256 HARNETT COUNTY BOARD OF COMMISS IONERS REGULAR MEETING, MAY 6, 1991.
The Harnett County Board of Commissioners met in regular session on
Monday, May 6, 1991, in the County Office Building, Lillington, North
Carolina, with the following members present: Mack Reid Hudson, Bill
Shaw, Walt Titchener, Beatrice Bailey Hill, and Chairman Lloyd G.
Stewart presiding. Others present were Dallas H. Pope, County
Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Finance
Officer and Clerk to the Board; and Kay S. Blanchard, Recording
Secretary.
Chairman Stewart called the meeting to order at 9:00 a.m.
Commissioner Shaw offered the invocation.
RESOLUTIONS OF APPRECIATION Dallas H. Pope, County Manager, presented for consideration
resolutions of appreciation for retiring county employees, Janet H.
JANET H. JOHNSON Johnson and Johnnie Halcomb. Commissioner Titchener moved for the
adoption of both resolutions. Commissioner Hill seconded the motion
JOHNNIE HALCOMB and it passed with a unanimous vote. The resolutions are copied in
full at the end of these minutes as Attachments lA. and lB.
Mr. Pope presented Ms. Johnson's resolution to her and Chairman
Stewart presented a plaque of appreciation for outstanding services
and contributions to Harnett County as Bookmobile Librarian. Mr. Pope
presented Mr. Halcomb's resolution to him and Chairman Stewart
presented a plaque of appreciation for outstanding services and
contributions to Harnett County with the Sheriff's Department.
Dr. Marvin Joyner presented to the Board an annual report on Central
Carolina Community College-Harnett County Campus for F.Y. 90-91 and
the proposed budget request for F.Y. 91-92.
Edward Hardee, President, Northern Harnett Rescue, Inc. Board of
'REQUEST FROM NORTHERN Directors, presented a request from the Northern Harnett Rescue Board
r~RNETT RESCUE, INC. of Directors to establish a county EMS operation in that area of the

Lee Sudia, Fire Marshal, presented for the Board's consideration a
ADOPTION OF HAZARDOUS Resolution adopting Hazardous Materials and Substances Ordinance for
~~TERIALS AND SUBSTANCES Harnett County. Commissioner Shaw moved for adoption of the
resolution. Commissioner Hudson seconded the motion and it passed
ORDINANCE with the following vote: Ayes: 4, Noes: 1, Absent: 0
FIRST CONSIDERATION Glenn Johnson, County Attorney, stated that in accordance with
Gen. Sta. 153A-45, the Ordinance would have to be considered a
second time at the next regular meeting because it was not approved
initially by all members of the Board.
Commissioner Titchener made a motion to amend the minutes of April 15,
AMENDMENT TO APRIL 15 1991, to state that a Board member was not excused from the meeting.
MINUTES Commissioner Hill seconded the motion and it passed with a unanimous
vote.
Commissioner Hudson moved for approval of the minutes of the regular
meeting April 15, 1991, as amended. Commissioner Hill seconded the
motion and it passed with a unanimous vote.
Commissioner Shaw moved for approval of the minutes of the special
meeting April 26, 1991. Commissioner Hill seconded the motion and it
passed with a unanimous vote.
Commissioner Titchener moved that Commissioner Shaw be excused from
the meeting. Commissioner Hill seconded the motion and it passed with
a unanimous vote.
REQUEST FROM H.C. FIRE Dan Denning, President, Harnett County Fire Chiefs' Association,
CHIEFS' ASSO. TO USE requested approval for the Fire Chiefs' Association to use the Harnett
AIRPORT FOR COUNTY-WIDE County Airport for a county-wide 4th of July celebration. Commissioner
4TH OF JULY CELEBRATION Hudson moved for approval of the request with the stipulation that the
APPROVED County Attorney and the County Manager would have to clarify various
requirements and conditions which will be identified as part of the
approval for use of the Harnett County Airport. Commissioner Hill
seconded the motion and it passed with a unanimous vote.
Commissioner Shaw departed the meeting at 11:00 a.m.
Commissioner Titchener moved that a letter of authorization be issued
by the County Manager in accordance with the Board's approval to the
Harnett County Fire Chiefs' Association to present a fireworks display
at the Harnett County Airport on July 4, 1991, with a rain date of
July 5, 1991. Commissioner Hill seconded the motion and it passed
with a unanimous vote.

