HARNETT COUNTY BOARD OF COMMISSIONERS
Minutes of Regular Meeting
September 3, 2002
The Harnett County Board of Commissioners met in regular session on Monday,
September 3, 2002, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 9:00 a.m. and Commissioner Titchener
led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with the additions listed
below. Commissioner Titchener seconded the motion and it passed unanimously.
Add to consent agenda:
- Resolution regarding Pledge of Allegiance
- Agreement for cleaning service for Child Care and Referral office space
- Resolution congratulating Kay Blanchard on designation as certified clerk
Add to regular agenda: public hearing regarding closing portion of a road.
Upon motion by Commissioner McNeill and seconded by Commissioner Andrews,
the Board unanimously approved the following items on the consent agenda:

11. Resolution regarding the Pledge of Allegiance (Attachment 6)
for the Child Care Resource & Referral and Parents as Teachers' office space,
located at 1901 North Main Street, Suites A & B, Lillington, NC. The term of
the contract shall be one year, beginning September 1, 2002 and ending
August 31, 2003.
13. Resolution congratulating Kay Blanchard on designation as certified clerk •
(Attachment 7)
Chairman Byrd read and presented the resolution of congratulations to Kay Blanchard
on her designation as certified clerk.
Jennifer Walker, Cooperative Extension Director, introduced Kenny Bailey, new
commercial horticulture agent. Mr. Bailey told the group that his background
and expertise is as a vegetable specialist in the commercial nursery field.
Chairman Byrd called to order a public hearing on the intent to close a portion of SR
1207. Neil Emory, County Manager, noted that the reason for the closing of this
public road is that it has been abandoned by the North Carolina Department of
Transportation and deleted from the state highway system as a part of the
improvements being made to NC Highway 87 and its intersecting roads.
Chairman Byrd opened the meeting for comments from the public. No comments
were offered and Chairman Byrd closed the public hearing. Commissioner McNeill
moved to approve closing of the abandoned portion of SR 1207 (Seawell Rosser
Road). Commissioner Hill seconded the motion and it passed unanimously.
Lynwood Rains, Judicial District Manager, NC Department of Correction, presented
the Judicial District 11 Annual Report. •
Patt Crissman, The Wooten Company, noted that prior to spending an FY 02 CDBG
Scattered Site Housing Program grant funds, the Board of Commissioners must adopt
a grant project ordinance to confirm and authorize the expenditure of grant funds on
the project activities approved in the grant. Commissioner Hill moved to adopt the
grant project ordinance as presented. Commissioner McNeill seconded the motion
and it passed unanimously. (Attachment 8)
Ms. Crissman noted that the Program Initiation Manual for the FY 02 CDBG
Scattered Site Housing Program must also be adopted by the Board prior to grant
expenditures. Commissioner McNeill moved to adopt the Program Initiation Manual
as presented. Commissioner Andrews seconded the motion and it passed
unanimously. (Attachment 9)
George Jackson, Planning Director, reported that the Planning Department has
received a Flood Mitigation Assistance Grant from F.E.M.A. This $20,000 grant will
be used to develop and promote hazard mitigation planning within the County. There
is a requirement to designate someone to act as the applicant's agent. Also, the grant
requires the County to provide a match of $5,000 of which $2,500 can be "in kind"
services and the remaining $2,500 must be a cash match. The Hazard Mitigation Plan,
which is required, will be of assistance to agencies throughout the County. •
Commissioner Andrews moved to adopt a resolution designating George Jackson as
the County's agent. Commissioner Titchener seconded the motion and it passed
unanimously. (Attachment 10)
Commissioner Hill moved to authorize expenditure of $2,500 from professional
services as the County's cash match for the grant proceeds. Commissioner Andrews
seconded the motion and it passed unanimously.
Wm. A. (Tony) Wilder, Assistant County Manager, presented a proposed land
lease agreement with Blu Sky, Inc., which would allow construction of a 100' x 80'
hangar at the Harnett County Airport. Commissioner Titchener moved to approve the
proposed agreement pending approval by the County Attorney. Commissioner
McNeill seconded the motion and it passed unanimously.
Departmental reports were filed with the Board from the Sheriff's Department and
Emergency Medical Service.
Neil Emory, County Manager, noted that concerned Harnett County citizens will again
participate in the statewide North Carolina Big Sweep on Saturday, September 21,
2002. Last year during North Carolina Big Sweep, 32 volunteers collected 1540
• pounds of trash from 4 sites along our waterways throughout Harnett County.
Commissioner McNeill moved to waive the tipping fee for trash collected by the
volunteers. Commissioner Hill seconded the motion and it passed unanimously.
Gary Pope, Emergency Management Director, announced that a 9/11 Remembrance
Service will be held in coordination with the Harnett County Fire Chief s Association.
The program will begin at 9:45 a.m., Wednesday, September 11, 2002 near the flag
pole at the Governmental Complex in Lillington.
Sherre Toler, Board of Elections Director, presented an update from the Board of
Elections regarding the upcoming election. Ms. Toler noted that additional poll
workers are needed. Commissioner McNeill moved to allow any County employee
who volunteers to assist the Board of Elections staff on election day to do so without
having to use leave time, and for the employee to be compensated by the Board of
Elections in addition to their regular pay. Commissioner Andrews seconded the
motion and it passed unanimously.
There being no further business, Commissioner Hill moved for adjournment.

