REQUEST:
Request permission to receive satellite equipment upgrades to one of Harnett County's
mobile towers.
Harnett County Emergency Services has been contacted by Mike Hodgson with N.C. State
Viper in regards to receiving some satellite equipment for one of Harnett County's mobile
towers. Originally this equipment was intended for Sampson County and Warren County;
however, after realizing that these counties have moved into different DPR regions, the
funding cannot be spent in their new regions. Harnett County is next in line to receive these
funds and this would give us further backup communication capabilities. The state has given
us a deadline of August 31, 2016 for this commitment.
This is a Dept of Homeland Security/DPR grant.
No County funds required.

Larry, in a nutshell we sought grant dollars for upgrades to the mobi le towers to provide a P25 site that could be
connected back into the w ide area VIPER network. These funds were originally directed equally to Dpr2 (Sampson) and
DP4 (Warren) since that's where two trailers were . We need to move forward with purchasing the ground station
(satellite downlink) from the trailers to the Zone Controller in Raleigh . That location is obviously in Wake County (DPR6).
Wake's calendar is later than yours and we need to able to close things out by the end of August give or take a few days .
Essentially you would be accepting a portion of the Sampson grant and an equal portion of the Warren grant
($64,281.40 per) and from that we wou ld proceed with purchasing the satellite equipment.
EM is poised to send the paperwork out and we already have been to bid and are ready to cut the PO for the equipment
which is all ready to ship pending the order so we anticipate a very short turn around on the invoice well within EM's
schedule. We simply need a DPR 6 county to accept the fund s.

larry, I am in need of some assistance. Two years ago we sought and received grant funds to work on upgrading the
VIPER mobile towers to be P25 compliant. This will replace the old standalone 2C10 system that we utilized across the

state. The grant was approved and a DPR host county within DPR2 and DPR4 was chosen to each receive half of the
funding. We have hit a wall with NCEM over the placement of one piece of the equipment in that it (the satellite uplink)
resides within DPR6 (Raleigh) and we have been asked to peel off the funds needed to complete that purchase and place
them with a county within DPR6 . Our issue is that Wake County does not have their next Commission meeting until
August 23'd and the grant ends August 3oth and we have been asked to see if there is another DPR6 host county that
could accept the funds and complete the paperwork in a shorter timeframe. Is this something that Harnett County could
assist us with?
I did also talk to Bryan Phillips in Moore and he suggested you guys since rumor has it that you have a great history of
turning things quickly!

I. PARTIES. The parties to this Memo randum of Understanding/ Agreement (hereinafter
referred to a s "MOA., or "Agreement") are the State of North Carolina, Department o f
Public Safety, North Carolina Emergency Management, the North Carolina Highway
Patrol and Harnett County.
II. AUTHORITY. This Agreement is authorized under the provisions of: 1) Public Law
112-74, The Department of Homeland Security Appropriations Act, 2 014 (Pub. L. No.
113-76); 'D1e 9/11 Commission Act of2007; 3) Public Law 107-5 6 , (6 U.S.C . § 101 eL

procedure s to im plement the terms of the U.S. Department of Homeland Security

This Agreement is to set fonh tenns by which the State of North Carolina, Department
ofPublic Safety, Nonh Carolina Emergency Management (Grantee), shall provide FY
2014 Homeland Security Grant funding to Harnett County (Sub-Grantee) to purchase
Interoperable Communications Equipment that will enable NCSHP to prevent, protect
against, respond to , mitigate, and recover from potential acts of terrorism and other
ha7..ardous or catastrophic events.
IV. BACKGROUND. The Department of Homeland Security (DHS), through the
Federal Emergency Management Agency (FEMA) GranlS Program Directorate, in
a ccordance with the authorities listed herein, created the FY2014 Homeland Security
Grant Program, FOA Number DHS-14-GPD-067-000-01. This program was
established to implement objecti ves addressed in a seri es of post-9/l l laws, strategy
documents, plans, and presidential policy directives, including Presidential Pol1cy
Directive-S (PPD-8) and the National Preparedness Goal (NPG), copies of which are

