Minutes of Regular Meeting
May 5, 2014
The Harnett County Board of Commissioners met in regular session on Monday, May 5, 2014, in
the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman Miller called the meeting to order at 9:00 am. Commissioner Burgin led the pledge of
allegiance and invocation.
Chairman Miller called for additions and deletions to the published agenda. Mr. Burns offered
the two following changes:
- Resolution directing County Staff to schedule and notice a public hearing concerning a
proposal for Harnett County to extend economic development incentives to Carthage
Realty, LLC instead of Precision Realty, LLC.
- Resolution directing County Staff to schedule and notice a public hearing concerning a
proposal for Harnett County to extend economic development incentives to Dunn
Hospitality Ventures, LLC instead of Clarendon Properties, LLC.
Vice Chairman House moved to approve the agenda as amended. Commissioner Hill seconded
the motion which passed unanimously.

3. Tax refunds, rebates and release (Attachment 1)
4. Sheriffs Office requested approval of resolution to award service weapon to retiree
Lieutenant Sabrina Currin. (Attachment 2)
5. Sheriff's Office requested approval to reclassify a vacant Fingerprint Technician position
to a Detention Officer position. The pay grade is the same for both classifications so no
new money is requested. Reclassification of these positions from civilian to sworn
detention officers will assist the Sheriff's Office in scheduling of hours and qualify this
position to back up and assist in Detention Center as needed.
6. Sheriff's Office requested permission to apply and accept funding through the FY 2014
State Criminal Alien Assistance Program (SCAAP). SCAAP provides federal payments
to states and localities that incurred correctional officer salary costs for incarcerating
undocumented criminal aliens with a least one felony or two misdemeanor convictions
for violations of state or local law, and incarcerated for at least 4 consecutive days during
the reporting period.
7. Sheriff's Office requested approval to reclassify Joseph Webb's Lieutenant Investigator
position (pay grade 74) to a Captain Investigator position (pay grade 76) with a 5% raise.
Additional cost of $2,955 in salary line with no new funds needed in the 2013-2014
budget year.
8. Public Utilities requested approval of a decreasing change order for Sanford Contractors
in the amount of $233,683.32. This reduces the amount of their construction contract for
the South Central Wastewater Phase 1C1 Project to $1,994,495.34.

9. Public Utilities requested approval of write-offs for the first quarter of 2014 in the
amount of $16,020.42. All of these accounts have been delinquent for more than three
years. HCDPU is currently using the Local Government Debt Set-off Program and On -
Line Collections, Inc. to help collect delinquent accounts. The facilitation of these write-
offs is an important step in a continuing effort to effectively manage collections and bad -
debt.
10. Scott Mason Tar Heel Traveler Day Proclamation
11. Department of Public Health's Division on Aging requested award of bid to Compass
Group USA, Inc., through its Bateman Division, for $183,449.45 for meal services to
seniors in Harnett County. This was the only bid received. This is a 3% increase from the
current rate which is within the agreed upon guidelines for increase for increase due to
the Consumer Price Index.
12. Resolution directing County Staff to schedule and notice a public hearing concerning a
proposal for Harnett County to extend economic development incentives to Carthage
Realty, LLC. (Attachment 3)
13. Resolution directing County Staff to schedule and notice a public hearing concerning a
proposal for Harnett County to extend economic development incentives to Dunn
Hospitality Ventures, LLC. (Attachment 4)
14. Planning Services requested permission to apply for a $10,000 to $20,000 grant from the
Partners for Green Growth in conjunction with the NC Wildlife Resources Commission
to help aid the county with drafting the natural resources component of our proposed land
use/comprehensive growth plan. If awarded this grant, staff anticipates that these funds
could help offset the overall cost of the recently proposed land use/comp plan.
15. Resolution Creating the West Johnston Fire Protection Service District (Attachment 5)
16. Resolution Relocating the Boundary Lines of Angier Black River Fire Protection Service
District and Coats Grove Fire Protection Service District (Attachment 6)
Chairman Miller opened the floor for informal comments by the public, allowing up to 3 minutes
for each presentation up to 30 minutes.
- Paul Long of 645 Old Buies Creek Road stressed his support of mental health treatment
in North Carolina but said without answers to questions we can't even begin to write a
justification to give Good Hope any more money. Mr. Long noted he has been asking for
an audit or accounting from Good Hope for over 15 months. Mr. Long said Good Hope
doesn't know how to be certified or how to manage their budget. He suggested taking
the $400,000 allocation from the Sheriffs budget since it has been reported it costs him
to transport. Mr. Long said we can't build schools, we can't provide good health
insurance for our employees and the last thing we need to do is take our new tax revenue
and spend it on a mental health facility that is failing.

