The Harnett County Board of Commissioners met in regular session on Monday, September 16,
2019, in the Commissioners Meeting Room, County Administration Building, 420 McKinney
Parkway, Lillington, North Carolina.

Chairman Springle called the meeting to order at 6:00 pm. Commissioner Johnson led the
Pledge of Allegiance and invocation.
Chairman Springle called for any additions or deletions to the published agenda. Mrs. Stewart
requested moving closed session up earlier on the agenda. Vice Chairman Penny moved to
approve the agenda as amended. Commissioner Johnson seconded the motion that passed
4-0.
Vice Chairman Penny moved to approve items on the consent agenda. Commissioner Miller
seconded the motion, which passed 4 - 0.

7. Harnett County General Services, Harnett Area Rural Transit System (HARTS),
requested approval of the N.C. Department of Transportation (NC DOT) FY2020 5311
grant agreement in the amount of $279,619; total County match is $41,944. This grant
provides funding for Administrative expenses associated with providing public
transportation for the citizens of Harnett County.
8. Harnett County Emergency Management requested approval to accept the Duke Energy
Foundation Grant award, NC Storm Resiliency Grant Category, in the amount of
$25,000. This grant will provide gear for our teams at no cost to the county.
9. Harnett County Emergency Services requested approval of Resolution Authorizing
Disposition of Personal Property to donate two 2013 Stryker MX PRO manual stretchers
to Benhaven Emergency Services. (Attachment 4)
10. Harnett County Emergency Services requested approval of the North Carolina Division
of Emergency Resolution Designation of Applicant's Agent (Hurricane Matthews and
Florence) for FEMA Hazard Mitigation Funding.
11. Harnett County Library requested approval to amend the library's rate and fee schedule
to include maker space project materials that will be available for purchase.
12. Harnett County Library requested approval to apply for annual state aid, estimated at
$173,376, from the NC Department of Cultural Resources, the State Library. The State
Library allocates a certain amount of funds each year for local libraries intended to
promote, aid, and equalize public library services in North Carolina. No County match is
required.

13. Administration requested approval of the School Resource Officer Program
Memorandum of Understanding (MOU) between the County of Harnett, Harnett County
Board of Education, and Harnett County Sheriffs Office. The MOU outlines the
responsibilities and expectations of all parties involved related to the location of School
Resource Officers in the elementary schools within the Harnett County School system.
14. Sheriff Office requested approval to purchase a 3D Crime Scene Program (software and
hardware) from Faro Technologies for $72,717.44. This purchase will be funded with
Federal Asset Forfeiture funds.
Chairman Springle opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes. No one spoke.
Commissioner Miller moved to approve the appointments listed below. Commissioner McKoy
seconded the motion that passed unanimously.
Harnett County Public Library Board of Trustees
Drennan Fuller was appointed to serve, as Anderson Creek representative, for a term of
three (3) years expiring September 30, 2022.
Home and Community Care Block Grant Committee
Wanda Fike was appointed to serve on this committee.
Chairman Springle moved to charge the Harnett County Tax Administrator with collection of all
real, personal, and public service companies taxes for the 2019-2020 levy year, with the
collections of all delinquent taxes. Commissioner Miller seconded the motion that passed 4 - 0.
Senior Staff Attorney Christopher Appel introduced a proposed amendment to the Harnett
County Personnel Ordinance to include Bereavement Leave as an employee benefit.
Jay Sikes, Manager of Harnett County Planning Services, petitioned the Board for a public
hearing regarding proposed zoning change: Case # PLAN 1908-0001, Landowner/Applicant:
Harold T. Butts, Jr; 10.3 acres (26.75 total acres); Pin # 0662-905908; From RA -30 to RA -20M;
Harnett Central Rd; Neill's Creek Township. On September 3, 2019, the Harnett County
Planning Board voted 5 — 0 to recommend approval of this application based on the similarity of
adjacent zoning. Staff said no one spoke in opposition.
Mr. Sikes reported the site is currently vacant farmland; the parcel is currently split -zoned with
16.45 acres zoned RA -20M and 10.3 acres zoned RA -30. Surrounding land uses consist of
individual single-family residences, agriculture land, a manufactured home park, and a mini -
storage facility. Services available include public water and private septic tank.

