HomeMy WebLinkAbout09041933173 4th. 1933. The Board of County Commissioners met in regular session with the following members present: J.B.Ennis, Chairman, J.D. Byrd, H.M. O'Qginn, J.S. Barker and E.L. Cooke. It is ordered that William D. Page be granted peddler's license in Harnett County for the year 1933 -34 without charge. It is ordered that report oZ ie. Ctisffin,C.S.C. be accepted and filed and that cheelsin the sum of 462.20/11 t ±4i over to the County Auditor. It is ordered that report of Geo. L' Cannaday, Tax Collector, be accepted and filed. It is ordered that report of Dr. A.W. Feeds, It is ordxred that J.C. Ammons of Averasboro of tax on one female dog for the year 1932. Health Officer, be accepted and filed. Township be relieved of the payment It is ordered that a Committee composed of J.B. Ennis, Chairman, Board of County Commissioners, H.W. Prince, Chairman, Board of Education, J.S. McLean, County Auditor and I.R. Williams, County Attorney be appointed to confer with the Depart- ment of Public Works in regard to securing loans for the ereotion of additions to the Schools at Coats, Buckhorn, Benhaven and Shawtown. It is ordered that petition for road in Duke Township beginning at East Erwin on Route 1217 and connecting with j60 at South Erwin, be approved and ordered mailed to the State Highway Commission. L.B. Jackson having appeared before the Board with a request that he be allowed to withdraw as one of the Sureties on the bond of J.W. MoArtan, Constable, said bond being in the sum of 41000.00, it is ordered that J.W. Mokrtan file a new bond to be approved by the Board of County Commissioners. It is ordered that petition for road in Upper Little River Township known as the "Old River Road" be approved and forwarded to the State Highway Commission for investigation. RESOLUTION: WHEREAS, the Board of Commissioners, at the regular meeting in August ordered that the sale of lands for the non - payment of taxes for the year 1932 be postponed for thirty days; And whereas since that meeting the weather has been such that farmers could not pink sons' and gin cotton; And whereas the tobacco markets have been closed by order of the Governor on account of low prices; Ant whereas it believed that it will be to the best interest of Harnett County as a whole that the sale of lands for non - payment if 1932 tales be postponed for thirty days from that data; Now therefore, be it resolved that the sale of lands for the non - payment of 1932 taxes be post -poned for thirty days from the first Monday in Ootober,1933. Commissioner Barker moved the adoption of the resolution. This motion was seconded by Commissioner O'Quinn. Upon a vojie being taken the following voted for said resolution: All Against said resolution: None NORTH CAROLINA: HARNETT COUNTY: IN SUPERIOR COURT JUST TERM 1933 Whereas on account of the necessary absence of the Solicitor, Clawson L. Williams, Neill Me K. Salmon has as Special Solicitor under appointment of the Court prosecuted the docket for one week •f this term. It is ordered by the Court that said Neill MoK. Salmon be paid as compen- sation for said servioe a sum equivalent to the salary of Solicitor for one week said sum to be paid by the Board of Commissioners of the County. Paul Frizzelle, Judge Presiding It is ordered that in order to comply with the order of Judge Paul FrAzzelle that Neill MoK. Salmon be paid an amount oomparable to the salary drawn/ the regular solicitor of the Superior Court for a period of one week. It appearing to the Commissioners that J.D. Weathers has lately succeeded R.H. Templeton as Administrator of the Estate of J. Herbert Baker, deceased, and that the real estate of said J. Herbert Baker in Buckhorn Township, consisting of about 90 acres of land, has not heretofore been listed for taxes, and that the present Administrator desires the land listed in orrder that the taxes may be computed and paid; and it further appearing to the Commissioners that a reasonable andfair valuation for the said property it 4650.00; and it further appearing to the Commissioners that the dounty is without authority to assess taxes against the property for more than five years back: It is thereupon ordered by the Board that the Auditor