HomeMy WebLinkAbout1002193988 October 2, 1939 The Board of Commissioners met in regular session on October 2, 1939, at 10 :00 A.M. with Chairman J.B.Ennis present and the following Commissioners: Ferd D..Jackson, Lonnie R.Byrd,and A.A.Caaieron. Commissioner R.L.Pate was absent. County Attorney H.C.Strickland was also present. It is ordered that the 78 acres of land listed to M.V.Lanier, in Buckhorn Township, Harnett County, be released and relieved of the lien of taxes for the years 1931, 1933, 1934, 1935, and 1936; and the County Auditor will so note the release upon the tax receipts and certificates for said years, taking credit therefor. And it appearing that all taxes for said years on other lands listed to M.V.Lanier have been paid. IT IS ORDERED that a non -suit be taken in the pending tax suit against him, S.D. No. 1959. It is ordered that J.R.Martin of Grove 'Township, be relieved of poll tax for the year 1939, he being a disabled World War Veteran. The Board appointed A.A.Cameron and Venable Baggett as a committee to investigate the tax valuation on the property listed to Mrs. J.B.Ramsey in Barbecue Township. BE IT RESOLVED that the County of Harnett quitclaim to Walter Waddell and Dora Waddell - - -- the tract of land in Johnsonville Township, Harnett County, formerly listed to Mary McNeill Loving, described as 90 acres, and which the County purchased at tax foreclosure sale under Judgment No. A -SD 2358, upon payment to the County of $100.00, and upon receipt of said sum by the County, the Chairman is hereby authorized and directed to execute deed in behalf of the County and the Clerk to the Board will attest the same. Upon motion of Commissioner Jackson, and seconded by Commissioner Cameron, Miss Christine Odum was appointed as Home Demonstration Agent, to fill out the unexpired term of Miss Naomi Carr ending June 30, 1940. It is ordered that a salary of $100.00 per month appropriated for the Solicitor of Recorder's Court, be paid monthly to him, at the end of each month, beginning at end of July, 1939. It is ordered that a salary of 0150.00 per month appropriated for the salary of Judge of Recorder's Court, be paid monthly to him at the end of each month, beginning at the end of July, 1939. It is ordered that the land in Johnsonville Township, listed in the name of John W.Cameron estate, be surveyed. BE IP RESOLVED that the 33 1/3 acres of land in Barbecue Township, formerly listed to Estelle Reid (colored) and acquired by the County of Harnett at a tax foreclosure sale under Judgment No. SD 2344 -A -1358, be sold to - - -- Sidney G. Thomas - - - -on the following terms and conditions: Total price of $333.33; cash with this offer: $33.33; and $100.00 on Jan. 1, 1940; and 0200.00 together with 6% interest, and 1939 and subsequent years taxes on January 1, 1941. The Chairman of the Board is hereby authorized to execute deed on behalf of the County to Sidney G.Thomas, and the Clerk to the Board will attest the same. It is ordered that beer license be granted to Bert M.Holland, Dunn, N.C. at Bert's Tavern, one -half mile south of Dunn, en Highway No. 301. The report of Inez Harrington, Register of Deeds, was approved and ordered filed. The report of Howard Godwin, Clerk of Superior Court, was approved and ordered filed. The report of the Grand Jury for First September Term 1939, was ordered filed Which reads as follows: "NORTH CAROLINA: IN THE SUPERIOR COURT HARNEE' T COUNTY: , FIRST SEPTEMBER TERM 1939 TO -HIS HONOR WALTER J.BONE, Judge Presiding: We, the Grand Jury, at this term of Harnett Superior Court, do respectfully submit the following report: 1. We have considered and passed upon all bills of indictment sent us by the Solicitor and have made returns on same. 2. We visited the State Highway and Public Works Commission Camp at Lillington, in a body, and found the camp to be in excellent condition. 3. We visited the County Home and found it keptin excellent condition and that the inmates are happy and contented. 4. We inspected all offices sin the Courthouse and found them being kept in as good condition as possible. 5. We inspected the jail and found it in a most sanitary condition. 6. We found that all guardians and justices of the peace weremaking proper reports. We desire to make the following recommendations: (a) That the plastering in the living quarters of the jail, and leaks in the roof of the jail, be repaired as early as possible when finances of the county will permit same. (b) That the school trucks or buses be Inspected by the next Grand Jury, to see that they are in safe and proper condition for the safety of our children. (c) That the officers of the County investigate at once the legality of all slot machines in the County, and that the operators of all illegal machines be prosecuted. NORTH CAROLINA: HARNEPT COUNTY: RESOLUTION Whereas, the County of Harnett instituted suit, SD No. 4050, against Sarah M. Wade and others, for the purpose of recovering taxes due on a certain lot in Dunn, Averasboro Township, as described in the complaint; and, Whereas, Jackson Townsend, mortgagee, filed an answer and a cross action against his co- defendant, Town of Dunn, as will appear