Mr. Sikes stated staffs evaluation as:
The IMPACT to the adjacent property owners and the surrounding community is
reasonable, and the benefits of the rezoning outweigh any potential inconvenience or
harm to the community. REASONING: The impact to the surrounding community is
reasonable, as the requested zoning district is the same as a portion of this property and is
also immediately adjacent.
The requested zoning district is COMPATIBLE with the existing Land Use
Classification. REASONING: The request is compatible with the overall land use
classification of Ag & Rural Residential since the request is to remain residential. Also,
Ag & Rural Residential areas are often located outside of existing & future sewer
services areas.
The proposal does ENHANCE or maintain the public health, safety and general welfare.
REASONING: The request would maintain the public health, safety and general welfare
due to the existing residential uses within the area.
The request is NOT for a SMALL SCALE REZONING and should not be evaluated for
reasonableness. REASONING: Since a portion of this parcel is currently zoned RA -20M
and is also adjacent to such, the application does not need to be considered for Small
Scale Rezoning.
Suggested Statement -of -Consistency: Staff concludes that the requested rezoning to RA -20M
would not have an unreasonable impact on the surrounding community based on the similar,
existing residential uses in the area as well as the same districts being part of this tract and
immediately adjacent. It is recommended that this rezoning request be approved.
Chairman Springle called to order a public hearing on the matter and opened the meeting for
comments from the public.
- Anne Burgin of 6099 Hwy 55 W in Angier spoke in opposition of the proposed rezoning.
- Harold Butts of 2191 Keith Hills Road in Buies Creek, the applicant, spoke in favor of
the requested rezoning.
Mr. Sikes responded that 20M would allow for a manufactured home park via a conditional use
permit. Seeing no one else move Chairman Springle closed the public hearing. Vice Chairman
Penny moved to approve the proposed zoning change as the requested rezoning to RA -20M
would not have an unreasonable impact on the surrounding communitybased on the similar
existing residential uses in the area as well as the same districts being part of this tract and
immediately adjacent. Commissioner Johnson seconded the motion which passed 3 — 1 with
Commissioner Miller opposing.
Mr. Sikes petitioned the Board for a public hearing regarding the proposed zoning change: Case
# PLAN 1908-0002, Landowner/Applicant: JPF Properties, LLC/ PJ's Truck Bodies &
Equipment; 2.15 acres (14.52 total acres) Pin # 1537-17-7937; From RA -20M to Commercial;
George Lee Perry Rd; Averasboro Township. On September 3, 2019 the Harnett County
Planning Board voted 3 — 2 to recommend approval of this application based on the parcel's
history of uses in the area as well as the need to utilize this property due to the I-95 realignment
at this exit. Staff noted that one citizen voiced concerns about noise, wetland impacts and future
stormwater flooding.

Mr. Sikes stated staffs evaluation as:
The IMPACT to the adjacent property owners and the surrounding community is

reasonable, as the majority of the parcel is currently zoned the same as the requested
district.
The requested zoning district is COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning to Commercial is compatible with
the overall land use classification of Employment Mixed Use. Employment Mixed Use
areas are located along major thoroughfares and include prime locations for economic
development opportunities.
The proposal does ENHANCE or maintain the public health, safety and general welfare.
REASONING: The requested rezoning to Commercial would maintain or enhance the
public health, safety and general welfare due to the existing commercial uses as well as
the neighboring commercially zoned parcels.
The request is NOT for a SMALL SCALE REZONING and should not be evaluated for
reasonableness. REASONING: Since the parcel is predominately zoned Commercial, as
well as being immediately adjacent to other Commercially zoned properties Small Scale
rezoning does not need to be considered.

would not have an unreasonable impact on the surrounding community based on the existing
non -residentially zoned properties within the area as well as compliance with the County's Land
Use Plan. It is recommended that this rezoning request be approved.
Chairman Springle called to order a public hearing on the matter and opened the meeting for
comments from the public.
- Don Beasley of 1693 Hodges Chapel Road in Benson spoke in opposition of the
requested rezoning.
- Johnathan Thornton, on behalf of the applicant, spoke in favor of the rezoning request.
Discussions continued at length. Mr. Sikes confirmed that the State or the US Army Corp of
Engineers would need to certify if the land contains wetlands. The applicant, who wants to use
the parcel for employee parking, has hired Enoch Engineering to handle everything. Seeing no
one else move Chairman Springle closed the public hearing. Vice Chairman Penny moved to
approve the proposed zoning change as the requested rezoning to Commercial would not have an
unreasonable impact on the surrounding community based on the existing non-residential zoned
properties within the area as well as the compliance with the County's Land Use Plan.
Commissioner Miller seconded the motion which passed 4 — 0.
Mr. Sikes petitioned the Board for a public hearing regarding proposed Text Amendment: Case
# PLAN 1908-0003, Harnett County Unified Development Ordinance Text Amendment
Article VII: Development Design Guidelines, Section 8.2 Design Standards for Open Space.
Mr. Sikes noted the requested Text Amendment is compatible with Harnett county regulatory
documents, and the benefits outweigh any potential inconvenience or harm to the community.
On September 3, 2019 the Harnett County Planning Board voted 5-0 to recommend approval of

