HomeMy WebLinkAbout08162004 HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting August 16, 2004 The Harnett County Board of Commissioners met in regular session on Monday, August 16, 2004, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett Boulevard, Lillington, North Carolina. Members present: Teddy J. Byrd, Chairman Beatrice B. Hill, Vice Chairman Dan B. Andrews Walt Titchener Tim McNeill Staff present: Neil Emory, County Manager Wm. A. (Tony) Wilder, Assistant County Manager Dwight W. Snow, County Attorney Kay S. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener led the pledge of allegiance and prayer. Commissioner Titchener moved to approve the agenda as published with the following additions: - Consent agenda: additional budget amendments resolution in support of Amendment One: Self-Financing Bonds authorize acceptance of grant for Sheriff’s Department - Regular agenda: recognition of Dr. Marvin Joyner, retiring president, CCCC Commissioner Andrews seconded the motion and it passed unanimously. Airport Master Plan Work Authorization – approval to proceed with block grants pending approval of “in-kind” contribution to be used as the local match. Report of unpaid taxes as of June 30, 2004 (Attachment 3) 7. Memorandum of Understanding for State Medical Assistance Team (SMAT) III Trailer. The trailer was awarded to Harnett County as part of a terrorism grant. 8. Designation for Work First Program be remain a “Standard County” for the 2005-2007 SFY. 9. Authorization for Emergency Medical Service to purchase a Chevrolet Tahoe to replace a Chevrolet Lumina with 90,000 miles. The Lumina will be transferred to General Services. 10. Resolution in support of Amendment One: Self-Financing Bonds (Attachment 4) 11. Authorization for Sheriff’s Department to accept a $10,000.00 grant to be expended on Methamphetamine issues in Harnett County. The funds were awarded by COPS DEC Program for North Carolina – Grant – DOJ Center # 2363. Chairman Byrd read and presented a resolution recognizing and honoring Dr. Marvin Joyner, retiring president of Central Carolina Community College. Each commissioner congratulated Dr. Joyner on his retirement and expressed appreciation for him furthering education, promoting economic development and being a friend of Harnett County. Commissioner Hill moved to appoint Vann Stephens to the Dangerous Dog Committee for a 3-year term to expire 8/31/07. Commissioner Andrews seconded the motion and it passed unanimously. Mr. Stephens was nominated by Commissioner Titchener. Joe Monk and Kelly Blankenship, World Changers Organization, presented a slide program regarding projects completed in Harnett County this summer. World Changers repaired 10 homes locally which included house painting, building of wheelchair ramp, construction of screened-in porch, shoveling gravel in a driveway and others. The County provided the funds to purchase materials and the World Changer Group provided the labor. Chairman Byrd called to order a public hearing regarding a proposed Community Development Block Grant (CDBG) Project and called on Steve Ward, Assistant Director, Public Utilities. Mr. Ward noted that the purpose of the public hearing is to discuss the details of the CDBG Infrastructure Hookup Program and to request input from the public on community development needs and priorities. The proposed grant is in the amount of $75,000 and would be used for water and sewer. This is the first of two public hearings required prior to the submission of an application. Chairman Byrd opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Chairman Byrd called to order a public hearing on a zoning change request for Daniel P. and Janet Maynard, from RA-20R to Commercial Zoning District, 1.27 acres located on SR 2064-Anderson Creek School Road, Anderson Creek Township. Mark Locklear, Senior Planner, presented and reviewed the zoning change request and staff findings with the Board. The Planning Board recommended denial with a 4 to 1 vote on the motion. Chairman Byrd opened the meeting for comments from the public. Comments were received from the following citizens: 1. Dan Maynard, applicant for 2. Janet Maynard, applicant for 3. Commissioner McNeill moved to approve the zoning change request for Dan and Janet Maynard as presented. Commissioner Titchener seconded the motion and it passed unanimously. Chairman Byrd called to order a public hearing on a zoning change request for Terry W. Thomas, from RA-20R to Commercial Zoning District, 4.01 acres, SR 1207- Seawell-Rosser Road, Barbecue Township. Mark Locklear, Senior Planner, presented and reviewed the zoning change request and staff findings with the Board. The Planning Board unanimously recommended approval of the zoning change request. Chairman Byrd opened the meeting for comments from the public. Comments were received from Terry W. Thomas, applicant. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve the zoning change request for Terry W. Thomas as presented. Commissioner Hill seconded the motion and it passed unanimously. Chairman Byrd called to order a public hearing on a proposed Airport Rules and Regulations Ordinance. Wm. A. (Tony) Wilder, Assistant County Manager, reviewed the proposed ordinance and noted that this will allow enforcement of the rules and regulations currently in place. The ordinance would be enforced by the Sheriff’s Department. Chairman Byrd opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner Titchener moved to adopt the Airport Rules and Regulations Ordinance as presented. Commissioner Andrews seconded the motion and it passed unanimously. The ordinance is copied in full in Harnett County Ordinance Book 2, page 325. Dwight Snow, County Attorney, presented for the Board’s consideration, an Amendment to the Franchise Agreement with Central Carolina Tire Disposal. Commissioner McNeill recused himself from discussion or voting on the matter because he is employed by Central Carolina Tire Disposal. Commissioner Titchener moved to allow Commissioner McNeill to abstain from voting on the proposed amendment. Commissioner Andrews seconded the motion and it passed unanimously. Mr. Snow stated that the amendment is to insert population figures of states in the Service Area of the franchise. The population numbers are based on the 2000 Census. Commissioner Hill moved to adopt the amendment to the franchise agreement as presented by Mr. Snow. Commissioner Titchener seconded the motion and it passed unanimously. Departmental reports were filed with the Board from Veterans Affairs, Housing, Animal Control, Emergency Medical Service, and Fund Balance Changes (Attachment 5). County Manager Neil Emory reported on the following items: 1. Local Government Association meeting is scheduled August 23 at 6:30 p.m. 2. Proposed meeting with Planning Board members to discuss Land Use. 3. Request for waiver of inspection fees for tornado victims - Commissioner McNeill moved to waiver inspection fees for those impacted by the storm for the next 30 days. Commissioner Hill seconded the motion and it passed unanimously. Several structures in and near the Heritage Village community were damaged by a tornado that touched down August 12, 2004. Commissioner McNeill moved for the Board to go into closed session to discuss matters relating to the location or expansion of industries or other businesses in Harnett County. This motion is made pursuant to N.C. General Statute Section 143- 318.11 (a)(4). Commissioner Hill seconded the motion and it passed unanimously. Commissioner McNeill moved for the Board to come out of closed session. Commissioner Hill seconded the motion and it passed unanimously. There being no further business, Commissioner Andrews moved to adjourn. Commissioner McNeill seconded the motion and it passed unanimously.