by reference to the judgment roll, in which answer and cross - action Jackson Townsend, mortgagee, attacked the listing of said property for taxation by the County of Harnett and Town of Dunn for all years except 1934, 1935, 1936, 1937, 1938, and 1939; and, Whereas, in January 1939, the supervisor of taxation, after - listed the said property for the years 1934, 1935, 1936, 1937, and 1938, and the County Attorney has advised that, as said property was not lawfully listed by the owners during the years covered by the years before after - listing, or by the authorized agent of the owners, the defense set up by Jackson Townsend is valid as has been declared in the case of Madison County -vs- Coxe, 204 N.C. 58: Now, Therefore, it is ordered that the acts of J.S.Mcikean, Tax Supervisor, in after - listing the said property for the years 1934, 1935, 1936, 1937 and 1938 at a valuation of $1,000.00, be and the same is hereby approved; that in behalf of the County of Harnett, a consent judgment be signed by the County Attorney waiving any alleged rights to recover taxes for all years prior to 1934; and that the Money Judgment recovered, which is a lien on the subject property of equal dignity with that of the Town of Dunn, if not paid within ten days, be satisfied by a sale of the said property by a Commissioner to be appointed by the court; that upon payment of the Money Judgment, together with all interest, penalties and costs within ten days from the date hereof, the County Auditor is hereby authorized and directed to transfer and assign the said judgment to any person who may pay full value for the same, without recourse on the County of Harnett. NORTH CAROLINA: HARAIT'T COUNTY RESOLUTION On Motion of Commissioner Byrd, and seconded by Commissioner Jackson, and duly passed and carried, BE IT RESOLVED and ordered by the Board of County Commissioners of Harnett County, North Carolina, as follows: FIRST: Be it resolved that W.D.Harrington be and he is hereby appointed Tax Collector for the county of Harnett for the tax year 1939 county tax levy. SECOND: 'Be it resolved that the bond of W.D.Harrington, the duly appointed Tax Collector of Harnett County, for the 1939 tax, levy year, be and the same is fixed at the sum of Twenty five Thousand Dollars, said bond to be approved at this meeting or at any adjourned, or at the next regular meeting of this Board of County Commissioners. THIRD: W.D.Harrington, Tax Collector for the 1939 county tax levy, having informed the Board of Commissioners that he has appointed Miss Elizabeth Lasater, Assistant Tax Collector for said 1-939 levy, therefore be it resolved and ordered, that the bond of Miss Elizabeth Lasater, Assistant Tax Collector for 1939 tax levy, be fixed at the sum of Five Thousand Dollars, said bond to be approved by this Board at this meeting or any adjourned or at the next regular meeting of this Board of Commissioners. FOURTH: And further be it resolved that the salary of W.D.Harrington, the duly appointed Tax Collector of Harnett County for the year 1939 tax levy, be and the same is hereby fixed at the sum of $431.25 per month, and that in addition to said monthly salary, the said W.D.Harrington, Tax Collector shall receive all legal levy and garnishee fees now allowed by law, and that in addition to said monthly salary and said levy and garnishee fees, the said W.D.Harrington, Tax Collector, dhall receive such sums for land sales as shall be allowed and fixed by the Board of County Commissioners; and that the said salary and compensation shall be the full salary and compensation for the said office of Tax Collector, and said Tax Collector shall pay and discharge all expenses of the said office. FIF'T'H: And further, be it resolved that said W.D.Harrington, Tax Collator, of Harnett County, for the year 1939 county tax levy, be and he is hereby relieved and discharged from the duty of collecting any taxes prior to the 1939 county tax levy made by the Board of Commissioners of Harnett County, 93 SIXTH: And further, be it resolved that said W.D.Harrington, be and he is hereby ordered to deposit daily all sums and amounts collected on said 1939 county taxes in the First- Citizens Bank and Trust Company, of Dunn, North Carolina, the official depository of the said County of Harnett, to the credit of Harnett County 1939 Tax Distribution Account, and that the said official depository bank shall daily issue to said W.D.Harrington, a receipt Cbr such deposits, and the said W.D.Harrington shall thereupon daily deliver to the County Accountant each and every of said receipts so received from said Depository; and that upon cprtpliance therewith by said Tax Collector, that thereupon, he, the said W.D.Harrington, Tax Collector, and his said surety on his said bond, shall be released and relieved of all further liability, and responsibility for such amounts or sums so deposited in said depository. SEVENTH: And be it further resolved, that the first- Citizens Bank and Trust Company, Dunn, N.C. Branch, be and the same is hereby designated as the official depository of the County of Harnett, for all funds of said County, including all funds which may be collected