Chairman Stewart called to order a public hearing on North Carolina
Department of Transportation Secondary Road Construction Program. Mr.
SECONDARY ROAD CONS. B.B. Isom briefed the group that the purpose of the public hearing was
PROGRAM FOR F. Y. 91-92 to obtain public comments concerning the proposed Secondary Road
Construction Program for F.Y. 91-92. Mr. Isom presented the proposed
Road Construction Program and Chairman stewart opened the meeting for
public comments. Comments were provided by the following citizens:
1. Doris Shue, Rt. 2, Broadway concerning SR 1271
2. Rebecca Thomas, Rt. 2, Broadway concerning SR 1271
3. B. J. Cramer, Anderson Creek Area concerning SR 1177

WESTIN~HOUSE ENV. Westinghouse Environmental and Geotechnical Services, Inc. for an.
& GEOTECHNICAL SERVICES amount not to exceed $10,650. for Phase I Site Assessment concern1ng
CONCERNING FUEL LEAK possible petroleum contamination in soil Cind ground water at the
AT GARAGE Harnett County Garage, NcNeil Street, Lillington. Commissioner
Titchener moved for approval of the agreement. Commissioner Hill
seconded the motion and it passed with a unanimous vote.
W. Glenn Johnson, County Attorney, presented for the Board's
TRANSWORLD SYSTEMS consideration a proposal from Transworld Systems, Inc. for collection
services for Emergency Medical Services and recommended that the
County purchase 100 transmittals for a preliminary trial of the system
for collections. Commissioner Titchener moved for approval of the
contract agreement for 100 transmittals for Phase I service only of
the agreement. Commissioner Hill seconded the motion and it passed
with a unanimous vote.
Commissioner Hudson moved that requested disposal of records in the
DISPOSAL OF RECORDS Regist.er of Deeds Office be approved in accordance with G.S. 121-5
IN REGISTER OF DEEDS (b). Commissioner Hill seconded the motion and it passed with a
'OFFICE unanimous vote. The list of records to be disposed of is copied in
full at the end of these minutes as Attachment 2.
Commissioner Titchener moved for the adoption of a Proclamation
PROCLAMATION FOR concerning "Emergency Medical Services Week" in Harnett County, May
EMS WEEK 12, 1991 through May 18, 1991. Commissioner Hill seconded the motion
and it passed with a unanimous vote. The proclamation is copied in
full at the end of these minutes as Attachment 3.
TOM MOORE APPOINTED Commissioner Hill moved for the appointment of Mr. E. Thomas Moore to
to PLANNING BOARD the Harnett County Planning Board to replace Mr. Haywood Hall.
Commissioner Hudson seconded the motion and it passed with a unanimous
vote.
MOTION TO APPOINT Dallas H. Pope, County Manager, asked the Board to consider appointing
ARCHITECTUAL and architectural committee to select a firm to develop a county
CO~~ITTEE facility master plan. Commissioner Hudson made a motion that the
Board appoint an architectural committee and that the Board submit
names at the next regular Board meeting. Commissioner Hill seconded
the motion and it passed with a unanimous vote.
Bobby Wicker, Tax Administrator, presented for the Board's
RESOLUTION TO consideration a proposed Resolution for Support to Land Records
SUPPORT LAND RECORDS Management Program. Commissioner Hudson moved for adoption of the
MANAGEMENT PROGRAM resolution. Commissioner Hill seconded the motion and it passed with
the following vote: Ayes: 3, Noes: 1, Absent: 1 The resolution is
copied in full at the end of these minutes as Attachment 4.
Bobby Wicker, Tax Administrator~ presented a proposed Land Records Fee
LAND RECORDS FEE Schedule. Commissioner Hudson made a motion that the Land Records Fee
SCHEDULE Schedule be adopted as presented. Commissioner Hill seconded the
motion and it passed with a unanimous vote. The Land Records Fee

Chairman Stewart recessed the meeting for lunch at 12:00 noon.

Commissioner Titchener moved that Commissioner Shaw rejoin the
meeting. Commissioner Hill seconded the motion and it passed with a
unanimous vote. Commissioner Shaw rejoined the meeting at 1:00 p.m.
Commissioner Shaw made a motion to proceed to develop a contract

Landfill. Commissioner Hudson seconded the motion and it passed with
a unanimous vote. The contract agreement will be considered at the
next regular Board meeting.
John M. Phelps, II, Public Utilities Attorney, presented for the RESOLUTION RE: PURCHASE
Board's consideration a Resolution Regarding Purchase of Tank Site OF TANK SITE (SW)
(Southwest Water and,Sewer District of Harnett County). Commissioner
Shaw moved for the adoption of the resolution. Commissioner Hudson
seconded the motion and it passed with the following vote: Ayes: 4,
Noes: 1, Absent: 0 The resolution is copied in full at the end of
these minutes as Attachment 6.
John M. Phelps, II, Public Utilities Attorney, presented for the
Board's consideration a Resolution Awarding Contract (Elevated Tank RESOLUTION RE: CONTRACT
painting Project - Metro No.4). Commissioner Ti tchener moved for the FOR PAINTING TANK NO.4
adoption of the resolution. Commissioner Hill seconded the motion and
it passed with a unanimous vote. The resolution is copied in full at

