D. Hamett County Board of Commissioners authorizes, empowers and commands the
Tax Administrator to collect the taxes set forth in the tax records filed in the office of
Harnett County and in the tax receipts herewith delivered to the Tax Administrator, in
the amounts and from the taxpayers likewise therein set forth . This charge is for the
2017/2018 tax year.
E. Harnett County Health Director requests approval to establish the following fees:

G. Harnett County Public Utilities requests approval of write-offs for the second quarter
of 2017 in the amount of $39,799.25.
H. Hamett County Finance Officer requests approval of an agreement to enter into an
installment purchase financing with PNC at an interest rate of 1.82% for
Finance/Human Resources Software and Courthouse Audio Visual Upfits in the
amount of $1,902,953 for a term of three years and interest totaling $43 ,434.61.
I. Consider denial of request to waive rezoning fees for the Williams Property on US
401 South.
5. Period of up to 30 minutes for informal comments allowing 3 minutes for each
presentation

The Harnett County Board of Commissioners met in regular session on Monday, August 7, 2017,
in the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman Springle called the meeting to order at 9 :00 am. Commissioner McKoy led the Pledge
of Allegiance and invocation.
Chairman Springle called for additions and deletions to the published agenda. Mr. Jeffries
requested the removal of Budget Amendment 11 b from the consent agenda. Commissioner
Elmore moved to approve the agenda as amended. Vice Chairman Miller seconded the motion,
which passed 4-0.
Commissioner Elmore moved to approve the following items listed on the consent agenda.
Commissioner McKoy seconded the motion, which passed unanimously.

4. Harnett County Emergency Services requested authorization to receive awarded funds in
the amount of $1 ,000 from the North Carolina Department of Public Safety Emergency
Management Division 2017 Tier II Grant/LEPC. Funds will be used by Hamett County
LEPC for hazardous materials emergency response planning, training and related
exercises.
5. Harnett County Finance Officer requested approval of Resolution Declaring the Intent of
the County of Harnett, North Carolina, to Reimburse Itself for Capital Expenditures from
the Proceeds of Tax-Exempt Obligations Expected to be Executed and Delivered in
Fiscal Year 2018. The resolution allows the County to reimburse itself for any
expenditures incurred in connection with the construction of the new governmental
building and the renovations of the current governmental building. (Attachment 2)
6. Harnett County Public Library requested approval to continue contracting with the North
Carolina Department of Cultural Resources for its integrated library system, NC
Cardinal. This will be Harnett County's fourth year with the NC Cardinal consortium.
7 . Harnett County Health Director requested approval of a revision to the Debt Set Off
Collection Policy: Section VII. Service Plan -Added #2 under A .
8. Harnett County General Services/ Animal Services requested approval of a new Adoption
Coordinator/Manager position with a proposed salary range of $39,630 -$47 ,556. This
position will manage shelter operations and match persons, groups and other animal
welfare advocates to adopt animals, modify strategies to coordinate with and develop
relationships with partner rescues moving more animals through the sheltering process,
stopping overcrowding and ensuring all animals are altered as to not reproduce after
adoption. This position will also coordinate and administer available grants and resource
allocations to ensure Animal Welfare laws are being followed with the shelter
environment.
9. Hamett County Finance Officer requested approval of the following additional capital
items requested by the Harnett County Board of Education totaling $241 ,000:
Chiller at North Harnett -approximately $218,000
Water heater at Hamett Central High -approximately $12,000
Water heater at Angier -approximately $11 ,000
The Board will appropriate funding to cover the pretax cost of these items at a future
meeting.

