Personnel Ordinance, which are being revised, include adding a definition for "Work
Week" under Article I, Section 3 (Definitions); Article III, Section 18 (Emergency
Operations Compensation); Article V , Section 11 (Emergency Operations); and
Article VI, Section 13 (Adverse Weather Policy).
H. Harnett County Veterans Services requests approval of a new Veterans Services
Officer Position, Pay Grade 20 with a job rate of $47,556 plus benefits. A current
Veterans Services Specialist Position within Veterans Services, Pay Grade 17 with a
job rate of $41,081 plus benefits, will be closed to offset the cost. Contingency fund s
will be used to cover this additional cost for the remainder of FY 2019 if needed.
I. Harnett County Development Services requests approval of a new E nforcement Code
Officer I position, Pay Grade 22, $43,692 plus benefits. Contingency funds will be
used to cover this additional cost for the remainder of FY 2019 if needed.

Invitations and upcoming meetings
Ryan Combs, Executive Director of Research Triangle Regional Partnership (RTRP), updated
the board on recent RTRP activitie s and re sponded to questions.
Mr. Haney reviewed proposed revisions to the Hamett County Personnel Ordinance. Mr. Hane y
noted the proposed revisions, which were identified as necessary following Hurricane Florence,
are intended to clarify expectations for County employees during activation of the County's

Emergency Operations Center (EOC), as well as during Adverse Weather Events. Portions of
the Personnel Ordinance which are being revised include:
1) Adding a definition for "Work Week" under Article I , Section 3 (Definitions);

3} Article V, Section 11 (Emergency Operations); and
4) Article VI, Section 13 (Adverse Weather Policy).
Hamett County Sheriff Wayne Coats introduced Cumberland County Sheriffs Office In-House
Council Ronnie Mitchell and CALEA Accreditation Manager Nicole Poveromo who addressed
the group. Cumberland County became CALEA accredited in 1998 and is one of five in North
Carolina. Consultant Michael D. Robertson also spoke.
Sheriff Coats previously requested approval of a Consulting Services Agreement and an
additional administrative assistant position to begin the process of receiving accreditation from
CALEA. The Sheriff also noted an additional cost of $14,000 per year for software/training
module. Staff estimates this will cost the County approximately $150,000 annually starting July
1, 2019. Once accredited. in approximately three years, a full-time Captain position and the
administrative assistant will oversee this program. Mrs. Stewart requested additional time to
develop a plan and calculate total cost. It was consensus of the Board that this is a good idea
conceptually. The Board directed staff to come back with a total cost per year in February.
Mrs. Stewart presented the following FY 2019 budget requests for consideration:
1) Approval of the creation of new position within Veteran Services -Veterans Services
Officer Position -Pay Grade 20 -47,556 plus benefits. Mrs. Stewart said the additional
funding for this position would be minimal as they will close a current positon within
Veteran Services to offset the cost.
2) Approval of an additional building inspector in Development Services -Code
Enforcement Officer I-grade 22 -$43,692 plus benefits. Mrs. Stewart said the
additional position is needed due to the growth in the county.
3) Approval of a program manager in Department of Social Services -Child Support
Enforcement Program Manager -grade 28 -$58,552 plus benefits. This position was
previously contracted out and monies are available to fund this position for the remaining
FY 2019.
Mrs. Stewart said there are contingency funds available to cover these additional costs if needed.
Mrs. Stewart sought direction regarding Dunn Emergency Services' request for funds to help
purchase four ZOLL heart monitors. The total cost is $131 ,266. Staff believes it would be
beneficial for them to use the same ZOLL monitors as the County. Mrs. Honeycutt suggested
reviewing Dunn Emergency Services audit first to see how much cash they have on-hand. Mrs.
Stewart believes they will need approximately $32,000 but will confirm and follow-up with the
Board during a future work session.
Mrs. Stewart reviewed the proposed January 22, 2019 regular meeting agenda. She also
reviewed invitations and upcoming meetings.

Commissioner Miller moved that the Board go into closed session to discuss the following
purposes:
1) To assist in the formulation of plans by the Harnett County Board of Education
relating to the emergency response to incidents of school violence; and
2) Consultation with the County's legal staff in order to preserve the attorney-client
privilege concerning the handling of certain claims.
This motion is made pursuant to N.C. General Statute Section 143-318.1 l(a)(8)&(3). Vice
Chairman Penny second the motion that passed unanimously.
Vice Chairman Penny moved that the Board come out of closed session. Commissioner Miller
second the motion, which passed unanimously.
Vice Chairman Penny moved to adjourn the meeting at 11: 18 am. Commissioner McKoy second
the motion that passed unanimously.

7. Harnett County Sheriffs Office requested permission to accept the donation of a
Bloodhound puppy from Tammy Lynn Bybee. The puppy will be trained in tracking to
assist in locating missing persons and suspects in criminal cases.
8. Harnett County Animal Services requested approval of a new full time Animal Shelter
Attendant position, Salary grade 11, for shelter operations and an additional budget
allocation up to $7,100.
9 . Sheriff Coats requested approval of a resolution to award a Glock Model 22, 40 Caliber,
Serial number SMF-324 to Deputy Sgt. Duncan Edward Jaggers upon his retirement from
the Harnett County Sheriffs Office on December 1, 2018. (Attachment 4)
I 0. Harnett County Department of Aging requested approval to accept a funding increase of
$48,626 in Home and Community Block Grant funding for 2018-2019.