The State of North Carolina, Department of Public Safety Nonh Carolina Emergency
Management, as tbe designated State Administrative Agency (SAA) to administer
funds under the U.S. Department of Homeland Security, FEMA Grants Program, and
Harnett County have the common purpose to prevent, deter, respond to, and recover
from threats and incidents of terrorism and ensure the safety and security of our
homeland.
On September l, 2014: the United States Department of Homeland Security issued
grant number 2014-SS-00069-SOl to the State of North Carolina, Department of Public
Safety, North Carolina Emergency Management (Grantee). Grantee is mandated to
allocate at least 80% of the total amount of the grant to local units of government or
combinations oflocal units, <md may retain some or all of the local units· allocation of
grant funds for expenditures made by the State on behalf of the local units of
government, provided that the local units of government g.ive written consent
specifying the amount of funds to be retained and the intended use of funds, and
provided that the parties enter into a memorandum of understanding.
The N .C. State Highway Patrol (NCSHP) is the agency responsible for creating the
infrastructure and managing the Voice Interoperability Plan for Emergency
Responders (VIPER). Harnett County (Sub-grantee) desires for NCSHP to purchase
interoperable communications equipment on its behalf, with its allocation of One
Hundred Twenty-eight Thousand, Five Huodrc...-d Sixty-two Dollars and Eighty
cents ($128,562.80) in HSGP funds.
The Grantee and NCSHP enter into an arrangement by which the Grantee will provide
Federal reimbursement funding to the NCSHP for the purchase of Interoperable
Communications Equipment.

V. RESPONSIBILITIES.
a. TI1e State ofl\orth Carolina. Department of Public Safety, North Carolina
Emergency Management shall:
(1) Purposes of plunning, training, exercise or equipment on the At1aclunent
I. on behalf and for the benefit of Barnett County.
(2) Conduct periodic monitoring vis it s to the NCSHP to maintain grant
comp liance.
(3)The perfonnancc period for the award to the State ofNorth Carolina,
Department of Public Safety, North Carolina Emergency Management,
ends on February 28 ,2016. Funds allocated for the procurement of
equipment must be encumbered and invoices dated on or prior to
February 28,2016.
(4) Reserves the right to de-ohligate any remaining award f unds after this
agreement 's expiration date, or before the expiration date of this
agrecmem should the sub-grantee violate the terms of this agreement or
should it become apparent that the sub-grantee will not be able to expend
the funds prior to the expiration date of this agreement. Before taking
action, the Grantee will provide the Sub-grantee reasonable notice of
intent to impose corrective measures and will make every effort to
resolve the problem informally.
b. The North Carolina State Highway Patrol shall:
{!)Expend FY 2014 Homeland Security Grant Program funds in accordance
with the applicable FY 20 14 Homeland Security Grant Program (HSGP)
Fundi ng Opportunity Announcement (FOA). the Grant Application Package,
and the Grant Award and Special Conditions docwnents, incorporated by
reference herein, of this MOA for the purchase of Interoperable
Communicati ons Equipment and the enhancement of all hazard preparedness.
(2) Utilize State of North Carolina and/or local procurement policies and
procedures for the purposes of planning, training, exercise or equipment (See
Attachment A for scope of work incorporated by reference herein) and
conform to applicable State and Federal law and the standards identified in
the Procurement Standards Sections of 44 Code of Federal Regulations
(CFR) Part 13 and 2 CFR Part 215. NCSHP must follow procurement
procedures and policies as outlined in the applicable FY 2014 Homeland
Security Grant Program (HSGP) Funding Opportunity Announcement (FOA)
and the USDHS Financial Management Guide. NCSHP shall comply with all
applicable laws, regulations and program gujdance. NCSI lP must comply
with the most recent version of the Administrative Requirements, Cost
Principles, and Audit requirements. Administrative and procurement

