Minutes of Regular Meeting
November 18, 2002
The Harnett County Board of Commissioners met in regular session on Monday,
November 18, 2002, in the Commissioners meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Commissioner Dan Andrews was absent due to illness.

Neil Emory, County Manager, was absent due to illness.
Chairman Byrd called the meeting to order at 9:00 a.m. and Vice Chairman Hill led
the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with the addition to the
consent agenda of a budget amendment and addition to the regular agenda of a
resolution to change the place of the December 2nd Board of Commissioners' meeting.
Commissioner Titchener seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Hill, the
Board unanimously approved the following items on the consent agenda:

6. Renewal agreement with Republic Services of North Carolina, LLC, d.b.a.
Uwharrie Environmental for transportation and disposal of solid waste. The
agreement is extended for a five-year term commencing January 1, 2002. The
initial fee for this extension shall be $27.48 per ton. The first annual fee
adjustment shall be for the period commencing January 1, 2004.
7. Acceptance of two Federal funding grants for the Airport:
A. AIR-21 grant in the amount of $150,000.
B. Runway extension project grant in the amount of $2,972,799.
The County's previous expenditures will serve as an in -kind contribution and
will meet the required match.
8. Authorization for Finance staff to finalize financing with CCB for lease -purchase
of a used Minolta RP609Z w/ACF-2 for the Register of Deeds.
Informal comments were provided by the following citizens:
- Ronald Thomas and James Latta expressed concerns regarding a proposed
group home on Temple Road.
Halford Matthews, Jonathan Smith, and Kay Matthews expressed concerns
with noise from a turkey shoot in Chalybeate Springs.
Wilton Lee expressed concerns with empty mobile homes in the Old Farm
area.
Commissioner Hill moved for the appointments listed below. Commissioner McNeill
seconded the motion and it passed unanimously.

A public hearing was held November 4, 2002, regarding the proposed Schedule of
Values to be used by the Tax Department for revaluation of real property.
Commissioner McNeill moved to adopt an Order approving the Schedule of Values
for the 2003 Revaluation of Real Property, as presented. Commissioner Hill seconded
the motion and it passed unanimously. Notice of this Order and the rights of the
property owner will be published for four successive weeks. If the Schedule of Values
validity is not challenged on or before December 12, 2002, it will become the values
for real property that will be in effect until the County's next Revaluation.

• Steve Ward, Assistant Director, Public Utilities, presented a request for the Board to
consider the introduction of a bond order authorizing the issuance of $42,000,000
general obligation water and sewer bonds for the South Central Water and Sewer
District of Harnett County. This is an introduction of the bond order. The Board will
not officially authorize the order until a public hearing is held on the matter at its
regular meeting, December 2, 2002, at 9 a.m. Mr. Ward presented a statement of
outstanding debt of the district and a proposed resolution setting the date for the public
hearing, for the Board's consideration. Commissioner McNeill moved to adopt the
resolution. Commissioner Titchener seconded the motion and it passed unanimously.

Chairman Byrd called to order at public hearing on a zoning change request for
applicant Enoch Engineers, P.A., landowner: Western Harnett Indistrial Park, from
RA-20R to Industrial Zoning District, Hwy. 87, Barbecue Township, 250.0 +/- acres,
Parcel Numbers 039576 0035 and 039567 0017. Mark locklear, Planner, presented
the zoning change request and stated that the Planning Board unanimously
recommended approval of the request. Chairman Byrd opened the meeting for
comments from the public. Jerry Hartgrove, Economic Development Director,
recommended approval based on this being one of four proposed industrial sites
recommended by the Leake-Goforth study; and stating that an industrial site in this
location would be a significant opportunity for the County to broaden its tax base.
isThere being no further comments, Chairman Byrd closed the public hearing.
Commissioner McNeill moved to approve the zoning change request as presented.
Commissioner Titchener seconded the motion and it passed unanimously.
Chairman Byrd called to order a public hearing on proposed text amendments to the
Subdivision Regulations. June Cowles, Planner, presented and reviewed proposed text
amendments to Subdivision Ordinance, Article III, Section 3.4.2 and Article V,
Section 5.2.2., adding a requirement for a recorded Ingress and Egress Easement
Maintenance Agreement for minor subdivisions. Chairman Byrd opened the meeting
for comments from the public. No comments were offered and Chairman Byrd closed
the public hearing. Commissioner McNeill moved to approve the text amendments as
presented. Commissioner Hill seconded the motion and it passed unanimously.

Chairman Byrd called to order a public hearing on a proposed Zoning Ordinance text
amendment. June Cowles, Planner, presented and reviewed the proposed text
amendment to Article XIV, Section 4.0, to delete requirement for applicant to furnish
information now available online via GIS. Chairman Byrd opened the meeting for
comments from the public. No comments were offered and Chairman Byrd closed the
public hearing. Commissioner Titchener moved to approve the text amendment as
presented. Commissioner Hill seconded the motion and it passed unanimously.