11. Harnett County Library Director requested approval of the revised rate and fee schedule
for the Harnett County Public Library. Additions to the current schedule include a
detailed explanation for Jost and damaged library materials.
12. Harnett County Library Director requested approval to accept the LST A grant awarded
by the NC State Library for the "Computers in Libraries Conference". This is a
reimbursable grant up to $2,500 for costs of registration, lodging, and travel. There is no
match required.
13. Harnett County Engineer requested approval of the sale of 0.067 acres of Right-of-Way
and 0.160 acres of Permanent Utility Easement to NCDOT for the Marshbanks bridge
replacement. NCDOT offered a total of$1000 for the ROW and easement.
14. Harnett Regional Water requested approval of award of bid for a construction project in
the amount of $10,163,717 to State Utility Contractors Inc. of Monroe, NC. State Utility
Contractors were the lowest bidder of five listed on the certified bid tabulation provided.
This project consists of the construction of a new sludge dewatering system and building,
new treatment filters, anoxic mixers and a low lift pump station drain. This project is
necessary to build additional bio solids capacity at the plant. It will also increase the
filter treatment efficiency to help with ever increasing influent flows. This project will be
funded from HCDPU's cash reserves. (Attachment 5)
15. Harnett County Emergency Services requested approval to apply for and accept the 2019
annual Emergency Management Performance Grant and TIER 11/LEPC Grant funds . The
North Carolina Department of Public Safety, Emergency Management Division,
administers the grants.
Chairman Springle opened the floor for informal comments by the public, allowing up to
3 minutes for each presentation up to 30 minutes. The following citizens addressed the

MID-CAROLINA AGING ADVISORY COMMITTEE
Joan Harmon was appointed to serve on this board for a term of three years expiring
January 31 , 2022.
Angela McCauley, Harnett County Library Director, requested approval of the Memorandum of
Agreement for the Student ID Access Project allowing the Harnett County Public Library and
Harnett County Schools to work together as educational partners to provide quality electronic
resources to students, their families, and school staff in Hamett County at no cost and without
need of additional funding. Mrs. McCauley said this is an amazing opportunity. Vice Chairman
Penny moved to approve the request as presented. Commissioner Elmore seconded the motion
that passed unanimously.
Chairman Springle announced the Board was now sitting as the Governing Body of the South
Central Water and Sewer Authority.
Steve Ward , Director of Harnett Regional Water, requested approval of an increasing change
order for the South Central Water Transmission Project in the amount of $121 ,533 to Temple
Grading and Construction Co. Inc. Mr. Ward said this is needed to install a twelve-inch water
main on Neill Thomas Road. Mr. Ward noted the project has the current contingency funding
available to support this change.

Mr. Ward also requested approval of an increasing amendment in the amount of $18,800 for the
engineering contract of McGill & Associates out of Pinehurst, NC. This is for additional design,
survey and contract administration work associated with the South Central Water Transmission
Main Project . Commissioner Miller moved to approve both requests as presented . Vice
Chairman Penny seconded the motion, which passed unanimously.
Chairman Springle announced the Board was once again sitting as the Hamett County Board of
Commissioners.
Hamett County Sheriff Wayne Coats requested approval of a Consulting Services Agreement
with Michael D . Robertson in the amount of$64,800 per year to consult on the update of policy
and procedures and to begin the process of receiving Accreditation from the Commission on
Accreditation for Law Enforcement Agencies, Inc. (CALEA). Sheriff Coats also requested an
additional Administrative Assistant position, Pay Grade 17 $34,234 plus benefits, to assist in the
management of the CALEA accreditation process. He said the contract and new position would
not require additional funds this fiscal year.
Sheriff Coats said it is a hard process that will take approximately three years to complete. He
noted only six agencies in the state are CALEA certified. Sheriff Coats said once accredited, a
full-time Captain position, along with the administrative assi stant po sition, would oversee the
program. Discussions continued. Commissioners asked staff to determine the total budget for
this project. The Board will discuss the requests and funding during their upcoming work
session.
Ira Hall , Director of Harnett County Information Technology, requested approval of a new
Applications Analyst position, Pay Grade 25 $60,695.00, and an additional budget allocation of
approximately $12,000 to partially fund this position. Lapse salaries in the GIS budget will
cover additional funding for this position this fiscal year. Mr. Hall said to continue to take
advantage of all the possible efficiencies with the implementation of new software packages, the
IT department is requesting a new position that includes a software integration skill set.

Interdepartmental budget amendments
Mrs . Stewart announced Tim Mathews was recently hired as the new Director of Hamett County
Cooperative Extension. Mr. Mathews was previously with Pender County Cooperative
Extension and will start in Hamett County on February 1, 2019.
Mrs. Stewart also distributed a copy of the Average Private Sector Wages calculated by the NC
Department of Commerce, Labor and Economic Analysis Division. Hamett County remains a
Tier Two County.
Chairman Springle called for any new business. It was the consensus of the Board that
Chairman Springle work with Moore County and Cumberland County to correct our shared
boundary lines with the assistance of Hamett County's GIS/E911 Division and the N.C.
Geodetic Survey.
Commissioner McKoy moved that the Board go into closed session to discuss certain personnel
matters. This motion is made pursuant to N.C. General Statute Section 143-318.1 l(a)(6). Vice
Chairman Penny second the motion that passed unanimously.

A RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
DECLARING ITS INTENT TO CLOSE CERTAIN PORTIONS OF THE
UNMAINTAINED RIGHTS-OF-WAY OF SENTER STREET, BETTS STREET, AND
BYRD STREET, AND CALLING A PUBLIC HEARING ON THE QUESTION
WHEREAS , Harnett County received a request for the closure of certain portions of the
following unmaintained rights-of-way: (i) Senter Street between the Northern and Southern
Railroad right-of-way and U.S. Highway 401; (ii) Betts Street between the Northern and Southern
Railroad right-of-way and U.S. Highway 401 ; and (iii) Byrd Street between the northern line of
the Betts Street right-of-way and the southern line of the Senter Street right-of-way; and
WHEREAS , the portions of the unmaintained rights-of-way to be closed are the areas within
the diagonal lines shown on Exhibit A attached hereto and incorporated herein; and
WHEREAS , the Hamett County Board of Commissioners (hereinafter referred to as the
"Board") is advised that all abutting properties have existing access to and from public streets and
closure of the right-of-way sections in question would not deprive any property owner of
reasonable means of ingress and egress.
WHEREAS, the provisions of North Carolina General Statute § 153A-24 l require that a
resolution be adopted by the Board declaring the intent of the Board to close such right-of-way
and to call a public hearing to hear all interested persons who appear with respect to whether the
closure would be detrimental to the public interest or to any individual property rights.
NOW , THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners
that the Board hereby declares its intent to consider closing certain portions of the following
unmaintained rights-of-way: (i) Senter Street between the Northern and Southern Railroad right-
of-way and U.S . Highway 401 ; (ii) Betts Street between the Northern and Southern Railroad right-
of-way and U.S. Highway 401; and (iii) Byrd Street between the northern line of the Betts Street
right-of-way and the southern line of the Senter Street right-of-way.
BE IT FURTHER RESOLVED that the Board calls a Public Hearing at 6 :00 pm on Tuesday,
January 22, 2019 in the County Administration Building at 420 McKinney Parkway, Lillington,
North Carolina 27546 to hear all interested persons who appear with respect to whether the closure
of said rights-of-way would be detrimental to the public interest or to any individual property
rights, and hereby authorizes the Harnett County Manager, at the expense of the applicant, to
arrange publication, posting, and mailing of notices of the Public Hearing as required by law.
This resolution shall be effective upon adoption.

A RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
DECLARING ITS INTENT TO CLOSE CERTAIN PORTIONS OF THE
UNMAINTAINED RIGHTS-OF-WAY OF SENTER STREET, BETTS STREET, AND
BYRD STREET, AND CALLING A PUBLIC HEARING ON THE QUESTION
WHEREAS , Harnett County received a request for the closure of certain portions of the
following unmaintained rights-of-way: (i) Senter Street between the Northern and Southern
Railroad right-of-way and U.S. Highway 401; (ii) Betts Street between the Northern and Southern
Railroad right-of-way and U.S. Highway 401 ; and (iii) Byrd Street between the northern line of
the Betts Street right-of-way and the southern line of the Senter Street right-of-way ; and
WHEREAS , the portions of the unmaintained rights-of-way to be closed are the areas within
the diagonal lines shown on Exhibit A attached hereto and incorporated herein; and
WHEREAS , the Harnett County Board of Commissioners (hereinafter referred to as the
"Board") is advised that all abutting properties have existing access to and from public streets and
closure of the right-of-way sections in question would not deprive any property o~er of
reasonable means of ingress and egress.
WHEREAS , the provisions of North Carolina General Statute §153A-241 require that a
resolution be adopted by the Board declaring the intent of the Board to close such right-of-way
and to call a public hearing to hear all interested persons who appear with respect to whether the
closure would be detrimental to the public interest or to any individual property rights.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners
that the Board hereby declares its intent to consider closing certain portions of the following
unmaintained rights -of-way : (i) Senter Street between the Northern and Southern Rai lroad right-
of-way and U.S. Highway 401; (ii) Betts Street between the Northern and Southern Railroad right-
of-way and U .S. Highway 401; and (iii) Byrd Street between the northern line of the Betts Street
right-of-way and the southern line of the Senter Street right-of-way.
BE IT FURTHER RESOLVED that the Board calls a Public Hearing at 6 :00 pm on Monday,
February 18 , 2019 in the County Admini stration Building at 420 McKinney Parkway, Lillington,
North Carolina 27546 to hear all interested persons who appear with respect to whether the closure
of said rights-of-way would be detrimental to the public interest or to any individual property
rights , and hereby authorizes the Hamett County Manager, at the expense of the applicant, to
arrange publication, posting , and mailing of notices of the Public Hearing as required by law.
This resolution shall be effective upon adoption.

