March 3rd 1919 County Comissioners met in regular session ,Present J.D. Barnes Chtt, J.C, Byrd P.T. Johnson ,l?.P. Fay, W.J.- McStewart, full board present, tfinutes of lest meeting read and approved, Moved by J.C. Byrd and seconded by R T. .Johnson that A.H. Harper be d.prointed Township Constable of Duke Township and he be required to give a Bond in the Sum of Five Hundred Dollars. It was recomended by the Board of County Comissioners that L.L. Levison be appointed procuting Attorney by recoeder D.H. VoLean, A.H. Shaw County Auditor This Agreement made and entered in to this 23 del, of January ,1919 By and Between the Atlantic Rail Road Company-, a corporation existing under and by virtue of the laws of the State of Virginias, Party of the first part, and THE BOARD '?F CONU SSIONLRS OF HARNETT COiINTY, State Of North Carolina, Party of the second part, WITNESSETH: That the py�trty of the first part , for and in consideration of the sum of one Dollar, to it in hand paid has agreed and does hereby cotenatt and agree to and with, the Board of of Comissioners of Harnett County, party of the second part, to erect as soon as possible,at atnumidnm a location near Olivia N.V., a.statian of the Yadkin Branch of The Atlantic Coatt Line Rail Road, and between said-Olivia and Pineview, N.C. at a point where an established high way laid out to the line of said Rail-road is located, a. good metal overhead bridge, out of second hand material which the party of the first part may have on hand, with a wooden floor and cement foundations, to be erected by thv party of the first part in a workman like a&# careful manner, at an estimated cost.of Twen- ty Seven Hundred and three dollars,(;`2703.00), The expense two thirds of which is to be borne by the party of the first part and one third by the Board. of Comissioners of Harnett Cc,?r-ty, and it is agreed that -if said bridge cannotb=mtrxb&h be properly bmbft constructed at the estimated price above agreed to, that the party of the first part may exceed said prise only}/ to an amount to sufficient to properly construct said metal bridge, and the Board of Comissioners of Harnett. County agrees to pay one third of said excess, upon a statement duly certified to by the party of the first part that said excess has been properly expended. And estimate of the cost of amterikl and labor necessary to con - struct, said bridge is hereby attached and made a part of this contract. If the cost of construction of said bridge does not ammount to as much as the estimate attached hereto , and above referred to. then, The Board of Comissioners of Harnett County shall only be required to pay one third of the actual cost thereof; And the Board of Comissioners of Harnett County,upon their part agree to const- ruct the necessary approaches to said bridge, in a manner satisfactory to the Cheif Engineer of of the party of the first part, and maintain same with the bridge and said approches therto in a safe and suitable condition while same is used for the, purpose of crossing over said rail road track at said Highway, and also agree to pay to the party of the first part one third of the actual cost of the construction of the bridge upon the completion of the same. second part Party of Iftsrammat Faut agnmeomftm herby agrees to indemnify and hold harmless the party of the first part from any and all damages that may be done or slain to have been done to the property of the adjoining land owners in the construction by party of the second part, of the approches of said bridge. During Federal Control of the rail road of the Atlantic rail road company, the provision of timw=xwnhmmm* this contract shall ennure to the benifit and be binding upon said 8ompany and United States Rail Road Administration Director General of Rail Roads Atlantic Coats Line Rail Road, as their respective interest may appear after such Federal Control ceases, this contract shall innure to the benifit end be binding upon said Compnny: This Contract apace on the part of the Board of Comissioners of Harnett County, is to be sig- ned by J.D. Faucett Clerk 2,977.14 The Board of Commissioners having received bids in response to advertisement duly published for the conetructi on of steel concrete bridge across Black River between Duke and Dunn, and across Upper Little River at the site known as the "Kivvet'aBridge" and J.W. Turnage, contractor, having submitted a bid Of ASr700.c0 for the Black River bridge and $4301.00 for Upper Little River Bridge, the county to furnish the steel in both instances, and this being the lowest ©id submitted it was orderdd by the Board that J.D. Barnes, be authorized on behalf of the Board to execute a contract with the said J. W. 'Turnage for the construction of said Bridge in accordance with his bid and the County At .orney was instructed to draw said contract and W. T. Smith was appointed engineer to supervise the work.
