BACKGROUND:
Case file reflects a continuing violation of the land use regulations of the Unified Development Ordinance. A compliance
officer has engaged in notification and enforcement actions with the property owner since September 2016. To this date
the owner of the property has refused to render compliance after receiving notifications to abate the property as well as
multiple civil citations. Citations and late penalties totaling $625 .00 have not been paid at this time. Enforcement actions
to remedy the violation from the staff level have been exhausted .

AN ACT GRANTING COUNTIES THE SAME AUTHORITY AS CITIES TO DECLARE
CERTAIN BUILDINGS OR STRUCTURES UNSAFE AND TO REMOVE OR
D EMOLISH UNSAFE BUILDINGS OR STRUCTURES AND TO PLACE A LIEN ON
THE OWNER'S REAL PROPERTY FOR THE COSTS INCURRED.
The General Assembly of North Carolina enacts:
SECTION 1. G .S . I 53A-366 reads as rewritten:
"§ 153A-366. Unsafe buildings condemned.
(fil Residential Building and Nonresidential Building or Structure. -The inspector shall
condemn as unsafe each building that appears to him to be especially dangerous to life because
of its liability to fire, bad conditions of walls, overloaded floors, defective construction, decay,
unsafe wiring or heating system , inadequate means of egress, or other causes; and he shall affix
a notice of the dangerous character of the building to a conspicuous place on its exterior wall.
(hl Nonresidential Building or Structure. -In addition to the authority granted in
subsection (a) of this section, an inspector may declare a nonresidential building or structure
within a community development target area to be unsafe if it meets both of the following
conditions:

It appears to the inspector to be vacant or abandoned.
It appears to the inspector to be in such dilapidated condition as to cause or
contribute to blight, disease, vagrancy, fire, or safety hazard, to be a danger
to children, or to tend to attract persons intent on criminal activities or other
activities that wou ld constitute a public nuisance .
.{f.) If an inspector declares a nonresidential building or structure to be unsafe under
subsection (b) of this section, the inspector must affix a notice of the unsafe character of the
structure to a conspicuous place on the exterior wall of the building. For the purposes of this
section, the term "community development target area" means an area that has characteristics
of an urban progress zone under G.S. 1438-437.09, a "nonresidential redevelopment area"
under G.S. 160A-503(10), or an area with similar characteristics designated by the board of
commissioners as being in special need of revitalization for the benefit and welfare of its
citizens.
@ A county may expand subsections (b) and (c) of this section to apply to residential
buildings by adopting an ordinance . Before adopting the ordinance, the county shall hold a
public hearing and shall provide notice of the hearing at least l O days in advance of the
hearing."
SECTION 2. G.S. I53A-368 reads as rewritten:
"§ 153A-368. Action in event of failure to take corrective action.
If the owner of a building that has been condemned as unsafe purs uant to G.S. 153A-366
fails to take prompt corrective action, the local inspector shall by certified or regi stered mail to
his last known address or by personal service give him written notice:
(1) That the building or structure is in a condition that appears to coAstitute meet
one or more of the following conditions:

a. Constitutes a fire or safety hazard or to be hazard.
b. k_dangerous to life, health, or other property;property.
c . Is likely to cause or contribute to blight, disease, vagrancy, or danger
to children.
d. Has a tendency to attract persons intent on criminal activities or other
activities that would constitute a public nuisance.
(2) That a hearing will be held before the inspector at a designated place and
time, not later than 10 days after the date of the notice, at which time the
owner is entitled to be heard in person or by counsel and to present
arguments and evidence pertaining to the matter; and
(3) That following the hearing, the inspector may issue any order to repair,
close, vacate, or demolish the building that appears appropriate.
If the name or whereabouts of the owner cannot after due diligence be discovered, the notice
shall be considered properly and adequately served if a copy thereof is posted on the outside of
the building in question at least 10 days before the day of the hearing and a notice of the
hearing is published at least once not later than one week before the hearing."
SECTION 3. G.S. 153A-372 reads as rewritten:
"§ 153A-372. Equitable enforcement.
W Action Authorized. -Whenever a violation is denominated a misdemeanor under
the provisions of this Part, the county, either in addition to or in lieu of other remedies, may
initiate any appropriate action or proceeding to prevent, restrain, correct, or abate the violation
or to prevent the occupancy of the. building involved .
.(hl Removal of Building. -In the case of a building or structure declared unsafe under
G .S. 153A-366 or an ordinance adopted pursuant to G .S. 153A-366, a county may, in lieu of
taking action under subsection (a) of this section, cause the building or structure to be removed
or demolished. The amounts incurred by the county in connection with the removal or
demolition shall be a lien against the real property upon which the cost was incurred. The lien
shall be filed, have the same priority, and be collected in the same manner as liens for special
assessments provided in Article 9 of this Chapter. ff the building or structure is removed or
demolished by the county, the county shall sell the usable materials of the building and any
personal property, fixtures, or appurtenances found in or attached to the building. The county
shall credit the proceeds of the sale against the cost of the removal or demolition. Any balance
remaining from the sale shall be deposited with the clerk of superior court of the county where
the property is located and shall be disbursed by the court to the person found to be entitled
thereto by final order or decree of the court.
iliD Additional Lien. -The amounts incurred by the county in connection with the
removal or demolition shall also be a lien against any other real property owned by the owner
of the building or structure and located within the county's jurisdictional limits, except for the
owner's primary residence. The provisions of subsection (b) of this section apply to this
additional lien, except that this additional lien is inferior to all prior liens and shall be collected
as a money judgment.
(£)_ Nonexclusive Remedy. -Nothing in this section shall be construed to impair or
limit the power of the county to define and declare nuisances and to cause their removal or
abatement by summary proceedings or otherwise."

