family structure can be altered as long as the overall nonconformity (in
this case the existing setback encroachment) is not increased. As you
stated in an earlier correspondence, “None of our new addition will
extend the front of the house closer to this property line”, therefore
per Art II , Sect 4.0, you do not need a variance.
So, if you will, please send me a request to pull your variance
request application and we’ll start the process to return you fee.

Jay,
Thank you for the note. We drove down this morning to measure
and be sure our numbers were correct. The house currently sits 10'5"
from the roadside property line, so it sits well within the setback
area. None of our new addition will extend the front of the house
closer to this property line. On the east side of the house our
addition of the porch and bath will be 12'8" from the property line, so
we would need a 22'4" variance. On the westside of the house, our
addition of the master suite will sit 24'4" from the property line, so
we would need a 10'8" variance on that side.
Just to clarify, we don't consider the McLamb Rd side of the
house as the front, but most people would look at it this way. The
house is actually oriented towards HWY 27 (Westerly). So when we use
the front setback limit, we are deferring to conventional thought rather
than actual orientation. Currently, and per our plan, the home's main
entrance is on the westside of the house facing HWY 27.
Having said this, we may actually be requesting a side setback
variance depending on your perspective. Feel free to call me if you
still have questions.

Jay,
Thank you for the information. We will work on the
application and try our best to get it submitted prior to next Monday.
The address is 1614 McLamb Rd. The variance we are
requesting a for the front setback. You will see that the house
currently sits within the front setback area. Our request will be
within this area, but would not add construction any closer to the road
then the house already sits.

completing the application.

Yes, you would be allowed to apply for a variance. This
is typically a difficult exception for the Board of Adjustment (BOA) to
grant, but the procedure is pretty basic. The BOA is a quasi-judicial
meeting consisting of County Commissioner nominated Board members.
Staff does not offer recommendations, we just present a staff report
detailing the specific request.
To apply, the attached application and a fee of $400
should be returned to our office by next Monday…10/9/17. This will get
your request onto the Board of Adjustment’s Nov agenda…11/13/17 @6:30
pm. The last page of this app is the ‘worksheet’ that the Board would
use to make their determination. So, it may be beneficial to provide
your best answers/ reply to this list to further assist your
justification.
2 other quick notes….I’m not sure if this is a front,
rear, or side setback encroachment, but the Ordinance & Article to ref
w/in the app is Art IV, Sect 14.2. Also, please send me the address of
this site & I’ll look it over to see if any other options seem evident.

Mr. Sikes,
I was provided your name from Mr. Howard Penny as the
point of contact to assist my wife and I in preparing necessary
paperwork to request consideration of our retirement home
renovation/addition. My wife, Martha, inherited her Grandfather's house
located in Lillington, near Campbell University. This house sits on
land that has been in the family for 5 generations and we hope to make
it our home. We hired an Architect and Engineer to draw up plans to add
a Master bedroom and screened porch to the small home. In order to keep
the original home intact and to tie into the original structure design,
the addition must be added to the sides of the home. The problem is
that the home currently sits within the setback area from an unimproved
dirt road (McLamb Rd). When I went to central permitting to inquire
about getting my septic system checked to support this addition, I was
told that we could not add onto this home within the setback area. I
understand this policy and I would like to know how I can go through the
process to request an exception to this policy.
I currently live in Chesterfield VA, where I retired
from the US Army, so I want to be sure that I know the procedures
required to support this request so I can maximize my trips to NC to
process the paperwork. If you can assist me, or provide me the point of
contact information to someone who can assist, I would appreciate it.
We look forward to retiring in Lillington and preserving
Martha's family homestead. I always loved the area while attending
Campbell and look forward to returning.
