September 1, 1941
The Board of County Commissioners met in a regular session on Monday,
September 1, 1941, with Chairman J.B.Ennis and Commissioners L.R.Byrd,
Fered D.Jackson, R.L.Pate and Angus A.Cameron present. Also County Attorney
H.C.Strickland, and Inez Harrington Clerk to the Board.
It is ordered that beer license be granted to Don E.Wimberley, at
Wimberley's Service Station, in Willow Springs, N.C. RFD 1.
The report of W.D.Harrington, Tax Collector, for the month of August,
was approved and ordered filed.
The report of Lola O'Quinn, Delinquent Tax Collector, for the month of
August, was approved and ordered filed.
The report of Inez Harrington, Register of Deeds, for the month of August,
was approved and ordered filed.
The report of Howard Godwin, Clerk Superior Court, for the month of August,
was approved and ordered filed.
It is ordered that insurance policy No. 6653 in the amount of $2500.00
on the Courthouse, with Commerce Insurance Company, was approved and ordered
filed with the County Auditor.
It is ordered that insurance policy No. 1976 in the amount of $9000.00 on
the Jail Building, with Aetna Insurance Company, was approved and ordered
filed with the County Auditor.
WHEREAS, under tax foreclosure suits the County of Harnett has received
deeds for the lands hereinafter described, made by H.C.Strickland, Commissioner,
which deeds are recorded in Book 247, page 287, and Book 247, page 296,
respectively;
AND WHEREAS, at the time said suits were brought Geo.F.Pope and A.F.Pope
were the owners of said lands and were not made parties to said suits; and
WHEREAS, said Geo.F.pope and A.F.Pope have offered to pay the taxes on
said property including penalties, provided all costs of foreclosure suits
be remitted.
IT IS ORDERED that upon payment by said Geo.F.Pope and A.F.Pope of the
taxes plus penalties (without cost of foreclosure suits) a deed be executed
by theproper officers of Harnett County to Geo.F.Pope and A.F.Pope conveying
all the interest of said County in and to the following described lots or
parcels of land in the town of Dunn, Harnett County, N.C.:
First:- Being those lots on South Layton Avenue and Canary Street, described
in that deed from C.J1 Smith and J.C.Clifford, Commissioners, to
Geo.F.Pope, A.F.Pope, and L.A.Tart, dated Dec. 22, 1931 and recorded in
Book 259, page 477, Harnett County Registry.
Second:- Beginning at the intersection of the North line of Pope Street with y
the West line of Ellis Avenue aid runs Westwardly with the Northern
±argin of Pope Street 140 feet to the alley; thence with the eastern margin of
the alley, parallel with Ellis Avenue 150 feet; thence eastwardly parallel with
Pope Street 140 feet to the west margin of Ellis Avenue; thence Southwardly
with West margin of Ellis Avenue 150 feet to the beginning.
The Board accepted the resignation of L.C.Ezzell of Dunn, N.C. as
Registrar of Vital Statistics in Averasboro Township, and Mrs. L.C.Ezzell was
appointed to fill the unexpired term as Registrar of Vital Statistics of
Averasboro Tpwnship.
It is ordered that upon request of J.O.West, that the American Legion be
permitted to have a Carnival for one week in Dunn tax free.
It is ordered that J.O.Elmore of Averasboro Tpwnship, be granted permanent
poll tax on account of physical disability, he being a World War Veteran,
and that J.O.Elmore be reimbursed poll tax for the year 1940.
It is ordered that W.H.Gilbert be refunded rebate on six acres of land
in Buckhorn Township on account of error in listing.
It is ordered that George Vann of Duke Township, be granted free peddler's
license for the year 1941, on account of physical disability.