SECTION 4. This act is effective when it becomes law.

Our mom, Lillian Jones, passed away October 24, 2016. She lived at 3143 US 401 South and
owned over 46 acres of land adjacent to her home. Johnson Properties sold 9 .8 acres and the
home in March 2017 leaving us 36.6 acres left to sell. We contracted with Ann Milton Realty to
sell the remaining 36.6 acres. She has brought to our attention that the land is zoned Industrial
and questioned were we aware of that. We have always been under the assumption that this
land was zoned Residential.
After talking with David at the Planning Board, we questioned as to why the family had no
knowledge of the land/zoning being Industrial. He responded that with the land being rented
out for farm use for many years and with the land being in deferment is why no one knew the
zoning was Industrial.
Ann Milton Rea lty states that potential buyers would like this land to be zoned Residential. We
are asking the fee to be waived in changing the zoning to Residential seeing that it had been
changed with nobody having any knowledge .

REASONING: The requested zoning to RA-30 is compatible with the overall land use
classification of Medium Density Res idential, as well as within the Compatibility
Development Target area. The MOR land use class could have lot densities that range
from 2-5 units per acre and have areas of existing utilities. The Compatibility
Development Target areas is based on potential utility availability and flexibility with lot
sizes.
The proposal does ENHANCE or maintain the public health, safety and general welfare.
REASONING: The requested zoning to RA -30 would maintain the public health, safety
and general welfare due to the existing residential uses within the area.
The request is for a SMALL SCALE REZONING and should be evaluated for
reasonableness.
REASONING: Since the proposed zoning district of RA-30 is i mmediately across the
road, as well as due to the similarity of the two d istricts, this application does need to
be considered a Small Scale Rezoning.

As stated in the evaluation, the requested rezoning to RA-30 would not have an unreasonable impact on
the surrounding community and will maintain the public health, safety, and general welfare based on the
existing residential uses as well as the County's Land Use Plan. Therefore, it is recommended that this
rezoning request be APPROVED.
Additional Information
On August 7th, the Harnett County Planning Board voted unanimously ( 4-0) to recommend approval of
application based on compatibility to the Land Use Plan and the existing RA-30 zoning in the area.

I am writing this letter in regards to the tract of land on Christian Light Road
that I am currently under contract to purchase. It is my intentions to subdivide
5 building lots f rom the total tract and build single family dwellings on each
tract for economic gain. The lots will be approximately 1 acre each . The
houses will range in size from 2.000-2,500 sf in size.
The property is current ly zoned R-40. I am requestin g t hat the property be
rezoned R-30. The reason for my rezoning request is that it will allow th e road
frontage access to the large remaining tract to be 100' wide instead of 50'.
This is due to the difference in th e lot width req u iremen t s for R-40 vs. R-30.

E.M.S. Funding Mechanism
EMS Enhanced Federal Medicaid Settlement Program
This program is an annual cost reporting program that allows for reimbursement of a portion of a
participating units annual operational cost as they relate to Medicaid eligible emergency ambulance
services. The North Carolina Association of County Commissioners (NCACC) administers this program in
conjunction with the NC Department of Health and Human Services (DHHS) for units of government that
deliver EMS services. Units of government must meet specific criteria in order to participate in the
settlement program. The unit of government must first be enrolled as a NC Medicaid provider. The unit
must also be a governmental unit as described in G.S. 138 A-3 (lSd) of the state statue and have
certified public expenditures (CPE) in order to be eligible for cost settlement. EMS Medicaid cost
settlement is for governmental providers of emergency ambulance services only. Units of government
that deliver these EMS services, or deliver those services through special arrangements with volunteers
or private contractors, could be eligible to participate in the program.
The program above is recouped by Harnett County Finance Department for Harn ett County E.M.S. unit s
only at this time. Emergency Services would like to propose that other Harnett County E.M.S. Squads
become eligible to gain this reimbursement as well so that the rising costs to provide emergency
medical services can be offset. In order to accompl ish this each squad will be required to lease their
E.M.S. units to Harnett County on an annual basis. Finance will then file for these incident responses in
the fall of each year with the reimbursements appropriated back to the county in the following spring of
the next year.

