December 3, 2018
The Harnett County Board of Commissioners met in regular session on Monday, December 3,
2018, in the Commissioners Meeting Room, County Administration Building, 420 McKinney
Parkway, Lillington, North Carolina.

Chairman Springle called the meeting to order at 9:00 am. Commissioner McKoy led the Pledge
of Allegiance and invocation.
Chairman Springle called for any additions or deletions to the published agenda. Mrs. Stewart
requested the addition of approval of the Public Official Bond for Harnett County Sheriff Wayne
Alfred Coats in the amount of $10,000. Commissioner Elmore moved to approve the agenda as
amended. Commissioner Miller seconded the motion, which passed unanimously.
Commissioner Elmore moved to approve items on the revised consent agenda. Vice Chairman
Penny seconded the motion, which passed unanimously.

4. Proclamation Recognizing Harnett County Emergency Services Director Jimmy Riddle's
Contributions to Harnett County and its Citizens
5. Harnett County Staff Attorney requested Disclosure of Settlement Agreement of
Devontay Deon Myles v. Harnett County Sheriff's Department, Wayne Coats, Julie
Panko, Holli Jenkins, Steven Tart, and Travelers Casualty and Insurance Company of
America (full release of all claims)
6. Harnett County Tax Administration requested approval to bar off 2008 taxes totaling
$16,653.13 of real and personal property and $44,810.83 of motor vehicle. These taxes
can no longer be legally collected through forced collection procedures.
7. Harnett County Solid Waste requested award of bid and approval of a three-year service
contract with Martin Edwards for yard waste reduction. (Attachment 2)

8. Administration requested approval of the School Resource Officer Program
Reimbursement Agreement for Elementary and Primary Schools between the County of
Harnett, the Harnett County Board of Education and the Town of Coats.
9. Administration requested approval of Harnett County Promise Memorandum of
Understanding between the Trustees of Central Carolina Community College and the
County of Harnett.
10. Administration requested approval of a Resolution to Amend the Rules of Procedures of
the Harnett County Board of Commissioners. (Attachment 3)
11. Administration requested approval of the Resolution to Approve the 2019 Schedule of
Meetings of the Harnett County Board of Commissioners (Attachment 4)
12. Harnett County GIS/E-911 Operations Administrator requested approval of the Joint
Resolution Adopting and Establishing the Common Boundary Between Chatham County
and Harnett County. The resolution also directs staff to work together to reconcile
county services to affected properties such as board of elections, zoning, building
permitting, emergency response and tax assessments. (Attachment 5)
13. Harnett County General Services requested approval of the Full Service Fixed Base
Operator (FBO) Agreement between County of Harnett and Warren Investments of NC,
Inc. for $138,500 per year with the price increasing 2% each year during the initial term
of the agreement starting July 1, 2019. The term of the lease and services to be provided
commenced on July 1, 2018 and will continue through June 30, 2023.
14. Administration requested approval of an Ordinance Enacting and Adopting a Supplement
to the Code of Ordinances for the County of Harnett, North Carolina - 2018 S-1
supplement to the Code of Ordinances of the County of Harnett Code of Ordinances,
which supplement contains all ordinances of a general and permanent nature enacted
since the prior supplement to the Code of Ordinances. (Attachment 6)
15. Harnett County Public Utilities requested approval of a Resolution Adopting the
Amended Harnett County Water Shortage & Conservation Ordinance. NCDEQ Division
of Water Resources required adoption or amendment of the ordinance to address possible
needed changes however none were needed for the existing plan. (Attachment 7)
16. Resolution to Cancel the December 17, 2018 Regular Meeting of the Harnett County
Board of Commissioners (Attachment 8)
17. Approval the Public Official Bond for Harnett County Sheriff Wayne Alfred Coats in the
amount of $10,000.
Chairman Springle presented Jimmy Riddle with a proclamation recognizing his contributions to
Harnett County and its citizens.

Chairman Springle recessed the meeting to reconvene following the swearing-in ceremony.
Mr. Snow served as the Master of Ceremonies. Pastor Daniel Selman gave the invocation and
benediction. Harnett County Superior Clerk of Court Marsha Johnson administered
Commissioner Barbara McKoy's Oath of Office. District Court Judge Caron Stewart
administered Commissioner Abe Elmore's Oath of Office.
NC General Statute 153A-39 requires the Board of Commissioners to reorganize at its first
regular meeting in December of each year. Ms. Wheeler reconvened the meeting and opened the
floor for nominations for chairman. Commissioner Miller nominated Commissioner Penny.
Commissioner McKoy nominated Commissioner Springle. Commissioner Miller moved to close
the nominations. Commissioner Springle seconded the motion that passed unanimously. The
nomination of Commissioner Penny as chairman failed 2 to 3 with Commissioners Penny,
Springle and McKoy opposing. The nomination of Commissioner Springle as chairman was
approved 4 to 1 with Commissioner Miller opposing.
Ms. Wheeler opened the floor for nominations for vice chairman. Chairman Springle nominated
Commissioner Howard Penny. Commissioner Elmore moved to close the nominations.
Commissioner McKoy seconded the motion that passed unanimously. The nomination of
Commissioner Penny as vice chairman was approved unanimously.
Chairman Springle opened the floor for informal comments by the public, allowing up to
3 minutes for each presentation up to 30 minutes.
Keith Kaeding addressed the Board on behalf of the Harnett Central High School
Honors Civics and Economics class and Business Law class students attending the
meeting.
Bob Woolston of 125 Forest Pond in Cameron said he recently saw a Harnett
County emergency vehicle filling up in Lee County and he thinks they should fill
up in Harnett County so that the tax dollars come back to Harnett County.
Commissioner Miller moved to approve the appointments listed below. Commissioner Elmore
seconded the motion that passed unanimously.
Harnett County Planning Board
Stanley Price was reappointed to serve on this board as a District 1 representative for a
term of three years expiring November 30, 2021.
Harnett County Public Library Board
Gloria Gulledge was reappointed to serve on this board as Dunn's representative for a
term of three years expiring June 30, 2021.