Sharon Cooley, Extension Homemakers Council, presented for the Board's
consideration a proclamation concerning "Extension Homemakers Week" PROCLA.Iv1ATION - EXTENSION
May 5, 1991 through May 11, 1991. Commissioner Titchener moved for HOMEMAKERS WEEK
adoption of the proclamation. Commissioner Hill seconded the motion
and it passed with a unanimous vote.
Reports for the month of April were filed with the Board from the
following departments: Data Processing, Emergency Medical Services,
Tax Department, Forest Service, and Veteran's Affairs. The Tax
Attorney's report was also filed with the Board and is copied in full
at the end of these minutes as Attachment 8.

Commissioner Titchener made a motion that Chairman Stewart be DUNN'S APPEAL OF
authorized to execute a letter to the Regional Census Center CENSUS FIGURES
concerning a request from the City of Dunn regarding the City's appeal
of its 1990 census figures. Commissioner Hill seconded the motion and
it passed with a unanimous vote.
Dallas H. Pope, County Manager, presented the letter authorized by GIFT CONTRIBUTION
motion approved by the Board during its special Board meeting held on LETTER FROM EDGAR
April 26, 1991, and addressed to Mr. Edgar Bain concerning gift BAIN ASSO. WITH
contribution associated with the County's purchase of 340.16 acres. 340.16 ACRES OF LAND

THAT WHEREAS, Janet H. Johnson began her services to Harnett County
thirty-three years ago on the Bookmobile; and
WHEREAS, in 1958, Janet H. Johnson accepted the position of Bookmobile
Librarian and thereafter faithfully served that office for thirty-three years
of employment; undertaking and discharging her responsibilities in both an
exemplary and inspirational manner; and
WHEREAS, Janet H. Johnson, through her active participation in civic,
religious, and community affairs, has gained recognition and support for the
Harnett County Library, reflecting credit on the department and the people of
Harnett County; and
WHEREAS, Janet H. Johnson's kind spirit and just manner were exemplified
in the daily execution of her bookmobile responsibilities and will continue
to be an inspiration to those who follow her; and
WHEREAS, Janet H. Johnson left the service of the Harnett County Library
on March 28, 1991.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS

PROCLAMATION
Harnett County has developed an outstanding Emergency Medical Services
(EMS) program for providing medical services. The progress and growth of EMS
has resulted 1n better equipped and designed ambulances, improved personnel
training, more efficient hospital emergency departments, and more expedient
public access when emergency care is needed.
All Harnett County citizens can be proud of our emergency medical system,
which provides life-saving treatment and care to our citizens 24-hours a day.
This is made possible by the dedicated team effort of emergency medical
technicians, emergency department physicians, nurses, and volunteer rescue
squad workers. all of whom receive specialized training to respond quickly and
efficiently to emergencies.
To recognize and honor this dedication and service. we set aside a special
period to observe the great contributions our Emergency Medical Service personnel
make to our county.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
that the period beginning May 12 through May 18. 1991. is hereby proclaimed

ATTACHMENT 4 RESOLUTION FOR SUPPORT TO
LAND RECORDS MANAGEMENT PROGRAM
WHEREAS, the Harnett County Soard of Commissioners desires to
endorse the Land Records Management Program now under the
Department of Environmental Health and Natural Resources to insure
for its continued operations as a part of state government; and
WHEREAS, the Harnett County Soard of Commissioners have
benefited greatly from the Land Records Management Program in that
the County has received technical and financial assistance for
establishing a Harnett County Land Records/GIS Office; and
WHEREAS, the Land Records Management Program has been
instrumental in giving hands on gUidance and training as to the
county's undertaking of cadastral mapping; and
WHEREAS, the Land Records Management Program has benefited the
North Carollna Property Mappers Association of which county
employees are members in assisting the association with its annual
school and conference, as well as various other functions of
interest to county governments relating to parcel mapping and
digital mapping; and
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that we do hereby endorse and give unanimous support
to the Land Records Management Program; and request that the
Governor of the state of North Carolina continue funding for this
program in order that counties may continue to receive technical
support and financial assistance
BE IT FURTHER RESOLVED that a copy of this Resolution be
disseminated to the acting director of the Land Records Management
Program and to our state legislators.

