HARNETT COUNTY BOARD OF COMMISSIONERS
Minutes of Regular Meeting
January 21, 2003
The Harnett County Board of Commissioners met in regular session on Tuesday,
January 21,2003, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.
Members present: Teddy J. Byrd, Chairman .
Beatrice Bailey Hill, Vice Chairman
Walt Titchener
Tim McNeill
Commissioner Dan B. Andrews was absent.
Staff present: Wm. A. (Tony) Wilder, Assistant County Manager
Dwight W. Snow, County Attorney
Kay S. Blanchard, Clerk to the Board
Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener
led the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with the following
items added to the consent agenda:
- Additional budget amendments
- Resolutions recognizing Larry Knott and Steve West
- Resolutions recognizing four Eagle Scouts
- Pre-application for grant for Sheriff's Department
- Transfer of easement documents for Shawtown sewer project
Commissioner Hill seconded the motion and it passed unanimously.
Upon motion by Commissioner Hill and seconded by Commissioner Titchener, the .

which is equal to the cost of the water-tap and the environmental health cost
related to beginning construction of a senior center.
5. Change'order for 18 MGD Water Plant Upgrade project (Attachment 2)
6. Change order for Anderson Creek Homes project (Attachment 3)
7. Write-off of delinquent Public Utilities accounts determined to be at write-off
status for the last quarter of 2002, in the amount of $13,907.23. All of these
accounts have been in a delinquent status for more than three years.
8. Designation of Steve Ward as hearing officer for the purpose of hearing Public .
Utilities appeals relating to the Debt Setoff Program.
9. Creation of a budget revenue line for donations for animal shelter construction.
10. Resolutions recognizing former Sheriff, Larry Knott and former Major, Steve
West (Attachment 4)
11. Resolution recognizing four Eagle Scouts: Johnathan L. Suggs, Mark
Quakenbush, Kyle Spence Harrington, and Jonas Parrish (Attachment 5)
12. Authorization for the Sheriffs Department to submit pre-applications for two
Governor's Crime Commission Grants
13. Easement documents for the Shawtown Sewer project: Assignment and Transfer
of Sewer Line Easements and North Carolina General Warranty Deed

Commissioner McNeill moved for the appointments listed below. Commissioner Hill
seconded the motion and it passed unanimously.

John A. Thomason re-appointed for a 4- year term to expire 1/31/07.

Chairman Byrd called to order a public hearing on a proposed text amendment to the
Zoning Ordinance regarding Group Care Facilities as a use. This text would offer this
use as a conditional use in all residential and commercial zoning districts. Mark
Locklear, Planner, presented the proposed amendment and staff recommendation.
Chairman Byrd opened the meeting for comments from the public. No comments
were offered and Chairman Byrd closed the public hearing. Commissioner McNeill
moved to adopt the amendment as presented. Commissioner Hill seconded the motion
and it passed unanimously. (Attachment 7)

Chairman Byrd called to order a public hearing on a proposed text amendment to the
Zoning Ordinance regarding the definition for Group Care Facilities. Mark Locklear,
Planner, presented the proposed amendment and staff recommendation. Chairman
Byrd opened the meeting for comments from the public. Tracy Flynn, R.N. and
Hospice nurse, provided general comments, stating that there is a strong need for
group homes for the elderly population. Mahlon McCoy, Anderson Creek, inquired
about the number of group homes allowed in a half-mile radius. There being no further
comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved
to adopt the amendment as presented. Commissioner Titchener seconded the motion
. and it passed unanimously. (Attachment 8)
Departmental reports were filed with the Board from the Sheriff s Department,
Economic Development, General Services, Fire Marshal and Emergency
Management, Animal Control, and Emergency Medical Services.
There being no further business, Commissioner McNeill moved for adjournment.
Commissioner Hill seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners' regular meeting, January 21,2003 adjourned at 7:40
p.m.

Sheriff Larry Knott

Whereas, the safety and well-being of any community is dependent in large part upon the
commitment and dedication of law enforcement officers that serve their fellow citizens; and
Whereas, Sheriff Larry Knott dedicated 24 years of service to the citizens of Harnett
County through his service to the Harnett County Sheriffs Department; and
Whereas, Sheriff Knott served from February 7, 1994 to December 2,2002 as Sheriff of
Harnett County; and
Whereas, throughout his years of service Sheriff Knott served our community in a most
exemplary and professional manner; and
Whereas, his service has resulted in numerous public safety improvements throughout
our County; and
Whereas, the citizens of Harnett County now live in a safer place as a result of Sheriff
Knott's long and distinguished law enforcement career.
Now, Therefore, Be It Resolved that the Harnett County Board of Commissioners does
. hereby recognize and commend Sheriff Larry Knott for his dedication and long term service to
the citizens of Harnett County.