Chairman Byrd called to order a public hearing on a proposed Zoning Ordinance text is
amendment. Mark Locklear, Planner, presented and reviewed the proposed text
amendment to Article VI, Section 5.2Q & 7.1G, to require that all conditions are met
for manufactured homes prior to issuing a Certificate of Occupancy. Chairman Byrd
opened the meeting for comments from the public. No comments were offered
regarding the proposed text amendment and Chairman Byrd closed the public hearing.
Commissioner Hill moved to approve the text amendment as presented.
Commissioner Titchener seconded the motion and it passed. (Attachment 7)
Departmental reports were filed with the Board from Animal Control and the Sheriff's
Department.
Dwight W. Snow, County Attorney, presented a proposed resolution which would
change the meeting place of the regular Board of Commissioners meeting on Monday,
December 2, 2002, at 9:00 a.m. from the County Office Building to Courtroom No. 6
which is located on the third floor of the new Harnett County Courthouse. This
change in meeting place is specifically only for the regular meeting on December 2,
2002; all other regular meetings of the Board shall continue to be conducted at the
Harnett County Office Building. Commissioner Hill moved to adopt the resolution.
Commissioner Titchener seconded the motion and it passed unanimously.

CONCERNING THE TRUE VALUE SCHEDULE OF VALUES, STANDARDS
AND RULES TO BE USED IN APPRAISING REAL PROPERTY AT ITS TRUE
VALUE FOR THE JANUARY 1, 2003 REAVALUATION
Upon motion by Commissioner, Tim -.McNeill, , seconded by
Commissioner, Beatrice Hill , the Harnett County Board of
Commissioners hereby issues an order adopting the final schedules, standards, and
rules to be used in appraising real property at its true value as of January 1, 2003.
isTheHarnett County Tax Administrator is hereby ordered to provide for
public examination a copy of these schedules in his office at 729 South Main Street,
Lillington, NC. A property owner who asserts that these schedules, standards, and
rules are invalid may appeal them to the North Carolina Property Tax Commissl90,
within 30 days from November 10, 2002.
The Harnett County Clerk to the Board is hereby ordered to publish in a
newspaper of general circulation a notice of this order and the rights of the property
owner. This notice shall be published for four successive weeks, on November 20th
& 27th and December 4th & 11th, 2002.

AUTHORIZING THE ISSUANCE OF $42,000,000 GENERAL OBLIGATION WATER AND SEWER BONDS OF
THE SOUTH CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY, SETTING A PUBLIC
HEARING THEREON AND DIRECTING PUBLICATION OF A NOTICE OF SAID PUBLIC HEARING
WHEREAS, bond order entitled:
"BOND ORDER AUTHORIZING THE' ISSUANCE OF $42,000,000
GENERAL OBLIGATION WATER AND SEWER BONDS OF THE SOUTH
CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY"
has been introduced at a meeting of the Board Of Commissioners of the County of Harnett, North Carolina
sitting as the governing body (the 'Board') of the South Central Water and Sewer District of Harnett
County (the "District'), this 18th day of November, 2002; and
WHEREAS, the Board desires to provide for the holding of a public hearing thereon on
December 2, 2002 and the submission of a statement of debt in connection therewith as required by The
Local Government Bond Act.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
THE COUNTY OF HARNETT, NORTH CAROLINA SITTING AS THE GOVERNING BODY OF
THE DISTRICT that the public hearing on said bond order shall be held on the 21" day of December

directed to file prior to publication of the bond order with the notice of such public hearing, a statement
setting forth the debt incurred or to be incurred, the net debt of the District, the assessed value of property

NOTICE OF PUBLIC HEARING
BOND ORDER AUTHORIZING THE ISSUANCE OF $42,000,000
GENERAL OBLIGATION WATER AND SEWER BONDS OF THE
SOUTH CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY
WHEREAS, the South Central Water and Sewer District of Harnett County, North Carolina (the
"District') desires to raise $42,000,000 to provide for the costs incurred in the construction, equipping,
renovation and furnishing of a centralized wastewater collection system within the District, including, but
not limited to, the acquisition of pumping stations, the upgrading of a wastewater treatment plant and the
installation of gravity collection lines and forcemain; and
WHEREAS, an application has been filed with the Secretary of the Local Government
Commission of North Carolina requesting Commission approval of the general obligation water and
sewer bonds hereinafter described as required by the Local Government Bond Act, and the Clerk to the
Board of Commissioners of the County of Harnett sitting as the governing body of the District (the
"Board") has notified the Board that the application has been accepted for submission to the Local
Government Commission.
NOW, THEREFORE, BE IT ORDERED by the Board, as follows:
Section 1. In order to raise the money required for the construction, equipping,
renovation and furnishing of the wastewater collection system described above, in addition to any
funds which may be made available for such purpose from any other source, general obligation
water and sewer bonds of the District are hereby authorized and shall be issued pursuant to the
Local Government Finance Act of North Carolina. The maximum aggregate principal amount of
such general obligation water and sewer bonds authorized by this order shall be $42,000,000.
Section 2. A tax sufficient to pay the principal of and interest on said general
obligation water and sewer bonds when due shall be annually levied and collected.
Section 3. A sworn statement of the District's debt has been filed with the Clerk to
the Board and is open to public inspection.
Section 4. This bond order shall take effect when approved by the voters of the
County at -a referendum scheduled for February 4, 2003.
The foregoing bond order has been introduced and a sworn statement of debt has been filed under
the Local Government Bond Act showing the appraised value of the property located within the Central

