Minutes of Regular Meeting
September 20, 2004
The Harnett County Board of Commissioners met in regular session on Monday,
September 20,2004, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius
Harnett Boulevard, Lillington, North Carolina.
Members present:

Chairman Byrd called the meeting to order and Commissioner McNeill led the pledge
of allegiance and prayer.
Chairman Byrd welcomed Boy Scouts and Leader, Dr. Martin, from Troop 750 in
Kipling to the Board of Commissioners meeting. The scouts are working on obtaining
their community and government merit badges.
Chairman Byrd also mentioned that our friend, Mr. Wilton Lee, 132 Rose Bud Street,
Spring Lake, will be missed. Mr. Lee regularly attended our meetings and participated
in the informal comment section. He cared about his community and did his part to
make it a better place. Mr. Lee passed away suddenly September 12, 2004.
Commissioner Titchener moved to approve the agenda as published with the following
additions to the consent agenda:
- resolution authorizing application for supplemental grant for water and sewer
project
- authorize donation of surplus computers to non-profit organizations
- authorize Cooperative Extension to submit a grant application for Teens as Parents
program
- resolution recognizing Wesley Chapel Church on its 135th Founders Day celebration
- resolution authorizing sale of surplus pistol to deputy who carried it for many years
Commissioner Andrews seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Hill, the
Board unanimously approved the following items on the consent agenda:

3. Tax refunds and releases (Attachment 1)
4. Resolution to add roads to state system (Attachment 2)
5. Resolution declaring items surplus for annual auction (Attachment 3)
6. Authorization for Register of Deeds to use sole source method to purchase
computer software to enhance the current program, Anthem,l provided by Hart
Intercivic. The cost of the capital outlay item is $3,600.00 to add a cemetery index
to the present program and $10,000.00 to add an online marriage application.
7. Renewal of cleaning service agreement with Jefferson's Cleaning Service, Inc. for
office of Child Care Resource and Referral and Parents As Teachers programs.
The facility is located at 1901 North Main Street, Suites A & B, Lillington. The
contract is for one year and the monthly fee shall be $160.00.
8. Renewal of contracts with County Fire and Rescue Departments for Fire and
Rescue Services. Two departments have made changes from last year in the type
of service they provide. Spout Springs has added vehicle extrication and water
rescue and Angier-Black River Fire has added vehicle extrication and dive service
with the Harnett County Underwater Search and Recovery Team.
9. Request from Harnett County Literacy, Inc. for funds due to funding shortfall
from the United Way. The request is for the amount of$3,200.00.
10. Contract with The Management and Personnel Services (MAPS) Group to
conduct a classification an compensation study of county personnel positions.
The cost for the study will be $34,200.00.
11. Request from the Department on Aging to add a Social Worker II position for
CAP/DA.
12. Lease agreement with Odell Hardee and wife Rudy Powell Hardee for Buckhorn
Container Site Agreement renewal. Amount of the lease has been increased to
$1,600.00 per year.
13. Resolution authorizing application for supplemental grant for water and sewer
project. (Attachment 4)
14. Authorization for Management Information Systems and the Department of Social
Services to donate 45 used computers to non-profit organizations. The computers
are in good working order but are outdated for software applications currently
running in Harnett County offices. They would be donated on an as-is basis with
no warranty.
15. Authorization for Cooperative Extension to submit a grant application to the NC
Governor's Crime Commission for the amount of $26,000.00 for the Teens as
Parents program.
16. Resolution recognizing Wesley Chapel Church on its 135th Founders Day
celebration (Attachment 5)
17. Resolution authorizing sale of surplus pistol to Deputy Billy Wade, who carried
the service weapon for many years. (Attachment 6)
In the informal comments period, the following citizens offered comments:
- Tom Hogg, Town of Lillington Mayor, spoke regarding Lillington's proposed
Extra Territorial Jurisdiction (ETJ) expansion.
- Christopher Sutton, client, Lee-Harnett Mental Health Psychosocial Rehabilitation,
expressed concerns regarding the proposed merger with Sandhills Center for mental
health services.
Commissioner Hill moved to adopt a resolution appointing Ricky Johnson to the
Averasboro Township Tourism Development Authority. Commissioner Andrews
seconded the motion and it passed unanimously. (Attachment 7)
Wm. A. (Tony) Wilder, Assistant County Manager, presented for the Board's
consideration, an agreement with UNC Hospitals to park a helicopter at the Harnett
County Airport during the hours of 11 a.m. and 11 p.m., seven days a week. A six
month trial period will be used to determine the need for a permanent base at the
airport with the intent of reducing response times for emergency calls requiring air
transportation to UNC Hospitals. Commissioner Titchener moved to approve the
agreement pending County Attorney review. Commissioner Andrews seconded the
motion and it passed unanimously.
Concerned employees of Lee-Harnett Mental Health appeared before the Board to
address the concerns of numerous staff members regarding proposed merger issues
with Sandhills Center. The employees listed below expressed their concerns.