THAT, WHEREAS, the Boy Scouts is an organization which has long helped shape the
lives of young people across America; and
WHEREAS, this organization is dedicated to developing the future leaders of our
communities and our nation; and

Eagle Scout; and
WHEREAS, this award is only presented to those individuals that demonstrate a .

OF SEWER LINE EASEMENTS
HARNETT COUNTY
. THIS ASSIGNMENT AND TRANSFER OF SEWER LINE EASEMENTS, made this the
day of January, 2003, by and between the COUNTY OF HARr-lJ:~.TL, P.O. Box 759,
Lillington, NC 27546, hereinafter called GRANTOR, and the TOWN OF LILLINGTON, P,O.
Box ~96, Lllllngton, NC 27546, hereinafter called GRAN'I'eB.
WIT N E SSE T H:
THA TWHEREAS, the Grantor has previously obtained a Community Development Block
Grant (CDBG) for the construction of sewer improvements in the Shawtown Community in
Lillington Township, Harnett County, N. C.; that in the process of developing the sewer plans and
the construction and installation of the sewer improvement system, the Grantor obtained several
sewer line Easements from various landowners in the Shawtown area where the sewer line was
located; and
WHEREAS, the Shawtown Area Sewer Project phase 2000 has been completed, and the
Grantor and Grantee have entered into an Agreement To Transfer the Shawtown 2000 Community
Development Block Grant Sewer System in order that the Grantee can own, operate, manage, and
maintain the particular sewer line phase as part of the overall Lillington sewer system; that as part
of said Agreement, all Easements conveyed to the Grantor for the installation of the sewer system
and the subsequent operation and maintenance of said sewer system lines are to be transferred,
assigned and conveyed to the Grantee and the parties desire to complete this transfer and
assignment through the execution and recordation of this instrument.
NOW, THEREFORE, for and in consideration of the sum of Ten Dollars and other good
and valuable consideration the receipt of which is hereby acknowledged and pursuant to that
earlier Agreement To Transfer the Shawtown 2000 CDBG Sewer System dated January 6, 2003,
the Grantor does hereby grant, bargain, transfer, sell and assign without recourse unto the Grantee
and its successors and assigns all its right, title and interest in and to those underground sewer
. gravity lines and sewer force main lines which make up the CDBG Shawtown sewer project 2000
and those Easements for sewer line instruments which are part of the CDBG Shawtown Sewer
Project 2000 as shown on those maps recorded in Map Nos. 2002-651,653,655,657,659,661;
2002-11 07 ,11 08; and 2002-1303, Harnett County Registry, which said Easement instruments are
more particularly described as follows:

As part of this conveyance, the Grantor includes any and all improvements made
and located on the above-referenced tract including but not limited to pumpllift
station equipment, power source hook up, equipment shelter and fencing.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and
al'PlLlLenances thereto belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee that Grantor is seized of the premises in fee
simple, has the right to convey the same in fee simple, that title is marketable and free and clear
of all encumbrances, and that Grantor will warrant and defend the title against the lawful claims
of all persons whomsoever except for the exceptions hereinafter stated.
Title to the property hereinabove described is subject to the following exceptions:
a. General utility easements for phone and power purposes.
b. Roadways and rights-of-way of record and those visible by inspection of the
premises including the right-of-way of Murchison Lane as shown on Map No.
2002-653, Harnett County Registry.
c. Such facts as an environmental study on the subject property by an environmental
. engineer would reveal.
d. Such facts that are revealed by that survey on the subject tract which is recorded

A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE TEXT
WHEREAS, the Board of Commissioners of Harnett County-adopted-lf"ZuningOrdinance on July
18,1988 and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of
the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A-340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those .
provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article III and
Article XV of the Zoning Ordinance and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMlSSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article X Ofthe Zoning Ordinance be amended
by adding the following new text to section 12.0 as follows:
Group Care Facility: An establishment qualified for a license by the State of North Carolina for
the provision of resident services of seven (7) or more individuals of whom one or more are
unrelated, and who are either handicapped, or aged, or disabled, or who are runaway, disturbed, or
emotionally deprived children and who aTe undergoing rehabilitation or extendeltcare; and who are
provided services to meet their needs. For the purposes of this definition included in this are group
homes for all ages, half-way houses, boarding homes for children, and convalescent and nursing
homes"
Duly adopted this 21" day of January, Two Thousand Three and effective upon adoption.