practices must confom1 to applicable federal requirements. A non-exclusive
list of regulations commonly applicable to DHS grants are listed below,
codified in the following guidance: 44 CFR Part 13 ; 2 CFR 215; 2 CFR Parts
225,220, and 230 (formerly OMB Circulars A-87. A2l and A-122); Federal
Acquisition Regulations (FAR), Part 31.2; and OMB Circular A-133 "Audits
of States, Local Governments, and Non-Profit Organizations"; 28 CFR Part
23 •·criminallntelligenee Systems Operating Policies"; 49 CFR Part 1520
"Sensitive Security Information"; Public Law 107-296, The Critical
Infrastructure Act of2002; Title VI of the Civil Rights Act of 1964, as
amended , 42 U.S .C . 2000 cL seq.; Title IX of the Education Amendments of
1972, as amended, 20 U.S.C. 168 I et. seq; Section 504 of the Rehabilitatjon
Act of 1973, as amended , 29 U.S .C. 794; The Age Discrimination Act of
1975, as amended, 20 U.S.C. 6101 eL seq.; Certifications and Assurances
regarding Lobbying 3 1 U.S.C. 1352, Drug-free Workplace Act, as amended,
41 U.S.C. 701 et. seq. and Certification Regarding Drug-Free Workplace
Requirements, Debarment and Suspension Executive Orders 12549 and
12{;89 and 44 CFR Part 17 and Certification Regarding Dcbarmenl,
Suspension and Other Responsibility Matters; Assurances as listed in SF
4248 and SF 424D; and Grant Award and Special Conditions documents.
(3) Submit invoice(s) requesting reimbursement for item(s) received to the
NCEM Homeland Security grants manager. Grantee will reimburse NCSHP
for eligible costs as outlined in the applicable USDHS Program Guidelines
and Funding Opportunity Announcements. NCSHP must take possession of
all purchased equipment and receive any grant-eligible service prior to
seeking reimbursement from the grantee. S u bgran tcc m u st subm it request

(4) Complete the procurement (s) process not later than August 31 ,2016.
(5) Provide quarterly progress reports to the NCEM Homeland Security grants
manager as described in Attachment 2 by the following dat es: 15 January, 15
April , 15 July, and 15 October.
(6) Provide inventory list at project completion phase to the Homeland Security
grants manager listing all equipment purchased through the grant.
(7) Comply with the applicable federal statutes, regulations, policies, guidelines
and requirements, reporting requirements and certifications as outlined in the
applicable 2014 Homeland Security Grant Program (HSGP) Funding
Opportunity Armouneement (FOA) and the USDHS Financial Management
Guide and Special Conditions documents and FEMA Grant Programs
Directorate Information Bulletins. As required in the FY 2014 Homeland
Security Grant Program (HSGP) Funding Opportunity Announcement (FOA)
and FEMA Grant Programs Directorate Information Bulletin No . 388 dated
July 18, 2012, NCSHP must report all g rant-funded equipment that supports
defined resource typed capabilities and all training that supports a defined
resource typed team using the fields in the FY 2014 Grant-Funded Typed
Resource Report. The link to thi s instrument and a completed example of this
report as well as all options available in the drop-down boxes can be found

on Attachment 3 of this document. This reporting will include both NIMS
typed resources and State and local typed resources. The description and

