HomeMy WebLinkAbout09281938587 September 28, 1938 The Board of Commissioners of Harnett County met in their room at the courthouse, Lillington, N.C., at 2 o'clock P.D., September 28, 1938, upon expiration of the recess taken Monday, September 5, 1938. Present were: Chairman J.B.Ennis, Commissioners Geo.T.Noel, Jno.S.Barker, Lonnie R.Byrd, Angus A.Cameron, Clerk to the Board Inez Harrington, and County Attorney H.C.Strickland. Bids of contractos for the construction of the County Hospital, were received, publicly opened and red. The Board ordered that its architect, Eric G.Flannagan, and Gus Engineer - Inspector, tabulate the bids. The following resolutions were then adopted, all members of the present and voting for their adoption: at Dunn, N.C., Palmer, PWA Board being RESOLUTION ORDERING THE FILING OF BIDS WHEREAS, pursuant to advertisement, bids for the construction of Hospital at Dunn, N.C. PWA Docket No. N C 1344 -F have been filed by the following bidders: General Contractors: Charles W'.Angle, Inc., Greensboro, N.C. Goode Construction Corp., Charlotte, N.C. Byrd Bros. & Shaw, Inc., Lillington, N.C. Ervin -West Construction Co. Inc., Statesville, N.C. V.P.Loftis, Charlotte, N.C. T.A.Loving & Co., Goldsboro, N.C. F.N.Thompson, Raleigh, N.C. W.L.Jewell, Sanford, N.C. A.H.Guion & Co. Inc. Charlotte, N.C. Plumbing and heating Contractors: W.M.Wiggins & Company, Wilson, N.C. Albermarle Plumbing & Heating Co. inc., Albemarle, N.C. APPROVED: NORTH CAROLINA: HARNETT COUNTY: RESOLUTION AWARDING CONTRACT FOR CONSTRUCTION OF HARNETT COUNTY HOSPITAL AT DUNN, N.C., INCLUDING DEDUCTIVE ALTERNATES WHEREAS, Eric G.Flannagan, Consulting Architect, pursuant to a Resolution heretofore adopted, has tabulated and considered all bids heretofore received for the construction of Harnett County. Hospital, at Dunn, N.C., and has duly made his recommendations to the Board of Commissioners of Harnett County, North Carolina, and it appearing from said recommendations and report that the lowest and beat base.- bid is in excess of the funds available, that the use of deductive alternates will be necessary, and that BYRD BROS. & SHAW, INC. of Lillington, N.C., is the lowest and beat bidder within the amount of funds available for the construction of said hospital, in the sum of SIXTY EIGHT THOUSAND TWO HUNDRED SEVENTY FOUR ($68,274.00) DOLLARS, after deducting alternates numbered one to nine (1 to 9) both inclusive, amounting to THREE THOUSAND SEVEN HUNDRED TWENTY SIX ($3,726.00) DOLLARS and that said bid is on the general construction of said hospital, exclusive of the plumbing and- heating;'and that the Board of Commissioners of the County of Harnett, North Carolina, after considering said report and the recommendations and all bids heretofore filed, finds that the lowest and best base bid is in excess of the funds available, that the use of the deductible alternates will be necessary, and that the bid of BYRD BROS. & SHAW, INC. is the lowest and best bid, within the amount of funds available, after deducting alternates numbered one to nine (1 to 9), both inelusive, as specified in the bid: ',w,oriarxem ?a— ,ora AND IT FURTHER APPEARING that the tabulation of the bids received for the plumbing and ±rothlthearecommendations and report of Erie G.Flannagan, architect, indicates that the use of deductive alternates will be necessary, and that W.M.WIGGINS & CO., of Wilson, North Carolina, is the lowest and best bidder within the amount of funds available for the furnishing of-all labor and material in connection with the plumbing to be done in the said hospital structure inthe sum of NINE THOUSAND TWO ($9002.00) DOLLARS, after deducting alternate numbered one.(1) in the amount of TWO HUNDRED EIGHTY FIVE ($285.00) DOLLARS,as specified in the bid; and that the Board of Commissioners of the County of Harnett, North Carolina, after considering said report and recommendations and all bids heretofore filed, finds that the lowest and best base bid is in excess of the funds-available, that the use of deductible alternates will be necessary, and that the bid of W.M.Wiggins & Co., of Wilson, North Carolina, is the lowest and best bid for the plumbing, 'Within the amounts of funds available, after deducting alternate numbered one (1), as specified in the bid; AND IT FURTHER APPEARING that the tabulation of the bids received for the heating and from the r ecemmendations and report of Eric G.Flannagan, architect, indicates that the use of deductive alternates will be necessary;. and t hat J.L.POWERS, of Bennettsville, South Carolina, is the lowest and best bidder within the amount of funds available for the furnishing of all labor and material in connection with the heating to be-done in the said hospital structure in the sum of EIGHT THOUSAND FIVE HUNDRED NINETY NINE ($9,599.00) DOLLARS after deducting alternate numbered one (1) in the amount of TWELVE HUNDRED SIXTY (01260.00) DOLLARS as specified in the bid; and that the Board of Commissioners of the County of Harnett, North Carolina, after considering said report and recommendations and all bids heretofore filed, finds that the lowest and best base bid is in excess of the funds available, that the use of deductible alternates will be necessary, and that the bid of J.L.POWERS of Bennettsville, -South Carolina, is the lowest and best bid for the heating, within the amounts of funds available, after deducting alternate numbered one (1), as specified in the bid; NOW, THEREFORE, BE IT RESOLVED BY THE Board of Commissioners of The County of Harnett, North Carolina, as follows: Section 1: That the bid of BYRD BROS.