We drove down this morning to measure and be sure our numbers were correct. The house currently sits 10'5" from the roadside property line, so it sits well within the setback area. None of our new addition will extend the front of the house closer to this property line. On the east side of the house our addition of the porch and bath will be 12'8" from the property line, so we would need a 22'4" variance. On the westside of the house, our addition of the master suite will sit 24'4" from the property line, so we would need a 10'8" variance on that side. Just to clarify, we don't consider the McLamb Rd side of the house as the front, but most people would look at it this way. The house is actually oriented towards HWY 27 (Westerly). So when we use the front setback limit, we are deferring to conventional thought rather than actual orientation. Currently, and per our plan, the home's main entrance is on the westside of the house facing HWY 27. Having said this, we may actually be requesting a side setback variance depending on your perspective. Feel free to call me if you still have questions. Yes, you would be allowed to apply for a variance. This is typically a difficult exception for the Board of Adjustment (BOA) to grant, but the procedure is pretty basic. The BOA is a quasi-judicial meeting consisting of County Commissioner nominated Board members. Staff does not offer recommendations, we just present a staff report detailing the specific request. To apply, the attached application and a fee of $400 should be returned to our office by next Monday…10/9/17. This will get your request onto the Board of Adjustment’s Nov agenda…11/13/17 @6:30 pm. The last page of this app is the ‘worksheet’ that the Board would use to make their determination. So, it may be beneficial to provide your best answers/ reply to this list to further assist your justification. 2 other quick notes….I’m not sure if this is a front, rear, or side setback encroachment, but the Ordinance & Article to ref w/in the app is Art IV, Sect 14.2. My wife, Martha, inherited her Grandfather's house located in Lillington, near Campbell University. This house sits on land that has been in the family for 5 generations and we hope to make it our home. We hired an Architect and Engineer to draw up plans to add a Master bedroom and screened porch to the small home. In order to keep the original home intact and to tie into the original structure design, the addition must be added to the sides of the home. The problem is that the home currently sits within the setback area from an unimproved dirt road (McLamb Rd). When I went to central permitting to inquire about getting my septic system checked to support this addition, I was told that we could not add onto this home within the setback area. I understand this policy and I would like to know how I can go through the process to request an exception to this policy. I currently live in Chesterfield VA, where I retired from the US Army, so I want to be sure that I know the procedures required to support this request so I can maximize my trips to NC to process the paperwork. If you can assist me, or provide me the point of contact information to someone who can assist, I would appreciate it. We look forward to retiring in Lillington and preserving Martha's family homestead. I always loved the area while attending Campbell and look forward to returning. Thank you for your assistance.