The following road petitions were presented and approved and ordered
forwarded to the State Highway and Public Works Commission:
1 - to improve and maintain that certain road in Upper Little River Township,
beginning at a point at home of Peter McKay and runs eastwardly by the
home of Thomas Douglass, John McKay, Elsie Gilmore, Alton Womack, and
G.W.Edwards at distance of approximately one mile. This road is used as a
school bus route.
2 - to work the hereinafter described road. The road is the one in
Anderson Creek Township which leads from the Clarkts- Bridge- Overhills Road
at a point about one -half mile south of John -Aaron Senteris store along an old
fire line road to N.C.Highway No. 210 ( or the Fort Bragg - Lillington Road),
and enters the said N.C.Highway No. 210 about 200 yards north of B.J.Howardts
filling station. This road is also used by the school bus and the mail carrier.
This road is approximately six miles in length.
It is ordered that upon receipt by the County of Harnett of the sum of
$127.82, the lots of land in town of Lillington, formerly listed without
authority to S.M.Finch for taxation, as described in Book 235, page 280,
Harnett County Registry, be quit - claimed by the County of Harnett to
Lettie U.Finch, the true former owner; and that the said sum includes all
taxes through the year 1941.
W.D.Harrington, Tax Collector, presented to the Board, the 1940 Insolvent
List. The Board refused: to accept the list and returned same to the Tax
Collector with the instructions to continue to collect or levy on personal
property.
Upon the bringing up bf the taxes due on the Eliza Pope Estate lands
before the Board, it was moved and carried that appraisers Charlie Thornton
and Herman Holloway, visit the premises of the Eliza Pope lands on
September 6, 1941 and ascertain such property as had not been heretofore
listed by the said estate, if any; and to report such findings to the Board;
And it was further decised by the Board that upon the report of the two
said appraisers, that the Board of Commissioners would approve such
computation of taxes due in consequence of such report, and that payment of
such taxes by the administrator of his agent, would constitute full, final,
and complete settlement of the taxes due to date on the Eliza Pope estate lands
located within the corporate limits of the town of Dunn and shown in detail
on that certain map recorded in Map Book No. 4, page 115, office of the
Register of Deeds for Harnett County.

BE IT RESOLVED that the 40 acres of land in Anderson Creek Township,
formerly listed to Partin Moore Estate, and acquired by the County of Harnett
at tax foreclosure sale under Judgment No. A -1262, be sold to -- -Troy
for the the total amount of $215.00 on the following terms: $40.00 cash;
0.00 on December 1, 1941; 0.00 on December 1, 1942; and $65.00 on
December 1, 1943, and the Chairman is hereby authorized to execute deed to
Troy Black, and the Clerk will attest same.

BE IT RESOLVED that the lot or parcel of land located on the corner of
North Wilson Avenue and East Vance Street, Dunn, N.C., and acquired by the
County of Harnett and the Town of Dunn at tax foreclosure sale,
No. SD 1799 -A -1084, be sold to - - -- George R.Joseph - - -- for the sum of $690.00
on the following terms: $50.00 dash, and $150.00 on approval of this offer,
and 4163.33 January 15, 1942, $163.33 July 15, 1942, and $163.34 on
January 15, 1943, and the Chairman of the Board is hereby authorized to
execute deed to George R.Jpaeph, and the Clerk to the Board will attest the
same.
BE IT RESOLVEDthat the 115 acres of land in Buckhorn Township
formerly listed to Mrs. T.J.Smith and acquitedr' by the County of $arnett
at tax foreclosure sale under Judgment No. A -1060, be sold to ---- C.S.Cade - - --
on the following terms: $300.00 cash with this offer, and the Chairman of
the Board is hereby authorized to execute deed to C.S.Cade and the Clerk
will attest the same.
J.Leo Betts appeared before the Board and offered the sum of $350.00
on the 115 acres of land in Buckhorn Township acquired by the County under
foreclosure Judgment No. A -1060 which amount is higher than the bid made
by C.S.Cade, therefore, the Board rescinded the action of the Board in the
Resolution adopted authorizing the sale to C.S.Cade. The Clerk to the
Board was authorized to return to A.L.Newberry, Agent, both the sale
purchase contracts for further investigation.