& SHAW, INC. of Lillington, North Carolina, for the general contract in connection with the construction of the Harnett County Hospital, at Dunn, North Carolina, exclusive of plumbing and heating, in the sum of SIXTY EIGHT THOUSAND TWO HUNDRED SEVENTY FOUR($68,274.00) DOLLARS, after deducting alternates numbered one to nine (1 to 9) both inclusive, as specified in the bid, is hereby accepted, determined and declared to be lowest and best bid within the amount of funds available; and that a contract for the construction of said work, as heretofore prescribed by the plan, specifications and contract document, be forthwith executed for said construction-. Section 2: That J.B.Ennis, Chairman of the Board of Commissioners of Harnett County, North Carolina, is hereby authorized and directed to execute said contract for and on behalf of the CounLy of Harnett, North Carolina. Section a: It appearing that the award for the construction of,said hospital, together with the heating and plumbing of the same will require an expenditure of EIGHTY FIVE THOUSAND EIGHT HUNDRED SEVENTY F1VE($85,875.00) DOLLARS, exclusive of equipment, and that the said sum exceeds the amount available for said purposes by FIVE'THOUSAND EIGHT HUNDRED SEVENTY FIVE (50875.00) DOLLARS; and it-further appearing that it is-the desire of the Board of Commissioners of Harnett County, North Carolina, to construct the projects as specified by the plans, and specifications; IT IS FURTHER RESOLVED that the county of Harnett North Carolina, from its own funds, and'with the understanding that no additional allotment is to be received from the United States of America, shall pay said additional cost; and that in addition to the funds representing 55% of the construction cost, which is to be deposited in the Construction Account, there shall also be deposited in such Construe-flan Account the sum of FIVE THOUSAND EIGHT HUNDRED SEVENTY FIVE ($5,875.00) DOLLARS. Section 4: That the Auditor of Harnett County, -.North Carolina, is hereby authorized and directed to deposit said additional sum of FIVE THOUSAND EIGHT HUNDRED SEVENTY FIVE ($5,875.00) DOLLARS in said Construction Account, and said sum is hereby specifically appropriated for the purpose of supplementing the funds heretofore made available for the construction of the project. Section 5: That the Commercial Bank, of Dunn, North Carolina, be and the same is hereby designated as the depository of all funds in connection with the construction of said County Hospital, including the plumbing and heating of said structure, and the Auditor of Harnett County is directed to deposit all sums for said purposes in said depository upon said Bank securing the said deposits as is required by law. AND BE IT FURTHER RESOLVED: Section 1-A: That the bid of W.M.Wiggins and Co., of Wilson, North Carolina, for the furnishing Of all labor and materials in connection with the plumbing of the said County Hospital, at Dunn, North Carolina, in the sum of NINE THOUSAND TWO ($9002.00) DOLLARS , after deducting alternate numbered one (1) aS specified in the bid, is hereby accepted, determined and declared to be the lowest and best bid within the amount of funds available, and that a contract for the construction of said work, as heretofore prescribed by the plans, specifications and contract documents, be forthwith executed for said construction. f 589 Section 2 -A: That the bid of J.L.Powers of Bennettsville, South Carolina, for the furnishing of all labor and materials in connection with the heating of the said County Hospital at Dunn, North Carolina, in the sujj of EIGPT THOUSAND FIVE HUNDRED NINETY NINE ($8,599.00) DOLLARS, after deducting alternate numbered one (1) as specified in the bid, is hereby accepted, determined and declared to be the lowest and best bid within the amount of funds available; and that a contract for the construction for said work, as heretofore prescribed by the plans, specifications and contract documents, be forthwith executed for said construction. Section 3 -A: That J.B.Ennis, Chairman of the Board of Commissioners of Harnett County, North Carolina, is hereby authorized and directed to execute slid :contracts for the plumbing and heating of the said County Hospital, at Dunn, North Carolina, for and on behalf of the County of Harnett, North Carolina. It is ordered that, in event The Commercial Bank, of Dunn, N.C. should fail to secure the deposits of Harnett County, in the Construction Account for the County Hospital, at Dunn, as required by law, the County Auditor shall deposit said funds in the First - Citizens Bank and Trust Co. of Dunn, A.C. It