HomeMy WebLinkAbout07021928D76 MINUTES OF MEETING OF COMMaSSIO1ERS The Board of County Commissioner in regular session, at its offices in L the following members being present: Mrj Snipes, Mr. L.R• Byrd, Mr. J.A. Hockaday Williams, County Attorney. Mr. B.?. Ingram offered the following Resolution, which was unanimously adopted and ordered spread upon the minutes of the Board: "Resolution of the Board of County Commissioners of Harnett County voiding all resolutions and orders heretofore made regarding the issuance of $35,000.00 County Home Bonds ". "Whereas, this Board has been appraised of the fact that the attorneys employed for the purpose of apprgving the issuance of bonds of Harnett County, North Carolina, in the sum of 035,000.00 to be known as "County Home Bonds ", ha declined to make approval of the proceedings heretofore had in connection with the same for that it did not appear that ten (10) days expired between the firs publication authorizingthe issuance of said bonds and the hearing on said order and for the further reason that there appeared some discrepancy in the financia statement filed in connection with the proceedings; and "Whereas, this Board is now advised that it would be proper to void al proceedings heretofore had by this Board regarding the said issue of bonds to the end that the proceedings may be had anew in the same manner as though no former proceedings had ever been taken relative to the issuance of the said bonds: . "Now, Therefore, be it resolved that all proceedings' orders and other matters and things heretofore done or ordered to be done by this Board regardin the proceedings for said issuances of bonds be and they are hereby declared to be utterly void and of no effect k. "Be it ordered by the Board of ounty Commissioners of Harnett County as follows: ounty Horne Bonds "1. That pursuant to the county Finance Act of North Carolina, bonds of Harnett County are hereby authorized in the principal amount of not exceed- ing a35,000.0O for the purposes hereinafter sat forth; "2. The proceeds of,sa,id bonds shall be used solely for the purpose of erecting a County Home for the indigent and infirm of the said County of Harnett. The erecting of the said this Board to be a public necessa "3. A tax sufficient t County Home is hereby declared and found by t ty and a necessary expense for Harnett County. o pay principal and inaerest of said bonds *hen due shall be annually levied and collected. "4. A statement of the!Oounty Debt of Harnett County had been filed with the `lerk hereof and is open to public inspection. "5. All expenses to be defrayed by meands'of the bonds hereby author - ized are necessary expenses within the meaning of aection 7 of Article VII of 'the 'constitution of-North Carolina, "6. That this order shall .take effect upon its passage and shall not be submittedeto a vote of the Peeples Upon motion of Mr. Byrd the following resolution was unanimously adopted: "Be it resolved that a public hearing upon the order entitled "An' Order Authorizing the Issuance of §35,000,00 Bounty Home Bonds of Barnett County,North Carolina", introduced at a meeting of the Board of Commissioners of • aarnett Go»nty held on the 2nd. day of July, 1928, shall be held on the 17th day °of July, 1928 at 10_o'clock,,A -M. in the regular meeting place of this Board in Lillington, North Carolina. "Be it rfn.rther resolved, that the County Auditor of Harnett county is the officer designated by this, Board to file with the Clerk hereof, a state- ment of the debt incurred and to be incurred for other than school purposes es required by Sextiog 14, et seq. of the County Finance .9ct, "Be it further resolved, that the clerk of this Board publish said order in the Harnett County News, a newspaper published in Harnett county, North Carolina, with a statement :Immediately below the same in substantially the following form: "The foregoing order has been introduced and a sworn statement has -been filed under the Bounty Finance Aot, showing the assessed valuation of the County to be $24,507,921.00, and the net debt for other than school purposes, including the proposed bonds, to be 0610,000.00.',A tax will be levied for the ayment of the proposed bonds and interest, if the same shall be issued. Any citizen or tax payer may protest against the issuance of such bonds at a meeting of the noa rd of County Commissioners to be held at 10 o'clock, A.M. _July 17th. 1928, or an adjournment thereof. At the hour Of 12 o'clock, M. the Chairman anno need to the Board that the hour of sale of X51,000.00 School Funding Bonds of Harnett