Chairman Springle opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
Cris Nystrom of 391 Center Lane in Bunnlevel addressed the group.
Eric Benson of 435 Fleming Road in Coats, on behalf of the North Carolina
Economic Assistance Center who provides free income tax preparation and electronic
filing services, thanked commissioners for their nonprofit funding this year.
Jerry Rivas of 362 Twin Ponds Road in Sanford addressed the group.
John Matthews, CCCC Provost for Hamett County, briefly updated commissioners on
CCCC enrollment, programs and activities. He also thanked them for their support
and funding for the physical plant and operations in Harnett County.
Rhonda Holder of2533 Spring Hill Church Road in Lillington, who runs a childcare
facility in Lillington, said she does not want to compete with any after-school
programs that may be offered by the County.
Vice Chairman Miller moved to approve the appointment listed below. Commissioner Elmore
seconded the motion, which passed 4-0.
HARNETT COUNTY LIBRARY BOARD OF TRUSTEES
Betty Wishart was reappointed to serve an additional term as the Town of Erwin's
representative on this Board for a term of three years expiring August 31, 2020.
HARNETT COUNTY COUNCIL FOR WOMEN
Dionne Holliday was appointed to serve on this council for a term of three years expiring
August 31, 2020.
Dr. Rebecca H. Crouch, Assistant Professor for Doctoral Program of Physical Therapy,
Campbell University College of Pharmacy and Health Sciences, announced the American Lung
Association Better Breathers Club is a new health care service available to Harnett County
citizens that will improve their quality of life while living with respiratory disease. She noted the
Club will meet the third Friday of each month from 10:30 am until noon at the First Choice
Community Health Center in Lillington. She said this. The Better Breathers Clubs are regularly
scheduled, support groups for individuals with chronic lung disease including COPD, pulmonary
fibrosis , asthma and lung cancer.
Carl Davis, Director of Harnett County Parks and Recreation , provided an update on recent
activities at the new Boone Trail Community Center operated jointly with the Harnett County
Library. He said staff is looking at building on some of the programs they offer in response to
community input. Mr. Davis sought guidance regarding an after-school program at the center.
Based on trends in the state and other successful programs, staff believes this could be a good
program for the county. Mr. Davis responded the Parks and Recreation Master Plan ensures the
same level of recreation for citizens throughout the entire county. Commissioners thanked
Hamett County Parks and Recreation staff for their hard work and continuing efforts .

Mrs. Stewart briefed the Board on the recent Keep Harnett County Beautiful campaign that was a
great success. She reported 130 volunteers picked up over 2,300 cubic feet of garbage during the
event. Commissioners thanked volunteers and congratulated Solid Waste staff on a job well
done.
There was no new business.
Vice Chairman Miller moved that the Board go into closed session for the following purposes:
1. To consult with the County's legal staff in order to preserve the attorney-client privilege
concerning the handling of certain claims and litigation including the following:
a. The Department of Justice claim against the Harnett County Sheriff's
Department; and
b. Livingston, et als vs Kehagias, et als, US District Court, NC Eastern district,
Western division, File No. 5:16 CV 00906-BO; and
c. The workers compensation claim of William Wagstaff.
2. To discuss certain economic development matters.
This motion is made pursuant to N. C. General Statute Section 143-318.1 l(a)(3)&(4).
Commissioner Elmore seconded the motion, which passed 4-0.
Commissioner Elmore moved that the Board come out of closed session. Vice Chairman Miller
seconded the motion that passed 4-0.

was available with the Board and which was read by title:
RESOLUTION OF THE COUNTY OF HARNETT, NORTH CAROLINA DECLARING THE
INTENT OF THE COUNTY OF HARNETT, NORTH CAROLINA TO REIMBURSE ITSELF
FOR CAPITAL EXPENDITURES FROM THE PROCEEDS OF TAX-EXEMPT OBLIGATIONS
EXPECTED TO BE EXECUTED AND DELIVERED IN FISCAL YEAR 2018.
WHEREAS, the County intends to finance the construction of a new governmental building and
the remodeling of an existing governmental building (the "Project') and expects to incur and pay certain
expenditures in connection with the Project prior to the date of execution and delivery of the tax-exempt
obligation (the "Original Expenditures"), such Original Expenditures to be paid for originally from a
source other than the proceeds of the tax-exempt obligation, and the County intends, and reasonably
expects, to be reimbursed for such Original Expenditures from a portion of the proceeds of the tax-exempt
obligation to be issued at a date occurring after the dates of such Original Expenditures;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of
Harnett, North Carolina as follows:
Section l . Official Declaration of Intent The County presently intends, and reasonably expects,
to reimburse itself for the Original Expenditures incurred and paid by the County on or after the date
occurring 60 days prior to the date of adoption of this Resolution from a portion of the proceeds of a tax-
exempt obligation. The County reasonably expects to execute and deliver such tax-exempt obligation
during the fiscal year ending June 30, 2018, and the maximum principal amount of such tax-exempt
obligation reasonably expected to be executed and delivered by the County for the costs of the Project is
expected to not exceed $20,000,000.