is ordered that the County Auditor issue voucher to Eric G.Flannagan, in the amount of $3,005.62 on the Harnett County Hospital, at Dunn, N.C. Construction Account. It representing 311% of the $85,875.00 bid, for the construction of hospital. It is ordered that 95 acres of land listed to W.M.Blue in Johnsonville Township be discharged of all tax liens due Harnett County for 1938 and prior years upon receipt of $150.00 from Mrs. W.W.Blue, Raeford, N.C. The following road petition was approved and ordered forwarded to the State Highway and Public Works Commission: (1) To work and maintain the road that intersects with Highway at the Old Fair Grounds and passing the Geo.Moore Lee's old home place and connects with the Benson and Erwin Highway, a distance of approximately mile, in Averasboro Township. NORTH CAROLINA: HARNETT COUNTY: RESOLUTION TO HONORABLE DUNCAN C.WILSON, JUDGE OF DUNN RECORDER'S COURT: TO HONORABLE F.H.TAYLCR, JUDGE OF RECORDER'S COURT: GREETINGS: We, the County Commissioners of the county of Harnett, respectfully submit to your honor in the form of a request that your honor upon request from the Superintendent of The County Home of Harnett County that women prisoners( whom the Superintendent is unable to manage have their sentence changed from the County Home to some other judgment by the Court. We make this request upon the known fact that the County Home is not equipped to care for prisoners which require armed supervision and constant guarding. We the undersigned Commissioners have hereunto set forth and subscribed our hands this the 28th. day of September, 1938. Duke Stewart's Creek Grove i�eill s Creek Grove Grove 590 BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF HARNETT COUNTY: That it appearing to the Board of Commissioners that in the year 1907, the Board of CountyCCommissioners of Harnett County attempted to execute a deed, which deed is recorded in Book 167, page 408, and that said deed was defective; IT IS THEREFORE ORDERED by the Board of County Commissioners that its Chairman be authorized to execute a Quitclaim Deed, a copy of which is hereto attached, correcting said deed, the same to be attested and the seal of said County affixed by the Clerk. "NORTH CAROLINA: HARNETT COUNTY: THIS DEED made this the 28th. day of September, 1938, by TEE BOARD OF COUNTY COMMISSIONERS OF HARNETT COUNTY', party of the first part, and D.H.BRADLEY and J.G.LAYTON, parties of the second part, both of the County of Harnett, State of North Carolina, WITNESSETR: THAT WHEREAS the Board of County Commissioners of Harnett County, on June 5, 1907 attempted to execute a Deed to the Lillington Baptist Church ( Trustees) conveying certain property, hereinafter described, which said deed was recorded in the office of the Register of Deeds of Harnett County, in Book 167, page 408; AND WHEREAS, it appears from an examination of said Deed that same is defective and the parties of the second part now being the owners of the legal title to said property as appears of said record in the office of the Register of Deeds. NOW, THEREFORE, in consideration of the sum of ONE DOLLAR paid to the party of the first part by the parties of the second part, receipt of which is hereby acknowledged, the said party of the first part has remised, released and quitclaimed and by these presents does remise, release and forever quitclaim unto the party of the second part, their heirs and assigns, the following described tracts or lots of land located in the town of Lillington, and more particularly described as follows :, Being all of Block 111 according to the Kelly map of the town of Lillington described by metes and bounds :as follows: BEGINNING at the intersection of "H" and 9th. Streets and runs with 9th. Street North 18 East 330 feet to a stake, corner of said Block 111; thence South 72 East as "G" Street 330 feet to a stake, the corner the block; thence South 18 West 330 feet as 8th. Street to the corner on "H" Street; thence with "H" Street 330 feet to the beginning, being the entire block, the same containing 22 acres. All of the above lot of land is released to D.H.Bradley except the lot hereinafter described released to J.G.Layton: Beginning at the southeast corner of Block No. 111 according to the Kelly plan of the town of Lillington, the same being the point where "H" and 8th. Streets intersects, and runs as the line of "H "SJ,reet North 68 West fifty feet to a stake in the northern margin of "H" Street; thence as right angle to "H" Street North 22 East sixty feet to a stake; thence South 68 East fifty feet to the line of, 8th. Street; thence as 8th. Street South 22 West sixty feet to the beginning, containing 3000 square feet. TO HAVE AND TO HOLD the aforesaid tract or lots of land unto the parties of the second part, their heirs and assigns, to their only use and behoof forever, se that the Board of County Commissioners of Harnett County nor its successors in office shall or will herafter claim or demand any rights or title to the premises or any part thereof, and the same shall by these presents be excluded and forever_. barred.
