HARNETT COUNTY BOARD OF COMMISSIONERS
Minutes of Regular Meeting
August 19, 2002
The Harnett County Board of Commissioners met in regular session on Monday,
August 19, 2002, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Andrews
led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with the addition of a
proposed resolution endorsing the request for a segment of Hwy. 82, which passes
through Averasboro Battlefield, be designated a "Scenic Byway". Commissioner
Andrews seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Hill, the
Board unanimously approved the following items on the consent agenda:

standard, which requires all 24 hour shift employees to be reclassified as listed

10. Resolution recognizing Mr. W.N. Porter (Attachment 5)
Chairman Byrd read and presented a resolution in memory of van driver, Melvin
Wright, Sr., to Mr. Wright's family members. Ralph Thurman, Transportation
Manager, shared thoughts about Mr. Wright with the group. The resolution adopted
July 15th recognized his contributions to the County by retiring both his Radio Call
Number 95 and his Vehicle number 7900.
Chairman Byrd read and presented Mr. W.N. Porter a resolution recognizing and
commending his service to others.
Informal comments were made by Carnell Robinson regarding redistricting.
Commissioner Titchener moved for the appointments listed below. Commissioner
Andrews seconded the motion and it passed unanimously.

Jerry Bullock re -appointed for a 3-year term to expire 09/01/05
nominated by Commissioner Andrews
Harnett County Board of Adjustment
Walter T. Weeks, Jr. re -appointed for a 3-year term to expire 09/01/05
nominated by Commissioner Byrd
Lee -Harnett Mental Health Board
Gail M.Weeks re -appointed for a 4-year term to expire 09/01/06
nominated by Commissioner McNeill
Harnett County Council for Women
Elsa Sears re -appointed for a 3-year term to expire 09/30/05
nominated by Commissioner Byrd
Lisa Munday, Kennis Creek Neighborhood Watch, and other Kennis Creek
subdivision residents voiced concerns and asked for assistance regarding crime in their
neighborhood, specifically noting problems from a mobile home park adjacent to their
subdivision. Others who spoke were: Melodie Scruggs, Randal Arnold, Bill Penner,
Jennie Rieldfeld, Glenda Strickland, Richard Pagan, and Chris Merkle. Joseph
Jeffries, Chief Planner, noted that a committee is being organized to study the current
Mobile Home Park Ordinance and suggest changes needed.
Chairman Byrd called to order a public hearing on a zoning change request for
applicant Lester Stancil & Associates; landowner: Robert J. Barker, from RA-30 to
Commercial -Business Zoning District, NC 210, Black River Township, 19.267 acres.

Mark Locklear, Planner, presented the zoning change request and stated that the
Planning Board recommended denial of the zoning change request. Chairman Byrd
opened the meeting for comments from the public. Comments were received from the
following citizens:

There being no further comments, Chairman Byrd closed the public hearing.
Commissioner Andrews moved to approve the zoning change request from RA-30 to
Commercial -Business. Commissioner McNeill seconded the motion and it passed
unanimously.
Chairman Byrd called to order a public hearing on four proposed Zoning Ordinance
text amendments. June Cowles, Planner, presented and reviewed the four proposed
text amendments Chairman Byrd opened the meeting for comments from the public
on all four issues. No comments were offered and Chairman Byrd closed the public
hearing. Commissioner Titchener moved to adopt the four amendments as presented.
Commissioner Hill seconded the motion and it passed unanimously. (Attachment 6)
Chairman Byrd called to order a public hearing on a proposed amendment to the
Subdivision Regulations regarding placement of fire hydrants. June Cowles, Planner,
presented and reviewed the proposed amendment. Chairman Byrd opened the
meeting for comments from the public. No comments were offered and Chairman
Byrd closed the public hearing. Commissioner Hill moved to adopt the amendment as
presented. Commissioner Andrews seconded the motion and it passed unanimously.

isWm. A. (Tony) Wilder, Assistant County Manager, reported to the Board that the
furniture contract for the new Courthouse was awarded to McThrift Furniture. An
inventory has been conducted of furniture currently being used by departments that.
will be moving into the new facility and new furniture needs have been determined.
Commissioner McNeill moved to approve purchase of the new furniture required.
Commissioner Andrews seconded the motion and it passed unanimously.

Departmental reports were filed with the Board from Economic Development, Animal
Control, and Fund Balance Changes (from General Fund). (Attachment 8)
Neil Emory, County Manager, presented a proposed resolution endorsing an attempt to
have the segment of Hwy. 82 that passes through Averasboro Battlefield designated by
the State as a "Scenic Byway". Commissioner Titchener moved to adopt the
resolution. Commissioner Andrews seconded the motion and it passed unanimously.

McClain -McCormick Family
WHEREAS, the quality of life the families of Harnett County enjoy today is due in large
part to the contributions and sacrifices of those who came before; and
WHEREAS, the McClain -McCormick Family Reunion serves as a celebration and
recognition of this family's forefathers; and
WHEREAS, this gathering also serves as a means by which current family members may
continue to build the ties which bind this family together today and into the future.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners does hereby recognize the McClain -McCormick family for its contributions to
Harnett County and does hereby wish it great success as it gathers for its first family reunion.

