June 5, 1939
The Board of Commissioners of Harnett County met in regular session Monday,
June 5th. 1939, with Chairman J.B.Ennis and Commissioners A.A.Cameron, R.L.Pate,
Lonnie R.Byrd and Ferd D.Jackson present. Also H.C.Strickland,County Attorney
was present.
The following road petition was approved and ordered forwarded to State
Highway and Public Works Commission:
The road leading from Dunn in an easterly direction known as the Jonesboro road.
The road is surfaced with gravel and tar from Dunn to Carlyle Core's filling
station. We request that said road be surfaced with tar and gravel from
Carlyle Core's filling station to Johnston County line.
The following road petition was approved and ordered delivered to Neill McKay
Ross, who will present same to the State Highway and Public Works Commission:
That proposed road a distance of one mile, connecting U.S.No. 421 and the Old
River Road two miles west of Erwin by the homes of J.F.Avery, E.S.Avery and others.
The report of the Register of Deeds was approved and ordered filed.
The report of the Clerk of Superior Court was approved and ordered filed.
The report of the Tax Collector was approved and ordered filed.
The report of the Grand Jury for the Second Term 1939 was read by the Board
and ordered filed.
The Board of Commissioners of Harnett County approved the appointment of
Duncan C.Wilson ad Judge of Recorders Court of Dunn by the Board of Commissioners
of the.town of'Dunn on May 15, 1939.
The Board approved the Extension Budget for the County fiscal year
July 1, 1939 to June 30, 1940, which was submitted at this meeting as follows:

Upon motion of Commissioner L.R.Byrd, seconded by Commissioner F.D.Jackson,
a motion was put providing that no amusement slot machines -or devices be
licensed in Harnett County. Upon putting the question, Commissioners Byrd and
Jackson voted not to license such devices, and Commissioners Cameron and Pate
voted to so license such devices. Whereupon Chairman Ennis voted to tax them,
and it was so provided in the Schedule of "B" License Taxes adopted.
The County Attorney was instructed to communicate with Mrs.Estelle Smith and
Miss Isabelle Moseley with a view, if possible, of arranging for the appointment
of Miss Wilma Williams, as County Home Demonstration Agent, it having been
represented to this Board at its May meeting that Miss Moseley should be
appointed to the position for that there was no one qualified for the work in
Harnett County.
It is ordered that the 6 acres of cleared land listed in the name of
Mrs. Effie Allen, Averasboro Township, be reduced from $65.00 to $45.00 an acre
for years 1937 and 1938.
It is ordered that the 172 acres of land listed to Henry Sulton(colored)
in Stewart's Creek Township, and acquired by the County of Harnett under tax
foreclosure Judgment No. A -994, be conveyed to Henry Sulton upon payment by him
of $5.00 this date and the balance with 6% interest on or before Nov. 15, 1939.
It is ordered that Stewart Hardee of Grove Township be relieved permanently
of poll tax on account of physical disability.
It is ordered that E.W.Huguelet of Averasboro Township be relieved of poll
tax for years 1938 and 1939 on account of physical disability.
It is ordered that W.A.Johnson of Buckle rn Township ba relieved of poll tax
for years 1938 and 1939 on account of physical disability.

