The Board of Commissioners of Harnett County met in regular session on Monday, March 3, 1941, at 10:00 A.M. with Chairman J.B.Ennis, and Commissioners R.L.Pate, L.R.Byrd, A.A.Cameron and Ferd D.Jackson present; also County Attorney H.C.Strickland, and the Clerk to the Board. It is ordered that the fees for vaccination of dogs in Harnett County be raised from 50;L to 75¢`. The reason for this is that the vaccine has been advanced in price. It is ordered that I.A.Ausley formerly of Buckhorn Township, be released of 014.84 for the year 1938 on account of error, he having moved to -South Carolina in year 1937. - It is ordered that $1.21 penalty for late listing in Neills Creek Twp. berefunded to Mrs. Mamie Avent on account of error by list taker. - It is ordered that a colored nurse be employed by the county for the County Health Dept. to begin her duties on July 1, 1941. The Bond of Percy Arnold, Constable in Buckhorn Township, was approved in the amount of $1,000.00, ending on December 2, 1942, and ordered filed with Clerk Superior Court. "The Fidelity and Casualty Company, of New York " Know all men by these presents: That Percy Abe Arnold of Fuquay Springs, State of North Carolina, hereinafter called the Principal, and The Fidelity and Casualty Company of New York, hereinafter called the Surety, a corporation organized under the laws of the State of New York, with its home office in the City of New York, in the said State, are held and firmly bound unto State of North Carolina, hereinafter called the Obligee, in the sum of One thousand Dollars ($1,000.00) for the payment whereof to the Obligee the Principal binds himself, his heirs, executors, administrators, and assigns, dnd the Surety binds itself, its successors and assigns, jointly and severally firmly by these presents. Signed, sealed and dated this 27 day of February 1941. Whereas, the above -named principal has been duly appointed or elected to the office of Constable of the County of Harnett, State of North Carolina, for the term of office beginning on December 2, 1940 and ending on December 2, 1942. Now, therefore, the condition of the foregoing obligation is such, that if the principal shall faithfully perform such duties as may be imposed on him by law and shall honestly account for all monejthat may come into his own hands in his official capacity during the said term, then this obligation shall.be void; otherwise it shall remain in force; provided, however, that the Surety shall not be liable heereunder for any loss of public money deposited by or in behalf of the principal with any bank when such loss is occasioned by the failure of such bank faith fully to account for and pay over such money on legal demand; any law, decision, or statute to the contrary notwithstanding. " It is ordered that Pedler's license be granted free to Gervis C.Parker, of Wendell, N.C., for a period of one year on account of being a disabled World War Veteran. It is ordered that A.Langford Fann, of Erwin, Duke Township, be refunded '3.57 on account of error, he being a resident of Sampson County but working in Erwin, and having paid his taxes in Sampson Countyl It is ordered that C.g.Avery, Deputy Sheriff, Erwin, N.C., be allowed $40.00 for the purchase of a uniform as compensation for patroling school grounds at Irwin, N.C. It is ordered that James Floyd Whittenton of Averasboro Township, be relieved of poll tax on account of physicial disability,for a period of two years 1940, 1941. 275 It is ordered that L.D.Honeycutt, of Duke Township, be granted free pedler's license on account of his disability, for the year 1941. It is ordered that L.D.Honeycutt, of Duke Township, be and is hereby exempted from the payment of poll taxes for the year 1941 and prior years, on account of physicial disability, and a release will be Issued accordingly. It is ordered that penalty of $1.00 be refunded to James Milton Faircloth, in Averasboro Township, because of error in listing. It is ordered that the open season for fox hunting in Harnett County be set up to September 15th. from the former time of August 15th. It is ordered that C.T.Moore, a disabled world War Veteran, be allowed release for poll tax in Upper Little River Township, for the yeaze1940 and 1941. Be it resolved that Miss Lola O'Quinn be and she herein is appointed as Harnett County Delinquent Tax Collector for an extended term, beginning March 1, 1941 and ending June 30, 1911, her bond having been extended and approved by the Board. The following road petition was presented to the Board approved and ordered forwarded to the State Highway and Public Works Commissions (petition given to H.A.Turlington for presentation.) 