Vice Chairman House requested Mr. Burns send a thank you note to Good Hope for their recent
presentation to the Board. Commissioner Hill thanked Mr. Burns for attending the May 3rd
dedication of the Habitat for Humanity home built in Cameron, NC for a disabled veteran.
Commissioner Hill thanked all those who have contributed time and money towards the 18
homes built by Habitat for Humanity of Harnett County. Chairman Miller read a tribute to Mr.
William "Bill" Cunningham Jr. acknowledging his contributions to the County during his 20
years as Executive Director of Habitat for Humanity of Harnett County. The 18th Habitat for
Humanity home was dedicated in honor or Mr. Cunningham.
Commissioner Springle moved to approve the appointment listed below. Commissioner Burgin
seconded the motion which passed unanimously.
BOARD OF HEALTH
Dr. Nicholas Pennings, DO, (nominated by Commissioner Springle)
serve on this Board for a term of three years ending May 31, 2017.
TRIANGLE WORK FORCE DEVELOPMENT BOARD
Nick Dula (nominated by Commissioner Springle) was appointed to
Jeffries on this Board with the term ending June 30, 2017.
RESEARCH TRIANGLE REGIONAL PARTNERSHIP

Buren Fulmer, Harnett County Ranger, delivered the 2013 Summary of Accomplishments in
Harnett County. Mr. Fulmer reported forest management and reforestation activities added
nearly $2.4 million dollars to the Harnett County economy during 2013. He said these efforts
also provided seasonal work for site preparation contractors, logging crews, planting crews and
pre -commercial thinning crews. Mr. Fulmer stated continued management of reforested areas
should result in estimated future economic benefits of over $3.1 million dollars.
Mr. Fulmer reported in 2013 192 landowners were assisted by the N.C. Forest Service and 102
Forest Management Plans were prepared which placed an additional 4,640 acres under active
forest management. Based on Forest Service recommendations, 1,053 acres were planted with
trees and 1,344 acres of timber were harvested on NCFS projects. Mr. Fulmer also reported in
2013 the NCFS in Harnett County responded to 127 wildfires that burned 188 acres. Sixty-four
warning tickets were issued to burning offenders along with one court case. Mr. Fulmer also
reported that 103 Harnett County landowners have planted 1348 acres of longleaf pine trees
through the Conservation Reserve Program and the 2013 annual rental payment is $78,813.
Mr. Fulmer discussed problems with Cogan Grass which has now been found in Pender and
Stanley County. He updated the Board on the recent 6th Annual Harnett County Environmental
Field Day held for over 375 fifth graders. Mr. Fulmer also noted Forest Services assisted

California, Idaho, Utah and Oregon in 2013. Forest Services also participated in Fire
Department Training Programs in Angier, Spout Springs, Boone Trail, North West Harnett and
Coats.
Mr. Fulmer reported the N.C. Forest Service's 2014 budget request from Harnett County is
$114,992 which is an increase of $143 from 2013. He noted a top priority is another new truck
as they currently have two trucks with over 100,000 miles each. Commissioners asked Mr.
Buren to consider offering a chain saw class to the public which would be through Central
Carolina Community College. Mr. Buren also reported that chippers are now being used on-site
to better utilize logging debris. Commissioner Burgin encouraged continuing discussions
regarding the housing of the Harnett County Forest Services Office at the Old Boone Trail Media
Center.
Victoria Whitt, CEO of Sandhills Center, reported they have received notice that their Local
Business Plan was approved without any changes or recommendations. She said they have
submitted all of the required material to the Office of State Personnel to move forward with
substantial equivalency which would allow them to set up their own Human Resources section
without having to go through the State to establish positions and hire people.
Mrs. Whitt presented a program update and FY 2014/2015 County general budget request for
Harnett County in the amount of $199,679. Mrs. Whitt noted Sandhills Center has not requested
an increase in county general funding during the past ten years. She reminded the group that all
of that funding stays in Harnett County as the Sandhills Center devotes its entire County General
funding allocation to the support of our County Walk-in/Crisis Units. Mrs. Whitt noted
Daymark Recovery Services, Inc. is the private company who operates these crisis centers in
each county and the county funding provided goes toward subsidizing indigent care of people in
Harnett County. Mrs. Whitt said people are able to walk in to these centers and receive out-
patient on-going services as well as crisis services. She provided a breakdown of the number of
people served in Harnett County as well as an overview of services provided at the center.
Mrs. Whitt also shared the Sandhills Center's Quarterly Community Report January 2014 and a
table showing the actual county general contribution and county general per capita contributions
FY13-14. Commissioner Burgin asked Mrs. Whitt to provide the weighted per capital average of
county contributions. Vice Chairman House thanked Mrs. Whitt and Sandhills Center for
recognizing the needs we have in Harnett County and surrounding counties. Last, Mrs. Whitt
responded there is talk about additional consolidation on the state level as NC DHHS Secretary
Wos believes nine LME -MCO is too many. Mrs. Whitt reported that the Sandhills Board has
decided to wait and see what the legislature does before making any moves regarding this.
The group watched the NCACC Legislative Update Video.
Mr. Burns presented the following report:

Mr. Burns noted the County received the School Board's budget request for the upcoming year
and noted the Board is scheduled to meeting jointly with the Board of Education on May 27th.
Mr. Burns asked the group to remember the Sharp Family who recently lost a loved one.
Chairman Miller called for any new business. Vice Chairman House said he recently visited
West Park and it was wonderful seeing kids playing on the playground and the park being
utilized but said some parents shared their concerns that there is not enough parking available.
Vice Chairman House moved to appoint Sharlene Jones to Employee Benefits Committee to
represent dependents on the Committee. Commissioner Hill seconded the motion which passed
unanimously.
Vice Chairman House moved that the Board go into closed session to 1) consult with the
County's legal staff in order to preserve the attorney-client privilege concerning the handling of
certain claims; and 2) to discuss certain personnel matters. This motion is made pursuant to N.C.
General Statute Section 143-318.11(a)(3)&(6). Commissioner Hill seconded the motion which
passed unanimously.
Commissioner Hill moved that the Board come out of closed session. Commissioner House
seconded the motion which passed unanimously.
Vice Chairman House said he would like to sit in on the upcoming broker presentations, in
addition to Chairman Miller, as he understands that Commissioner Springle has offered to step
aside if another Board member would like to attend. Commissioner Burgin said he did not agree
with Commissioner Springle not being present for the broker presentations given he serves on
the Committee, has been involved all along and has background in insurance. Commissioners
recognized if three commissioners attend the presentations it would then be required to be posted
as a public meeting which would then allow all brokers in the room at the same time.
Commissioner Springle said at the time he offered to not attend the presentations he did not think
it would make that much of a difference but he now believes it would and said he would like to
be present for the presentations. Commissioner Springle said he has some knowledge that he
believes will help and reiterated that the Committee will be recommending the selection of a
broker. He also said he watched the activity for insurance selection prior to becoming a
commissioner and it seemed to cause issue having everyone in the same room at one time and
said the Committee would prefer to have brokers present individually. Mr. Jeffries said Human
Resources staff will provide committee members with a check list to rate each broker as they
present.
Chairman Miller said he was wary of this process as he had recently been given copies of emails
from 2012 between Commissioner Burgin and representatives of Snipes Insurance which caused
him concern about how things were previously handled regarding insurance. Commissioner
Burgin said he had only communicated with brokers following public meetings but said those
emails were circulated and discussed a long time ago. Discussions continued with Chairman
Miller having to call the audience to order at one point.