Proclamation Supporting Harnett Ag Strong Initiative
WHEREAS, Hamett County has strong roots deeply rooted in production agriculture; and
WHEREAS, agriculture is the number one industry in Hamett County annually contributing
$198 million to the local economy; and
WHEREAS, farms utilize local businesses and provide jobs strengthening the local economy;
and
WHEREAS, agriculture touches our lives daily from the food we eat, to the homes we live in,
and the clothes we wear; and
WHEREAS, Hamett County farmers produce agricultural commodities and contribute to
supplies that enable our citizens to enjoy a food that is abundant, affordable, and among the
safest in the world; and
WHEREAS, it is estimated that food production needs to grow by at least 70 percent by 2050 to
meet the demands the world's growing population with Hamett farmers utilizing some of the
most innovative production methods to help meet this need; and
WHEREAS, farm families provide a strong foundation of grassroots volunteers and community
leaders; and
WHEREAS, Hamett County landscapes are adorned with a wealth of natural resources
including the Cape Fear River and its tributaries making up a portion of North Carolina's largest
river basin in addition to an array of soils allowing for production of diverse agricultural
commodities with greater than 20 various row crops marketed annually in addition to livestock
and poultry; and
WHEREAS, diverse agricultural production promotes a strong local foods network; and
WHEREAS, Barnett's working agricultural lands help to strengthen our national defense system
by being within the Sentinel Landscape and having greater than 20,000 acres of farmland
enrolled in the Voluntary Agricultural District; and
WHEREAS, despite record low commodity prices, market challenges, and record setting
weather events, Hamett County family farms remain persistent, optimistic, and strong.
NOW, THEREFORE LET IT BE PROCLAIMED that the Hamett County Board of
Commissioners does hereby:
• Recognize and value the strength that the agricultural community provides Hamett
County in both its citizenship and economic contributions;
• Support and encourage policies that promote efficient use of natural resources and that
advocate for a strong agricultural industry within Hamett County by making informed
judgements;

REQUEST:
Capital Projects Directors requests approval of award of bid in the amount of $519,300 to
Bolton Construction and Service, LLC from Raleigh, NC for equipment and installation of a
chilled water system replacement for DSS/Commons/Health Dept. Buildings . This chiller
replacement is badly needed, as the existing chiller and tower are beyond feasible to repair.
This chiller should meet the HVAC needs of the existing buildings and the planned DSS
expansion for the foreseeable future. Attached is a letter of recommendation and the certified
bid tabs for your review. Please place this item on the agenda at the next available meeting.

Provide on the Bid : Under GS 143-128 .3 (c) the undersigned bidder shall identify on its bid the minority
business that it will use on the project and the total dollar value of the bid that will be performed by the

1. Introductions: All present introduced themselves. Chris Johnson (CJ) will be the Harnett Co.
Project Manager and G reg Mills (GM) will represent the Designer, Dewberry Eng ineers.
2. Description of Projec t: Dewberry (GM) reviewed th e project plans will all attending . Basically, the
project involves replacing the ex isting ice storage tanks, water cooled screw compressor chiller,
cooling tower, chilled water and condenser water pumps, piping, and ethylene glycol circulating
system with a nominal 225 ton air cooled chiller with primary-secondary chilled water pumping
system. Controls work will include a new BACnet compatibl e controller that will interface with
new chiller mounted controller and existing Trane Tracer Summit controls . Intent is for backward
and forward compatibility with future controls renovation work.
3. Contract Requirements : Dewberry (GM) reviewed some of the contract requireme nts per below:
a. Single Prime -Contract will be for single pri me work only .

County Manager's Office requests approval of revisions to the Harnett County Personnel
Ordinance. The proposed revisions, which were identified as necessary following Hurricane
Florence, are intended to clarify expectations for County employees during activation of the
County's Emergency Operations Center (EOC), as well as during Adverse Weather Events.
Portions of the Personnel Ordinance which are being revised include:
Adding a definition for "Work Week" under Article I, Section 3 (Definitions); Article III,
Section 18 (Emergency Operations Compensation); Article V, Section 11 (Emergency
Operations); and Article VI, Section 13 (Adverse Weather Policy).

Work Week: For the purposes of this Ordinance, Harnett County considers the work
week to be from Sunday through the following Saturday.
Section 18. Emergency Operations Compensation
In the event of a major emergencyJ. or natural or man-made disaster, Harnett County
seeks to provide shelter and comfort to those adversely affected by creating and
following a detailed Emergency Response Plan.
In accordance with the County's Emergency Response Plan, and the instructions of the
Emergency Operations Center Director, Harnett County employees may be required to
carry out specific emergency response tasks to ensure the safety and continued
prosperity of the County. These tasks may be carried out at the Emergency Operations
Center or at other sites necessary for emergency response. Such employees, who work
under the direction of the Emergency Operation Center Director during such an
emergencyJ. or natural or man-made disaster, will be compensated according to this
policy.
County Offices Remain Open: If the emergency or natural disaster requires the
activation of the Emergency Operations Center and County offices are open as
regularly scheduled, employees required to work under the direction of the Emergency
Operations Center Director will be compensated as described below:
L Nonexempt employees, as defined above in Article Ill, Section 4-2--11._and in the
FLSA, will be paid one and one-half (1 and%) times their regular rate of pay for
actual hours worked beyond the regular 40 hour workweekemployee 's regular

E. When the County Manager provides Administrative Leave as a result of County
offices being closed , employees required to work under the direction of the
Emergency Operations Center Director will receive Administrative Leave in
addition to any compensation they earn during the event. For nonexempt
employees, as defined above in Article Ill, Section 12 and in the FLSA, any
Administrative Leave will not count towards the time needed to earn one and
one-half (1 and %) times their regular rate of pay .
For the purpose of payroll , event timesheets should cover only the period during which
the County 's Emergency Operations Center is activated .
Employees required to work under the direction of the Emergency Operations Center
Director will not be compensated for the time required to report to the Emergency
Operations Center or their designated location if elsewhere.
In the event employees are required to work long and continuous hours, the County
Manager may grant time off with pay/administrative leave for rest and recuperation to
ensure safe working conditions .
In order to ensure the safety of the County's personnel , citizens , and continued
operations of emergency response tasks, employees required to work under the
direction of the Emergency Operations Center Director will be requ ired to take a break
of at least eight hours within a 24 -hour period .