this Text Amendment. Mr. Sikes also noted that the US Army Corps of Engineers was contacted
and they sent comments of support for the idea of creating awareness and encouraging
conservation by preventing any type of disturbance in environmentally sensitive areas.
Chairman Springle called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move Chairman Springle closed the public hearing.
Commissioner Miller moved to approve a Resolution Amending the Harnett County Unified
Development Ordinance Article VII Development Design Guidelines, Section 8.2 Design
Standards for Open Space as presented. Vice Chairman Penny seconded the motion which
passed 4 — 0. (Attachment 5)
Mr. Sikes petitioned the Board for a public hearing regarding proposed Text Amendment: Case
# PLAN 1908-0004, Harnett County Unified Development Ordinance Text Amendment
Article V: Use Regulations, Section 1.2 Tables of Use Types & Regulations and Section 8.0
Industrial Uses. Mr. Sikes noted the requested Text Amendment is compatible with Harnett
county regulatory documents, and the impact to the surrounding community is reasonable, as the
proposed Text Amendment is similar to existing regulations within the U.D.O. On September 3,
2019 the Harnett County Planning Board voted 5-0 to recommend approval of this Text
Amendment based on the parcel's history of uses.
Chairman Springle called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move Chairman Springle closed the public hearing.
Commissioner Miller moved to approve a Resolution Amending the Harnett County Unified
Development Ordinance Article V Use Regulations, Section 1.2 Table of Use Types &
Regulations and Section 8.0 Industrial Uses. Commissioner Johnson seconded the motion which
passed 4 — 0. (Attachment 6)
Commissioners and staff discuss the following previously tabled leases:
a. A one (1) year lease agreement with Johnston -Lee -Harnett Community Action for
Suite 101 at 252 Irene Roberts Road, Lillington, NC.
b. A one (1) year lease agreement with Shawtown Alumni Association for Suite 100 at
252 Irene Roberts Road, Lillington, NC.
Administration requested approval of new lease agreements for 10 years at a cost of $1 per year
with the Shawtown High School Alumni Association and Johnston -Lee -Harnett Community
Action to occupy space within the building at 252 Irene Roberts Road in Lillington, on the
former Shawtown School Campus. Both entities currently occupancy the space described in
their respective lease agreements.
It was the consensus of commissioners that they were okay with the proposed $1 per year for
rent however, they had issues with the tenants not paying for their own utilities. Staff noted that
both tenants have occupied this space for years without paying any rent or utilities. It was also
the consensus of commissioners that they still prefer a one-year lease until they can get an
average cost of utilities for the tenants. Staff believes they can provide commissioners with that

information quickly. Vice Chairman Penny moved that these two leases remained tabled until
more information is provided. Commissioner Miller seconded the motion that passed 4 — 0.
Commissioner Johnson moved that the Board go into closed session for the following purposes:
1) To instruct the County staff concerning the position to be taken by the County in the
acquisition of real property; and
2) To instruct the County staff concerning the position to be taken by the County in
negotiating the material terms of an employment contract.
This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(5).
Vice Chairman Penny seconded the motion that passed 4— 0.
Vice Chairman Penny moved that the Board come out of closed session. Commissioner Johnson
seconded the motion, which passed 4— 0.
Commissioner Miller moved to approve the Resolution by the Harnett County Board of
Commissioners to Accept the Conveyance of the Old Benhaven School Site Real Property from
the Harnett County Board of Education. Commissioner Johnson seconded the motion that
passed 4 - 0. (Attachment 7)

Under new business, Vice Chairman Penny moved to approve the employment agreement with
William R. "Bill" Tyson as Tax Administrator. Commissioner Johnson seconded the motion,
which passed 4 — 0.
Commissioner Johnson moved to adjourn the meeting at 7:31 pm. Commissioner Miller
seconded the motion that passed 4— 0.

