WHEREAS, a petition requesting annexation of the area described herein has been
received; and
WHEREAS, the City Council has by resolution directed the City Clerk to investigate the
sufficiency of the petition; and
WHEREAS, certification by the City Clerk as to the sufficiency of the petition has been
made;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dunn, North
Carolina that:
Section 1. A public hearing on the question of annexation of the area described herein will
be held at the City of Dunn Municipal Building at 7:00 p.m. on September 10,
2019.

THIS MATTER came before the City Council of the City of Dunn on the 131h day of August,
2019. After conclusion of the proceedings, the City Council finds the following:
1. This is a petition for the closing of the City's right-of-way of the PUBLIC STREET AT THE
200 BLOCK OF EAST BEST STREET ON THE WEST SIDE OF SOUTH CLINTON AVENUE,
AND SOUTH WILSON AVENUE BETWEEN SOUTH CLINTON AVENUE, CSX RAILROAD,
COOKE STREET AND YAM STREET. (AS SHOWN ON THE ATTACHED MAP "EXHIBIT
A").
2. The City Council met on July 9, 2019 at which time they by unanimous vote, adopted a
resolution declaring the intent to permanently close the street, more particularly
described above.
3. The Council further set a public hearing on this question for the 13th day of August, 2019
at 7:00 p.m. in the Municipal Building at City Hall.
4. The resolution declaring an intent to permanently close the PUBLIC STREET AT THE
200 BLOCK OF EAST BEST STREET ON THE WEST SIDE OF SOUTH CLINTON AVENUE,
AND SOUTH WILSON AVENUE BETWEEN SOUTH CLINTON AVENUE, CSX RAILROAD,
COOKE STREET AND YAM STREET was published once a week for four consecutive
weeks prior to the hearing. A copy thereof was sent by registered or certified mail to all
owners of property adjoining this property as was shown on the county tax record.

S. A notice of the closing and public hearing was prominently posted in at least two places along
the property.
6. The property in question was not under the authority and control of the Department of
Transportation and therefore it was not necessary to forward a copy of the resolution to the
Department of Transportation.
7. The public hearing commenced at the scheduled time on August 13, 2019.
8. The closing would not be detrimental to the public interest or the property rights of any
individuals.
BASED ON THE FOREGOING FINDINGS OF FACT, it is concluded to the satisfaction of the City
Council that closing the described right-of-way is not contrary to the public interest and no individual
owning property in the vicinity of the property would be deprived of reasonable means of ingress
and egress to its property.
IT IS THEREFORE RESOLVED AND ORDERED by the City Council at the meeting duly assembled on
August 13, 2019 that:
1. The right-of-way designation of the 200 BLOCK OF EAST BEST STREET ON THE WEST SIDE
OF SOUTH CLINTON AVENUE, AND SOUTH WILSON AVENUE BETWEEN SOUTH CLINTON
AVENUE, CSX RAILROAD, COOKE STREET AND YAM STREET be closed.
2. By the closing of this street the City of Dunn does hereby close the street as a public
thoroughfare.
3. The City of Dunn reserves its right, title and interest in any utility improvement within this
property closed pursuant to this Order.
4. This Order shall be filed in the office of the Register of Deeds of Harnett County, North
Carolina.

corporate name by its Mayor, attested to by authority of the City Council duly given on the 13th day
of August, 2019.

AN ORDINANCE DIRECTING PROPERTY OWNER OR BUILDING INSPECTOR TO
REMOVE OR DEMOLISH PROPERTY UNFIT FOR HUMAN HABITATION PURSUANT
TO N.C.G.S. §160A-441, ET SEQ.
WHEREAS, on or about on or about June 12th, 2018, the Dunn City Council adopted and
approved An Ordinance Declaring the Property Herein Described as Unfit for Human Habitation
Pursuant to N.C.G.S. §160A-441, et seq., which was recorded on or about July 6"', 2018 in Book 3620,
Pages 912-913, wherein the property located at 1004 S. King Ave. Dunn, North Carolina, then owned
by Huey Gene Malloy and Carrie M. Malloy was declared unfit for human habitation (the "Original
Ordinance"); and
WHEREAS, the Original Ordinance related to the property then owned by Huey Gene Malloy
and Carrie M. Malloy and generally located at 1004 S. King Ave. and having Harnett County PIN#:
1516-35-6103.000 and Harnett County Parcel ID#: 02151610540002; and
WHEREAS, the Original Ordinance provided the owner of the property twelve (12) months to
bring it into compliance with Section 4-31 of the Dunn City Code and N.C.G.S. §160A-441, et seq.
and if the property owner failed to do so, the Building Inspector for the City of Dunn was directed to
bring the matter back before the City Council for further consideration of the remedies available to the
City of Duren under North Carolina General Statute § 160A-443; and