5 AUTHORIZE THAT SPECIAL TAXING DISTRICT TO LEVY A SIX PERCENT
6 ROOM OCCUPANCY TAX.
7 The General Assembly of North Carolina enacts:

9 PART I. SANFORD OCCUPANCY TAX
10 SECTION 1. Occupancy tax. -(a) Authorization and Scope. -The City Council of
11 the City of Sanford may levy a room occupancy tax of up to three percent (3%) of the gross
12 receipts derived from the rental of an accommodation within the city that is subject to sales tax
13 imposed by the State under G.S . I05-I64.4(a)(3). This tax is in addition to any State or local
14 sales tax.
15 SECTION 1.(b) Administration. -A tax levied under this section shall be levied,
16 administered, collected, and repealed as provided in G.S. 160A-215. The penalties provided in
17 G.S. 160A-215 apply to a tax levied under this section.
18 SECTION 1.( c) Distribution and Use of Tax Revenue. -The City of Sanford shall,
19 on a quarterly basis, remit the net proceeds of the occupancy tax to the Sanford Tourism
20 Development Authority. The Authority shall use the funds remitted to it under this subsection
21 to promote travel and tourism in the City of Sanford.
22 The following definitions apply in this section:
23 (1) Net proceeds. -Gross proceeds less the cost to the city of administering and
24 collecting the tax, as determined by the finance officer, not to exceed three
25 percent (3%) of the first five hundred thousand dollars ($500,000) of gross
26 proceeds collected each year and one percent (I%) of the remaining gross
27 proceeds collected each year.
28 (2) Promote travel and tourism. -To advertise or market an area or activity,
29 publish and distribute pamphlets and other materials , conduct market
30 research, or engage in similar promotional activities that attract tourists or
31 business travelers to the area; the term includes administrative expenses
32 incurred in engaging in the listed activities.
33 SECTION 1.(d) Tourism Development Authority. -Appointment and
34 Membership. -When the City Council adopts a resolution levying a room occupancy tax under
35 this section, it shall also adopt a resolution creating the Sanford Tourism Development
36 Authority, which shall be a public authority under the Local Government Budget and Fiscal

1 Control Act. The resolution shall provide for the membership of the Authority, including the
2 members' terms of office , and for the filling of vacancies on the Authority. At least one-third of
3 the members shall be individuals who are affiliated with businesses that collect the tax in the
4 city and at least one-half of the members shall be individuals who are currently active in the
5 promotion of travel and tourism in the city. The City Council shall designate one member of
6 the Authority as chair and shall determine the compensation, if any, to be paid to members of
7 the Authority.
8 The Authority shall meet at the call of the chair and shall adopt rules of procedure to
9 govern its meetings. The finance officer for the City of Sanford shall be the ex officio finance
10 officer of the Authority.
11 SECTION l.(e) Duties. -The Authority shall expend the net proceeds of the tax
12 levied under this section for the purpose provided in subsection (c) of this section. The
13 Authority shall promote travel, tourism, and conventions in the city and sponsor tourist-related
14 events and activities in the city.
15 SECTION 1.(f) Reports. -The Authority sha11 report quarterly and at the close of
16 the fiscal year to the Sanford City Council on its receipts and expenditures for the preceding
I 7 quarter and for the year in such detail as the City Council may require.

19 PART II. HARNETT COUNTY OCCUPANCY TAX
20 SECTION 2.1.(a) District H Created. -Hamett County District His created as a
21 taxing district. Its jurisdiction consists of all of Hamett County exclusive of the A verasboro
22 Township. Hamett County District His a body politic and corporate and has the power to carry
23 out the provisions of this section. The Hamett County Board of Commissioners shall serve ex
24 officio as the governing body of the district and the officers of the board of commissioners shall
25 serve as the officers of the governing body of the district. A simple majority of the governing
26 body constitutes a quorum and approval by a majority of those present is sufficient to
27 determine any matter before the governing body, if a quorum is present.
28 SECTION 2.1.(b) Authorization and Scope. -The governing body of Hamett
29 County District H may levy a room occupancy tax of up to six percent ( 6%) of the gross
30 receipts derived from the rental of any room, lodging, or accommodation furnished by a hotel,
31 motel, inn, tourist camp, or similar place within the district that is subject to sales tax imposed
32 by the State under G.S. 105-164.4(a)(3). This tax is in addition to any State or local sales or
33 room occupancy tax.
34 SECTION 2.1.(c) Administration. - A tax levied under this section shall be levied,
35 administered, collected, and repealed as provided in G.S. 153A-155 as if Harnett County
36 District H were a county. The penalties provided in G.S. 153A-155 apply to a tax levied under
37 this section.
38 SECTION 2.1.(d) Distribution and Use of Tax Revenue . -Hamett County District
39 H shall, on a quarterly basis, remit the net proceeds of the occupancy tax to the Hamett County
40 District H Tourism Development Authority. The Hamett County District H Tourism
41 Development Authority shall use at least two-thirds of the proceeds to promote travel and
42 tourism and shall use the remainder for tourism-related expenditures in the district. In
43 accordance with the North Carolina Constitution and the United States Constitution, the tax
44 proceeds may be used only for the direct benefit of the jurisdiction of Hamett County District
45 H .
46 The following definitions apply in this subsection:
47 (1) Net proceeds. -Gross proceeds less the cost to the county of administering
48 and collecting the tax, as determined by the finance officer, not to exceed
49 three percent (3%) of the first five hundred thousand dollars ($500,000) of
50 gross proceeds collected each year and one percent (1 %) of the remaining