Town of Angier - ETJ Member - Planning Board and Board of Adjustment
Lee Marshall of 8051 NC 210 N in Angier was reappointed as an ETJ member for a two-
year term expiring December 31, 2020.

Invitations and upcoming meetings
Mrs. Stewart also introduced new Assistant County Manager Coley Price.
There was no new business.
Chairman Springle recessed the board meeting to allow Harnett County Veteran Services staff to
present awards, in collaboration with the Veterans Legacy Foundation, honoring the military
service of five veterans. Commissioners also responded to questions from Harnett Central High
School Honors Civics and Economics class and Business Law class students attending the
meeting.
Chairman Springle reconvened the board meeting.
Commissioner McKoy moved that the Board go in to closed session to discuss certain personnel
matters. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(6).
Commissioner Miller seconded the motion, which passed unanimously.
Commissioner Elmore moved that the Board come out of closed session. Vice Chairman Penny
seconded the motion that passed unanimously.
Commissioner Elmore moved to adjourn the meeting at 10:35 am. Vice Chairman Penny
seconded the motion, which passed unanimously.

BOARD OF COMMISSIONERS'
RULES OF PROCEDURE

THAT WHEREAS, on September 19, 1994 the Harnett County Board of Commissioners adopted
Rules of Procedure pursuant to N.C. General Statute §153A-41; and
WHEREAS, Rule 31 of the Rules of Procedure allows the Board of Commissioners to modify its
Rules pursuant to a two-thirds affirmative vote of the members of the Board; and
WHEREAS, the Board of Commissioners wished to change the time of their regular evening
meeting as well as address "Public Comments" during their regular meetings;
That minor corrections, changes and updates were needed upon detailed review of the Rules of
Procedures resulting in the following:
Rule 3. ADD subsection (a)(8) and (a)(9)
Rule 4. ADD If new members are elected, the order ....
Rule 5. ADD Vice Chairman to title
Rule 6. Regular and Special Meetings
Third Monday of each Month at 6 p.m.
ADD emergency meetings to subsection (e) Sunshine List
Rule 27. DELETE (c) Persons desiring to speak at a public hearing must
register with the Clerk to the Board prior to the commencement of
the meeting.
Rule 29. ADD Public Comment Section
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners does hereby approve the revised Rules of Procedure as presented.

A RESOLUTION TO APPROVE THE 2019 SCHEDULE OF MEETINGS
HARNETT COUNTY BOARD OF COMMISSIONERS
THAT WHEREAS, the Harnett County Board of Commissioners adopted on September 19, 1994
certain Rules of Procedure by which the Board would conduct its meetings; and
WHEREAS, Rule 6 of the Rules of Procedure concerning "Regular and Special Meetings" states
that the Board shall hold regular meetings the first Monday of each month at 9 a.m. and the third Monday
of each month at 6 p.m. It also states if a regular meeting day is a holiday on which county offices are
closed, the meeting shall be held on the next business and the Board may schedule regular work sessions.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett County
that the Board shall hold the following regular meetings and work sessions in 2019:

JOINT RESOLUTION ADOPTIONG AND ESTABLISHING THE COMMON
BOUNDARY LINE BETWEEN CHATHAM COUNTY AND HARNETT COUNTY
WHEREAS, N.C.G.S. § 153A-18 provides that if two or more counties are uncertain as
to the exact boundary between them, they may cause the boundary to be surveyed, marked and
mapped; and
WHEREAS, pursuant to a Joint Resolution with Wake County, Harnett County and Chatham
County approved by the Harnett County Board of Commissioners on or about April 16, 2018,
and approved by the Chatham County Board of Commissioners on or about May 21, 2018, North
Carolina Geodetic Survey was authorized to locate and survey the boundary line between
Chatham County and Harnett County; and
WHEREAS, as part of the preliminary survey work completed by North Carolina
Geodetic Survey, it was determined that Wake County and Chatham County had been using a
boundary corner established by survey in 1961 that differed from the actual location of the
Wake/Chatham/Harnett tri -county boundary corner; and
WHEREAS, pursuant to SL2018-62 ratified by the North Carolina General Assembly on
or about June 25, 2018, the tri -county corner boundary between Wake, Chatham and Harnett
County was established in accordance with N.C.G.S. § 153A-17; and
WHEREAS, now that the tri -county corner has been established, Chatham County and
Harnett County mutually desire to finalize the location of the common boundary shared between
them; and
WHEREAS, North Carolina Geodetic Survey has prepared an official survey of the
Chatham County and Harnett County common boundary for adoption and ratification by the
Chatham County and Harnett County Boards of Commissioners.
NOW THEREFORE, BE IT RESOLVED BY THE CHATHAM COUNTY
BOARD OF COMMISSIONERS AND THE HARNETT COUNTY BOARD OF
COMMISSIONERS that the survey completed by the North Carolina Geodetic Survey attached
hereto as Exhibit A is hereby adopted for the purpose of locating the common boundary between
Chatham County and Harnett County.
BE IT FURTHER RESOLVED that upon adoption of this Joint Resolution, Chatham
County and Harnett County will work together to reconcile county services to affected properties
such as board of elections, zoning, building permitting, emergency response, and tax assessments.