WHEREAS, the twelve (12) month period provided in the Original Ordinance has
expired and the owner of the property has not brought the property into compliance with Section
4-31 of the Dunn City Code; and
WHEREAS, the owner of the property has been given reasonable opportunity and the
opportunity as required by law to repair the dwelling as required by the Original Ordinance and
the Chief Building Inspector for the City of Dunn has brought the matter back to the Dunn City
Council for further consideration;
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Dunn,
North Carolina, that:
Section 1. The preambles to this Ordinance and the full terms of the Original Ordinance are
incorporated hereby by reference, the same as if fully set forth herein.
Section 2. The dwelling located on the property described herein continues to be unfit for
human habitation and the Chief Building Inspector is hereby authorized and directed to keep a
placard on the main entrance of the building located on the property containing the following
legend:
"This building is unfit for human habitation; the use or occupation of this building for human
habitation is prohibited and unlawful."

Section 3. The owner of the property has abandoned the intent and purpose to repair, alter or
improve the dwelling in order to render it fit for human habitation and the continuation of the
dwelling in its vacated and closed status would be inimical to the health, safety, morals and
welfare of the City of Dunn in that the dwelling would continue to deteriorate, would create a
fire and safety hazard, would be a threat to children and vagrants, would attract persons intent on
criminal activities, would cause or contribute to blight and the deterioration of property values in
the area, and would render unavailable property and a dwelling which might otherwise have been
made available to ease the persistent shortage of decent and affordable housing.
Section 4.
A. The repair of the dwelling to render it fit for human habitation can be made at a
cost not exceeding fifty percent (50%) of the then current value of the dwelling and the owner of
the property is directed to repair or demolish and remove the dwelling within ninety (90) days of
the adoption of this Ordinance.
Section 5.
A. If the owner of the property has not repaired or demolished the dwelling within
ninety (90) days of the adoption of this Ordinance, the Chief Building Inspector, or his designee
is directed to demolish and remove the dwelling.
Section 6. In the event the Chief Building Inspector or his designee removes and demolishes
the dwelling, then all costs of removal and demolition shall be a lien against the real property and
also any other real property of the owner located within the city limits of the City of Dunn or
within one (1) mile thereof, except for the owner's primary residence, pursuant to North Carolina
General Statute §160-443.

REMOVE OR DEMOLISH PROPERTY UNFIT FOR HUMAN HABITATION PURSUANT
TO N.C.G.S. §160A-441, ET SEQ.
WHEREAS, on or about on or about July 10t11, 2018, the Dunn City Council adopted and
approved An Ordinance Declaring the Property Herein Described as Unfit for Human Habitation
Pursuant to N.C.G.S. §160A-441, et seq., which was recorded on or about July 19t11, 2018 in Book
3624, Pages 497-498, wherein the property located at 103 E. Bay St., Dunn, North Carolina, then
owned by Huey Gene Malloy and Carrie M. Malloy was declared unfit for human habitation (the
"Original Ordinance"); and
WHEREAS, the Original Ordinance related to the property then owned by Huey Gene Malloy
and Carrie M. Malloy and generally located at 103 E. Bay St. and having Harnett County PIN#: 1516-
55-3875.000 and Harnett County Parcel ID#: 02151611210005; and
WHEREAS, the Original Ordinance provided the owner of the property twelve (12) months to
bring it into compliance with Section 4-31 of the Dunn City Code and N.C.G.S. §160A-441, et seq.
and if the property owner failed to do so, the Building Inspector for the City of Dunn was directed to
bring the matter back before the City Council for further consideration of the remedies available to the
City of Dunn under North Carolina General Statute § 160A-443; and

WHEREAS, the twelve (12) month period provided in the Original Ordinance has
expired and the owner of the property has not brought the property into compliance with Section
4-31 of the Dunn City Code; and
WHEREAS, the owner of the property has been given reasonable opportunity and the
opportunity as required by law to repair the dwelling as required by the Original Ordinance and
the Chief Building Inspector for the City of Dunn has brought the matter back to the Dunn City
Council for further consideration;
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Dunn,
North Carolina, that:
Section 1. The preambles to this Ordinance and the full terms of the Original Ordinance are
incorporated hereby by reference, the same as if fully set forth herein.
Section 2. The dwelling located on the property described herein continues to be unfit for
human habitation and the Chief Building Inspector is hereby authorized and directed to keep a
placard on the main entrance of the building located on the property containing the following
legend:
"This building is unfit for human habitation; the use or occupation of this building for human
habitation is prohibited and unlawful."

