July 5, 1938
The Board of Commissioners of Harnett County met in regular session Tuesday,
July 5, 1938 at 10:00 A.M. with Chairman J.B.Ennia, and Commissioners Geo.T.Noel,
A.A.Cameron, J.S.Barker, and L.R.Byrd present. Also H.C.Strickland, County
Attorney, was present.
It is ordered that the tentative County Budget for the fiscal year 1938 -1939
include $1,000.00 for the purchase of textiles for use as the County's
contribution to the sewing room project of W.P.A.
It is ordered that an appropriation of $850.00 be set up in the 1938 -1939
budget for the Department of Conservation and Development in Harnett County.
Attorney J.A.MoLeod appeared before the Board and presented the following
resolution which was adopted by the Board and ordered filed:
RESOLUTION
WHEREAS, Will Smith (colored) listed for taxes for the years 1927 and 1928
a tract of land in Stewart's Creek Township, Harnett County, containing 39 acres;
and Whereas, prior to that time said Will Smith had executed a deed of trust to
E.P.Davis Trustee, and said deed of trust was foreclosed in Feb. 1931, and
J.C.Byrd & Bro. became the purchasers of said land at the foreclosure sale,
which sale was made and handled by C.J.Smith, and said land was sold with
understanding that all taxes were to be paid from proceeds of sale; and whereas,
no funds came into the hands of E.P.Davis, Trustee and he received no benefit
from said sale; and whereas, C.J.Smith paid taxes on said tract of land for
the years 1929 and 1930; and whereas it appears that at that time tax receipts
and certificates on said land fro the years 1927 and 1928 were Loathe hands
41. J.O.West, former County Attorney, and had been in his hands for some time
for the purpose of bringing foreclosure suit, but no suit was brought, and it
Appears that C.J.Smith, who handled the said foreclosure under the deed of
true, above mentioned was not informed as to the taxes for said years 1927 and
1228 and the same were not paid; and whereas, it now appears that if said taxes
are required to be paid,either E.P.Davis, who was Trustee in said deed of trust,
and who received no benefits from said sale and no funds with which to pay said
taxes, or J.C.Byrd and Bro. who purchased said land and who were to receive
title free from taxes will be compelled to pay said taxes and thereby innocent
parties would suffer loss by reason of apparent negligence of said former
County Attorney; and whereas, it would be unfair for either of said parties to
suffer this loss when neither of them is responsible for the errors in
connection with this matter;
NOW, THEREFORE, be it resolved by the Board of County Commissioners of
Harnett County in session an Tuesday, July 5, 1938, that said t axes for the
years 1927 and 1928, on said 39 acres ef,land in Stewart's Creek Township,
Harnett County, and listed in the name of Will Smith (colored) be and the same
are hereby remitted and said land is released from the lien of said taxes.
The following road petitions were approved by the Board and ordered forwarded
to the State Highway and Public Works Commission:
(1) To take over and maintain the following described road: Begins at the Jimmie
Knight filling station in Upper Little River Township crossing Little River
at Darroch and McRae Bridge and extending on to the Hugh McCormick residence
a distance of about 4 miles.
(2) To lay off and open a road leading from the Benson Road to Angier road near
Mrs.Mary Ann Gregory's, to the road leading from G.W.Dorman to the Benson
or Coats road near the home of J.M.Johnson, a distance of about 1} miles.
(3) To improve and maintain as a community road leading eastward from
Highway NO. 55 at point opposite filling station of Nadia W.Ennis and
running thence by the home of Mrs.Laura Barnes and others to the public
road leading from Coats to the Green Ford at a point near the home of
Doc Denning.
It is ordered that upon recommendation of Geo.T.Noel that the lot 150 x 140
feet listed to Mrs.LP.Dickey on N.Wilson Avenue in the town of Dunn be reduced
in tax valuation from $560.00 to $300.00.
It is ordered that lot 150 x 140 feet listed to Mrs.W.P.Diokey on S.Orange
Avenue in the town of Dunn be reduced in tax valuation from $1225.00 to $700.00.
It is ordered that the report of the Tax Collector be accepted and filed.
It is ordered that the report of the Register of Deeds be accepted and filed.

