened the meeting for comments from the public. No comments were
• offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to
adopt two resolutions that approve all the text amendments as presented. Commissioner
House seconded the motion and it passed unanimously. (Attachment 10)
Hiram Marziano, Marziano &McGougan Engineers,presented a Discussion of Bids
associated with two separate construction contracts for the South Central Wastewater
Phase IA Project. Formal bids were received on December 19, 2007. 'A total of 9 bids
were received for contract number 1 and low bidder was Triangle Grading &Paving of
Burlington, NC. The proposal was for the amount of$6,185,885. The low bid on
contract number 2 out of the 3 received was submitted by TA Loving Company of
Goldsboro,NC. Public Utilities Department recommends award to this contractor in the
amount of$795,000. Commissioner Andrews moved to adopt a resolution to award the
contracts as recommended contingent upon the approval of an additional three million
dollars of loan funds provided by the USDA Rural Development; and authorize HCDPU
to provide interim financing until such time as additional funds can be processed and
received from USDA. Vice Chairman Hill seconded the motion and it passed
unanimously. (Attachment 11)
Steve Ward, Assistant Director, Public Utilities, presented for the Board's consideration a
Revised Water Shortage and Conservation Ordinance. Mr. Ward noted that in light of the
recent drought conditions throughout the County watershed, there is a need to update the
existing ordinance to minimize the need to make last minute decisions regarding the
• enactment of water conservation measures throughout the County. Commissioner House
moved to adopt the Revised Water Shortage and Conservation Ordinance. Vice
Chairman Hill seconded the motion and it passed unanimously. The ordinance is copied
into Ordinance Book 2.
Gary Pope, Director, Emergency Management,presented a request from Spout Springs
Fire Department for authorization to purchase two new fire trucks. Mr. Pope introduced
Robert Doberstein, Chairman, Spout Springs Board of Directors, who explained that they
would piggy back the purchase off Wake County specifications which would lower the
price to $300,000 for each truck. Commissioner McNeill moved to authorize the

purchase of the two trucks. Vice Chairman Hill seconded the motion and it passed
unanimously.
Departmental reports were filed with the Board from the Planning Depaitiiient and
Finance Department. (Attachment 12)
Commissioner Andrews moved to adopt a resolution requesting the NCDOT to consider
lowering the speed limit on a portion of Hwy. 401 through Kipling. Vice Chairman Hill
seconded the motion and it passed unanimously. (Attachment 13) .
Mr. Emory presented two requests regarding tax penalty fees. Commissioner McNeill ID
asked to recuse himself from voting on the matter due to being a relative of one of the
taxpayers. Commissioner Andrews moved to excuse Commissioner McNeill from voting
on this matter. Vice Chairman Hill seconded the motion and it passed unanimously.
• Commissioner Andrews moved to approve a release of$84.56 for Advance Sign
Company; and refund $67.86 to Thomas Brown. Commissioner House seconded the
motion and it passed unanimously.
Vice Chairman Hill moved to waive permit fees for Western Harnett PTO Thrift Shop.
Commissioner McNeill seconded the motion and it passed unanimously.
There being no further business, Vice Chairman Hill moved to adjourn. Commissioner
House seconded the motion and it passed unanimously. The Harnett County Board of
Commissioners regular meeting February 18, 2008, adjourned at 8:35 p.m.

Joint Resolution Celebrating 100 Years of County Unity in
Recognition of Our Association's Centennial
WHEREAS.the North Carolina Association of County Commissioners is an
advocacy and service organization made up of all one-hundred(100)North Carolina
counties:and •
WHEREAS,the active participation and engagement of all 10,0 counties have
directed,strengthened and enhanced our Association;and
WHEREAS,the dedication and talents of individual county commissioners and
county staff have led our Association's success in advocacy,county centered services and
educational programs;and
WHEREAS,an informal agreement to form our Association was made by a
handful of county commissioners who,at the behest of Craven County Commissioner
C.E.Foy,met in New Bern in 1908,to discuss county issues ofcommon interest;and
WHEREAS,the first session of our unofficial Association was held at the
Atlantic Hotel in Morehead City on August 19. 1908,where C.E. Foy was elected as
president;and
WHEREAS,the North Carolina General Assembly passed an act on March$,
1909 establishing our Association on behalf of counties.
NOW,THEREFORE..BE IT RESOLVED that the North Carolina Association of
County Commissioners and each Board of County Commissioners jointly recognize and
celebrate"100 Years of County Unity"in tribute to our Association's Centennial.
FURTHER BE IT RESOLVED that the Association communicate its copy of this
joint resolution to each Board of County Commissioners.

