Dec. 2, 1940
The Board met in regular session on Monday, December 2, with Chairman
J.B.Rnnis, and Commissioners L.R.Byrd, R.L.Pate, Ferd D.Jackson and
A.A.Cat`neron present. Also County Attorney H.C.Strickland, and Inez Harrington
Clerk to the Board.
It is ordered that advertisement be made in Harnett County News of the
fact that notices are being sent by the Delinquent Tax Collector to all
delinquent tax payers in the County.
It is ordered that upon payment by Allie Prince Blalock of the sum of
$23.42 to the County of Harnett this date, the 182 acres of land located in
Neiil's Creek Township, allocated to her by deed recorded in Book 275,
page 422, it being a part of 56 acres of land listed to J.Add Johnson
heretofore, be released and relieved of the lien of taxes due the County of
Harnett for the years 1938, balance of 1939, and 1940.
It is ordered that the property in Anderson Creek Township, Harnett County,
formerly listed to John and Angus McArtan for taxation, containing 367 acres,
more or less, acquired by the County of Harnett under tax foreclosure
judgment No. A -1295, be conveyed to Angus McArtan as per his offier,
for the sum of $1125.00, to be paid to the County, this date, and upon receipt
of said sum by the County, the Chairman of the Board is directed to execute
Deed and the Clerk to the Board will attest the same.
The report of Howard Godwin, C.S.C. for the month of November, was filed
and approved.
The report of Inez Harrington, Register of Deeds, for the month of
November, was filed and approved.
The report of W.D.Harrington, Tax Collector, for the month of November
was filed and approved.
The report of hiss Lola O'Quinn, delinquent tax collector, for the month
of November was filed and approved.
The annual report of Howard Godwin, C.S.C. from January 1, 1940 to
November 30, 1940 was presented and approved.
The report of the Grand Jury for the November Term, 1940 Superior Court,
was received and ordered recorded in the Minutes.
"North Carolina; In the Superior Court
Harnett County: November Term 1940.
To His Honor Henry L.Stephens, presiding:
We, the Grand Jury at this Term of Harnett Superior Court, do respectfully
submit the following report:
1. We have carefully considered and passed upon all bills of indictment
sent us by the Solicitor, and have made returns on same.
2. We have visited the Prison Camp and our inspection revealed a very
efficient management, all buildings being kept in good and sanitary condition
and inmates satisfied with prevailing conditions.
3. We find all County Officers performing their duties in a most
efficient manner.
4. We inspected the County Jail and found it in good condition except
for leak in roof over prisoners quarters and some repairs needed to plastering
The prisoners report datisfactory fate and keep.
5. We inspected the County Home and found conditions at a high standard
and inmates thoroughly satisfied with present personnel. However, we do
recommend that the plastering in the hall be repaired and material of some kind
be furnished to remove stain from bath room fixtures.

6. Pursuant to the instructions given in the Charge of the Court,
we investigated the matter of the alleged accountability of Mr. J.S.McLean,
former County Auditor, and interrogated witnesses whose knowledge best
qualified them to know of the facts in respect thereto. As a result of our
investigation, we do not find any evidence or information to support a
presentment or indictment against Mr. McLean for the commission of any crime.
This matter appears to have been considered by former grand juries with the
same result.
In connection with the alleged discrepancies which occurred in the office
of the County Auditor, we find that much and unneccessary publicity was given
to an alleged "shortage" on the part of Mr. McLean, which was unjustified,
as his accountability was fully made then it was definitely fixed and upon
demand for payment. We further find that the special audit covering the
sixEnonths period, during the course of which the discrepancies appeared to
have occurred, was requested by Mr. McLean in person, in order to clear up
a situation which had its inception prior to the time he took office, and that
the County was paid 100% of the accountability of Mr. McLean.
We take this occasion to condemn the practice, particularly in the instant
case, of persons writing unsigned letters to the Presiding Judge, thereby
attempting to pervert the functions of the Grand Jury to satisfy personal
animosity, as our jury may be approached at any time by any aggrieved citizen,
and any complaints will receive a responsive ear.
In conclusion, we wish to express our thanks to the Court for his able
Charge which we, as a body, consider a masterpiece, and hope for his assignment
to this County again soon.
We wish to thank all the court officials for their prompt and courteous
assistance rendered; also, the prison personnel for the sumptuous dinner served.
Every one joins in the saying: "This has been a very pleasant and happy
Week."