1. Beginning at No. 55, Mrs. W.H.Turlington and Stuart Turlington places running West between the W.H.Turlington estate and L.L.Thrlington estate and Stuart Tutlington; thence by the old Turlington school house, B.W.Barbour est., F.T.Tart, and R.A.Poole; thence to the J.B.Kelly place, Etta Wiggins place, into the road known as the Brick Mill Road at a point known as the shingle house, between H.A.Turlington and D.T.Grimes. (The Brick Mill Road is the one leading from Hiram Stewart's fillingtstation, wire road, to Coats.) 2. To approve for maintenance and request the State Road authorities to place on its map of road for maintenance, and to maintain and keep in good repair that certain road leading from the "Mary Stewart School House to Hodges Chapel Road ", to Stewart Pond Road, and running over the property of L.A.Massengill Claude Young, Harvey Barefoot, W.R.Miller, O.H.Miller, Minson McLamb, and Monroe McLamb, said road being situate in Averasboro Township, Harnett County North Carolina. Honorable Board of County Commissioners: Your committee appointed on February 3, 1941 to make settlement with Mr. T.B.Smith on delinquent taxes in Averasboro Township, wish to offer the following resolution and move its adoption: tlthereas, Mr. T.B.Smith is charged with taxes on one house which he did not own, and is not charged with 31 small lots of 25 feet frontage, which your committee thinks is of equal value, and Whereas, there has been listed to Mr. Smith several lots which have also been listed by the Durham & Souhhern Railway Company and taxes have been paid by them for a number of years, Now, therefore, be it resolved that if Mr. Smith will pay the net amount of taxes charged against him, the Delinquent Tax Collector of Harnett County be authorized to accept same as full settlement of any and all liens against his property and the County Attorney be authorized to take a non -suit in the case against him at the cost of the County. Be it resolved further that the Tax Supervisor be empowered to list all of Mr. Smith's property as now held by him, on a basis of one dollar per front foot. Reddish R.J.Broadwell H.D.Oarson Tom Newton J.H.Moore Edward Turnage J.L.Hamilton it 7, 1941: Grove Duke Averasboro Black River Lillington Lillington Grove Averasboro Lillington It appearing to the Board of Commissioners of Harnett County that in 1931 a tax foreclosure judgment was entered in Book 23, page 98, it being Judgment No. A -418, at the instance of J.O.West, Attorney, in the case of County of Harnett vs Lula Williamson and husband, for the recovery of $29.17, interest and costs, for taxes allegedly due on the properties therein described and that sale of said property was made but before confirmation of said sale, the matters in controversy were settled, and that the judgment is a cloud upon the title to the property therein described: BE IT RESOLVED that J.B.Ennis, Chairman of the Board of Commissioners, be, and he hereby is authorized and directed to enter satisfaction of said judgment of record in Judgment Docket No. 23, page 98, it being numbered A -418, and his acts in so doing are hereby ratified. WHEREAS, 25 acres of land in Upper Little River Township described in Judgment A -1070, were purchased from the County of Harnett by H.M.O'Quinn & Bro. at a sum in excess of the investment of the County of Harnett in said land; and., whereas, it appears that there was a defect of parties in that, the tax listing owner had died, and service by publication on her was insufficient to bind her heirs at law; and, whereas, the owners legally entitled to an interest in said land have obtained from said H.M.OtQuinn & Bro. a quitclaim Deed, and have paid therefor '4207.61, including interest on the investment of the said O +Quinn Bros., and which said sum lacks $23.98 of reimbursing the said H.M.41Quinn & Bro. in full in respect of said transaction; and, whereas, to perfect title in a proper manner- would involve expense in excess of $23.98, for which said