BE IT FURTHER RESOLVED that upon adoption of this Joint Resolution, staff is
directed to register a copy of the same with the Register of Deeds in Chatham County and Harnett
County as well as the North Carolina Secretary of State's Office.
That this JOINT RESOLUTION shall become effective on January 1, 2019.

AN ORDINACE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF
ORDINANCES FOR THE COUNTY OF HARNETT, NORTH CAROLINA

WHEREAS, American Legal Publishing Corporation of Cincinnati, Ohio ("American Legal
Publishing") has completed the 2018 S-1 supplement to the Code of Ordinances of the County of
Harnett ("Code of Ordinances"), which supplement contains all ordinances of a general and
permanent nature enacted since the prior supplement to the Code of Ordinances; and
WHEREAS, American Legal Publishing has recommended the revision or addition of certain
sections of the Code of Ordinances which are based on or make reference to sections of the
North Carolina code; and
WHEREAS, it is the intent of the Harnett County Board of Commissioners to accept these
updated sections in accordance with the changes of the law of the State of North Carolina; and
WHEREAS, it is necessary to provide for the usual daily operation of the county and for the
immediate preservation of the public peace, health, safety and general welfare of the county that
this ordinance take effect at an early date;
NOW, THEREFORE, BE IT ORDAINED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS:

That the 2018 S-1 supplement to the Code of Ordinances as submitted by
American Legal Publishing Corporation of Cincinnati, Ohio, and as attached
hereto, be and the same is hereby adopted by reference as if set out in its entirely.
Such supplement shall be deemed published as of the day of its adoption and
approval by the Harnett County Board of Commissioners and the Clerk to the
Harnett County Board of Commissioners is hereby authorized and ordered to
insert such supplement into the copy of the Code of Ordinances kept on file in the
Office of the Clerk.

RESOLUTION TO ADOPT HARNETT COUNTY WATER SHORTAGE &
CONSERVATION ORDINANCE
WHEREAS, North Carolina general Statute 143-355 (I) requires that each unit of local
government that provides public water services or plans to provide such services shall, either
individually or together with other such units of local government, prepare and submit a Water
Shortage Response Plan; and
WHEREAS, as required by the statute and in the interests of sound local planning, a
Water Shortage Response Plan for Harnett County Department of Public Utilities, has been
developed and submitted to the Harnett County Board of Commissioners for approval; and
WHEREAS, the Harnett County Board of Commissioners finds that the Water Shortage
Response Plan is in accordance with the provisions of North Carolina General Statute 143-355
(I) and that it will provide appropriate guidance for the future management of water supplies for
Harnett County, as well as useful information to the Department of Environment and Natural
Resources for the development of a state water supply plan as required by statute.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett
County that the Water Shortage Response Plan entitled, Harnett County Water Shortage &
Conservation Ordinance dated December 3, 2018, is hereby approved and shall be submitted to
the Department of Environment and Natural resources, Division of Water Resources; and
BE IT FURTHER RESOLVED that the Harnett County Board of Commissioners intends
that this plan shall be revised to reflect changes in relevant data and projections at least once
every five years or as otherwise requested by the Department, in accordance with the statute and
sound planning practice.

A RESOLUTION TO CANCEL THE
DECEMBER 17, 2018 REGULAR MEETING OF THE
HARNETT COUNTY BOARD OF COMMISSIONERS
THAT WHEREAS, the Harnett County Board of Commissioners adopted on September
19, 1994 certain Rules of Procedure by which the Board would conduct its meetings; and
WHEREAS, Rule 6 of the Rules of Procedure concerning "Regular and Special
Meetings" states that the Board may cancel the place or time of a particular regular meeting by
resolution: that the Board has determined that it will not meet at its regular scheduled evening
meeting of Monday, December 17, 2018.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett
County that its regular meeting scheduled for Monday, December 17, 2018 is hereby canceled;
that this Resolution shall be filed with the Clerk to the Board, posed at the regular meeting place
and forwarded to all parties on the County's Sunshine List.
Adopted by the Harnett County Board of Commissioners in regular session, this 3`d day