Section 3. The owner of the property has abandoned the intent and purpose to repair, alter or
improve the dwelling in order to render it fit for human habitation and the continuation of the
dwelling in its vacated and closed status would be inimical to the health, safety, morals and
welfare of the City of Dunn in that the dwelling would continue to deteriorate, would create a
fire and safety hazard, would be a threat to children and vagrants, would attract persons intent on
criminal activities, would cause or contribute to blight and the deterioration of property values in
the area, and would render unavailable property and a dwelling which might otherwise have been
made available to ease the persistent shortage of decent and affordable housing.
Section 4.
A. The repair of the dwelling to render it fit for human habitation can be made at a
cost not exceeding fifty percent (50%) of the then current value of the dwelling and the owner of
the property is directed to repair or demolish and remove the dwelling within ninety (90) days of
the adoption of this Ordinance.
Section 5.
A. If the owner of the property has not repaired or demolished the dwelling within
ninety (90) days of the adoption of this Ordinance, the Chief Building Inspector, or his designee
is directed to demolish and remove the dwelling.
Section 6. In the event the Chief Building Inspector or his designee removes and demolishes
the dwelling, then all costs of removal and demolition shall be a lien against the real property and
also any other real property of the owner located within the city limits of the City of Dunn or
within one (1) mile thereof, except for the owner's primary residence, pursuant to North Carolina
General Statute §160-443.

RESOLUTION OF TENTATIVE AWARD
WHEREAS, the City of Dunn, North Carolina has received bids, pursuant to duly advertisement
notice therefore, for construction of the Black River Wastewater Treatment Plant Aeration System
Replacement, and
WHEREAS, Davis • Martin • Powell & Associates, the consulting Engineers have reviewed the bids;
and
WHEREAS, Laughlin -Sutton Construction Company was the lowest bidder for the Aeration System
Replacement, in the total bid amount of $2,999,400.00, and
WHEREAS, the consulting Engineers recommend TENTATIVE AWARD to the lowest bidder.
NOW, THERE FORE, BE IT RESOLVED that TENTATIVE AWARD is made to the Laughlin -Sutton
Construction Company in the Amount of $2,649,400.00 for all work except Bid Item A2.
BE IT FURTHER RESOLVED that such TENTATIVE AWARD be contingent upon the approval of
the North Carolina Department of Environmental Quality. �y

WHEREAS, the City of Dunn desires to commend and recognize those citizens who give of themselves,
their time, their talents and their efforts to make our community a better place in which to live; and
WHEREAS, Carolyn P. McDougal, the daughter of Charles and Helen Poston of Four Oaks, North
Carolina, is a graduate of Forest Hill High School and attended Campbell University; and
WHEREAS, Carolyn was married to the late Deacon Leslie McDougal and from their union, they have
one daughter, Towanda McDougal Witherspoon, and one granddaughter, Amiyah Andrea Witherspoon;
and
WHEREAS, Carolyn has worshiped and served for many years at Dunn Chapel Freewill Baptist Church,
where she is a member on the Hospitality and Courtesy Guild Ministry. She also is a member under watch,
care at Word of Faith Christian Church in Four Oaks; and
WHEREAS, Carolyn has dedicated her life to public service, helping others, and doing her part to make
certain that Martin Luther King Jr.'s dream lives on for generations to come; and
WHEREAS, she is a lifetime member of the NAACP, currently serving as the Second Vice President at
the State level, President of the IIarnett County Branch, Democratic Party East Averasboro Precinct Chair,
and on the Community Development Board in the City of Dunn; and
WHEREAS, Carolyn has achieved many accomplishments over her years of service including serving on
the Dunn City Council for six years; and
WHEREAS, she has received many honors and awards including the Governor's Volunteer Award,
NAACP Humanitarian Award, Torch of Freedom Award, US Small Businesses Administration Award and
many others.
NOW THEREFORE BE IT RESOLVED, I, Oscar N Harris, Mayor of the City of Dunn, North Carolina
do hereby join the family and friends of Carolyn P. McDougal in wishing her a happy and blessed. 70°i
birthday with many wonderful years to come; and
BE IT FURTHER RESOLVED that on this occasion, appreciation is also extended for her many
