May 5th. 1941
The Board of Commissioners met in regular session on Monday,
May 5th. 1941, at 10:00 A.M. with Chairman J.B.Ennis and Commissioners-
R.L.Pate, Ferd D.Jackson, A.A.Cameron and L.R.Byrd present; also the
County Attorney and the Clerk to the Board.
The Board ordered that the advertisement and sale of tax certificates
relative to 1940 taxes, be postponed for one month.
The Bond of J.B.Hubbard, Constable in Duke Township, with Fidelity and
Casualty Company as Surety, was presented and accepted and ordered recorded
with notation of its acceptance thereon«

KNOW ALL MEN BY THESE PRESENTS:
That Joseph D.Hubbard, of Erwin, State of North Carolina, hereinafter
called the Principal, and the Fidelity and Casualty Company of New. York,
hereinafter called the surety, a corporation organized under the laws
of the State of New York, with its home office in the City of 14ew York,
in the said State, are held and firmly bound unto Harnett County of North
Carolina, hereinafter called the Obligee, in the sum of One Thousand Dollars;
for the payment whereof to the Obligee the principal bins himself, his
heirs, executors, administrators, and assigns, and the surety binds itself;,
its successors and assigns, jointly and severally, firmly by these presents..
Signed, sealed and dated this 21st. day of April, 1941.
WHEREAS, the above -named principal hat been duly authorized or elected
to the office of Constable, Duke Township, of the County of Harnett, State
of North Carolina, for the term of office beginning on April 21st. 1941.
NOW, THEREFORE, the condition of the foregoing obligation is such that
if the principal shall faithfully perform such duties as may be imposed
on him by law and shall honestly account for all money that may come into
his hands in his official capacity during the said term, then this
obligation shall be void; otherwise it shall remain in force.

The Board approved the payment of per diem and expenses for the members
of the County Welfare Board on the same basis as is provided by law as
compensation for members of the County Board of Commissioners.
The following road petitions were presented and ordered forwarded to
The State Highway and Public Works Commission:
(1) Rebuild the old road in the village of Olivia leading from the Main
Highway at Asa L.Seawells to the main highway leading west from
Lillington Cameron, a distance of not over one -half mile and
inexpensive to construct.
(2) That the old road leading from the McDougald Road at a point near the
home of Willie McDougald to a point an highway No. 60, by way of
J.K.Stewart's sabre, and terminating at or near the home of Dave
Cameron, covering a distance of approximately three miles, be improved
and treated with hard surface.
It is ordered that David Lucas of Duke township, be relieved of poll
tax for the years 1939, 1940, 1941, on account of physical disability.
It is ordered that Paul A Tilleay, of Dunn, N.C., be refunded $3.05
for the year 1940, on account of error in late listing.
The Board refused to grant beer license to Charlie Bee Davis, at
Pine State Service Station 2 miles North of Lillington.

It is ordered that S.A.Lanier, Stewart's Creek Township, be relieved of
taxes and all cost on valuation of $3600.00 for year 1937, and that upon
payment of $106.33, the tax receipt for year 1938, be accordingly revised to
show only the sum of $106.33 and be released to tax payer.
Miss Maude Searcy appeared before the Board and presented a report of the
Home Demonstration work in the County.
It is ordered that, subject to the approval of the Local Government
Commission, the contract forms as submitted for the County Audit and that of
the office of the Clerk of the Superior Court with George C.Scott & Company,
Accountants, be executed by the Chairman of the Board in behalf of the County.
The County Audit to cover from June 30, 1940 to July 1, 1941, and the Audit
of the Clerk's office to cover all funds from December 5, 1938, through
June 30, 1941.
It is ordered that B.H.Sellars be authorized to overhaul electric wiring
at the County Home for the sum of $91.50, including labor and materials.
It is ordered that S.G.Davis of Upper Little River Township, be relieved
of all poll taxes permanently , on account of physical disability,he'being a
disabled World War Veteran.
It is ordered that J.W.Senter, Fuquay Springs, N.C., be allowed $10.00
per month out of the General Fund, beginning the month of May, on account
of serious illness.
The monthly report of Howard Godwin, C.S.C., was approved and ordered filed.
The monthly report of Inez Harrington, Register of Deeds, was approved and
ordered filed.
The monthly report of Lola O'Quinn, D.T.C. was approved and ordered filed.
The monthly report of W.D.Harrington, C.T.C. was approved and ordered filed.

"To the Honorable Board of Commissioners
In re: SD #2274 -A -1350 - J.R.Cannady
Gentlemen:
• On February 28, 1941, I submitted to you an offer from
Mrs.Lizzie Monds, to purchase three lots or parcels of land within the corporate
limits of the Town of Dunn in the sum of $950.00 on terms of $475.00 cash with
offer and balance to be paid in two equal annual payments with 6% interest.
This offer was accepted by your Board and also by the Board of
Commissioners of the Town of Dunn.
The title at that time appeared to be satisfactory to Mrs. Moods
attorney, Mr.I.R.Williams, but later Mr. Williams discovered that by error in
the tax foreclosure proceedings the wrong lot on South Magnolia avenue was
included in the tax foreclosure and that the County of Harnett and Town of Dunn
did not have title to lot on South '°•agnolia Avenue, on which the offer from
Mrs. Monds was based.
The town Board of Commissioners at its meeting last month ordered
that its part, that is, 58% of $75.00, or $275.50, be refunded Mrs. Monds.
The County's part should it follow the same course as the town of Dunn, would
be 42% of $475.00, or $199.50/
I an attaching to this report my personal check for $19.95 being
by refund to Harnett County for its part of the commission on the sale paid
to me by the County. I will also make the proper refund to the town of Dunn
tonight at its regular monthly meeting.
I recommend that a new suit be brought at once to include this
lot in question in order that the County and town of Dunn may be in position
to sell same. I also recommend that a quit claim be issued to A.B.Bethune
by Harnett County in order to clear Mr. Bethune's title caused by error in
the suit above referred to.

On motion 18 acres R.T.Rambeaut land, Black River Township, was rented
to Mr. H.G.Partin for 1941 for the sum of $50.00 cash rental.
It is ordered that W.E.Jackson, Averasboro Township, disabled World War
Veteran, be released of any and all poll tax due the County to date.
RESOLVED: Whereas, Joe Gordon made an offer subject to being put in
possession, dated January 21, 1941 for the purchase of 51 acres of land,
which was formerly listed by Amie Chance and was foreclosed by the County
under SD #2174 and A -1249;
And Whereas, the County has not been able to give Joe Gordon possession,
the offer of said Joe Gordon, under above date, is hereby rescinded and
cancelled.
It is ordered that W.D.Harrington be refunded the sum of $3.99 because
of over payment in taxes on land of Bessie Harrington Patterson in Upper Little
River Township, on account of shortage of four acres for the year 1936 -40,
inclusive.

for the sum of $92.00 cash with this offer, and subject to life estate in
the property to Amie Chance. The Chairman is hereby authorized to execute
deed and the Clerk will attest same, upon receipt of said sum from the
purchaser.
The Board. of Commissioners adjourned to re- convene at 1:30 P.M.
as a Board of Equalization and Review.