Section 2. Compliance with Regulations. The County adopts this Resolution as a declaration of
official intent under Section 1.150-2 of the Treasury Regulations promu lgated under Section I 03 of the
Internal Revenue Code of 1986, as amended, to evidence the County's intent to reimburse itself for the
Original Expenditures from proceeds of the tax -exempt obligation.
Section 3. Itemization of Capital Expenditures. The Finance Officer of the County, with advice
from special counsel, is hereby authorized, directed and designated to act on behalf of the County in
determining and itemizing all of the Original Expenditures incurred and paid by the County in connection
with the Project during the period commencing on the date occurring 60 days prior to the date of adoption
of this Resolution and ending on the date of execution and delivery of the tax-exempt obligation.
Section 4. Effective Date. This Resolution is effective immediately on the date of its adoption.

MARSY'S LAW FOR NORTH CAROLINA
www.harnett.org
WHEREAS, Marsy's Law for North Carolina and advocacy organizations statewide are dedicated
to guaranteeing victims' rights and providing a voice; and
WHEREAS, Marsy's Law for North Carolina supporters agree victims should always be treated
with fairness and respect throughout the criminal justice process, protected from the defendant,
reasonably heard at public preceedings regarding their case, and given a voice through the process
of the case; and
WHEREAS, per the Federal Bureau oflnvestigation's (FBI) most recent "Crime in the United
States" report, in 2013 a total of 33,700 North Carolinians were the victim of Violent "Index
Crimes" including: murder, rape, robbery, aggravated assault, burglary, larceny, motor vehicle
theft and arson; and
WHEREAS, Marsy's Law for North Carolina will insure that victim's receive the same rights that
are afforded to criminals and have rights to notification of release, hearings, appropriate restitution,
and the right to speak at during criminal proceedings; and
WHEREAS , Victims' Rights is a non-partisan, non-political issue, and Marsy 's Law is a common
sense approach to ensuring Victims' Rights.
NOW, THEREFORE, we, the Harnett County Board of Commissiners, do hereby
proclaim, support for HB 551/SB 595 (Marsy's Law) and encourage all of our citi zens to join in
the commitment to protect the rights of North Carolina Crime Victims.

Enclosed are the delinquent accounts determined to be at write-off status for the second
quarter of 2017. All of these accounts have been delinquent for more than three years and
total $39,799 .25. The facilitation of these write-offs is an important step in a continuing
effort to effectively manage our collections and bad debt. HCDPU is currently using the
Local Government Debt Setoff Program and On-Line Collections, Inc. to help collect our
delinquent accounts. We are happy to report that we have recovered over $630,000 in bad
debt previously written off through the Debt Setoff Program. Please place this request on the
consent agenda at the next available meeting.

Dear Ms . Honeycutt:
PNC Equipment Finance, LLC (herein called "Lessor"), for itself, its successors, and assigns,
is pleased to submit this tax-exempt lease purchase proposal for the acquisition of software
and Audio/Visual Equipment. Our proposal is as follows :

PNC Equipment Finance, LLC, its successors and
assigns
Tax-exempt Lease Purchase Agreement with
$1.00 buyout option at end of lease term. Said
agreement shall be a net lease arrangement
whereby lessee is responsible for all costs of
operation, maintenance, insurance, and taxes.
This proposal assumes that the lessee will be
issuing more than $10 million in tax-ex empt debt
this calendar year. Furthermore, it is assumed
that the lessee will not designate this issue as a
qualified ta x -exempt obligation per the tax act of
1986.

The lease rates used to establish the periodic

CONDITIONS PRECEDENT
TO LESSOR PERFORMANCE:
Lessor shall be named as loss payee and
additional insured on such coverage.
The lessee's governing board shall provide PNC
Equipment Finance with its resolution or
ordinance authorizing this agreement and shall
designate the individual(s) to execute all
necessary documents used therein .
The lessee's counsel shall furnish Lessor with an
opinion covering this transaction and the
documents used herein. This opinion shall be in
a form and substance satisfactory to Lessor.
Legal title to the equipment during the lease term
shall vest in the lessee; with Lessor perfecting a
first security interest through uniform commercial
code filing or any other such instruments as may
be required by law. Upon performance of the
terms and conditions of the lease agreement, the
lessee shall have the option to purchase all
equipment for $1.00.
Lease documentation shall be by Lessor.
After the second anniversary of the lease
commencement, so long as there is no event of
default, on any Rent Payment due date, Lessee
shall have the option to purchase all, but not less
than all, of the equipment financed by paying to
Lessor all Rent Payments and any other amounts
then due plus the Termination Value set forth in
the Agreement. The Termination Value reflects
the outstanding principal balance plus a three
percent premium.

all documents to be satisfactory in form and
substance to the Lessor .

rezoned R-30. The reason for my rezoning request is that it will allow th e road
