Minutes of Regular Meeting
April 20, 2015
The Harnett County Board of Commissioners met in regular session on Monday, April 20, 2015,
in the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman Burgin called the meeting to order at 7:00 pm. Commissioner McKoy led the pledge
of allegiance and invocation.
Chairman Burgin called for additions and deletions to the published agenda. Commissioner
Miller moved to approve the agenda as presented. Vice Chairman Springle seconded the motion
which passed unanimously.
Vice Chairman Springle moved to approve the following items listed on the consent agenda.
Commissioner Elmore seconded the motion. Commissioner Elmore questioned if any new
monies were being appropriated within the budget amendments being considered. Mrs.
Honeycutt said there was not and reviewed the budget amendments being considered. The
motion passed unanimously.

3. Resolutions to add roads to state system (Attachment 2 & 3)
4. Harnett County Tax Administrator requested approval of waiver of competition under
NC G.S. 143- 129(e) to upgrade the current NCPTS Tax Billing and Collection System to
Version 4 software with Farragut Systems, Inc. Standardization, compatibility and
integration with our current systems is justification for the waiver. The cost of the
upgrade is $185,475 to be paid in three yearly installments of $61,825 per year.
5. Harnett County Public Utilities requested approval of write -offs for the first quarter of
2015 in the amount of $58,899.59. All of these accounts have been delinquent for more
than three years. The facilitation of these write -offs is an important step in a continuing
effort to effectively manage collections and bad debt. Harnett County Public Utilities is
currently using the Local Government Debt Setoff Program and On -Line Collections,
Inc. to help collect delinquent accounts.
6. Harnett County Public Utilities requested approval to award the primary construction
contract for the 42 MGD Water Treatment Plant Upgrade to State Utility Contractors,
Inc. in the amount of $10,297,000. The total project budget is estimated to be
$11,613,050 and funding will consist of $5,450,000 from Moore County and the
remainder of $6,163,050 from HCDPU reserves. (Attachment 4)
7. Harnett County Sheriffs Office requested approval to adopt a bloodhound from Rescue
UR Forever Friend to replace Canine Justice who was medically retired in October 2014.
The adoption fee is $175.00 and neuter fee is $100.
8. Harnett County Social Services requested waiver of competitive bidding under NC G.S.
143- 129(g) for the purchase of Compass Software from Northwoods Consulting Partners,
Inc. The seller has agreed to extend to Harnett County the same or more favorable prices
and terms as set forth in its contract with Brunswick County. The total cost of the
software and hardware implementation is $563,200.50 with a portion of the total cost
reimbursable by the NC DHHS estimated at $222,722.19. Social Services requests award
of contract to Northwoods Consulting Partners, Inc. and approval of a Resolution
Authorizing the "Piggybacking" on a Purchase Agreement from Brunswick County for
Electronic Document Management. (Attachment 5)
9. Amended Harnett County Ordinance Permitting the Posting of Signs to Prohibit the
Carrying of Concealed Handguns on Certain County Property
10. Resolution in Support of Senate Bill 369 Sales Tax Fairness Act (Attachment 6)
Chairman Burgin opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
- Kris Nystrom of 391 Center Lane in Bunnlevel said the school maintenance personnel
are outstanding and hardworking employees. He said he felt that the money it would cost

to include county agendas in monthly water bills could be more productive used
elsewhere. Mr. Nystrom said it would be far better to increase the accuracy and
robustness of the County website in order to keep citizens well informed and volunteered
to assist with this effort.
There were no appointments. Chairman Burgin stressed the need for appointments to the Adult
Care Home Community Advisory Committee, Harnett County Board of Adjustment, Harnett
County Planning Board, Harnett County Public Facilities Corp. Board of Directors, Harnett
Nursing Home Community Advisory Committee and the Historic Properties Commission.
Mark Locklear, Planning Services Director, petitioned the Board for a public hearing on a
proposed zoning change, Landowner /Applicant: Trustees of Solid Rock United Methodist
Church; 16.16 +/- acres; From RA -20R to Commercial; NC Hwy 24 West; Johnsonville
Township. Mr. Locklear noted the site is currently vacant. Surrounding land uses include single
family residential homes and residential subdivisions, two churches, a daycare as well as
undeveloped land. He said public water is available however they currently use a private septic
tank on the site.
Mr. Locklear stated, as required for all zoning changes within a five mile radius of Fort Bragg,
the Regional Land Use Advisory Commissioner (RLUAC) was contacted and their comments
were as follows:
• The parcel is identified as important to conserve on the JLUS maps due to its
identified high suitability for Working Forests (9 out of a possible 9 points along
the Fort Bragg boundary);
• It is not affected by any military impacts; and
• Since most of the property has been clear -cut of its natural forest, RLUAC has no
issues with the proposed rezoning of the parcel from RA -20R to Commercial
however, where the forest still exists along the Fort Bragg boundary line, RLUAC
encourages the developer to preserve and protect it from destruction.
Mr. Locklear reported the application was heard at the April 6, 2015, Planning Board meeting
and the Harnett County Planning Board recommended approval with a unanimous vote based on
the existing zoning compatibility to the surrounding properties.
Mr. Locklear reported staff evaluation as:
The IMPACT to the adjacent property owners and the surrounding community is
reasonable, and the benefits of the rezoning outweigh any potential inconvenience or
harm to the community. REASONING: The requested zoning change to
Commercial will not have a negative impact on the surrounding properties or the
community as it is similar in nature to existing zoning districts in the area.
The requested zoning district is NOT COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning is not compatible with the
existing Land Use Classification of Medium Density Residential. The Medium
Density Residential is to encourage a typical residential uses and lot sizes. However,
due to the existing Commercial zoned parcels, as well as the adjacent Rural