NCSHP will specify the number of resources, capability supported,
whether it is a NIMS or State/local typed resource, the cost, and whether
the resource sustains current capabilities or adds new capabilities. The
resources should he reponed only after equipment is deli vered or after
training has occurred and the corresponding grant funds have been
expended. The i'JCSHP wil1 include this Typed Resource Report with
each cost report submitted for reimbursement.
(8 ) Maintain grant management filing system as required in Attaclunent 4 .
(9) Retain all original records pertinent to this MOA for a period of five years
following the date ofthe closure of the gram award. or audit if required. or
longer where required by law. However, if litigation. claim or audit has been
initiated p ri o r to the expiration of the five-year period and extends beyond the
five year period, the records s hall be retained until all litigation, claims or
audit findings involving the records have been resolved.
( 1 0) Comply with c.urrem federal suspension and debarment regulations pursuant
to OMB Circ ular A-133 which states in pertinent part that ''[e]ffcctivc
November 26. 2003, when a non-federal entity enters into a covered
transaction with an entit y at a lower t ier, the non-federal entity must verify
tJ1at the entity is not suspended or debarred or otherwise excluded. NCSHP
shall be responsible to ensure that it has checked the federal Excluded Parties
List System (EPLS) to verify that contractors or sub-recipients have not been
suspended or debarred from doing business wi th the federal government.''
( 11) Ensure that FY 2014 HSGP funds are not used to support the hlring of any
personnel for the purposes of fulfilling traditional public safety duties or to
s upplant traditional public safety positions and responsibilities.
(12) Non-supplanting Requirement. Federal grant funds will be used to
supplement existing funds, and will not replace (supplant) funds that have
been appropriated for the same purpose.
( 13) All materials publicizing or resulting from award activities shall contain this
acknowledgement: ''This project was supported by a Federal award from
the US Department of Homeland Security, Office of Grams and Training
and rhe North Carolina Deparrment of Public Safety, North Carolina
Emergency Management . "
Use of the federal program logo must be approved by DHS. Printed as a
legend, either below or beside the logo shall be the '''-'Ords "1 00 percent
Funded by U.S Department of Homeland Security."
(14) NCSHP shall order, receive, inspect, and stage the equipment and supplies .
The purchase or acquisition of any additional materials, equipment,

accessories or supplies beyond those identified in this MOA shall be the sole
responsibility ofNCSHP and shall not be reimbursed under this MOA.
NCSHP shall prominently mark any equipment purchased with grant funding
as follows: "Pw·chased withfund'i provided by the U.S Department of
Homeland Security .. ,
(15) NCSHP shall maintain exclusive custody, care and control oftbe Safer
Schools equipment and shall have sole decision-making authority as to its
maintenance, operation and use .
(16) NCSI IP shall have sole responsibility for the maintenance, insurance, upkeep,
and replacement of the Safer Schools infrastructure equipment procured
pursuant to this Agreement
( 17) NCSHP shall maintain an effective property management system that complies
with the following requirements. Equipment is defined as tangible, non-
expendable property having a useful life of more than one year and an
acquisition cost of$5.000 or more per unit. NCSIIP may have property
management guidelines that are more restrictive, requiring a unit of
equipment with a value of less than $5,000 to be inventoried; if so, such
equipment purchased under this award allocation shall be included in the
reports submitted to Grantee.
a) Grantee and NCSHP shall take a physical inventory of the
equipment. The NCSHP Equipment Inventory Report, Cost
Reports with backup documentation, Certificate of Title, Site
Visit Report and any other NCSHP reports or inventory reports
that include infonnation regarding the grant, vendor, invoice
number, cost per item, number of items, description, location,
condition and identification number may be used to meet this
requirement NCSHP must provide Quarterly Progress Reports
until all funds are expended.
b) NCSHP must ensure adequate safeguards to prevent loss,
damage or theft. NCSHP shall be responsible for replacing or
repairing equipment which is willfully or negligently lost,
stolen, damaged, or destroyed. Any loss, damage or theft of the
property must be investigated and fully documented, and made
pan of the official project records .
c) l\CSHP must ensure adequate maintenance procedures exist to
keep the equipment in good condition.
d) Disposition Procedures. NCSHP may dispose of the equipment
when the original or replacement equipment acquired under the
grant award is no longer needed for the original project or
program. Items with a fair market value of less tGhan $5,000
may be retained , transferred or otherwise disposed of with prior
approval of Grantee and in accordance with applicable program
requirMAents. Items with a current per unit standard federal or