We, the undersigned tax appraisers appointed by the Board of Commissioners
of Harnett County, to ascertain and report any and all unlisted property of
the Eliza rope Estate, located within the corporate limits of the town of Dunn,
and shown on the subdivision of said Eliza Pope property as recorded in ,a
map in Book 4, page 115, office. of the Register of Deeds for Harnett County,
hereby render our report as follows:
After careful and painstaking investigation of the premises and of the
tax records and of the map of the subdivision of the Eliza Pope property,
as referred to, we find and so report, that approximately five acres of farm
and waste land appearing on said map of the said subdivision appears to be
unlisted. We are of the opinion that such unlisted land should bear a value
of one thousand dollars, and we therefore, recommend such valuation for the
year 1941 and such prior years as the Commissioners see fit to after -list
said land.
We, therefore, recommend that the taxes due on the five acres above
referred to, be considered as all taxes the on unlisted land of the Eliza
Pope Estate, and that payment of such taxes as are due on the five acres
referred to, added to the taxes computed as being due on the land listed,
constitute full payment for all taxes due on all that land included in that
certain map of the Eliza Pope subdivision recorded in Map Book 4, at page 115,
Harnett County Registry.

EXTRACTS FROM THE MINUTES OF A REGULAR MEETING
OF THE BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF HARNETT, NORTH CAROLINA.
The Board of County Commissioners of the County of Harnett, North
Carolina, met in regular session at its regular meeting place on the lst.
day of September, 1941. The Chairman presided. Those present and absent
were as follows:
Present: J.B.Ennis, L.R.Byrd, A.A.Cameron, R.L.Pate and Ferd D.Jackson.
Absent: None.
Commissioner L.R.Byrd introduced the following Resolution which was read
in full by the Clerk and considered by the Commissioners:
RESOLUTION.NO.
"A Resolution Approving The Provisions Of A Proposed Cooperation
Agreement Between The County of Harnett, North Carolina, and
The Eastern Carolina Regional Housing Authority, and
Authorizing The Execution of said Agrement On
Behalf of the County. "
WHEREAS the Eastern Carolina Regional Housing Authority (hereinafter
called the T'Authority ") proposes to develop and administer low -rent housing
projects (herein called the roject • within the territorial limits of the
County of Harnett, North Carolina (herein called the "County "); and
WHEREAS, The County desires and is willing to cooperate with the Authority
by furnishing customary services and facilities to such Projects and the
tenants thereof, and to cooperate in other ways with the Authority, as more
particularly appears in the Agreement hereinafter set forth:
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
County of Harnett, North Carolina, that the County shall enter into an
Agreement with the Authority in substantially the following form:
COOPERATION AGREEMENT
WHEREAS, the Housing Authorities Law of North Carolina provides that
Local Authorities created pursuant to said law shall be exempt from the
payment of any taxes or fees to the State or any subdivision thereof or
to any officer or employee of the State or any subdivision thereof and the
property of a Local Authority shall be exempt from all local and municipal