In the event of natural or man-made disaster, the County Manager and the BOC
reserves the right to close all County offices, but still require County employees ,
essential and non-essential , to report to work to assist with any necessary emergency
operations.

Those employees required to work during a natural or man-made disaster will be
compensated in accordance with Article UNI , Section -W-.1..l_of this policy .
Any employees who are required to work under the direction of the Emergency
Operations Center Director during an emergency or natural disaster will be
compensated in accordance with Article Ill , Section 18 of this policy .
Se ct io n 13. Adverse W e ather Po l icy (Ad mi nistrati v e Lea ve )
Purpose: Harnett County must ensure the delivery of services to citizens and
businesses even during times of adverse weather. Considering the varied geographic
locations and diverse populous of this County, it is the intent of this Adverse Weather
Policy to establish a uniform Countywide plan regarding how operations will be affected
during times of adverse weather and to establish guidelines for accounting for time and
for releasing non-essential personnel from work when : (1) adverse weather prohibits or
adversely impacts the ability of non-essential personnel to report to work or to remain at
work, or (2) adverse weather necessitates the suspension of non-essential operations .
Note : All County employees are to presume, unless otherwise notified, that County
operations will continue as normal and they are expected to report to work regardless of
any weather or other emergency conditions that may develop. The Harnett County
Adverse Weather Policy will not go into effect until the County Manager has determined
that normal operations at all Harnett County facilities is jeopardized by the existence of
adverse weather that may put lives or property in danger. Such a determination will be
forwarded to all major news and radio outlets across the County , distributed via Harnett
County e-mail , and posted on www.harnett.org and designated County social media
platforms .
Designation of Essential & Non-Essential Personnel: All County employees shall be
designated as essential or non-essential personnel by the appropriate Department
Head or the County Manager. Non-essential personnel shall be designated in writing
through an e-mail or memorandum . This e-mail or memorandum shall act as an
employee's recognition of his or her status as a-non-essential personnel. Essential
personnel shall be designated in writing through a formal memorandum and each
essential employee shall acknowledge this designation in writing . This designation and
acknowledgement will be included in each employee's personnel file .
While not all County department heads and/or their assistant directors may be
considered essential personnel, all department heads and/or their assistant directors
should make themselves available to the County Manager via an agreed upon method
of communication should they be needed during times of adverse weather .
Some County departments may, in their discretion, assign employees to shifts in order
to maintain essential County operations . In these situations, employees may be deemed
essential or non -essential in accordance with their respective shift.
Duties of Essential Personnel :
A. Essential personnel who are required to work during adverse weather because
their positions have been designated as such by their Department Heads or the
County Manager aoo--should perform to the best of their abilities during this time .

8. Those essential personnel who cannot report to work because of driving
conditions will notify their immediate Supervisor or Department Head so that
County transportation can be dispatched to pick them up .
C. If an essential employee refuses to report to work , remain at work , or be carried
to work by County transportation once this policy has been activated the
employee will not be granted administrative leave and will be charged absent.
D. Essential employees are not allowed to take a day off at such future time to
compensate for working during an emergency. Any compensation received by
such employees for working during an emergency is governed by the Emergency
Operations Compensation policy addressed in Article Ill , Section 19.
Non-Essential Personnel & Administrative Leave :
A. Non-essential personnel are those employees who may be approved for
administrative leave during adverse weather because their positions have been
designated as such by their Department Head or the County Manager.
8 . Once this policy has been activated , administrative leave for nonessential
personnel may be granted in the discretion of the County Manager to
administratively excuse all non-essential personnel.
C. Administrative Leave will be granted to employees in the amount of hours the
employee is scheduled to work, not to exceed 10 hours.
D. Entitlement to administrative leave depends on a variety of factors, including but
not limited to the non-essential employee's status at the time of the
announcement, when the adverse weather develops, and how it affects County
operations.
a) During Normal County Operating Hours: If adverse weather develops
during normal County operating hours and the County Manager so
chooses to cease all County operations the following shall apply:
i. If the employee was on duty and was scheduled to depart early
through the use of his or her accrued leave after official word was
received but before the time for dismissal , leave is charged only
from the time the employee departed until the dismissal time .
ii. If the employee was scheduled to return to duty after an initial
period of leave and dismissal is given before the employee can
physically report to work , leave is charged until time for dismissal.
b) Outside of Normal County Operating Hours: If adverse weather develops
outside of normal County operating hours but there is no significant
curtailment of county activities the following applies :
i. Regardless of road and weather conditions essential and non-
essential employees are expected to be at work on time. Employee
tardiness caused by treacherous driving conditions may be
excused on a case-by-case basis by their department head or the
County Manager, but failure to report to work will result in the
employee being charged absent.
ii . The County Manager, in his or her discretion, may delay opening
the County for a period of the workday . In the event he or she
chooses to do so , non-essential personnel will be administratively
excused for the delay period , but this does not excuse an employee
from being absent once the delay period has passed.
c) Outside of Normal County Operating Hours: If adverse weather develops
outside of normal County operating hours but there is a significant
curtailment of County activities the following applies :