fair market value in excess of S5,000 may be retained,
transferred or otherwise disposed of with prior Grantee approval
in accordance with disposition requirements in 44 C.F .R . Part
I 3 . NCSHP must provide documentation that includes the
method used to determine current fair market value.
( 18 ) The purchase or acquisition of any additional materials, equipment,
accessories or supplies, or the provision of any training or exercise beyond
that identified in this MOA shall be the sole responsibility of>JCSHP and
shall not be reimbursed under this MOA.
( 19) No indirect or administrative costs will be charged to this allocation award.
(20) NCSHPs must utilize equipment as intended in the project proposal form
/pr oject detail workbook submitted to NCE:vt-HLS . Any variation from this
intended usc must be requ ested in writing and approved by NCEM-HLS
office _
(21 ) Each Sub-grdl1 tee must have a DLT'J'\S Nwnbcr, prior to any funds being

(22) System for Award ~1anagement (SAM) registration is requi red for all
applicants_ Each Sub-grantee shall ensure that your organization's name,
address, DLl\S number and EIN are up to date in SAM and that the DUNS
number used in SAM is the same one used to apply for all FE!\11\ awards.

that the information is correct.
Harnett County (Sub-grantee) agrees that :
( l) The purchase or acquisition of any additional materials, equipment,
accessories or supplies, or the provision of any training or exercise
beyond that identified in this MOA shall be the sole responsibility of
Sub-grantee and shall not be reimbursed under this MOA.
(2) NCSHP s hall have exclusive custody, care and control of the VIPER
equipment and shall have sole decision-making authority as to its
maintenance, operation and use. NCSHP's decision-making authority
shall include, but is not limited to, the authority t o approve any and all
modifications, additions, deletions, or right of access r elated to the
VrPER s ite.
VI. FliNDING AND COMPEI'iSATION. Grantee will reimburse NCSJ lP for the actual
eligible costs incurred for the subject of this grant, not to exceed $128,562.80 (One

VTI. WARRANTY. Harnett County shal l hold Grantee and I"CSHP hannless for any
liability and personal injury that may occur from or in connection \'Vith the performance
of this MOA to the extent pennitted by the North Carolina Tort C laims Act. The parties
agree that this Limitation of Liability shall not be construed as a waiver of sovereign
immunity by either party. Tins Agreement does not give any person or entity other
than the parties hereto any legal or equitable claim, right or remedy. This Agreement is
intended for the sole and exclusive benefit of the parties hereto. This Agreement is not
made for the benefit of any third person or persons. No third party may enforce any
part of this Agreement or shall have any rights hereunder. This Agreement does not
create, and shall not be construed as creating, any rights enforceable by any person not
a party to this Agreement.
VUI. COMMUNICATIONS AN)) POINTS OF CONTACT
To provide consistent and cflectivc communication between the ~CSHP and the
Department of Public Safety, Nortb Carolina Emergency Management, each party shall
appoint a Principal Representative(s) to serve as its central point of contact responsible
for coordinating and implementing this MOA. Grantee contacts s hall be Michael A.
Sprayberry, Director; Michael Daniska, Chief, Plaru1ing and Homeland Security
Section and Pany Moyer, Grant Manager. The NCSHP signatory shall be James Blank,
Captain, NCSHP. The point of contact shall be Tanya Luter, Project Manager, for
NCSIIP.
All confidential information of either party disclosed to the other party in connection
wi th the services provided hereunder will be treated by the receiving party as
confidential and restricted in i1s use to only those uses contemplated by the terms of
this MOA. Any information to be treated as confidential must be clearly marked as
confidential prior to transmittal to the other party. Neither party shall disclose to third
parties, the other party's confidential infom1ation wi thout written authorization to do
so from the other party. Specifically excluded from such confidential treatment shall
be information that: (i) as ofthe date of disclosure andlor delivery, is already knov.-11
to the party receiving such information; (ii) is o r becomes part of the public domain
through no fault of the receiving party; (iii) is lawfully disclosed to the receiving party
by a third pt:~rty who b not obligated to retain such information in confidence; or (iv)
is independently developed at the receiving party by someone not privy to the
confidential information. In accordance with the FY 2014 Homeland Security Grant

