The Harnett County Planning Board met on Monday, February 2, 2015 at 6:30 p.m. in the Administration Building in
Lillington, NC.
Board Members present were: Jay Smith, Chairman; Kathy Wood, Vice Chairman, Everette Blake, Cris Nystrom.
Planning Services Staff Members present were: Jay Sikes,
Manager of Planning Services, Randy Baker, Senior Zoning Inspector and Teresa Byrd, Planner I and Recording Secretary.
Chairman Jay Smith called the meeting to order and gave the invocation.
The
January minutes were presented for approval. Cris Nystrom made a motion to approve the minutes as written with a second by Everette Blake. There was a unanimous vote to approve.
Proposed
New Ordinance: Harnett County Explosives Detonation Ordinance; Requested by: Harnett County Planning Services; Police Power Ordinance; Administrator: Harnett County Sheriff; Reason:
Increase concerns over the life, health and safety of Harnett County citizens as related to the unregulated detonation of explosives.
Randy Baker, Senior Zoning Inspector gave the
history on the ordinance. Mr. Baker stated it was a Police Powers Ordinance and would be regulated by the Harnett County Sherriff’s Department. Mr. Baker went on to say that it went
before the Harnett County Commissioners in August of 2014, along with the Harnett County Firearms Ordinance as one ordinance. Mr. Baker stated it was tabled and sent back for further
review. The ten person committee that reviewed the proposed ordinance decided it needed to be separated. Mr. Baker stated that the ordinance were separated and went for approval two
separate times. Mr. Baker said the major change that was made was the removal from Section 10 “Explosive Restriction” the 1500 foot distance from any road.” Mr. Baker stated the reasoning
for the removal of this statement was due to the extensive area that would be prohibited.
Chairman Jay Smith asked if the board had any questions. Kathy Wood expressed her concerns
over the proposed Ordinance in not prohibiting detonation of explosives during specified hours of the day and specific days of the week. Mrs. Wood stated she felt that Sunday should
be a day that the detonation of explosives should be restricted.
Everette Blake expressed his concerns with the distance from schools.
Cris Nystrom stated his concerns that the 1500
feet was a bit excessive and went on to talk about the things he liked about the ordinance.
Several Citizens came forward during the meeting a spoke in support of the ordinance.
These citizens voiced their concerns over the lack of restriction from public roads, the separation distance should be increased and felt that banning explosives that are being used
as recreational
purposes. The citizens spoke loud and clear that continued explosive activities would have a negative impact on property values and future development, as well that the diminished quality
of life they have endured.
The Harnett County Planning Board reviewed the proposed Ordinance and had board discussions. There was a motion made by Everette Blake to forward the proposed
Explosives Detonation Ordinance, Draft 5 to the Harnett County Board of Commissioners with a favorable recommendation for approval as submitted. Cris Nystrom seconded the motion and
there was a unanimous vote.
There being no further business, the Planning Board adjourned at 8:26 p.m.