SUBJECT: New Veterans Services Officer Position
REQUESTED BY: Eric Truesdale
REQUEST:
Request approval of a new Veterans Services Officer Position in Pay Grade 20 with a job rate
of $47,556 plus benefits. This position will oversee the Veterans Services Outreach Program
and supervise the Veterans Services Specialist position. This will help greatly in growing the
Veterans Services Porgram to meet the needs of the growing Veterans population in Harnett
County by increasing outreach into nursing homes and assisted living facilities. This position
will report to the Veterans Services Director.
When this new position is approved the current Veterans Services Specialist Position, pay
grade 17 with a job rate of $41,081 plus benefits , will be reclassified to the new position. The
Veterans Services Specialist will be closed. The cost of creating the Veterans Services
Officer position will be the difference between the two positions.
Contingency funds will be used to cover this additional cost for the remainder of FY 2019 if
needed.

I position, Pay Grade 22, $43,692 plus benefits.
This position was lost in 2009 but is needed back due to steady growth in the County over the
last 10 years.
Contingency funds will be used to cover this additional cost for the remainder of FY 2019 if
needed.

Additional Information:
On December 3rd, the Hamett County Planning Board voted unanimously ( 4-0) to
recommend approval based on adjacent and existing Employment Mixed Use desgination as
well as compatibility with the County's Land Use plan.
Two citizens spoke in opposition with concerns about potential non-residential uses as well
as higher density residnetial uses and traffic.

Agricultural and Rural Residential: Primarily agricultural and forestry uses with some rural residential areas. These areas are
located outside of existing and future sewer service areas and rely on septic systems for wastewater treatment. They have a limited
road network and in some cases lie within High Quality Watershed or Water Supply Watershed areas. The lack of utility and
transportation infrastructure, the established low density development pattern and ongoing agricultural activities in these areas
contribute to their rural character. This character can be enhanced by encouraging only low intensity uses, single family residential up
to one unit per acre and context sensitive rural design.
Development Nodes
Rural Centers: Small scale commercial centers. The exact location and extent of the Rural Centers will be market driven , however,
the non-residential footprint will usually be less than 50,000 square feet in these areas. Site design and architecture should
complement the character of the surrounding community.
Compact Mixed Use: These areas are meant to be nodes or activity centers for growing areas in the county. They are located near
concentrations of existing or planned residences, and areas with access to major thoroughfares and utilities. These areas incorporate
commercial uses including grocery stores, retail establishments, restaurants and services. Office, civic and institutional uses should
complement commercial uses. Higher density residential including small lot single-family, townhomes and apartments should be
located in close proximity to shopping and service destinations and complimented by pedestrian facilities to provide more walking
opportunities to internal and external destinations. The exact location and size of non-residential areas will be dependent on market
conditions.
Employment Mixed Use: These areas are located along major thoroughfares and include prime locations for economic development
opportunities. Uses encouraged in the Employment Mixed Use areas include but are not limited to, industrial , warehouse, office,
research and development, tech-flex , medical , energy and distribution. Residential development is appropriate only when not in
conflict with existing or future industry or commercial uses.

*Explanation of Land Use Classifications:
Protected Areas (PA): Parks and other forms of protected open space, including large conservation
easements.
Environmentally Sensitive Areas (ESA): Environmentally sensitive areas, including floodplains and areas
located in the Conservation Overlay Zoning District. Primary uses in these areas would be open space,
forestry, and agriculture.
Compatibility Development Target Areas (COTA): Areas where water and sewer is read ily available and
residential developments are recommended to take advantage of the Compatibility Development option
in the Unified Development Ordinance (UDO). This option allows for greater flexibility in lot sizes in
exchange for h i gher amounts of open space. This allows for clustering development in order to preserve
rural views and key natura l features such as habitat corridors and farmland.
Military Corridor Buffer (MCB): Critical and Important to Conserve Lands as identified by the Fort Bragg JLUSE
within 1 mile of the base and parcels > 50 acres within 1/i mile of Fort Bragg. Except those lands with
existing or pending development (i.e. Lexington Plantation, Anderson Creek Club, Walmart), proposed
Compact Mixed Use Areas, and lands east of Ray Road. Proposed development in these areas is meant to
be reviewed by the Federal Government to ensure compatibility with Fort Bragg operations.

uses, single family residential up to one unit per acre and context sensitive rural design .
Low Density Residential (LOR): Single family detached residential intended to remain predominantly suburban in character
and provide for low density single-family res idential development on lots smaller than those in Rural Residential areas . Gross
densities of 1-3 dwelling units per acre depending on utilities, soils and character of adjacent development.
Medium Density Residential (MDR): Medium density residential with a mix of housing types including single family detached
homes with average lot sizes, small-lot homes and patio homes. Gross densities of 2-5 dwelling units per acre. Located in areas
served by current or planned utilities or in areas near the extra-territorial jurisdiction (ETJ) of towns. Additional housing types
(including townhomes and apartments) and higher densities may be appropriate as part of planned developments or near
Development Nodes.
Rural Centers (RC): Small scale commercial centers. The exact location and extent of the Rural Center s will be market driven,
however, the non-residential footprint will usually be less than 50,000 square feet in these areas.
Compact Mixed Use (CMU): These areas are meant to be nodes or activity centers for growing areas in the County. They are
located near concentrations of existing or planned residences, and areas with access t o major thoroughfares and utilities. These
areas incorporate commercial uses including grocery stores, retail establishments, restaurants and services. Office, civic and
in stitutional uses should complement commercial uses. Higher density residential including small lot single -family, townhomes
and apartments should be located in close proximity to shopping and service destinations and complimented by pedestrian
facilities to provide more walking opportunities to internal and external destinations. The exact location and size of
no nresidential areas will be dependent on market conditions.
Employment Mixed Use (EMU): These areas are located along major thoroughfares and include prime locations for economic
development opportunities. Uses encouraged in the Employment Mixed Use areas include but are not limited to i ndustrial,
warehouse, office, research and development, tech-flex, medical, energy and d istribution . Residential development is
appropriate only when not in conflict with existing or future in dustry or commercial u ses.

