HomeMy WebLinkAboutCityScape explanation of denialThis guy called me this morning about a similar situation in Harnett County, and you are absolutely right. The original tenant was supposed to be AT&T and they have placed a hold on
all new sites, the application was for a carrier, all applications must have a carrier and with AT&T withdrawing there is none and therefore there is no justification for an SUP and
it is denied under the County ordinance. Accordingly we caught this and requested supplemental information which was not provided.
In Harnett he asked to amend the SUP to say it will not be built until a carrier is assigned, I told him we cannot support this requested because anyway you cut it that is a space tower
and they are not allowed, and most of the time the carriers do not support spec towers for many reasons.
It needs to be permanently denied.
Another point of interest AT&T has an arrangement with American Tower to build to suit. When I 1st saw this application it didn’t pass the smell test so I contacted the attorney that
handles all AT&T and American Tower application, and he knew nothing about it.

This was sent from the applicant for the new tower request that has been tabled twice at the BOA and is trying to go again this coming Monday’s meeting. By reading this email below,
it seems they still do not have a tenant. Can you please clarify these issues he is addressing below and if he’s even submitted all the requirements and can even go this Monday to the
meeting? It has been quite the ordeal dealing with this one.

Hi Matt –
I looked at the on-line Agenda and it shows our proposed height for the tower is 295’. Good news… the proposed tower should only be 195’. Not sure if that was a typo on our end.
Our original client placed a “hold” on a majority of their new site builds. However, Verizon has approached us regarding this site as it pertains to their needs in the area. As this
site was RF designed for multiple carriers, this is a really good sign.
Is it possible for us to place our own Conditional Use on the application by stating a tower shall not/cannot be constructed until a signed lease is presented to Staff? No one – not
the community, not Staff or us want to build a tower without a tenant. By adding this mandatory condition of requiring the signed lease before construction should satisfy those concerns.

I just wanted to give you fair warning that if your conditional use request application isn’t ready by the January 12 Board of Adjustment meeting, the Board will most likely dismiss
without prejudice meaning you will have to resubmit, pay fees again, and essentially start the process over if you wish to continue. If you haven’t submitted everything to Cityscape
for review, please do so they can review the plans in order to have a recommendation for January.