of Harnett list the said.ninety (90) acres of land in the name of the Estate,of J. Herbert Baker, deceased, for the years 1928, 1929, 193Q4 1931, 1932 and 1937 at the value of 4650.00 and that the said Auditor compute the taxes dyne thereon for the year years in accordance with the lttea,.levied in said Township for those years, and that.he accept from the said Administrator the taxes so computed and duly receipt the said Administrator therefor. Althers of Ocala, Florida, is the owner of certain lands in Barbecue Township, Harnett County, described as follows: lst. tract: Being Lot No. 6 as described in the Report of the Commissioners -in that Special Proceedings entitled "Mary Holder and others VS M.P. Martin and others" as recorded in Book 217, page 346 of the records of the office of Register of Deeds for Harnett County. Beginning at a stake in the road, the second corner-of Lot No. 5 South 52 deg. West 12 chains to the corner; thence South 842 deg. East 8.56 chains to a stake in the slash or branch; thence South 28 deg. East 2.50 chains to a stake; thence North 62 deg. East 2.58 chains to a corner of the S.W. Withers old home tract; thence with a line of said tract North 292 deg. West 16.54 chains to the corner by a road; thence with a line of Lot No 4 North 842 deg. West 2.65 chains to the beginning. 2nd. tract :Beginning at a stake in the Jelioo Branch in McCormick's line and runs thence with the various courses of the branch as it runs to Barbecue Branch in a Southern direction 30 chains to a gum corner in said braneh near the edge of Bar- becue Swamp; thence South 80 deg. East 20 chains to a stake in another branch,Alex Withers' corner; thence up the channel of the branch about 30 chains to a stake, the original corner of the tract of land known as Small's "Diamond Hundred";thence as a line of the old "Diamond Hundred Acre Tract" North 80 deg. West 20 chains to the beginning, containing 60 acres, more or less. AND WHEREAS the said two tracts of land embrace about 64.6 acres of lance, which has a taxable valuation of 4745.00; and, WHERE`$, the taxes on the said property have not been paid for the years 1928, 1929, 1930, 1931 and 1932 due to the fact that there has been some ques$ion as to the title thereto; and WHEREAS, The County of Harnett has heretofore instituted suits in the Superior Court of Harnett County for the purpose of foreclosing the tax receipts for certain of said years as will appear by reference to the oases of the County of Harnett VS B.C. Withers and wife, being cases Nos. 122, 232 and 502 in the office of Clerk pf the Superior Court of Harnett County, in which said actions of foreclosure the pro- perty is incorrectly and improperly described, and none of which suits have been prosecuted to final judgment; and, WHEREAS, The said B.C. Withers and Mse. J.S. McLean, the Auditor for - Harnett County, hate gone into the matter thoroughly and made a full investigation as to the said taxes, including the accrued court eosts, and it appearing from the report of the said Auditor to this Board that the taxes for 1928,plus the court costs, is 456.56; that the taxes for 1929, plus court costs, is 423.70 ; that the taxes for 1930,including costs is 415.13; that the taxes for 1931, including costs, is 414.97 and that the taxes for 1932, plus costs, is 415.77; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF HARNETT COUNTY IN REGULAR SESSION ASSEMBLED ON THE FIRST MONDAY IN SEPTEMBER,1933: 1. That the said B.C. Withers be allowed to pay the Auditor of Harnett County the amount above stated for the taces for the years mentioned, which is a total amount of 4126.13, and that upon the payment of said amount to the Auditor of Harnett County the said Auditor is hereby authorized and directed to issue to the said B.C. Withers full receipt or reeeips Showing the payment of the said taxes; and 2. That upon the payment of the said taxes the County Attorney is hereby authorize' and directed to take a non -suit in each of the cases above referred to; and 3. That the said lands he hereafter listed in Barbecue Township, Harnett County as "64 6/10" acres B.C.Withers lands" and valued at 4745.00 until further ordered by this;,Beard, or by law, to be valued otherwise.