Program (HSGP) funding Opportunity Announcement {FOA), "FEMA recognizes
t11at much of the information submitted in the course of applying for funding under
this program. or provided in the course of its grant management activities, may be
considered law enforcement sensitive or otherwise important to national security
interest s. While this information under Federal control is subject to rcqueslc; made
pursuant to the Freedom of Information Act (FOIA ), 5 U .S.C. §552 ct. seq .. all
determinations concerning the release of information of this nature are made on a
case-by-case basis by the FEMA FOIA Office. The Grantee and NCOJ should be
famillar v:itl1 the regulations governing Sensitive Security Information (49 CFR Part
l 520). as it may providl! additional protection to certain classes of homeland security
information ."
IX. SL'BCONTRACTli\'G. lfthe NCSHP subcontracts any or all purchases required
under this Agreement., ~CSHP agrees to include in the subcontract that the
subcomractor is bound by the terms and conditions of this MOA. NCSHP agrees to
include in the subcontract that the subcontractor shall hold Grantee hannless against all
claims of whatever nature arising out of the subcontractor's performance of work
under this MOA. If NCSHP subcontracts, a copy ofthc executed subcontract
agreement must be forwarded to the North Carolina Emergency Management.
Contractual arrangement shall in no way relieve NCSJIP of its responsibilities to
ensure that all funds issued pursuant to this grant be administered in accordance with all
state and federal requirements. NCSHP is bound by the terms , conditions and
restrictions of the applicable USDHS Program Guidelines and Funding Opportunity
1\.nnouncement referenced herein.
X. SITliS. This Agreement sha!J be governed by the laws ofNorth Carolina, and venue
for any disputed maners or claims shall be in the Superior Court ofHamett County,
.:--Jorth Carolina.
X.l. Al':TITRUST LAWS. This Agreement is entered into in compliance with all State
and Federal antitrust laws.
XII. COMPLIANCE WITH THE LAW. 1'\CSHP shall be wholly responsible for the
purchases to be made under this MOA and for the supervision o f its employees and
assistants. NCSHP shall be responsible for compliance with all laws, ordinances. codes .
rules, regulations, licensing requirements and other regulatol)' matters that are
applicable to the conduct of its business and purchase requirements performed under
this MOA, including those of federal requirements and State and local agencies having
appropriate jurisdiction and found in the FY 2014 Homeland Security Grant Program
(HSGP) Funding Opportunity Announcement (FOA).