Chairman Byrd called to order a public hearing on a proposed Community
Development Block Grant (CDBG) Infrastructure Hookup Program. Steve Ward,
Assistant Director, Public Utilities, stated that this is the second and final public
hearing to discuss the details before application is made for the CDBG Infrastructure
Hookup Program. Chairman Byrd opened the meeting for comments from the public.
No comments were offered and Chairman Byrd closed the public hearing. No action
is required by the Board at this time.
Chairman Byrd called to order a public hearing on a zoning change request for H. M.
Kids, Inc. and Harnett County Planning Department, 5.94 acres, Anderson Creek
Township, Hwy. 87, from RA-30 to Commercial Zoning District. Mark Locklear,
Senior Planner, presented and reviewed the zoning change request and staff findings
with the Board. The Planning Board unanimously recommended approval. Chairman
Byrd opened the meeting for comments from the public. No comments were offered
and Chairman Byrd closed the public hearing. Commissioner McNeill moved to
approve the zoning change request as presented. Commissioner Andrews seconded
the motion and it passed unanimously.
Chairman Byrd called to order a public hearing on a zoning change request for Charles
E. Webb/Tanner & Elizabeth Webb, 1.00 acre, Averasboro Township, SR 1841-
Access Road, from Commercial to RA-30 Zoning District. Mark Locklear, Senior
Planner, presented and reviewed the zoning change request and staff findings with the
Board. The Planning Board unanimously recommended approval. Chairman Byrd
opened the meeting for comments from the public. No comments were offered and
Chairman Byrd closed the public hearing. Commissioner Titchener moved to approve
the zoning change request as presented. Commissioner Hill seconded the motion and
it passed unanimously.
Chairman Byrd called to order a public hearing on a proposed Harnett County Hazard
Mitigation Plan. Mark Locklear, Senior Planner, presented and reviewed the proposed
Plan. Chairman Byrd opened the meeting for comments from the public. No
comments were offered and Chairman Byrd closed the public hearing. Commissioner
Hill moved to adopt the Harnett County Hazard Mitigation Plan as presented.
Commissioner McNeill seconded the motion and it passed unanimously.

Chairman Byrd called to order a public hearing on a proposed text amendment to the
Zoning Ordinance regarding building height requirements for the
Commercial/Business Section. Joseph Jeffries, Chief Planner, presented and reviewed
the proposed text amendment. Mr. Jeffries noted that Campbell University is building
new dormitories that will reach a height of approximately 64'. The current height
requirement is maximum of35' due to safety reasons. Fire fighting equipment and
building code requirements for sprinkler systems in most buildings now addresses
public safety. The Planning Board recommended approval. Chairman Byrd opened
the meeting for comments from the public. No comments were received and
Chairman Byrd closed the public hearing. Commissioner Andrews moved to adopt the
Zoning Ordinance text amendment as presented. Commissioner Titchener seconded
the motion and it passed unanimously. (Attachment 9)
Neil Emory, County Manager, presented a proposed resolution authorizing the
negotiation of an installment contract for the Agricultural Center/Animal Control
Facility Project and to schedule a public hearing October 4,2004 at 9:00 a.m.
concerning the matter. Commissioner Titchener moved to adopt the resolution.
Commissioner Hill seconded the motion and it passed unanimously. (Attachment 10)
Departmental reports were filed with the Board from Emergency Medical Services,
Sheriff s Department, Economic Development, Fund Balance Changes & Intra-
Departmental Budget Amendments. (Attachment 11)
Commissioner McNeill moved for the Board to go into closed session for the
following purposes:
1) to instruct the County staff in negotiation the terms on a proposed contract
for the acquisition of real property; and
2) to discuss matters relating to the location or expansion of industries or other
businesses in Harnett County.
This motion is made pursuant to N.C. General Statute Section 143-318. 11 (a)(5)&(4).
Commissioner Hill seconded the motion and it passed with a unanimous vote.
Commissioner McNeill moved for the Board to come out of closed session.
Commissioner Hill seconded the motion and it passed unanimously.
There being no further business, Commissioner McNeill moved to adjourn. The
Harnett County Board of Commissioners regular meeting, September 20,2004,
adjourned at 9:10 p.m.