PROCLAMATION
Always Remember 9-11 Day
WHEREAS, in an unprovoked and senseless act of terrorism, four civilian aircraft were
hijacked on September 11, 2001, and crashed in New York City, Pennsylvania and the
Pentagon; and
WHEREAS, innocent U.S. citizens of all heritages as well as visiting citizens of foreign
nations were killed and injured as a result of these horrific acts; and
WHEREAS, while we as a Union still continue to recover from the unspeakable loss of
• so many innocent lives, the indomitable spirit of the United States has been revitalized and
given way to numerous expressions of heroism and patriotism; and
WHEREAS, Harnett County shares in the grief and will commemorate the one-year
anniversary of the September 11 tragedies.
NOW, THEREFORE, BE IT RESOLVED, that the Harnett County Board of
Commissioners extends our deepest condolences to the innocent victims of these unprovoked
actions by terrorists, as well as to their families and their friends; that we salute the heroism of
public safety and rescue workers, volunteers, local officials, and those who responded to these
tragic events with courage, selfless compassion, determination, and skill; and be it further
RESOLVED, that we dedicate September 11, 2002, ALWAYS REMEMBER 9-11 DAY,
a day to mourn, reflect and rededicate ourselves to ending terrorism in commemoration of the
anniversary of the terrorist attacks.

NORTH CAROLINA
CONTRACT AND AGREEMENT

THIS AGREEMENT is entered into as of the 294h day of August, 2002, between the •
TOWN OF LILLINGTON, a municipal corporation organized and existing under the laws of the
State of North Carolina, (hereinafter sometimes referred to as "Town"), and the COUNTY OF
HARNETT, a body politic organized and existing under the laws of the State of North Carolina
(hereinafter sometimes referred to as the "County").
WITNESSETH:
WHEREAS, the County and the Town made joint application for economic development
administration grants in the amount of $250,000.00 for the upgrade of the waste water treatment
plant that was conveyed to the County in the year 2000;
WHEREAS, the County and the Town have made additional applications for North Carolina
Clean Water Bond fund grants and loans in the amount of $2,001,000.00 of which $1,334,000.00 is
in the form of a grant and $667,000.00 is in the form of a loan.
WHEREAS, the above referenced loan and grants have been awarded for the purpose of the
waste water treatment plant upgrades and the establishment of the Harnett County regional waste
water collection and treatment facility;
WHEREAS, the County has the sole obligation to repay the loan amount plus interest, and
the Town has no obligation or responsibility for repayment of any sums in connection with the loan •
or grants.
WHEREAS, the Economic Development Administration funds are to be paid to the Town
of Lillington, pursuant to payment requests (ED form #113) as prepared by Skip Green and
Associates;
WHEREAS, the County of Harnett shall provide project administration as it relates to
construction and shall be the lead agency as it relates to completion of the project;
WHEREAS, funding of the project requires cooperation between the parties as it relates to
joining requests for drafts, receiving and disbursing funds for construction of both phases of the
project (Economic Development Administration funds for the waste water treatment plant upgrades
and state funds for construction of the regional sewer system); and
WHEREAS, the County shall be the contract administrator and project administrator for all
the North Carolina Clean Water Bond funds.
THEREFORE, THE PARTIES AGREE AS FOLLOWS:
ECONOMIC DEVELOPMENT ADMINISTRATION FUNDS
1. The Town shall receive payment requests (ED form #113) submitted by Skip Green and
Associates, along with supporting documentation, and forward the same to the Harnett •
County Director of Public Utilities. The County shall ascertain that said request is accurate.
The County Manager shall sign all payment requests prior to transmittal to Economic
Development Administration officials.
2. After the County has checked the accuracy of the payment request and the County Manager
has signed it, the Town, acting in good faith, will certify said payment request, with the Town
Manager executing these documents and forwarding the same to the Economic Development
Administration office as provided in the pay request and forward the same to the Director of
Harnett County Public Utilities.
The Town shall open a bank account for the purpose of receiving funds by electronic transfer
from the Economic Development Administration. Upon receipt of said funds the Town shall
in good faith issue a check to the County in the amount deposited by the Economic
Development Administration in the Town's bank account.
4. The Town shall execute construction agreements which have been accepted by the County
from T.A. Loving, in the amount of $996,500.00 for filter construction which is attached
• hereto and labeled Exhibit "A", and a contract by AAA Electrical Company, Inc., in the
amount of $28,895.00 which is attached hereto and labeled Exhibit `B".
5. The County shall receive the funds transferred from the Town in order to pay the invoices
submitted for completed portions of the project. The County shall be responsible for the
proper distribution of all such funds.
NORTH CAROLINA CLEAN WATER BOND FUNDING
1. The County shall be the contract and project administrator for the North Carolina Clean
Water Bond funds, and shall prepare all payment applications and requests for drafts requiring
the participation of the Town and present the Town with documentation to substantiate any
applications for payment requests or drafts. The County shall be responsible for the accuracy
of all such applications and documentation.
2. The Town shall in good faith execute said requests upon receipt from the County and forward
the same to the Division of Water Quality.
3. Upon receipt offunds provided to the Town pursuant to payment applications, the Town shall
isin good faith issue a check to the County in the same amount as received.
4. The County shall receive the funds transferred from the Town in order to pay for completed
portions of the regional sewer project. The County shall bear the responsibility for proper
distribution of such funds.
5. The Town shall in good faith execute construction contracts as required by the North
Carolina Division of Water Quality in order to complete the regional waste water collection
system.
INDEMNITY AGREEMENT
The County will indemnify the Town and hold it harmless from any and all liability, losses,
damages, costs, interest, penalties or attorney fees in any way arising out of or related to the
responsibilities undertaken by the Town under this Agreement, or in any way arising out of or related
to the expenditure of Economic Development Administration or North Carolina Clean Water Bond
funds or loans, the performance of contracts involving the expenditure of such funds or loans or the
ownership or operation ofthe Harnett County Regional waste water collection and treatment system.