Xlll. OTHER PROVISIO~S/SEVERABILITY Nothing in thj s Agreement is intended
to conflict with current laws or regulations of the State ofNorth Carolina, Department
of Public Safety Tbe N.C. Highway Patrol or Harnett County. If any term of thi s
Agreement is found by any court or other legal authority, or is agreed by the parties to
be in conOict witb any law or regulation governing its subject, tbc conflicting tem1
shall be considered null and void. Tbe remaining tenns and conditions of this
Agreement shall remain in full force and effect.
XIV . ENTIRE AGREEMENT. This Agreement and any exhibits and amendments
annexed hereto and any documents incorporated specificaUy by reference represtnt the
entire agreement between the parties and supersede all prior oral and wrincn statements
or agreements.
XV. MODIFICATION. Modifications of this agreement must be in \\Tiling and upon
approval of botl1 parties except as modified by official USDHS Federal Grant
Adjustment Notice (GA. 'f).
XVI. PROPERTY. The ~CSHP shall be responsible for the custody and care of any
propeny purchased with FY 2014 Homeland Security GratJl Progmm (HSGP) fund!>
and furnished for use in connection with the performance of this agreement and shall
reimburse the Grantee for any loss or damage to said property until the property is
disposed of in accordance with FY 2014 Homeland Security Grant Program
requirements. Grantee will not be held responsible for any property purchased under
this MOU. Title to the property purchased with FY 2014 HSGP funds shall be in 1he
State ofNortb Carolina, Department of Public Safety, NCSHP and Ilamctt County.
XVII. TERl\1l::'lATIO~. The terms of this agreement. as modified with the consent of all
parties. will remain in effect until August 31,2016. Either party may terminate this
Agreement upon thirty (30) days advance written notice to the other party.
Upon approval by USDHS, FEMA and the issuance of the Grant Adjustment Notice, if
this MOA is extended, the termination date for the extension will be the date listed in
the applicable USDHS Grant Adjustment Notice, incorporated by reference herein, or
as established by the State Administrative Agency, whichever is sooner.
IfNCSHP materially fails lo comply with the terms of the award and DHS or Grantee
suspends or terminates the grant award in accordance \lJith 44 C.F.R., the applicable FY
2014 Homeland Security Grant Program (HSGP) Funding Opportunity Announcement
(FOA) and other applicable authorities, incorporated by reference herein, NCSHP shall
reimburse the North Carolina Emergency Management for said property.
XVUJ. EXECVTION AND EFFECTIVE DATE. This Agreement will become binding
upon execution of all panies to the Agreement. The tenns ofthis Agreement became
effective on September 1, 2014. The last signature shall be that off'rank L. Perry,
Secretary, and North Carolina Department of Public Safety.
XIX. TERM OF THIS AGREEMENT. This Agreement shall be in effect from
September 1, 2014 LO August31, 2016.

Re: Staff recommendations for Re-Bids
Public Buildings recently posted Service Contract Requests for Proposals on the Harnett County
website for vendors who are in the business of performing fire extinguisher maintenance
services, pest control service and HV AC maintenance and service.
Pu b lic Buildings reco mmends the fire extinguisher services contract be awarded to A ll ied Fire &
Safety. There were two bids submitted: All American Fire Pro tection was non-resp onsive wi t h
their 3 year price.
The total proposed contract price for fire extinguisher services is as follows :

TO CONVEY PROPOERTY
This Letter of Intent is hereby submitted to verify the intentions ofTimothy W . Henson and Brenda
L. Henson (hereinafter referred to as '"Property Owners .. ) to convey ownership of the Real and/or
Personal Property currently located at 60 Gladiola Drive Spring Lake, NC to the County of Harnett,
North Carolina, (hereinafter referred to as "County .. ).
WHEREAS, Property located at 60 Gladiola Drive, also identified a s Harnett County Parcel ID
Number (01-0514-0512) located in the Anderson Creek Township of Harnett County, currently
contains a single family dwelling that has been condemned.
WHEREAS, The residential structure has suffered severe fire damage rendering the dwelling
uninhabitable. The current condition of the structure poses a risk to the public health and safet y
as well as the general welfare of the community in which it is located.
WHEREAS , Property owners acknowledge receipt of proper notification and hereby waive the
right to appeal any actions ordered to render compliance. Compliance actions required to render
compliance include the proper repair of the structure which would allow for occupancy or the
proper demolition and disposal of all debris.
NOW THEREFORE , In order to remove the property owners from any responsibility or liability
to take compliance actions . The property owners hereby express the interest in conveying the real
and/or personal property located at 60 Gladiola Drive to the County of Harnett. The property
owners acknowledge and agree that if the County decides to accept the conveyance of this real and
l or personal property that said conveyance must be of a fee simple title, free and clear of all
encumbrances except for those encumbrances specifically acceptable to the County.