RESOLUTION
Whereas.Title 20,Chapter 70 of the US Code provides that the Secretary of
Defense shall provide financial assistance to an eligible local educational system which
provides for the education of military dependents and military related dependents;and
Whereas,I IatTuen County Public Schools are significantly impacted by the growth
in the number of such students deemed to be military related as defined by Chapter 70;
and
• Whereas.this impact is projected to result in the addition of 4.500 students to the
average daily membership of the system over the next five years;and
Whereas,such growth will result in significant capital and operational expenses
ibr the overall school system;and
Whereas,the current formula for funding as defined in Chapter 70 does not fairly
and equitable appropriate funds to Harnett County;and
Whereas the unfairness of this tbrnlula is evident in the fact that Cumberland
County currently receives$323. per student while Harnett County receives funding at the
rate of$78_per student;and
Whereas,the capital needs created as the result of the influx of military related
dependents into the system will exceed S 120 million.
Now,Therefore,Be It Resolved that the Harnett County Board of Commissioners
does hereby request that federal legislation be introduced that would provide for Harnett
County to receive assistance for military related dependents in the same manner and
amount as counties such as Cumberland. In addition it is requested that capital impact
funds be allocated to the public schools to address the$120 million in capital needs
noted. Be It Further Resolved that this resolution be forwarded to Congressman Bob
Etheridge as well as Senator Elizabeth Dole and Senator Richard Burr.

than the proceeds of the Obligations,and the District intends,and reasonably expects,to be reimbursed

Section I. Official Declaration of Intern The District presently intends,and reasonably expects.
to reimburse itself for the Original Expenditures incurred and paid by the District on or after the date
occurring 60 days prior to the date of adoption of this Resolution from a portion of the proceeds of the
Obligations. The District reasonably expects to execute and deliver the Obligations to finance all or a
portion of the costs of the Project and the maximum principal amount of Obligations expelled to be

official intent under Section 1.150.2 of the Treasury Regulations promulgated under Section 103 of the

Original Expenditures from proceeds of the Obligations.
Section 3. Itemization of Capital Ezpendiwurtiv. The Assistant Public Utilities Director of the
County,with advice from bond counsel,is hereby authorized,directed and designated to act on behalf of
the District in determining and itemizing all of tile Original Expenditures incurred and paid by the District
in connection with the Project during the period commencing on the data occurring 60 days prior to the

Wastewater Collection Lines
GENERAL
Formal bids were received and read aloud at 3:00 pm, December 19,2007 at the
water plant in Lillington, North Carolina. The project was advertised according to
State Statutes in a Newspaper having statewide circulation at least seven days
prior to the bid opening. The project was also advertised in bulletins of the
Associated General Contractors of America and The F.W. Dodge Corporation at
various offices In North Carolina,
Contract 1 -Approximately 3.422 linear feet of 24", 14,855 linear feet of 15",
• 55.293 linear feet of 8'SDR 35 PVC Sewer Pipe and 7,098 linear feet of 12"
forcernain and all appurtenances to serve the South Central Water&Sewer
District of Harnett County.
Contract 2-3 pump stations including all site development,drainage,erosion
control, access road and fencing at each pump station. Pump structures,
mechanical piping,and all appurtenances to serve the South Central Water&
Sewer District of Harnett County.
PROPOSALS
The contracts had the following number of bid documents requested by
contractors with the indicated responses:

The low proposal for Contract No. 1 was submitted by Triangle Grading&Paving
of Burlington, NC for a total unit price amount of S6,185,885.00. The second low
proposal was submitted by Ralph Hodge Construction of Wilson. NC for a total
unit price amount of$6.447,683.81.

HARNETT COUNTY,NORTH CAROLINA that a formal request is being made to petition the
North Carolina Department of Transportation to review and consider a reduction of speed limit
from 55 miles per hour to 45 miles per hour along a portion of US Highway 401 in Harnett
County. The portion of US Highway 401 within which the request is being made shall be identified
as following the dedicated right-of-way of the facility from Lafayette Road to 4,000 feet South of
Harnett Central Road in the Kipling area of Harnett County.