by the said W.D.Harrington as Tax Collector of Harnett County for the 1939 County tax levy made by the Board of Commissioners of said County. EIGHTH: And be it further resolved that First- Citizens Bank and Trust Company said depository, be and it is hereby ordered and required to make bond in keeping with the provisions of law to secure all deposits of the County of Harnett, including all sums which may be collected by the said W.D.Harrington, Tax Collector for the 1939 county tax levy and deposited in the said banit, in the sum of not less than $75,000.00, to be increased and fixed from time to time as the amounts of deposits at any one time may require, said bond to aViall times be in a principal amount aggregating more than the total deposits of said Harnett County on any given date; and in lieu of said bond the said First- Citizens Bank and Trust Company may place in trust with Wachovia Bank and Trust Company, Raleigh, N.C., Trustee, acceptable securities approved by the County Accountant, for the benefit of securing all the deposits of Harnett County in said First - Citizens Bank and Trust Company, the aggregate amount of such securities to be in a sum not less than the bond required by law. NORTH CAROLINA: HARNEPT COUNTY: RESOLUTION On motion of Commissioner Byrd, and seconded by Commissioner Jackson, and duly passed and carried, BE IT RESOLVED and ordered by the Board of County Commissioners of Harnett County, as follows: FIRST: That the tax settlement of W.D.Harrington, Tax Collector for the year 1938 County tax levy, together with the insolvent list for said 1938 tax levy, hereto attached and made a part hereof, said insolvent list having been heretofore approved and accepted, be and the same is hereby accepted and approved, and same is hereby ordered to be recorded in the records of the Minutes of the Board of County Commissioners of Harnett County; SECOND: And further be it resolved and ordered by the Board of County Commissioners of Harnett County, that the said W.D.Harrington, Tax Collector of Harnett County for the year 1938 County tax levy, be and he is hereby released and relieved and discharged of and from any and all further liability and responsibility for the collection of any and all delinquent and insolvent taxes for the year 1938 county tax levy; THIRD: And further be it resolved and ordered, that the County Auditor, J.S.McLean, be and is hereby authorized and directed to execute and deliver any and all necessary and proper instruments for the full and proper clearance and discharge for the said 1938 tax levy, both for the said W.D.Harrington, Tax Collector, and his Assistant Tax Collector, Elizabeth Lasater, and said Maryland Casualty Company of Baltimore, Maryland, surety, on said bonds of said Tax Collector and Assistant. FOURTH: And be it further resolved and ordered, that said W.D.Harrington, Tax Collector for year 1938 tax levy, and said Elizabeth Lasater, Assistant Tax Collector for said year 1938 tax levy, and said Maryland Casualty Company of Baltimore, Maryland, as Surety on bonds of the said Tax Collector and Assistant Tax Collector for year 1938 tax levy, be and they are hereby released and discharged of and front collection of taxes for the year 1938 county tax levy. Inez Harrington, Ekerkoto the Board. 94 NORTH CAROLINA: HARNETT COUNTY: RESOLUTION On motion duly made and carried, BE IT RESOLVED, that W.D.Harrington, Tax Collector for the year 1938 county tax levy, be and he is hereby allowed the sum of $1.20 for each and every land sale made by him for the 1938 taxes, and salary up to October 1, 1939, and the County Auditor is hereby authorized and directed to pay said W.D.Harrington said sum so allowed herein for land sale of 1938 and salary to said October 1, 1939. And further, bE IT RESOLVED, that said W.D.Harrington shall pay out of the compensation herein allowed for said land sales, all expenses whatsoever connected with said 1938 land sale, including the account of newspaper for publication of said land sale notices. MARGARET WHITT In this action, the Grand Jury at this Term, has returned a True Bill against the defendant charging her with the murder of Worth Whitt. At the time of her arraignment it was suggested to the Court that the defendant could not obtain a fair trail in Chatham Counry because of the wide discussion of the matter through out the County, and thereupon the Court conferred with the Solicitor and the counsel for the defense, and it was agreed that a jury should be drawn from Harnett County in accordance with the provisions of -C.S. 473. IT IS NOW, THEREFORE, BY THE COURT ORDERED,- ADJUDGED AND DECREED that the Chairman of the Board of County Commissioners for the County of Harnett shall immediately cause to be drawn from the regular jury box of said county by a child under ten years of age one hundred scrolls containing the names of duly qualified jurors in said county, and that the Sheriff of Harnett County shall summon the jurors who are so drawn to be and appear at the court house in Pittsboro, N.C. at 9:30 A.M. on Friday, October the7th. 1939, to be examined as prospective jurors and to serve as Jurors in this case if selected.