Vice Chairman House moved that the broker presentations be during an open meeting which
would allow all commissioners to attend and all brokers to be present at the same time. The
motion died due to lack of a second. It was the consensus of the Board that Chairman Miller and
Commissioner Springle attend the broker presentations on Wednesday, May 7th. Mr. Jeffries
will provide Chairman Miller and Mrs. Jones with information before the presentations.
Mr. Burns said as a follow-up from last week's work session, and having asked Mrs. Whitt to
stay over to participate, the group wanted to discuss the process and Good Hope's concerns
about reimbursements. Mr. Bill Larrison, Executive Director of Good Hope, gave a broad
overview of their situation as it relates to reimbursements. Mr. Larrison said they have
approximately $238,000 of outstanding reimbursements with various third party payer
organizations which includes Medicare, Medicaid, three-way funding and commercial
insurances. Mr. Larrison said at the time they were opening the facility they had been told by
their fiscal intermediary that they would be reimbursed based on the date of their CMS855
application. He noted Sandhills reimbursed Good Hope $200,000 this year for unreimbursed
payments. The unreimbursed Medicare amount is $111,108 covering January until September
2013, when they were actually certified by the Centers for Medicaid/Medicare Services. Mr.
Larrison said they have now been told by their fiscal intermediary that the $111,108 will not be
reimbursed and the reimbursement will only go back to their date of certification. Mr. Larrison
said numerous sources told them they would get reimbursed based on their application date
including Horizons and the Division of Mental Health in Raleigh.
Commissioner Burgin asked Mrs. Whitt for her overall assessment of "what's gone on over there
as far as procedure". Mrs. Whitt said this was the first she had heard about the Medicare
situation and she was surprised. Mrs. Whitt said she thinks it's been a struggle with missed steps
along the way by Good Hope and the State and believes there have been a lot of set -backs that
maybe could have been prevented. She said this is a complicated business and you have to really
be on top of payer sources. Mrs. Whitt said it's no surprise that a 16 bed free standing unit is
tough and Harnett County took on a tough challenge but she feels if they can get the funding
stream straightened out there is a need for inpatient services in this part of the state. Mrs. Whitt
also noted she has mentioned to Good Hope that there are three other LME-MCOs around them.
She said she is surprised that Horizons would not have been able to see these some of these
issues before they hit.
Mrs. Whitt reminded the Board that the Medicaid funding for the nine counties does come
through Sandhills Center and that funding is caught up. She mentioned there was $18,000 of
duplicate billings that would not be paid as well as $20,000 billed incorrectly in state funding
that needs to be rekeyed. Mrs. Whitt also said Medicare is federal money and you have to really
be prepared to accept that federal money. She also noted that Sandhills covered their loss in
December to cover indigent and Medicaid. Mrs. Whitt responded, when asked what Harnett
County or Good Hope should be doing differently, that the Good Hope Board and staff may want
to make sure they have a good handle on Horizons and what they are providing. Mrs. Whitt said
they expect and encouraged Good Hope to submit a cost analysis as they are open to
renegotiating the Medicaid rate. Again, she encouraged them to also talk to surrounding LME-
MCOs and try to get contracts with them. Mrs. Whitt said Good Hope received a $1.6 Million

contract for indigent which is a real acknowledgement that that the State wants to see inpatient
beds in the community. Mr. Larrison said Good Hope is currently full. He said Good Hope
would never be profitable but hopefully self-sustaining at some point. Mrs. Whitt mentioned one
benefit to an inpatient facility being associated with a hospital is the ability to do cost shifting.
Commissioner Springle asked if Tax Administrator Keith Faulkner would be sending them a
plan on how they plan to tackle the $2.6 million of taxes owed to the County. Mr. Burns said he
has asked Mr. Faulkner to look at what is being done to address this collectively across state and
what others counties are doing. He said they are now sending debts to debt setoff. The group
continued to discuss the billing process for taxes owed. Mrs. Honeycutt noted there is a
minimum amount to send a debt to debt setoff.

THAT, WHEREAS, Sabrina M. Currin, began her Harnett County Law
Enforcement career on January 07, 1994; and
WHEREAS, after twenty years of distinguished service to
Harnett County, Sabrina M. Currin will retire; and
WHEREAS, North Carolina General Statute 20-187.2(a) provides
that the governing body of law enforcement agency may in its
discretion, award to a retiring member upon his/her request for
their service side arm; and
WHEREAS, according to North Carolina General Statute 14-402
and 14-409.1, proper permits have been obtained (as attached) in

THAT WHEREAS, Carthage Realty, LLC, a North Carolina Limited Liability Company
(Carthage Realty) has announced its intent to establish, construct and operate a Quick Lane Tire
& Auto Center on a site located next to the Precision Ford dealership on Main Street in
Lillington, Harnett County, NC; and
WHEREAS, Carthage Realty has requested that Harnett County provide certain
economic development incentives to Carthage Realty which will assist said company in the
establishment of its auto tire and maintenance/repair facility in Harnett County which will
provide a greater tax base, create jobs and increase economic activity for the benefit of the
County's citizens; and
WHEREAS, pursuant to the provisions of the Local Development Act, N.C. General
Statutes §158-7.1, prior to awarding economic development incentives, the Harnett County
Board of Commissioners shall hold a public hearing in order to obtain public comment
concerning the proposed appropriation of any economic incentives to an applicant industry; it is
the desire of the Board of Commissioners through this Resolution to direct the scheduling of said
public hearing.
NOW THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that the Harnett County Staff is hereby directed to schedule a public hearing to
be conducted at the next regular meeting of the Board on Monday, May 19, 2014, at 7:00 PM
concerning a proposal to extend economic incentives to Carthage Realty, LLC for its proposed
establishment of its Quick Lane Tire & Auto Center facility in Harnett County.
BE IT FURTHER RESOLVED that proper notice of this public hearing be forwarded to
all proper parties and published pursuant to N.C. General Statutes §158-7.1.