It is ordered that beer license be granted to A.B.Hayes in Anderson Creek
Township at "Hayes Service Station."
It is ordered that D.G.Darroch be relieved of poll tax for year 1940, on
account of being a disabled World War veteran.
It is ordered that Ferd D.Jackson and L.R.Byrd be appointed to purchase
a mule for use at the County Home.
It is ordered that a hog be purchased from E.C.Byrd for use at the County
Home, for the price of $25.00.
It is ordered that Mrs. G.W.Arnett of Upper Little River Township, be
released in the amount of 0220.00 on tax valuation, on 49 acres of property
listed to her in Upper Little River Township.
Mr. C.R.Ammons, County Farm Agent, appeared before the Board and requested
that Mrs. Joel Layton, Jr. be appointed temporary Home Demonstration Agent
for a period of two months, upon recommendation of Mrs. Ruth Current, of the
State Extension Division.
Commissioner Ferd D.Jackson made the motion and seconded by Commissioner
A.A.Cameron that Mrs. Layton be appointed temporarily. The motion was carried,
and Mrs. Layton was appointed Home Demonstration Agent temporarily for a period
of two months.
It is ordered that E.S.Matthews be granted an extension of 60 days time to
pay balance of $40.00 on 4365.00 payment, due December 1, 19400 on contract to
purchase land under contract with County, SD 2266 Judgment No. A -1279.
Out of respect for Mr. Ernest F.Young, Dunn, N.C., former County Official,
the Board ordered that the county offices be closed on Tuesday, Dec. 3, 1940,
from 10:00 to 2:00 for the funeral of Mr. Young. -
The Board appointed a committee composed of Ferd D.Jackson and A.A.Cameron,
to investigate tax valuation on property listed to J.D.Upchuroh estate in the
town of Lillington, N.C.

It is ordered that the deposit made by Dougald McRae as "earnest money"
on 367 acres of land in Anderson Creek Township, Harnett County, formerly
listed to John McArtan and Angus McArtan, in the amount of $500.00, evidenced
by receipt No. 2401, dated 10- 16 -40, be returned and refunded to said
Dougald McRae, the Board of Commissioners having failed to ratify and approve
said sale. This pertains to property acquired under Judgment No. A -1295.
It is ordered that the printed form notices to delinquent tax payers as
per copy attached, be forthwith mailed to all delinquent tax payers in
Harnett County, by the Delinquent Tax Collector, under the Supervision of
Geo. Scott Company, Accountants.

Attached hereto is a statement of your PAST DUE TAX. The Board
of County Commissioners has instructed me to proceed under the law to collect
all DELINQUENT TAXES. You can save yourself some money by making payment
immediately upon receipt of this letter.
I am sure that you are familiar with the fact that the law requires
me to proceed against every one who is on the delinquent list, and also that the
laws requires me to garnishee, levy, and reduce to sale, all taxes not paid.
Any one of the above methods is expensive, and to some might be embarrassing.
Please do not delay. Attend to this matter at once.

By unanimous vote of all members of the Board of County Commissioners,
the following appointments to the respective offices named below, were made:
H.S.Freeman as County Auditor and Tax Supervisor , for term expiring first
Monday in December, 1941.
E.C.Byrd, as Superintendent of the County Home for term expiring first Monday
in December, 1941.
M.O.Lee, as Solicitor of the County's Recorders Court, for term expiring first
Monday in December 1942, or at the pleasure of the Board.
Walter Lee Johnson, as Vice Recorder of the County's Recorders Court, for
term expiring first Monday in December 1942, or at the pleasure of the Board.
The Board of Commissioners by unanimous vote appointed R.L.Pate as Purchasing
Agent of the County for the term expiring first Monday in December, 1941.
By like vote the following committees were named for terms expiring first
Monday in December 1942:
Committee on County Home: R.L.Pate and A.A.Cameron.
Committee on County Farm: L.R.Byrd and Ferd D. Jackson.

days notice in writing to the Board of Commissioners of Harnett County, North
Carolina, and this bond shall be deemed canceled at the expiration of said

date of such cancelation, under the terra, conditions, and provisions of this

The Board of Commissioners net in a call session on Friday, Dec. 6, 1940
at 2:00 P.M. with Chairman J.B.inis present and Commissioners R.L.Pate,
L.R.Byrd, A.A.Camern and Fered D.Jackson present also. County Attorney
H'C.Strickland and Clerk to the Board Inez Harrington were present too.
The Board ordered that the tax valuation of property listed to
Mrs. J.D.Upchureh be reduced by 3300.00 on the building, but no change on
the lot, for years 1938, 1939, and 1940.
It is ordered that L.L.Williams in Barbecue Township, be released $2.00
dog tax on account of error in listing.
It is ordered that the amendment to the current budget of the Welfare
Department providing compensation to Mrs. Elizabeth Matthews at the rate of
$85.00 per month by transfer of unexpended clerk hire without increase
of total budget, be and the same is hereby approved.