(3) Tourism-related expenditures. -Expenditures that, in the judgment of the
Tourism Development Authority, are designed to increase the use of lodging
facilities, meeting facilities, or convention facilities in the county or to
attract tourists or business travelers to the district. The term includes
tourism-related capital expenditures.
SECTION 2.2. Hamett County District H Tourism Development Authority. -(a)
Appointment and Membership . -When the governing body of Hamett County District H

creating the Harnett County District H Tourism Development Authority, which shall be a

PART III. ADMINISTRATIVE PROVISIONS
SECTION 3.(a) G.S. 160A-215(g) reads as rewritten:
"(g) Applicability. -Subsection ( c) of this section applies to all c1t1es that levy an
occupancy tax. To the extent subsection (c) conflicts with any provision of a local act,
subsection (c) supersedes that provision. The remainder of this section applies only to Beech
Mountain District W, to the Cities of Belmont, Conover, Eden, Elizabeth City, Gastonia,
Goldsboro, Greensboro, Hickory, High Point, Jacksonville, Kings Mountain, Lenoir,
Lexington, Lincolnton, Lowell, Lumberton, Monroe, Mount Airy, Mount Holly, Reidsville,
Roanoke Rapids, Salisbury, Sanford, Shelby, Statesville, Washington, and Wilmington, to the
Towns of Ahoskie, Beech Mountain, Benson, Bermuda Run , Blowing Rock, Boiling Springs,
Boone, Burgaw, Carolina Beach, Carrboro, Cooleemee, Cramerton, Dallas, Dobson, Elkin,
Fontana Dam, Franklin, Grover, Hillsborough, Jonesville, Kenly, Kure Beach, Leland,
McAdenville, Mocksville, Mooresville, Murfreesboro, North Topsail Beach, Pembroke, Pilot
Mountain, Ranlo, Robbinsville, Selma, Smithfield, St. Pauls, Swansboro, Troutman, Tryon,
West Jefferson, Wilkesboro, Wrightsville Beach, Yadkinville, and Yanceyville, and to the
municipalities in A very and Brunswick Counties."
SECTION 3.(b) G.S. 153A-155(g) reads as rewritten:
"(g) Applicability. -Subsection (c) of this section applies to all counties and county
districts that levy an occupancy tax. To the extent subsection (c) conflicts with any provision of

PROCLAMATION SUPPORTING
MARSY'S LAW FOR NORTH CAROLINA
WHEREAS, Marsy's Law for North Carolina and advocacy organi zations statewide are dedicated
to guaranteeing victims ' rights and providing a voice ; and
WHEREAS , Marsy 's Law for North Carolina supporters agree victims should always be treated
with fairness and respect throughout the criminal justice process, protected from the defendant,
reasonably heard at public preceedings regarding their case, and given a v oice through the process
of the case; and
WHEREAS, per the Federal Bureau of Investigation's (FBI) most recent "Crime in the United
States" report, in 2013 a total of 33 ,700 North Carolinians were the victim of Violent "Index
Crimes" including: murder, rape, robbery, aggravated assault, burglary, larceny, motor vehicle
theft and arson; and
WHEREAS , Marsy 's Law for North Carolina will insure that victim 's receive the same rights that
are afforded to criminals and have rights to notification ofrelease, hearings, appropriate restitution,
and the right to speak at during criminal proceedings; and
WHEREAS, Victims' Rights is a non-partisan , non-political i ssue, and M ar sy's Law is a common
sense approach to ensuring Victims' Rights.
NOW, THEREFORE, we, the Harnett County Board of Commissiners, do hereby
proclaim, s upport for HB 551/SB 595 (Marsy's Law) and encourage all of our citi z ens to join in
the commitment to protect the rights of North Carolina Crime Victims.