BE IT RESOLVED by the Board of Commissioners of Harnett County:
That pursuant to and under the authority of the provision of the Revenue
Act of the General Assembly of North Carolina, enacted at its session of 1937
it being House Bill No. 35 as amended by House Bill No. 838, thus shall be and
the same is hereby imposed as a Harnett County License Tax for the privilege
of carrying on business exercising the privilege or doing the act named in
the following annual license tax for the tax year June 1, 1938 to and including
May 31, 1939, the same schedule of taxes set opposite the several respective
businesseprivilege as set forth on page Nos. 467, 468, and 469, of Minutes of
Commissioners in Docket No. 6.
It is ordered that the following be granted license to sell beer and wine:
(1) L.B.Matthews and R.'G.Smith, Chalybeate Springs, at Matthews & Smith
Filling Station, to sell beer and wine, Hector's Creek Township.
(2) Archie Wood, Dunn, N.C. No. 6 to sell beer at Archie's Place in
Averasboro Township.
(3)
B.Gilbert Porter, Dunn, N.C. to sell beer at Bannerman's Boffee Shoppe
in Averasboro Township.
(4) Mrs.Rena Rose, Erwin, N.C. to sell beer at Mike's Place in Duke Twp.
(5) Geo.R.Joseph, Dunn, N.C. to sell beer and wine at Cyystal Cream and
Candy Co. in tows of Dunn, N.C.
(6) R,L.Pate, Duke Township, to sell beer at Pate Bros. Inc. in town of Erwin.

The annual budget of the County Board of Education relating to schools
was presented to the Board of County Commissioners and filed as provided by
law. It was ordered that said .tentative budget be open to public inspection
and published as provided by law at the time the annual tentative budget of
the County sisal be published.

RESOLUTION:
WBEREAS, the Board of-,Education of Harnett County, North Carolina,
proposes to enter into an agreement as of July 1, 1937, with the United States
of America, acting by and through the Secretary of Agriculture, pursuant to
Executive Order No. 7530, dated December 31, 1936, as amended, for payment
in lieu of taxes in connection with the North Carolina Farm Tenant Security
Project, RR- NC -23, a copy of which agreement was presented at this meeting of
the Board of Commissioners for the County of Harnett, North Carolina; and made
a part of the minutes thereof; and
'WHEREAS, the aforesaid Board of Education of Harnett County, North Carolina,
in consideration of certain payments to be made by the United States in lieu
of taxes, agrees to provide school facilities for children of school age
residing in the North Carolina Farm Tenant Security Project, RR- NC -23; and
WBEREAS, the aforesaid Board of Commissioners for the County of Harnett
North Carolina, is desirous of approving the action of the aforesaid Board of
Education of Harnett County, North Carolina, in entering into said agreement
and rendering. the services provided therein;
NOW, THEREFORE, be-it resolved that the said agreement -made a part hereof,
together with the exect.tion thereof by the President of the aforesaid Board of
Education of Harnett County, North Carolina, on its behalf, be, and the same
hereby is, in all respects, approved.

At a meeting of the Board of County Commissioners of Harnett County held
on the 5th. day of July, 1938, the following members were present, the same
being a quorum of said board: Messrs. J.B.Ennis, G.T.Noel, A.A.Cameron,
J.S.Barker, L.R.Byrd.
The following resolution was offered by Mr.G.T.Noel and seconded by
Mr.L.R.Byrd:
"Resolved by the Board of County Commissioner of Harnett County:
(1) That for properly maintaining a six months' school term in District
No. 7, Hector's Creek Township, LaFayette School, White race, Harnett County,
as required by Article IX, Section 3 of the Constitution of the State of North
Carolina, it is necessary that certain improvements be made therein of the
following character: Assist in paying for construction of additional class
rooms for vocational work, high school library, two additional class rooms and
two toilets.
(2) That in order to provide said improvements it is necessary that the
sum of Fifty Five Hundred Dollars ($5500.00) be obtained by borrowing the same,
to be used by the County Board of Education, of Harnett County, for said purpose.
(3) That the Board of County Commissioners of Harnett County does hereby
approve of and authorize the application for, and procurement oft a loan for
said purpose from the State Literary Fund of the State of North uarolina,
established and operated under III C.S. 5683 -5687, the same being Article 24,
Chapter 136, Public Laws 1923, and Chapter 115, Public Laws 1937, and said
Board does hereby authorize and direct that all necessary steps be taken to
procure said loan under the terms of said statutes and the rules and regulations
of the State Board of Education governing the making of loans from said fund,
and the Chairman and Clerk to this Board are hereby authorized, empowered and
directed for and on behalf of this Board to join with the County Board of
Education of Harnett County in making the necessary application therefor, and
to take such action under this resolution and under said statutes, rules and
regulations as may be necessary for said purpose. The county accountant is
hereby authorized and directed to make application to The Local Government
Commission for approval of the issuance of such notes.
(4) That the Board of Commissioners of Harnett County hereby agrees to
levy at the appropriate tax levying period in each year, upon all taxable
property in said county, ad valorem taxes at a rate sufficient to meetth e
interest and principal payments on such part of the loan requested herein as may
be approved by the State Board of Education, and thereby provide the funds
necessary each and every year to meet and repay the interest and principal
payments due on such approved loan, under the terms of the statute by authority
of which the said loan is made, and in accordance with the rules and regulations
of the State Board of rduucation governing such loans, as found in Book 10,
pp. 340 and 368, of the minutes of the said State Board of Education."
The resolution was duly adopted by the following vote:
Those voting in the affirmative were: J.B.Ennis, J.S.Barker, G.T.Noel,
L.R.Byrd, A.A.Cameron.
Those voting in the negative were: None.
Whereupon the Chairman announoed that said resolution was duly and properly
adopted.
The following resolution was offered by Mr.L.R.Byrd and seconded by
Mr.J.S.Barker:
"Resolved by the Board of County Commissioners of Harnett County:
(1) That for properly maintaining a six months' school term in District#2,
Averasbc o Township, Dunn School, white race, Harnett County, as required by
Article IX, Section 3, of the Constitution of the State of North Carolina, it is
necessary that certain improvements be made therein of the following character:

No. 8, Lillington Township, Shawtown School, colored race, Harnett County, as
required by Article IX, Section 3. of the Constitution of the State of North
Carolina, it is necessary =that certain improvements be made therein of the
following character: Construction and equiping toilet rooms and installation
of modern sewerage disposal plant.
(2) That in order to provide said improvements it is necessary that the
sum of Four Thousand Dollars ($4,000.00) be obtained by borrowing the same, to
be used by the County Board of. Education of Harnett County for said purpose.
(3) That the Board of County Commissioners of Harnett County does hereby
approve of and authorize the application for, and procurement of, a loan for
said purpose from the State Literary Fund of the State of North Carolina,
established and operated under III C.S. 5683 - 5687, the same being Article 24,
Chapter 136, Public Laws 1923, and Chapter 115, Public Laws 1937 and said Board

of the following character: Construction and equiping toilet rooms and
installation of modern dewerage disposal plant.
(2) That in order to rovide said improvements it is necessary that the sum
Of Five Thousand Dgllars (5,000.00) be obtained by borrowing the same, to be
used by the County Board of Education of Barnett County for said purpose.

approve of and authorize the application for, and procurement of, a loan for

"Resolved by the Board of County Commissioners of Harnett County:
(1) That for properly maintting a six months' school term in
District No. 4, Black River Township, Angier School, white race, Harnett County,
as required by Article IX, Section 3 of the Constitution of the State of North
Carolina, it is necessary that certain improvements be made therein of the
following character: It is very essential that we provide room for teaching
vocational subjects and space for physical education.
(2) That in order to provide said improvements it is necessary that the
sum of Four Thousand Dollars ($4,000.00) be obtained by borrowing the same,
to be used by the County Board of E -talon of Harnett County for said purpose.
(3) That the Board of County Commissioners of Harnett County does hereby
approve of and authorize the application for, and procurement of, a loan for
said purpose from the State Literary Fund of the State of North Carolina,
established and operated under III C.S. 5683 - 5687, the same being Article 24,
Chapter 136, Public Laws 1923, and Chapter 115, Public Laws 1937, and said
Boardhereby authorize and direct that all necessary steps be taken to procure
said loan sunder the terms of said statutes and the rules and regulations of
the State oard of Education governing the making of loans from said fund,

The annual tentative budget of the County for the fiscal year 1938 -1939
was presented by the County Auditor. It was ordered filed for public
inspection and published as provided by law.

The Board of Commissioners of Harnett County met in a call session
Friday, July 15, 1938, at 2 :00 P.M. with Chairman J.B.Ennis, and Commissioners
Geo.T.Noel, J.S.Barker, L.R.Byrd and A.A.Cameron present. In the absence of
the County Attorney, H.C.Strickland, I.R.Williams, attorney, acted as County
.Attorney.
The Board appointed Geo.T.Noel and J.S.McLean and J.B.Ennis to investigate
the tax valuation on the property listed to Mrs.Julia Thornton Johnson in the
town of Dunn.
It is ordered that the tax valuation be investigated on the Warwick Hotel
in town of Lillington, N.G.