Carolina (the "County'), sitting as the governing body (the "Board") of the South Central Water and
Sewer District of Harnett County (the "District'), introduced the following Bond Order, copies of which
have been made available to the Board:

GENERAL OBLIGATION WATER AND SEWER BONDS
OF THE COUNTY OF HARNETT, NORTH CAROLINA

WHEREAS, the County desires to raise $42,000,000 to provide for the to pay the costs incurred
in connection with the construction, equipping, renovation and famishing of a centralized wastewater
collection system within the District, including, but not limited to, the acquisition of pumping stations, the
upgrading of a wastewater treatment plant and the installation of gravity collection lines and forcemain;
and
WHEREAS, an application has been filed with the Secretary of the Local Government
Commission of North Carolina requesting Commission approval of the general obligation water and
sewer bonds hereinafter described as required by the Local Government Bond Act, and the Clerk to the
Board of Commissioners has notified the Board that the application has been accepted for submission to
the Local Government Commission.
NOW, THEREFORE, BE IT ORDERED by the Board of Commissioners of the County of
Harnett, North Carolina sitting as the governing body of the District, as follows:
Section 1. In order to raise the money required for the construction of the
wastewater collection system described above, in addition to any funds which may be made
available for such purpose from any other source, general obligation water and sewer bonds of the
District are hereby authorized and shall be issued pursuant to the Local Government Finance Act
of North Carolina. The maximum aggregate principal amount of such general obligation water
and sewer bonds authorized by this order shall be $42,000,000.
Section 2. A tax sufficient to pay the principal of and interest on said general
obligation water and sewer bonds when due shall be annually levied and collected.
Section 3. A sworn statement of the County's debt has been filed with the Clerk to
the Board and is open to public inspection.
Section 4. This bond order shall take effect when approved by the voters of the
County at a referendum scheduled for February 4, 2003.

A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE TEXT
WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July
18, 1988 and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of
the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A-340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those
provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article XIV of
the Zoning Ordinance and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED By THE BOARD OF GONWSSIONERS OF
ITT COUNTY' NORTH CAROLINA that Article XIV Section 4.0 of the Zoning
Ordinance be amended by deleting the first sentence and replacing with the following;
All applications for land use permits shall be submitted by the owner(s) or owners' Agent
and all information that is necessary for staff to decide if all requirements of this
ordinance are being met, drawn to scale showing the actual dimensions and shape of the

and shall by approved by the Planning Director or designee and recorded with the County •
Register of Deeds in a legally valid and binding instrument that describes the method of
maintenance, who will be responsible for maintenance, and the properties which the
easement access way serves.

NORTH CAROLINA RESOLUTION
HARNETT COUNTY
THAT WHEREAS, N. C. General Statute §153A-40 states that the Harnett County Board
of Commissioners may by resolution fix the time and place of its regular meetings; that the Board
• has previously adopted certain Rules of Procedure for the Board of Commissioners and pursuant to
Rule 6 the regular meetings of the Board are scheduled to take place on the first Monday of each
month at 9:00 AM and the third Monday of each month at 7:00 p.m. in the County office building
at 102 East Front Street in LilliVon, N, C., and
WHEREAS, it is the desire of the Board through this Resolution to change the meeting place
for a specific meeting whereby the Board can meet at its next regular meeting scheduled for Monday,
December 2, 2002, at the newly opened Harnett County Courthouse for the purpose of not only
conducting the business of the current Board but to also conduct the swearing in ceremony for the
newly elected county officials and further, to conduct the business of the newly sworn in Board of
Commissioners.
NOW, nT7JEREFORE, PURSUANT TO THEPROVISIONS ofN. C. General Statute § 153A-
40 and Rule 6(a) of the Harnett County Board of Commissioners IT IS RESOLVED BY THE
HARNETT COUNTY BOARD OF COMMSSIONERS:
1. That the meeting place for that regular meeting of the Harnett County Board of
Commissioners scheduled for Monday, December 2, 2002 at 9:00 AM is changed
from the Assembly Room at the County office building to Courtroom No. 6 which
is located on the third floor ofthe new Harnett County Courthouse at 301 Cornelius
Harnett Boulevard, Lillington, N.C. 27546.
2. That this change in meeting place is specifically only for the regular meeting on
December 2, 2002; all other regular meetings of the Board shall continue to be
conducted at the Harnett County Office Building unless modified by further
resolutions of the Board.
3. That the County staff is directed to post and notice this change pursuant to Rule 6 of
the County Commissioners Rules of Procedures and N.C. Gen. Stat. § 153A-40(a)
• and §143-318.12.