A RESOLUTION TO ADOPT THE 2020 SCHEDULE OF MEETINGS
HARNETT COUNTY BOARD OF COMMISSIONERS
THAT WHEREAS, the Harnett County Board of Commissioners adopted on September 19, 1994
certain Rules of Procedure by which the Board would conduct its meetings; and
WHEREAS, Rule 6 of the Rules of Procedure concerning "Regular and Special Meetings" states
that the Board shall hold regular meetings the first Monday of each month at 9 a.m. and the third Monday
of each month at 6 p.m. It also states if a regular meeting day is a holiday on which county offices are
closed, the meeting shall be held on the next business and the Board may schedule regular work sessions.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett County

RESOLUTION AUTHORIZING
DISPOSITION OF PERSONAL PROPERTY
WHERAS, County of Harnett (the "County") owns the following stretchers, utilized by the Harnett County
Emergency Services Department:

WHEREAS, such stretchers are now obsolete and surplus to the needs of the County;
WHEREAS, said stretchers have little of any, value on the open and public market;
WHEREAS, Benhaven Emergency Services ("BES"), located in Harnett County, could utilize such stretchers
when responding to emergency 911 calls for the treatment and care of their patients.
WHEREAS, the transfer of such stretchers to BES would provide for and help with the transport for the sick and
injured citizens of Harnett County.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS, that the Harnett
County Emergency Services shall be and is hereby authorized and directed to take any such actions as might be
necessary and advisable to transfer the above -referenced stretchers to Benhaven Emergency Services, without
consideration, pursuant to the provisions of North Carolina General Statute 153-176.

A RESOLUTION AMENDING THE
HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE

WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the
purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North
Carolina, particularly G.S. 153A-340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been followed;
and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Harnett County Unified Development Ordinance Article VII
Development Design Guidelines, Section 8.2 Design Standards for Open Space shall be amended to read as
indicated in the "Attachment".
"Attachment" is filed with the Unified Development Ordinance in the Clerk to the Board's Office.
Duly adopted this 16`h day of September, 2019 and effective upon adoption.

Article VII Development Design Guidelines
8.2 Design Standards for Open Space
A. All floodplains, streams, ponds, lakes, and other water bodies are encouraged to be contained in open space area.
B. All wetlands, and blue -line streams with a required vegetative, riparian buffer, shall be contained in open space areas,
unless previously platted prior to September 16, 2019 or mitigated via the US Army Corps of Engineers permitting
process.
C. A minimum of 50 percent (50%) of the depth of the District (measured perpendicularly from the water feature and
located closest to the water feature) shall be dedicated to open space.
D. This dedication of open space shall count towards any other open space requirements.
E. Prime Views & Open Vistas
Such area shall be defined as the area between existing street right(s)-of-way and property line of proposed lots for the
new development.
1. Developments located adjacent to Interstate and Principle Arterials shall provide a 200 foot minimum of prime
views
2. Developments located adjacent to Minor Arterials and Major and Minor Collectors shall provide a 100 foot
minimum of prime views.
3. Developments located adjacent to all other street types shall provide a 75 foot minimum of prime views.
4. Required Streetscape Buffer shall be planted within the Prime Views & Open Vista area.
5. Administrative Review of Alternative Prime Views & Open Vista
An applicant may submit to the Administrator for review and approval of a detailed plan and specifications for
prime views and open vistas of up to a 25 percent (25%) reduction in width of the required area. In such case, the
requirements of the Type A and Type C Buffer shall be met for supplementation within the prime views and
open vistas area in lieu of installation of the streetscape buffer.
F. All open space area shall be permanently restricted from future subdivision and development unless specifically stated
here in.
G. Common open space areas shall have a minimum of one (1) access easement to allow for utilization by all owners of
property within the subdivision. Access easements shall be a minimum of 12 feet in width and shall include an
identification sign.
H. Parking for Improved Open Space Areas
All required parking areas shall, at a minimum, be development with six (6) inches of aggregate base course (ABC)
gravel and include parking stops. Shared parking shall be permitted for differing types of improved open space,
utilizing the greater number of spaces required.
1. Structures
Where a structure is built, parking shall be provided in accordance with this Ordinance for the same type of
facility. Structures that are not listed in this Ordinance shall provide parking at a ratio of one (1) space per 200
square feet of covered area.
2. Athletic Fields
When an athletic field is developed, parking shall be provided at a ratio of half (1/2) of what is required by this
Ordinance.
3. Pedestrian Trails & Other Improvements
Where a pedestrian trail or other improvements are made, parking shall be provided at the trail head or main
entrance with a minimum of five (5) parking spaces.

WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the
purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North
Carolina, particularly G.S. 153A-340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been
followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Harnett County Unified Development Ordinance Article V Use
Regulations, Section 1.2 Table of Use Types & Regulations and Section 8.0 Industrial Uses
shall be amended to read as indicated in the "Attachment".
"Attachment" is filed with the Unified Development Ordinance in the Clerk to the Board's Office.
Duly adopted this 16t day of September, 2019 and effective upon adoption.

SECTION 8.0 INDUSTRIAL USES
8.3 Warehousing & Freight Handling
8.3.3 Storage, Personal Recreational Vehicle & Travel Trailer
A personal travel trailer or recreational vehicle shall be parked or stored in the rear or side yard of arty the owner's
residential lot; provided that no living quarters shall be maintained, nor any business conducted therein while such
recreational vehicle or travel trailer is so parked or stored (not subject to lot size requirements), unless otherwise
specified within this Ordinance. This is intended as private, personal storage only and not for business purposes.
8.3.4 Storage, Self Mini -Warehouse
Subject to the following requirements:
A. Maximum building height of 20 feet.
B. A secured fence of at least six (6) feet in height shall surround the perimeter of the storage facility.
C. Adequate lighting shall be provided to illuminate the storage facility. The minimum size streetlight shall be a
175 watt Mercury-vapor (approximately 7,000 lumen class) or its equivalent, spaced at intervals of not more
than 300 feet.
D. No outside storage shall be permitted except as provided below.
E. Outdoor storage of boats, vehicles (including motorcycles), recreational vehicles, campers, equipment,
materials, etc in designated spaces shall meet the following requirements:
1. If outdoor storage space is proposed the area shall be designated as outdoor storage on the required site
plan.
a. Existing facilities expanding to include outdoor storage shall submit a revised site plan showing such, in
accordance with the provisions of this Ordinance.
2. Area designated for outdoor storage shall not be visible from adjacent right(s)-of-way and shall install a
Type D Buffer along the exterior of the perimeter fencing.
3. If associated with a mini -storage facility that will have enclosed storage buildings, outdoor storage space(s)
shall be located at the rear or side of the site.
4. No inoperable vehicles, or other items as listed above, shall be stored on-site unless on a towable trailer
with the intent to transport in a timely manner.
F. The storage of hazardous, toxic, or explosive substances shall be prohibited.
G. No business activity sales, service, or repair activities, other than rental of the storage units or spaces, shall be
conducted within the storage facilities.
ATTACHMENT 7
RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
TO ACCEPT THE CONVEYANCE OF THE
OLD BENHAVEN SCHOOL SITE REAL PROPERTY FROM THE
HARNETT COUNTY BOARD OF EDUCATION
WHEREAS, the Harnett County Board of Education (Board of Education) owns title to
seven (7) real property tracts located in Barbeque Township, Harnett County, which make up the
old Benhaven School site; and
WHEREAS, the Board of Education on September 9, 2019, adopted a Resolution which
includes the following:
(a) The Harnett County Board of Commissioners has provided funding for the design
and construction of the new Benhaven Elementary School, and plans to provide
funding for the design and constriction of the new Erwin Elementary School.
Pursuant to that funding the Board of Education has completed the construction of
the new Benhaven Elementary School, which has allowed the Board of Education
to close the old Benhaven Elementary School; and
(b) The Board of Education has declared the old Benhaven Elementary School to be
surplus, and it is no longer necessary or desirable for public school purposes; and
The Board of Education has found that the best interests of the school system
would be served by the disposal of said real property in accordance with the North
Carolina General Statutes; and
(c)
(d) The Board of Education has concluded that based on the above listed factors that
fair compensation has been conveyed by Harnett County for the old Benhaven
Elementary School site, and therefore the Board of Education has offered said real
property to the Harnett County Board of Commissioners.
That pursuant to the provisions of N.C. General Statutes §115C-518 and § 160A-
274, the Board of Education has authorized its officers to execute and tender a
deed to the County of Harnett for the old Benhaven School site real property; and
WHEREAS, it is the desire of the Harnett County Board of Commissioners to accept this
deed through this Resolution.
NOW THEREFORE, THE HARNETT COUNTY BOARD OF COMMISSIONERS
DOES HEREBY RESOLVE THAT Harnett County accept the deed tendered by the Board of
Education for the conveyance of any and all ownership title that the Board of Education has in
those seven (7) real property tracts described as the old Benhaven School site real property.