Bounty, North Carolina had iirrived. The bids receiv=ed were ordered opended, and it was found that bids had been received from the following bonding houses, to -wit A bid of Strannahan, Harris and Oatis, Incorporated of Toledo, Ohio, offering par accrued interest for the said bonds and a bid of David Robinson and Company Incorporated, of Toledo, Ohio, offering par and accrued interesy, plus a premiu of 4291.00 for said bonds. No other bids were received. Er. 3.P Ingram thereupon offered the following resolution which was unanimously passed. "Whereas, David Robinson and Company, Incorporated of Toldeo,Ohio, are the highest and best bidders for the X51,000.00 School Funding Bonds of Harnett vounty, North Carolina, dated June 15th. 1928, bearing interest at 44 per cent, payable semi - annually., to mature as specified in their bid bear- ing date of June 29th. 1928. Now, therefore, be it Resolved, that the said bond4 be and the same are hereby awarded to David Robinson and Company, Incorporated of Toledo, Ohio, and the Chairman and "lark of this Board are hereby authorized and directed to execute said bonds, and when executed, to deliver the same to the said David Robinson and Company, Incorporated, on compliance by them with the terms of their bid on file in the office of the Clerk of the Board of County Com- missioners of Barnett vodst$, North Carolina" Upon motion of Mr. Snipes, seconded by Mr. Ingram, the above resolu- tion was Adopted by the affirmative vote of the following members,to -wit: Mr. Jas. A. Buchanan, Charian; Mr. Z.Y. Snipes; Mr. J.A. Hockaday; Mr. B•P.,Ingram and Mr. L.R. Byrd. No members voting in the negative. PROPOSAL :' To Mamie S. Byrd, Clerk Board of ©aunty Commissioners, Harnett County, Lillington, N.C. vor $51,000.00 legally issued and properly executed School Funding Bonds of Harnett Bounty, N.0 promptly delivered to us at Toledo, Ohio, dated June 15th. 1928 and to become due and payable: $200b.00 June 15th. In each f the years 1929 to 1933, inclusive; $3000.00 on June 15th. in each of the pegs 1034 to 1936, inclusive; $4000.00 on June 15th. in each of the years 1937 to 1939, inclusive; $5000.00 on June 15$h. in each of the years 1940 to 1943, inclusive, said bonds to be in the denomination of $1000.00 bearing interest at the rate of 4* per annum, payable semi - annually, both principal and interest to be payable at Chase Rational Bank in the city of Aim York, N.Y. We will pay par, accrued interest from date of bonds to date of deliv- ery to us and in addition thereto a premium of Two Hundred Ninety One and no /100 "oilers ($291.00) Dollars. This offer is made subject to the unqualified approval of our attorneys (Who shall be one of the rezognised firms of Municipal Bond Attorneys) of the legality of said bonfsleeidthe taxation provisions relating thereto, you agree- ing to Tarnish us promptly and prior $o delivery of the bonds, a fait and corn plate transcript of proceedings had incident to the authorisation and issuance thereof, for examination by the above mentioned attorneys. You further agree to enact and famish without delay, any additional proceedings, which, in the opinion of the attorneys may be necessary to establish the legality of said bonds. As evidenoe of our good faith, we attach hereto, certified check for $1020.00 which cheek is to be held by you unoashed pending investigation of the legality of the issue by the attorneys and is to be returned to us upon demand in case they fail to approve the legality of the bonfs, or if this propos al is not accepted. RESOLUTION:' WHEREAS, it has become necessary for Harnett County to borrow money to pay the principal or interest on bonds or notes to become due within four months, and not otherwise adequately provided for. Bights for jail and courthouse, 15. Advance on 'July saalary, 50. 50. pen 8 NORTH CAROLINA, RESOLUTION OF BOARD OF COMMISSIONERS DECLARING RESULT OF HARNETT COUNTY. SCHOOL ELECTIONS. Whereas, the Board of Commissioners of Harnett County at its regular meeting on Monday, July 2nd, 1928, have canvassed the returns of certain school elections held in Harnett County on the 19th day of June, 1928, under resolu- tions duly passed by this Board at its regular meeting on the 7th day of May, 1927, and find the following facts relative thereto: 1. That in the election held in Harnett County School District No.32 (known as Benhaven School District), there was registered for said election 332 voters; that at said election there was 194 votes cast "For Local Tax" and 138 votes cast "Against Local Tax ". A majority of the registered vote having voted "For Local Tax" the said election is hereby declared to have been duly carried. 