PURCHASE OF TANK SITE
(SOUTHWEST WATER AND SEWER DISTRICT OF BARNETT COUNTY)
THAT WHEREAS, the Board of Commissioners of the County of
Harnett sitting as the governing body of the Southwest Water and
Sewer District of Harnett County (the "Board") has previously
approved a site for the construction of a 400,000 gallon water
storage tank associated with said District's phase I Water
Distribution Facilities Project; and
WHEREAS, said site is owned by Thomas Harrington Morrison and
wife, Dorothy O'Quinn Morrison and is a part of a larger tract
owned by them comprising about 80 acres; and
WHEREAS, it has been determined that a misunderstanding
occurred between said owners and representatives of the District
with respect to the location of the tank site as it relates to the
overall tract; and
WHEREAS, upon the recognition of said misunderstanding, and
after additional research and investigation was conducted regarding
the matter, the Board finds that a fair and reasonable purchase
price for said tank site is the sum of $7,500; and
WHEREAS, the Board desires to authorize the purchase of said
tank site for said sum.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett, sitting as the governing body of the
Southwest Water and Sewer District of Harnett County that:
1- The District is hereby authorized to purchase
from Thomas Harrington Morrison and wife,

Dorothy O'Quinn Morrison that tract or parcel
of real estate described on Exhibit A attached
hereto for the sum of $7,500.00, upon the
delivery to the District of a good and
sufficient deed to said property, free and
clear of all encumbrances, except those which

THAT WHEREAS, the Board of Commissioners of the County of
Harnett (hereinafter sometimes referred to as the "Board") by
resolution adopted at its meeting on April l, 1991, authorized the
advertisement for bids for a Contract to repaint and recondition
that elevated water storage tank, sometimes known as "Metro Tank III
Number 4" located on N.C. Highway 210 between Lillington and
Angier, the same being leased and operated by the County of
Harnett; and
WHEREAS, pursuant to said authorization, the appropriate
representatives of the County of Harnett did advertise bids for

Elevated Tank Painting May 2, 1991
Contract 1
SiE:NERAL,
Formal bids were received and read aloud at 3:00 p.m., May 1,
1991, in the conference room at the County Water Plant on W.
Duncan Street in Lillington, N. C. The project was advertised
according to State Statutes in a local Newspaper and in bulletins
of the Associated General Contractors of America and the F. W.
Dodge Corporation. Basically, the project involved surface
preparation, painting and reconditioning of a 300,000 gallon
elevated water tank on Highway 210 near the Town of Angier for
the Harnett County Department of Public Utilities.
PROPOSAL 5\
Five Contractors requested bid documents and five Contractors
submitted proposals for this project. The bid documents required
that the contractor provide one lump-sum price for the work and
was to name the paint manufacturer that he based his bid upon.
Additionally, the bid documents required that the Contractor
provide a 5% bid bond with his proposal. Each Contractor was to
allow an amount of $1,500.00 in his proposal for the testing,
hauling and disposal of the interior blast residue. This was
necessary in case the residue contained any lead and had to be
specially disposed of. Also, each contractor was to allow an
amount of $200.00 for replacement of overflow pipe support
brackets if required.
The low proposal was submitted by Tanks Inc. T/A Utility Service
Co. of Madison, N. C. at a lump-sum price of $37,800.00. The
second low proposal was submitted by J & W Sandblasting of New
Bern, N. C. at a lump-sum price of $39,700. A Certified
Tabulation of Bids of each Contractor appends this Discussion of
Bids.
The Engineers feel that the project was well advertised to the
construction industry and that the proposals received are the
best that can be expected at this time. In fact, the price
submitted is $200.00 less than the bid received last year for the
County's 300,000 gallon tank at Coats. A discussion held with
one of the Contractors after the bid opening indicated that th~re
appeared to be nothing that could be eliminated from this project
to reduce the construction price and obtain the desired paint
system. Based upon the above opinion, the Engineers recommend
award of this project tOI

recommendations of this Discussion of Bids, the following steps
would be necessary to initiate the construction:
. Approve a resolution awarding the Construction Contract.
. Execute Notice of Award.
. Execute Contract documents Between County & Contractor.
. Execute Notice to Proceed.
. Hold a preconstruct ion conference and authorize
the contractor to proceed with the work.
As the County's Engineer for this project, we will provide the
necessary contract documents for execution and arrange for and
hold the preconstruction conference.
SUMMARY

County Department of Public Utilities in acquiring bonafide

purchase of a 340.16 acre tract of property by the County of Harnett
is hereby acknowledged. In accordance with your letter dated March
20. 1991, the gift amount of $174,680 is accepted by Harnett County
as the difference in value paid by the County for the property and
appraised value of the property as indicated in your letter.