taxes; and
WHEREAS, it is understood and agreed that this Agreement shall not be
construed as requiring the County to perform any act or funish any service
not authorized by law nor shall it be construed as imposing any personal
liability upon the individual members of the Board of County Commissioners:
NOW, THEREFORE, THIS AGREEMENT WITNESSETH: that, in consideration of the
premises, the COUNTY OF HARNETT, in the State of North Carolina, and the
EASTERN CAROLINA REGIONAL HOUSING AUTHORITY do, by this Cooperation Agreement,
mutually agree as follows:
1. The following terms as used in this Agreement shall be construed, are
used and are intended to have the following meanings, unless a different
meaning clearly appears from the context:
(a) The term "Authority" shall mean the Eastern Carolina Regional Housing
Authority.
(b) Term "County" shall mean the County of Harnett, North Carolina.
(c) The term "Project" shall mean any low -rent housing project, or
portion thereof, situate within the territorial boundaries of the County,
developed or administered by the Authority under a contract or contracts
for financial assistance with the United States Housing Authority.
(d) The term "Bonds" shall mean any notes, interin receipts, bounds or
debentures issued by the Authority to assist in the development of the
Projects, or any notes, interin receipts, bounds or debentures issued
by the Authority, to refund the same.
2. The Authority agrees to undertake, develop and administer a Project
or Projects in the County and to endeavor to obtain contracts with the United
States Housing Authority for loans and annual contributions to assist in the
development and administration of such Project or Projects.
3. The County agrees:
(a) That, as a part of each Project it will secure or enforce, to the extent
it has the power to do so, the elimination (by demolition, condemnation
and effective closing, or by compulsory repair or improvement), within
one year after the date when such Project is substantially ready in its
entirety for occupancy, of a number of unsafe or insanitary dwelling
units situated in the County, at least equal in number to the number of
new dwelling units provided in such Project, less the number of unsafe
or insanitary dwelling units eliminated pursuant to the provisions
therefor in contracts entered into by the Authority for the acquisition
of the sites for such Project.
(b) To secure or enforce (to the extent it has power to do so) the elimination
of such unsafe or insanitary dwelling units in one or the other of the
following ways, or partly in one and partly in another:
(I) By demolishing or effectively closing dwelling units which are on land
acquired by the County by purchase or otherwise, including land
purchased for any public uses; or
(II) By causing the compulsory demolition, effective closing, repair or
improvement of such unsafe or insanitary dwelling units; or
(III) By inducing private owners to demolish or effectively close such
dwelling units.
In computing the number of unsafe or insanitary dwelling units eliminated
under the terms of this Agreement, there shall be included all unsafe or
insanitary units eliminated under this Agreement from the date hereof.
For the purpose of this Agreement a dwelling unit shall be considered unsafe
or insanitary whenever by reason of dilapidation, faulty arrangement or
design, lack of ventilation, light or sanitation facilities, or any
combination of those factors, it is detrtmental to safety, health or morals.
4. The County further agrees that during the period commencing with the
date of acquisition of any part of the site of each Projeot, and continuing
throughout the useful lit of such Project, so long as such Project or any part
thereof is owned by the Authority or any other public body or agency
authorized by law to engage in the development or administration of low -rent
housing projects (such ownership being hereinafter called "Public Ownership ",
(i) it will not levy, impose or charge any taxes, service fees, charges
or tolls against such Project or any part thereof under Public Owernship or
against the Authority for or with respect to such Project or any part
thereof under Public Ownership, and (ii) it will furnish, without cost or
charge to the Authority and the tenants of such Project (or the part thereof
under Public Ownership) the usual County services and facilities which are
or may be furnished without cost or charge to other dwellings in and
inhabitants of the County. The term "useful life of such Project" as used

in this paragraph shall mean the period of physical usefulness of the
particular Project for the purpose of providing dwelling accommodations to
persons of low income, but in no event less than the number of years during
which any of the Bonds shall remain outstanding.
5. The County further agrees to waive any building and inspection fees
to which the Authority or any Projects might otherwise be or become subject.
6. The County further agrees, to cooperate with the Authority in
recommending to the appropriate agency or agencies of the State of North
Carolina the building and maintenance, at -no expense to the Authority,
of roadways from public roads into those parcels of land on which the
Authority constructs dwellings forming parts of each Project, and the
installation and maintenance of all culverts, drainage and other roadway
facilities insofar as those things are performed by such agency or agencies
of the State without special charge for other dwellings in and inhabitants
of the County similarly situated.
7. The Authority agrees that it will use its best efforts to develop
each Project as rapidly as possible, to operate and maintain each Project
for families of low income and to keep the County fully informed as to the
status of each Project.
8. This Agreement shall constitute a contract between the County and
the holders of any Bonds, and after such Bonds have been issued for any
Project, this agreement shall not be amended or altered in any respect
which would adversely affect the rights of the holders of such, bonds.
IN WITNESS WHEREOF, the County of Harnett, North Carolina, and the
Eastern Carolina Regional Housing Authority have respectively caused this
Agreement to be duly executed in triplicate as of this 1st day of
September 1941.

Board of County Commissioners of the County of Harnett, North Carolina,
do hereby certify that the attached copy of the extracts of the minutes of
a regular meeting of the Board of County Commissioners of the County of
Harnett, North Carolina, held on the lat. day of September 1941, is a true,
correct and compared copy of the original minutes of said meeting e8 file
and of record, and I do further certify that a copy of the Resolution,
numbered entitled " A Resolution Approving the Provisions of a Proposed