2. That in the election held in Harnett County School District No.71 (known as Lillington School District), there was registered for said election 408 voters; that at said election 250 votes were cast "For Local Tax" and 46 votes were cast "Against Local Tax ". A majority of the registered voters havin voted "For Local Tax" the said election is hereby declared to have been duly carried. 3. That in the election held in Harnett County School District No.34, (known as Angier School District), there was registered for said election 520 voters; that at said election 271 votes were cast "For Local Tax" and 92 votes were cast "Against Local Tax ". A majority of the qualified voters in said elec having voted "For Local Tax" the said election is hereby declared to have been duly carried. 4. That in the election held in Harnett County School District No.61, (known as LaFayette School District), there was registered for said election 92 voters; that at said election 71 votes were east "For Local Tax" and 1 "Against Local Tax ". A majority of the qualified voters in said election havin voted "For Local Tax" the said election is hereby declared to have been duly carried. 5. That in the election held in Harnett County School District No.53 (known as Coats School District), there was registered for said election 151 voters; that at said election 111 votes were cast "For Local Wax" and 19 votes were cast "Against Local Tax ". A majority of the qualified voters in said election having voted "For Local Tax the said election is hereby declared to have been duly carried. 6. That in the election held in Harnett County School District Ho.80 (known as Upper Little River School District), there was registered for said election 615 voters; that at said election 391 votes were cast "For Local Tax" and 83 votes were cast "Against Local Tax. A majority of the qualified voters in said election having voted "For Local Tax" the said election is declared to have been duly carried. That in determining the results of each of the above referred to elections all registered voters who did not vote in said elections were counted as having cast their votes "Against Local Tax ", and the elections are declared carried only by a majority of the voters registered having actually voted "For Local Tax ". rs tiw Now, therefore, be it resolved by the Board of County Commissioners in regular session assembled, at the CourtHouse in Lillington, North Carolina, on Monday, July 2nd, 1928, that the above referred to elections, and each of them, have been duly carried. Be it further resolved, that this resolution be spread upon the minutes of this Board and that a copy thereof be published in the Harnett Count News, a weekly newspaper published in said County of Harnett and circulating in each of said districts. Whereas, there has been presented to this Board at its regular meeting on Monday, July 2nd, 1928, the returns of tine election officials duly appointe to hold an election in the Dunn Graded School District, known as Harnett County School District No.21, in accordance with a resolution duly passed by this Board on the 7th day of .ulay, 1928; and, Whereas, the said returns have been duly canvassed, and the following results have been ascertained: There was registered for said election 433 voters and at said election 296 voted "For Local Tax" and 26 voted "Against Local flax ". 111 did not vote. A majority of tie voters registered for said election having voted "For Local Tax ", the said election is hereby declared to have been duly carried. RETURNS OF THE REGISTRAR AND JUDGES OF ELECTION OF A SPECIAL ELECTION CALLED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY, TO BE HELD IN DUNN GRADED SCHOOL DISTRICT ON JUNE 19th, 1928. We, the undersigned Registrar and Judges of Election, do certify that we held a special election in Dunn Graded School District, it being designated as School District No.21 in Agerysboro Township, Rarnett County, on this the 19th day of June, 1928, pursuant to call of said election made by the Board of Commissioners of Harnett County. C.A. Thornton, one of the Judges appointed by the Board of Commissioners of Harnett County, declined to act in said capacity, upon the ground that he was a non - resident of said School District, and the office thus made vacant was filled by the remaining Registrar and Judge, they having appointed J.L. Wade to act as Judge in lieu of C.R. Thornton resigned. There was registered for said election 433 qualified voters of said district.