The single family residential structure that is located on the property has been vacant since January 2, 2017.
The manufactured home has confirmed structural damage and neglect that renders it in a condition that is
viewed as unsafe and a danger to the general public. A notice of the dangerous character of the structures have
been placed in a conspicuous place on the exterior. Due to the significate amount damage that the structure
has sustained, it is recommended that the condemned structure be demolished . The prolonged presence of the
structure is likely to cause or contribute to blight, disease, vagrancy or danger to children.

ORDINANCE AUTHORIZING DEMOLITION OF 21 E. TRYON COURT (SINGLE-
F AMIL Y RESIDENCE) AND IMPOSITION OF LIEN TO RECOVER COUNTY COSTS
WHEREAS, the County of Harnett has received complaints about life safety issues and potential
code violations on the single-family residence located at 21 E. Tryon Court, Spring Lake, NC,
owned by Karton Properties LLC through deed recorded in Book 2125 , Page 629, of the Harnett
County Registry, and
WHEREAS , the concerns identified have included structural deterioration and collapse, water
intrusion, and other code violations that present clear life safety issues, and
WHEREAS, on February 8, 2018 , the structure located at 21 E. Tryon Court was posted in a
conspicuous place as unsafe and a certified letter was sent to the owner, Karton Properties LLC
c/o Lancanster & Trotter on March 1, 2018 to order the structure not to be occupied, and to
advise the owner of the opportunity to present evidence concerning the structure at a hearing,
which was sc heduled for March 7 , 2018 , and
WHEREAS, County staff conducted a hearing on March 7 , 2018 in accordance with N.C.G.S.
l 53A-368, and the owners, persons in interest, agents or attorneys did not submit evidence that
would dispute the assessment of the structure, and
WHEREAS, based on the examination of the structure and the absence of evidence or argument
from Karton properties LLC., a formal order was issued to demolish the structure on March 22 ,
2018, and a deadline of May 28, 2018 to demolish the structure was established as required by
N.C.G.S. 153A-369, and
WHEREAS, Karton Properties LLC., did not appeal the March 22, 2018 order to the Hamett
County Board of Commissioners, and
WHEREAS, no significant progress has occurred to demoli sh the structure, and it remains in a
similar condition as noted in February 2018 , and
WHEREAS , in the interest of the public health, safety, and welfare, and despite the e fforts by
Hamett County staff to resolve the outstanding life safety concerns, and as a result of the owner
having fa il ed to comply with the order to demolish within the prescribe timeframe, the County
has determined that it is now necessary for the County to proceed with the demolition of the
single-family residential structure at 21 E. Tryon Court, Spring Lake, NC, and
WHEREAS, the County has solicited bids for the demolition of the structure, and the low bid is
the sum of $3 ,850.00 for the demolition and removal of debris and materials of the s ingle-family
residence, and

WHEREAS, the cost incurred by the County shall be a lien against the owner, Karton Properties
LLC., and the real property located at 21 E. Tryon Court, Spring Lake, NC as conveyed to owner
in Book 2125, Page 629, Harnett County Registry, and the County shall sell any usable materials
and personal property, fixtures, and appurtenances found in or attached to the structure and credit
the proceeds of the sale toward the costs and account to the owner,
NOW, THEREFORE BE IT ORDAINED by the Harnett County Board of Commissioners that:
Section 1. Due to significant life safety concerns and pursuant to N.C.G.S. 153A-3 72,
the demolition of the single-family residential structure at 21 E. Tryon Court, Spring Lake, NC ,
(PIN 0514-26-5034.000) is hereby authorized, and County staff shall contract for and carry out
the demolition and removal of the structure in accordance with the terms of this Ordinance.
Section 2. Pursuant to N.C.G.S. 153A-372, and N.C.G.S. 153A-200, a lien equal to the
amount of the County's cost associated with the demolition and removal , less any credits due the
owner, shall be imposed against the real property located at 21 E. Tryon Court, and the costs
shall be repaid to the County within 30 days following demolition and removal of the single-
family residential structure. If the County does not receive payment for said costs within 30
days, then all costs not paid to the County within 30 days shall accrue interest at a rate of 8% per
annum and said interest shall be added to the amount of the lien imposed, and the County is
authorized to foreclose its lien and recover all costs associated therewith including attorney's
fees and court costs.
Section 3. County shall sell the usable materials of the dwelling and credit the proceeds
against the cost of demolition and removal. If a surplus remains after the sale of materials and
satisfaction of the cost of removal or demolition, County shall deposit the surplus in the Superior
Court where it shall be secured and disbursed by the Court to the person found to be entitled
thereto by final order or decree of the Court.
Section 4. A certified copy of the Resolution and Ordinance be recorded in the Office of
the Hamett County Register of Deeds.
Section 5. This Ordinance shall become effective upon its adoption.