sum the County of Harnett is without hope of reimbursement: NOW, THEREFORE, it is ordered that the County of Harnett reimburse the said H.M.OtQuinn and Bro. in the amount of $23.98, voucher for which amount shall be made payable to the said O &Quinn Bros. and M.O.Lee, their attorney. W.E.Nichols, having become the purchaser of approximately 25 acres and 4 3/4 acres of land in Lillington Township, which lard is described in Judgments A -1340 and A -1228, respectively, and it appearing 'hat certain heirs at law were seized of certain interests, and that their names were undisclosed of record, and that the County of Harnett realized for the said property a sum in excess of its investment therein; and that John Spears, Esq., is familiar with the interests of the undisclosed parties, and that said title . should be perfected; it is, therefore, ordered that John Spears, Esq., be and he hereby is authorized and directed to perfect the title to the said properties in a legal and satisfactory manner, for which services the County of Harnett will compensate him., it appearing that he may be in position to accomplish this result at less cost to the County than will be the case if any other attorney should undertake the work. 277 To Harnett County and Town of Dunn Memorandum of offer from Mrs. Lizzie Monds, Dunn, N.C. to purchase three lots, or parcels of land located in the town of Dunn, N.C. as followa and being the same lots or parcels of land formerly belonging to J.R.Cannady and Myrtle Cannady and taken over by the County of Harnett and Town of Dunn under tax foreclosure proceedings #SD 2274 A 1350 for non - payment of taxes; 1 lot on South Magnolia Avenue 1 lot on South Wilson Avenue 1 lot on East Cumberland Street For the sum of Nine Hundred fifty dollars ($950.00). Terms of $475.00 cash with this offer and balance divided in two equal annual payments with 6% interest per annum, said payments due and payable Feb. 28, 1942 and February 28, 1943. Purchaser to pay taxes for the year 1941 and subsequent years. Purchaser agrees for South Magnolia Avenue to be opened and extended and to move at her expense the house which is now located in the proposed extension of South Magnolia Avenue. Mr. I.R.Williams, Attorney for the purchaser, has agreed that offer to purchase above property will be signed at a later date (or as soon as same can be prepared) and be delivered to the County of Harnett and Town of Dunn for properi¢- °filing. WHEREAS, W.B.Ferrell was double- listed for poll tax in Barbecue and Hector's Creek Townships for the year 1938; Be it resolved that the taxes for Barbecue Township in the amount of $2.24 charged to him for the year 1938, be released. BE IT RESOLVED that, upon receipt of $90.00 by the County of Harnett, the lot described in Judgment A -943, it being a lot in Grove Township, listed heretofore to Prentis McLean, be quit - claimed to - - -- Wilbert McLean, Gotbel McLean, James McLean, Coleman McLean, LaRue McLean, and Blanche McLean and upon receipt of said sum, the Chairman of the Board of Commissioners is hereby authorized and directed to execute in the name of the County of Harnett a Quit Claim Deed and the Clerk to the Board will. attest the sane. BE IT RESOLVED that property acquired by the County of Harnett and the Town of Dunn, at tax foreclosure sale under Judgment #2917 -A -952, be sold to - - -- Michael A.Williams and wife Leola B.Williams for the total sum of $1,000.00 on the following terms and conditions: $110.00 cash with this offer; and $50.00 March 17th 1941; $50.00 April 17, 1941; $40.00 May 17, 1941; and the remaining $750.00 due and payable $12.50 every thirty days beginning June 17, 1941 until the sum of $750.00 is paid in full with 6% interest per annum on deferred payments. Interest to be paid as stated below. All of a lot of land situare in Averasboro Township, Harnett County, in the town of Dunn, North Carolina, beginning at a stake in the Eastern edge of Washington Avenue fifty feet from the intersection of the Eastern edge of washington Avenue with the Southern edge of Divine Street and runs South with Washington Avenue seventy five feet to a stake; thence East and parallel with Divine Street two hundred twenty five (225) feet to a stake; thence North and parallel with Washington Avenue one hundred twenty five (125) feet to a stake