HomeMy WebLinkAbout01212003 836 HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting January 21, 2003 The Harnett County Board of Commissioners met in regular session on Tuesday, January 21,2003, in the Commissioners Meeting Room, County Administration Building, 102 East Front Street, Lillington, North Carolina. Members present: Teddy J. Byrd, Chairman . Beatrice Bailey Hill, Vice Chairman Walt Titchener Tim McNeill Commissioner Dan B. Andrews was absent. Staff present: Wm. A. (Tony) Wilder, Assistant County Manager Dwight W. Snow, County Attorney Kay S. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener led the pledge of allegiance and prayer. Commissioner Titchener moved to approve the agenda as published with the following items added to the consent agenda: - Additional budget amendments - Resolutions recognizing Larry Knott and Steve West - Resolutions recognizing four Eagle Scouts - Pre-application for grant for Sheriff's Department - Transfer of easement documents for Shawtown sewer project Commissioner Hill seconded the motion and it passed unanimously. Write-off of delinquent Public Utilities accounts determined to be at write-off status for the last quarter of 2002, in the amount of $13,907.23. All of these accounts have been in a delinquent status for more than three years. 8. Designation of Steve Ward as hearing officer for the purpose of hearing Public . Utilities appeals relating to the Debt Setoff Program. 9. Creation of a budget revenue line for donations for animal shelter construction. 10. Resolutions recognizing former Sheriff, Larry Knott and former Major, Steve West (Attachment 4) 11. Resolution recognizing four Eagle Scouts: Johnathan L. Suggs, Mark Quakenbush, Kyle Spence Harrington, and Jonas Parrish (Attachment 5) 12. Authorization for the Sheriffs Department to submit pre-applications for two Governor's Crime Commission Grants 13. Easement documents for the Shawtown Sewer project: Assignment and Transfer of Sewer Line Easements and North Carolina General Warranty Deed (Attachment 6) Informal comments were received from the following citizens: Comments regarding a Sheriff s Department personnel issue Patrick Flowers, 1135 Shady Grove Road Eddie Smith 126 Oak St., Lillington . Joe Bowden, Anderson Creek Ronny Holmes, Anderson Creek Lynwood Matthews Joe Miller, Twin Ponds Rd. Billy Brewer Larry Matthews, Bethel Church Rd. Dan Maynard Mahlon McCoy expressed concerns about vehicles permanently parked on the roadside. Commissioner McNeill moved for the appointments listed below. Commissioner Hill seconded the motion and it passed unanimously. Lee-Harnett Mental Health Board John A. Thomason re-appointed for a 4- year term to expire 1/31/07. nominated by Commissioner McNeill The eligibility rule was waived. CCC;C; Harnett COUl1,tv Cam!Jus Advisorv Committee Jerry Hartgrove re-appointed for a 3-year term to expire 12/31/05 . nominated by Chairman Byrd Home and Communitv Care Block Grant Committe~ Golda Bailey (no term limit) nominated by Chairman Byrd Chairman Byrd called to order a public hearing on a proposed text amendment to the Zoning Ordinance regarding Group Care Facilities as a use. This text would offer this use as a conditional use in all residential and commercial zoning districts. Mark Locklear, Planner, presented the proposed amendment and staff recommendation. Chairman Byrd opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt the amendment as presented. Commissioner Hill seconded the motion and it passed unanimously. (Attachment 7) .._-_....__~'r ._...__""._....,, 839 Chairman Byrd called to order a public hearing on a proposed text amendment to the Zoning Ordinance regarding the definition for Group Care Facilities. Mark Locklear, Planner, presented the proposed amendment and staff recommendation. Chairman Byrd opened the meeting for comments from the public. Tracy Flynn, R.N. and Hospice nurse, provided general comments, stating that there is a strong need for group homes for the elderly population. Mahlon McCoy, Anderson Creek, inquired about the number of group homes allowed in a half-mile radius. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt the amendment as presented. Commissioner Titchener seconded the motion . and it passed unanimously. (Attachment 8) Departmental reports were filed with the Board from the Sheriff s Department, Economic Development, General Services, Fire Marshal and Emergency Management, Animal Control, and Emergency Medical Services. There being no further business, Commissioner McNeill moved for adjournment. Commissioner Hill seconded the motion and it passed unanimously. NORTH CAROLINA www.harnett.org RESOLUTION Sheriff Larry Knott -,---- _.._.~---- ._- --.-...-- Whereas, the safety and well-being of any community is dependent in large part upon the commitment and dedication of law enforcement officers that serve their fellow citizens; and Whereas, Sheriff Larry Knott dedicated 24 years of service to the citizens of Harnett County through his service to the Harnett County Sheriffs Department; and Whereas, Sheriff Knott served from February 7, 1994 to December 2,2002 as Sheriff of Harnett County; and Whereas, throughout his years of service Sheriff Knott served our community in a most exemplary and professional manner; and Whereas, his service has resulted in numerous public safety improvements throughout our County; and Whereas, the citizens of Harnett County now live in a safer place as a result of Sheriff Knott's long and distinguished law enforcement career. WIT N E SSE T H: THA TWHEREAS, the Grantor has previously obtained a Community Development Block Grant (CDBG) for the construction of sewer improvements in the Shawtown Community in Lillington Township, Harnett County, N. C.; that in the process of developing the sewer plans and the construction and installation of the sewer improvement system, the Grantor obtained several sewer line Easements from various landowners in the Shawtown area where the sewer line was located; and WHEREAS, the Shawtown Area Sewer Project phase 2000 has been completed, and the Grantor and Grantee have entered into an Agreement To Transfer the Shawtown 2000 Community Development Block Grant Sewer System in order that the Grantee can own, operate, manage, and maintain the particular sewer line phase as part of the overall Lillington sewer system; that as part of said Agreement, all Easements conveyed to the Grantor for the installation of the sewer system and the subsequent operation and maintenance of said sewer system lines are to be transferred, assigned and conveyed to the Grantee and the parties desire to complete this transfer and assignment through the execution and recordation of this instrument.