The single family residential structures that are located on the property have been vacant for several years.
Both show signs of structural damage and neglect that renders them in a condition that is viewed as unsafe and
a danger to the general public. A notice of the dangerous character of the structures have been placed in a
conspicuous place on the exterior. Due to the significate amount damage that the structures have sustained, it
is recommended that the condemned structures be demolished. The prolonged presence of the structures is
likely to cause or contribute to blight, disease, vagrancy or danger to children.

ORDINANCE AUTHORIZING DEMOLITION OF 9018 US 401 NORTH (SINGLE-FAMILY
RESIDENCE & ACCESSORY STRUCTURE) AND IMPOSITION OF LIEN TO RECOVER
COUNTY COSTS
WHEREAS, the County of Harnett has received complaints about life safety issues and potential
code violations on the single-family residence and an accessory structure located at 9018 US 401
North, Fuquay Varina, NC, owned by Tarbit E. Johnson c/o Tarbart N. Faulk through deed
recorded in Book 404 , Page 21, of the Harnett County Registry, and
WHEREAS, the concerns identified have included structural deterioration and collapse, water
intrusion, and other code violations that present clear life safety issues, and
WHEREAS , on February 27, 2018, the structures located at 9018 US 401 North were posted in a
conspicuous place as unsafe and a certified letter was sent to the owner, Tarbit E. Johnson c/o
Tarbart N. Faulk on March 1, 2018 to order the structures not to be occupied, and to advise the
owner of the opportunity to present evidence concerning the structures at a hearing, which was
scheduled for March 7, 2018, and
WHEREAS, County staff conducted a hearing on March 7, 2018 in accordance with N.C.G.S.
153A-368, and the owners, persons in interest, agents or attorneys did not submit evidence that
would dispute the assessment of the structures, and
WHEREAS, based on the examination of the structures and the absence of evidence or argument
from Tarbart N. Faulk, the agent representing the property located at 9018 US 401 North, a
formal order was issued to demolish the structures on March 8, 2018 , and a deadline of May 11 ,
2018 to demolish the structures was established as required by N.C.G.S. 153A-369, and
WHEREAS, Tarbart N. Faulk, the agent representing the property located at 9018 US 401 North,
did not appeal the March 8, 2018 order to the Harnett County Board of Commissioners, and
WHEREAS, no significant progress has occurred to demolish the structures, and it r emains in a
similar condition as noted in February 2018 , and
WHEREAS, in the interest of the public health, safety, and welfare, and despite the efforts by
Hamett County staff to resolve the outstanding life safety concerns, and as a result of the owner
having failed to comply with the order to demolish within the prescribe timeframe, the County
has determined that it is now necessary for the County to proceed with the demolition of the
single-family residence and the accessory structure at 9018 US 401 North, Fuquay Varina, NC,
and
WHEREAS, the County has solicited bids for the demolition of the structures, and the low bid is
the sum of $6,250.00 for the demolition and removal of debris and materials of the single-family
residence and the accessory structure, and

WHEREAS, the cost incurred by the County shall be a lien against the owner, Tarbit E. Johnson
c/o Tarbart N. Faulk, and the real property located at 9018 US 401 North, Fuquay Varina, NC as
conveyed to owner in Book 404 , Page 21, Harnett County Registry, and the County shall sell any
usable materials and personal property, fixtures, and appurtenances found in or attached to the
structure and credit the proceeds of the sale toward the costs and account to the owner,
NOW, THEREFORE BE IT ORDAINED by the Harnett County Board of Commissioners that:
Section 1. Due to significant life safety concerns and pursuant to N. C. G. S. 15 3 A-3 72 ,
the demolition of the single-family residential structure and accessory structure at 9018 US 401
North, Fuquay Varina, NC, (PIN 0654-51-6833.000) is hereby authorized, and County staff shall
contract for and carry out the demolition and removal of the structures in accordance with the
terms of this Ordinance.
Section 2. Pursuant to N.C.G.S. 153A-372, and N.C.G.S. 153A-200, a lien equal to the
amount of the County's cost associated with the demolition and removal, less any credits due the
owner, shall be imposed against the real property located at 9018 US 401 North, and the costs
shall be repaid to the County within 30 days following demolition and removal of the single-
family residential structure and accessory structure. If the County does not receive payment for
said costs within 30 days, then all costs not paid to the County within 30 days shall accrue
interest at a rate of 8% per annum and said interest shall be added to the amount of the lien
imposed, and the County is authorized to foreclose its lien and recover all costs associated
therewith including attorney's fees and court costs.
Section 3. County shall sell the usable materials of the dwelling and credit the proceeds
against the cost of demolition and removal. If a surplus remains after the sale of materials and
satisfaction of the cost of removal or demolition, County shall deposit the surplus in the Superior
Court where it shall be secured and disbursed by the Court to the person found to be entitled
thereto by final order or decree of the Court.
Section 4. A certified copy of the Resolution and Ordinance be recorded in the Office of
the Hamett County Register of Deeds.
Section 5. This Ordinance shall become effective upon its adoption.
Adopted this the 22nd day of January, 2019.