The Pledge of Allegiance
WHEREAS, the United States Court of Appeals for the Ninth Circuit has ruled
that inclusion of the phrase "under God" in the Pledge of Allegiance constitutes a
violation of the First Amendment of the United States Constitution; and
and WHEREAS, this decision has been appealed to the United States Supreme Court;
WHEREAS, the phrase "under God" has been a part of the Pledge of Allegiance
by Act of congress a half century ago; and
WHEREAS, inclusion of the phrase "under God" in the pledge of Allegiance
represents a unifying belief in the Almighty and the hope that we continue to stand as
"one nation, under God" without requiring observance of any specific denomination or
set of religious beliefs.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners hereby expresses support for efforts undertaken in Federal Courts and in
Congress to assure that the phrase "under God" remains a part of our Nation's Pledge of
Allegiance.

WHEREAS, Kay S. Blanchard now serves the citizens of Harnett County and the
Board of Commissioners as Clerk to the Board; and
WHEREAS, in recognition of the professionalism and dedication she brings to the
position, she has been awarded the designation of Certified Municipal Clerk from the
International Institute of Municipal Clerks; and
WHEREAS, this designation comes as the result of Ms. Blanchard's service and
experience as well as her participation in numerous educational opportunities recognized
by the International Institute of Municipal Clerks and conducted in conjunction with the

SCATTERED SITE HOUSING PROJECT
GRANT PROJECT ORDINANCE
•
Be it ordained by the Board of Commissioners of Harnett County that, pursuant to
Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following
Grant Project Ordinance is hereby adopted:
Section 1. The project authorized is the Community Development Project described in
the work statement contained in the Grant Agreement 02-C-0955 between Harnett
County and the North Carolina Department of Commerce. This project is more familiarly
known as the Harnett County Scattered Site Housing Project.
Section 2. The officers of this unit are hereby directed to proceed with the grant project
within the terms of the grant document(s), the rules and regulations of the North Carolina
Department of Commerce and the budget contained herein.
Section 3. The following revenues are anticipated to be available to complete this
project:
Community Development Block Grant $ 400,000
Total $ 400,000
Section 4. The following amounts are appropriated for the project:
Rehabilitation of Privately Owned Dwellings $ 360,000
Administration $40,000
Total $400,000
Section 5. The Finance Officer is hereby directed to maintain within the Grant Project
Fund sufficient specific detailed accounting records to provide the accounting to the
grantor agency required by the Grant Agreement and Federal and State regulations.

Section 6. Funds will be requisitioned from the State after submission of documentation
to the County. Disbursement of funds will be made by the County upon actual receipt of
CDBG funds from the State. Compliance with all federal and state procurement
regulations is required.
Section 7. The Finance Officer is directed to report quarterly on the financial status of '
each project element in Section 4 and on the total grant revenues received or claimed.
Section 8. The Budget Officer is directed to include a detailed analysis of past and future
costs and revenues on this grant project in every budget submission made to this Board.
Section 9. Copies of this Grant Project Ordinance shall be made available to the Budget
Officer and the Finance Officer for direction in carrying out this project.