in the Southern edge of Divine Street; thence West with Divine Street seventy five feet to a stake; thence South and parallel with Washington Avenue fifty feet to a stake; thence West and parallel with Divine Street one hundred fifty (150) feet to the beginning, and being all of Lot -No. 3, the resident lot of the subdivision of the Holiday Block and appearing on the Blue Print Map of said property made by H.W.Prince, surveyor, December 12, 1923, and recorded in office of Register of Deeds Harnett County. The foregoing parcel of land being the identical parcel of land described in that certain judgment No. A 952 recorded in the office of the Register of Deeds for Harnett County, Lillington, N.C. and referred to in said judgment in the following language: "Being that lot or parcel of land on East Divine Street and South Washington Avenue in the town of Dunn, conveyed to Martin B. Williams by deed from John C.Williams dated December 6, 1924, and recorded in Book 216, page 22." The foregoing lot of land being one of the parcels foreclosed in that certain judgment hereinabove referred to and bearing date of July 25, 1938 and recorded in Book of Tax Judgments No. 25 at page 149. And the Chairman of the Board is hereby authorized to execute deed to Michael A.Williams and wife Leola, and the Clerk will attest same. 278 BE IT RESOLVED that the property acquired at tax foreclosure sale under Judgment #2040 -A -1048 be sold to - - -- H.P.Byrd - -- -for the suns of %900.00,on the following terms and conditions: y$"100.00 cash with this offer and $25.00 per month due and payable on the 20th day of each month until the remaining $800.00 has been paid with 6% interest on the deferred payments as stated below. Being a lot 75 x 165 feet on East Edgerton Street, Dunn, N.C. on which is located three small houses and formerly owned by Carlyle Bain. For further description reference is made to Book 236, page 411, and the Chairman of Board is hereby authorized to execute deed to H.P.Byrd and the Clerk will attest same. The report of Lola OtQuinn, Delinquent Tax Collector, was approved and ordered filed. The report of Inez Harrington, Register of Deeds, was approved and ordered filed. The following rider was ordered recorded in the Minutes of this meeting and attached to the bond of W.E.Salmon, Sheriff: "Rider to be attached to and form a part of bond No. 384079 K on behalf of William E.Salinon, as Sheriff of Harnett County, North Carolina, Penalty $5000. dated November 15, 1938, effective December 5, 1938 ". "In consideration of the premium charged for the attached bond, it is understood and agreed that in the recital of the bond where the words "for the term of . two years" appear, the word "four ", is substituted for the word "two ", it having been the intention of the parties t:5 the bond that it should cover the full term of office for which the Sheriff was elected filom and after the first Monday in December, 1938. It is ordered that the tax valuation on the property listed to E.M.Cain in Neills Creek Township, be reduced by $100.00 for the years 1934 to 1940, inc. 279 It appearing that R.L.Pate is intimately acquainted with the market value of drugs, groceries and supplies needed and used by the County, and that his services as Purchasing Agent will effect a substantial savings to the County, and that his services necessitate attendance at the County Seat frequently: BE IT RESOLVED that R.L.Pate be and he hereby is appointed as Purchasing Agent for Harnett County, his compensation to be the per diem (not exceeding one day each week) as is or may hereafter be prescribed by law or compensation for each County Commissioner. Voting for adoption: Commissioners L.R.Byrd, A.A.Cameron, and F.D.Jackson. Not voting: R.L.Pate. It is ordered that John F.McLean (colored) of Lillington, be relieved of ?1.00 dog tax for year 1937. It is ordered that a storage warehouse 30 x 60 feet be built et the rear of the Agricultrual Building. It is ordered that J.Ray Johnson, Neills Creek Township, be relieved of poll taxes for the year 1940 and year 1941, on•account of physicial disability. It is ordered that an office space be provided in hall of the Courthouse at the foot of the stairs for the use of the Auditor;and H.S.Freeman was authorized to have the room built at a cost of not more than $$100.00.