Development Node, the property's current land use classification will be requested to
be changed during the County's Land Use Plan update.
The proposal does ENHANCE or maintain the public health, safety and general
welfare. REASONING: The requested zoning to Commercial, whose intent is to
promote the development of business and institutional uses, would enhance the public
health, safety and general welfare due to the neighboring Commercial zoned parcels.
This request is NOT for a SMALL SCALE REZONING and should not be evaluated
for reasonableness. REASONING: This request does not need to be evaluated for a
small scale rezoning due to the property's size.
Suggested Statement -of- Consistency: Staff concludes that, as stated in the evaluation,
the requested rezoning to Commercial is compatible with Harnett County regulatory
documents and would not have an unreasonable impact on the surrounding community
and will enhance the public health, safety, and general welfare because this zoning
district is intended to promote the development of business and institutional uses. It is
recommended that this rezoning request be approved.
Mr. Locklear also mentioned that there is a deed restriction on this property which has been
reviewed by staff as well as the county attorney. Mr. Locklear said deed restrictions have no
bearing on zoning decisions and is simply a private issue. Mr. Snow said he did not see the deed
restriction as an issue for the rezoning but suggested that the grantee discuss the deed with their
attorney.
Chairman Burgin called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move, Chairman Burgin closed the public.
Commissioner Elmore moved to approve the proposed zoning change as presented.
Commissioner Miller seconded the motion which passed unanimously.
Mr. Jeffries presented the following reports:
- Harnett County Planning Services Report — March 2015
- Interdepartmental budget amendments
Chairman Burgin called for any new business. Commissioner Elmore said they are having some
problems in the Dunn area regarding 911 communications and responses. He said he has also
heard concerns from other communities. Commissioner Elmore asked that the 911
Communication Committee meet and listen to some of these concerns and see if they can work it
out and maybe explore other options. Mrs. Stewart will schedule the meeting and confirmed the
911 Communications Committee is made of representatives from all of the towns, fire
departments, Harnett County Public Safety and others. Commissioners Elmore and McKoy will
also attend the meeting.
Commissioner Miller moved that the Board go into closed session to (1) discuss matters relating
to economic development in Harnett County; and (2) to receive a report and give instructions to
the County legal staff concerning the handling of a claim against the County; and (3) to discuss
and to prevent the disclosure of an honorary award. This motion is made pursuant to N.C.

General Statute Section 143- 318.11(a)(4) &(3) &(2). Commissioner Elmore seconded the motion
which passed unanimously.
Commissioner Elmore moved that the Board come out of closed session. Commissioner Miller
seconded the motion which passed unanimously. Commissioner Miller moved to amend his
previous motion to go in to closed session to include 4) to give instructions to the staff regarding
negotiations on the purchase of real property. Commissioner Elmore seconded the motion which
passed unanimously.

RESOLUTION AUTHORIZING THE "PIGGYBACKING" ON A
PURCHASE AG ' IDI FROM BRUNSWICK COUNTY
FOR ELECTRONIC DOCUMENT MANAGEMENT
WHEREAS, the County of Harnett would like to piggyback on a purchase agreement by
Brunswick Count■,', North Carolina awarded on March 17, 2015 for electronic document
management, in accordance with provisions of North Carolina General Statute 143-129; and
WHEREAS, the Purchasing Agent has verified that the conditions of "piggybacking" on the original
contract have been met; and
WHEREAS, a public notice of this purchase without competitive bidding was placed in the legal
section of The Daily Record newspaper on April 9, 2015; and
WHEREAS, this Board desires to authorize the piggybacking on the Purchase agreement with
Brunswick County.
NOW THEREFORE BE IT RESOLVED by the Board of Commissioners for the County of Harnett as
follows:

RESOLUTION BY THE HARNETT COUNTY BOA OF COMMISSIONERS
IN SUPPORT OF SENATE BILL 369
THAT WHEREAS, the North Carolina Senate has introduced Senate Bill 369, an act to phase-in the
conversion of the local sales and use taxes authorized under Articles 39, 40 and 42 to a state sales and use
tax that is allocated to counties and cities on a per capita basis as a local revenue source, which is also
known as the Sales Tax Fairness Act; and
WHEREAS, the Act would eliminate most local sales taxes, such as the county-levied sales taxes, and
convert them to a state sales tax; and
WHEREAS, the State would then distribute the funds to counties and cities based on population; and
WHEREAS, Harnett County's population has grown considerably in recent years, outpacing retail and
commercial growth, causing residents to go out of county to shop; and
WHEREAS, under the current system of sales tax allotment, Harnett County loses large amounts of sales
tax dollars to neighboring counties; and
WHEREAS, in 2014, Harnett County lost approximately $244 million in potential retail spending from
residents shopping and dining outside of the county; and
WHEREAS, under Senate Bill 369, the North Carolina Association of County Commissioners estimates
Harnett County would gain $12 million in sales tax revenue in 2018-19 over the current allocation; and
NOW THEREFORE BE IT RESOLVED that the Harnett County Board of Commissioners:
1. Declares its support of Senate Bill 369; and
2. Urges the North Carolina General Assembly to pass Senate Bill 369; and
3. Directs that a copy of this resolution be sent to members of Harnett County's State delegation and
to the North Carolina Association of County Commissioners.