CREATING THE WEST JOHNSTON FIRE PROTECTION SERVICE DISTRICT

WHEREAS, County of Harnett has a total area of approximately 601 square miles and
has seen tremendous population growth over the years.
WHEREAS, County of Harnett is currently divided into 19 fire protection service
districts created pursuant to North Carolina General Statute §153A-301, et. seq.. County of
Harnett also has ten rural fire protection districts created pursuant to North Carolina General
Statute §69-25, et. seq.; however, in 2011, the Harnett County Board of Commissioners
conducted a comprehensive approach to realigning the districts and it was determined that there
would be a zero cent tax levy for the ten rural fire protection service districts.
WHEREAS, on the 16th day of December, 2013, the Harnett County Board of
Commissioners found that the protection of the health, safety and welfare of the citizens of
County of Harnett would be enhanced and promoted by changes in the boundary lines of fire
insurance districts within Harnett County. As a result, the Harnett County board of
Commissioners created the West Johnston Fire Insurance District and adjusted fire insurance
district boundaries of Angier Black River Fire Protection Insurance District and Coats Grove
Fire Protection Insurance District.
WHEREAS, at that time, the Harnett County Board of Commissioners did not have all
of the information necessary to take action on the creation and readjustment of fire protection
service district lines and took no action to create the West Johnston Fire Protection Service
District and adjust the boundaries of the Angier Black River and Coats Grove Fire Protection
Service Districts. As a result, fire protection service costs were not equitably allocated.
WHEREAS, the Harnett County Manager, Harnett County Emergency Services
Director, Harnett County Fire Marshal, and the Harnett County Senior Staff Attorney, and other
appropriate representatives and employees of the County of Harnett were authorized to take such
steps as might be required or necessary to pursue the statutory and administrative processes
relative to the proposal to (i) create the West Johnston Fire Protection Service District pursuant
to N.C.G.S.§153A-302 to fund the full cost of fire protection service, delivered on an equal basis
to all residents of the particular service district, and (ii) relocate the boundary lines of the
adjoining fire protection service districts, namely Angier Black River Fire Protection Service
District and Coats Grove Fire Protection Service District pursuant to N.C.G.S. §153A-304.3 to
fund the full cost of fire protection service, delivered on an equal basis to all residents of the

particular service districts, with the cost burden carried equitably by all service district property
owners through the particular service district tax.
WHEREAS, North Carolina General Statute §153A-302 provides the standards and
process to be utilized in defining a new service district.
WHEREAS, pursuant to the direction of the Harnett County Board of Commissioners
and North Carolina General Statutes, a thorough inquiry was conducted in connection with the
proposed establishment of the West Johnston Fire Protection Service District and boundary
relocation of Angier Black River Fire Protection Service District and Coats Grove Fire
Protection Service District. Such inquiry included input from citizens in the areas which would
be included in such service districts, fire departments which would service such districts,
independent inquiry by members of the Board of Commissioners, and the comments of citizens
received by the Board of Commissioners and county staff.
WHEREAS, the Harnett County Board of Commissioners caused to be prepared a report
containing maps of the proposed districts, showing the proposed boundaries, statements showing
the proposed districts meet the standards as required by law, and plans for providing fire
protection services to the proposed districts.
WHEREAS, the Harnett County Board of Commissioners conducted a duly noticed
public hearing on April 21, 2014 providing an opportunity for citizens to appear and be heard
concerning the subject proposal.
WHEREAS, it has been represented to the Harnett County Board of Commissioners that
such a proposal enjoys support within the respective communities involved and within the
subject districts.
WHEREAS, the fire protection service districts proposed to be established is shown as
follows:
a. West Johnston Fire Protection Service District, as shown on the map attached
hereto and incorporated herein as Exhibit A, and as represented in the GIS
produced maps certified by the County Fire Marshal.
WHEREAS, the Harnett County Board of Commissioners has carefully considered the
report dated March 20, 2014 containing maps of the proposed district, showing the proposed
boundaries, statements showing the proposed district meets the standards as required by law, and
plans for providing fire protection services to the proposed district, along with the input and
comments of citizens and fire departments which would service such districts.
WHEREAS, the Harnett County Board of Commissioners finds that there is a
demonstrable need for providing the fire protection services within the area of the proposed fire
protection district.

impracticable to provide fire protection services on a county -wide basis.

WHEREAS, the Harnett County Board of Commissioners finds that there is