RESOLUTION
Whereas, the North Carolina General Statutes permits a county to convey real or
personal property to any nonprofit agency to which it is authorized by law to appropriate
funds; and
Whereas, Harnett County desires to transfer an ambulance, 1996 Ford truck,
(VIN 1FDJS34F2THB59750) to the Bunnlevel Fire Department.
Now, Therefore, Be It Resolved that the Harnett County Board of Commissioners
does hereby, in accordance with N.C.G.S. 160A-279 and G.S. 160A-267, authorize the
County Manager to proceed with the necessary steps to convey the above noted vehicle to
Bunnlevel Fire Department, Inc.

RESOLUTION
Mr. W. N. Porter
WHEREAS, Mr. W.N. Porter has long served the citizens of Harnett County throughout
his long and distinguished career; and
WHEREAS, Mr. Porter's service has long been noted due to his work in the field of
education as well as his commitment to social justice for all; and
WHEREAS, his service has led him to serve his community in a variety of capacities that
include Mayor Pro Tem of the Town of Erwin, Chairman of the Third District Black Leadership
Caucus and Chairman of Lee Harnett Mental Health Board; and
WHEREAS, his commitment to others has long been reflected by his service throughout
his career.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners does hereby recognize and commend Mr. Porter for his service to others and
does hereby thank him for his ongoing service as a member of the Lee -Harnett Mental Health
Board and for his recent service as Chairman of this organization.

WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July
18, 1988 and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of
the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A-340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those
• provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article VI of
the Zoning Ordinance and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article VI. Section 6.9 of the Zoning
Ordinance be amended by correcting the current numbering sequence;

Zoning Ordinance be amended by correcting the typo in the current reference section
which reads;

HARNETT COUNTY, NORTH CAROLINA that Article VI. Section 5.1 L 6. of the
Zoning Ordinance be amended by replacing the current text with the following;
6. The minimum lot size must be one (1) acre excluding any street right-of-way and the
minimum lot frontage must be 150 feet as measured at the right-of-way or along an
easement whichever applies except on the bulb of a cul-de-sac where a minimum of
40 feet at the right-of-way is acceptable.

A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE TEXT
WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July 18, 1988
and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of the county
residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of
North Carolina, particularly G.S. 153A-340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those provisions
have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article VI of the Zoning
Ordinance and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Article VI Section 4.11 b, 5.1 J b, 6.1 M b, 7.1 K b of the Zoning
Ordinance be amended by deleting the current tent and replacing with the following:
All swimming pools shall be completely surrounded by a fence or wall with a height of no less than five (5)
feet. The fence or wall shall be made of any suitable and durable material that is intended for a fence. The
fence or wall shall be designed so that a four and one-half inch (4.5") diameter sphere cannot pass through
any opening.
Ail gates and doors opening through such fence or wall shall have a self -closing and self -latching devices
which keeps the gate or door closed at all times; however, the door of any dwelling which furnishes part of
the enclosure need not be so equipped.
An aboveground pool wall, itself, may be used as the barrier if the pool structure is on grade and the wall
and structure are at least five (5) feet in height.
Where an aboveground pool structure is used as a barrier or where the barrier is mounted on the pool

structure, the ladder or steps shall be surrounded by a barrier which meets the above requirements.

A RESOLUTION AMENDING THE HARNETT COUNTY SUBDIVISION REGULATIONS
TEXT
WHEREAS, the Board of Commissioners of Harnett County adopted the Harnett County
Subdivision Regulations on April 7, 1977 for the purpose of promoting the health, safety, and
general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A-330; and
• WHEREAS, the Subdivision Regulations contains provisions for amending said ordinance and
those provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the proposed amendments to the
Harnett County Subdivision Regulations and recommends the adoption of the following
amendments.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article V Section 5.3.1.G.5 of the
Subdivision Ordinance be amended by deleting the current text which reads;
Fire hydrants shall be located in such a manner that no lot is further than five
hundred feet (500) from a hydrant.
and adding the following text:

5. In residential districts the maximum distance between hydrants, measured along
street centerlines, shall be five hundred (500) feet. There shall be at least one (1)
fire hydrant at each street intersection. When residential intersections are less
than seven hundred (700) feet apart, a hydrant is not required between the
intersections.

RESOLUTION
WHEREAS, Harnett County is committed to assisting in the preservation of
historic sites throughout our county; and
WHEREAS, Averasboro Battlefield is a significant site where preservation efforts
are currently underway; and
W14FREAS, the historic nature of the site draws visitors from across our state and
the nation.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners does hereby request that the State of North Carolina designate the 4.7
mile segment of NC Hwy 82 which crosses the battlefield as a "Scenic Byway" under the
state's scenic byway program.