RESOLVED that the 54 acres, more or less, of land in Upper Little River
Township, Harnett County, N.C., heretofore listed for taxation by 0.D.Womack,
and acquired by the County under tax foreclosure Judgment No. A -966, be
conveyed to W.D.Harrington upon payment to the County of $255.00; and upon
receipt of said sum within thirty days hereafter, the Chairman of the Board
is directed to execute and deliver proper deed to purchaser, and the Clerk will
attest the same.
It is ordered that the minutes of the meeting of May 1, 1939 be amended to
show that upon payment of $150.00 by J.Frank McRae, the land involved therein
be released of all tax liens through the year 1938.
It is ordered that Joe Barnes be re- admitted to County Home as an inmate
on condition that be abide by the rules of the institution and he be allowed
three days off per month.
It is ordered that H.B.Morgan, Duke Township, be allowed free pedier's license
for the year 1939 on account of physical disability.
It is ordered that the County Auditor be instructed to pay one -half of the
purchase price of a short wave radio for the Sheriff's automobile.
It is ordered that L.Edison Byrd of Stewart's Creek Township be relieved of
poll tax permanently on account of physical disability.
It is ordered that G.C.Matthews of Neill's Creek Township be relieved of
poll tax permanently on account of physical disability.
It is ordered that the house and lot listed to Fred S.Thomas in the town of
Dunn on North Orange Avenue valued at $1925.00, be reduced in tax valuation to
$1350.00, (house $1000.00, lot $350.00) for the year 1938.
At a Joint meeting of the Board of County Commissioners and the County Board
of Charities and Public Welfare held on Monday, June 5th. 1939, Miss Lillie Davis
was appointed Superintendent of Public Welfare of Harnett County for the ensuing
two years.
It is ordered that the tax valuation of the house and lot on Broad Street,
in the town of Dunn, N.C., listed to Mrs. Lula G.Young, be reduced from
$3850.00 to $3100.00, ($2100.00 for lot and $1000.00 for house), for the years
1937, 1938 and 1939.
RESOLUTION: Be it resolved that one acre described in deed by A.K.Darroch to
Walter Lee Johnson, Book 269, page 168, be valued at $10.00 for taxation for
year 1939, and that same be afterlisted for years 1934, 1935, 1936, 1937, 1938
at valuation of $10.00 by the Auditor.
Further that the 1939 tax valuation of the N.A.Clark 124 acres described
in Book 266, page 499, Anderson Creek Township be fixed at the sum of $660.00
or 74 acres waste land at $3.50 and 50 acres cutover timber land at $8.00.
And further that the 1726 acres land of Walter Lee Johnson, Anderson Creek
Township, valued 1938 at $12,630.00 be reduced the sum of $630.00, on account
of timber cut and sold during the tax year 1938.
Done and ordered this June 5, 1939.
WHEREAS, Lots Nos. 33, 35 and 37 as shown in the subdivision of the Goodman
property according to survey made by E.F.Mayberry and recorded in May Book No. 1
page 10, in the office of the Register of Deeds for Harnett County, said lots
being owned by French G.Williams have not been listed for taxation for a period
of over five years; it is thereupon ORDERED that the Auditor of Harnett County
afterlist the above designated property at the value of 485.00, and the Auditor
is hereby authorized to give a tax receipt in full for all taxes thereon upon the
payment of the tax sum of i,:.09, said taxlisted property being listed in the
name of French G.Williams.
RESOLVES, whereas, the Board of County Commissioners of Harnett County did,
at the meeting of said Board of April 3, 1939, make an order to convey by Deed
to Margaret Etheleen Johnson Tract No. 1 containing 1924 acres of land situated
in Johnsonville Township, HarnettCounty, N.C., and to the heirs at law of
Daniel S.Johnson, Tract No. 2 containing 185 acres adjoining Tract No. 1 as
described in a tax foreclosure sale under Judgment No. A -1115 upon the payment
of $25.00 cash and the payment of $275.00 within 60 days, and whereas, the
above conditions have been complied with or the parties are ready to comply with
the same and to pay the sum of $275.00, and whereas, the above described parties
have requested that Deeds be made separately for said two tracts of land, one
for the Tract No. 1 of 1924 acres to D.B.Dean upon the payment of one -half of
said sum of $275.00, and to R.H.Matthews and wife Katie Matthews the other tract
of 185 acres upon the payment of the balance or one -half of said $275.00.
IT IS ORDERED by the Board that its resolution of April 3, 1939, be and the
sae is hereby amended as herein provided. It is further ordered by •the Board
of County Commissioners of Harnett County, that J.B.Ennis, Chairman of the Board,
be and he is hereby authorized and directed to execute and deliver proper deeds of

conveyance for the lands above described to the parties above named for the
respective tracts as above set out, each deed to recite as oonsideration the
sum of 8150.00 in full pa ent of taxes through 1938, upon receipt by County
of said total balance of275.00.
IT IS ORDERED that upon payment to the County of the sum of 050.00 this
date, that the lands described in Judgment A -1295, which lands the County now
has deed to, that the County will on or before November 1, 1939 upon payment of
the balance due of $833.95 and interest filed in said matter, execute a deed to
John McArtan or his assigns for said lands.
It is further ordered that Judgment No. A -996, County -vs- John McArtan et al
be and the same to be cancelled upon payment of the sum of $256.20 by John
McArtan to the County this date.

It was ordered by the Board that the Clerk to the Board of Commissioners
proceed to prepare a new and revised Juwy List as required bylaw, showing
correctly the names and addresses of those qualified to do jury duty and
eliminating those who have died or removed from the county or otherwise become
disqualified.
The County Home committee composed of A.A.Cameron and R.L.Pate reported that
upon visits and investigations at the- County Home, that the Home was in
excellent condition and the inmates contented.
It is ordered that the County Boma committee with the assistance of
J.S.McLean, Auditor, investigate as to the number needed for help at the County
Home and they are hereby instructed tohire same.
It is ordered that upon - recommendation of Miss Lillie Davis, that the County
allow 58.00 per month for food orders for K.H.Norris of Averasboro Township.

Mr.Harry C.Northrop, Certified Public Accountant, presented to the Board his
report on the audit of certain fees due by the County to Honorable L.M.Chaffin,
former Clerk of Superior Court, covering services rendered by him in connection
with the handling of 1757 tax suits during the period December 2, 1924 to
December 1, 1934, during which time the Clerk was on a fee basis.
The report indicates that Mr. Chaffin earned fees of $10,542.00, of which he
had been paid $1,806.87, leaving a balance of $8,735.13 owed by the County to the
former Clerk. It further indicates that after the payment by the County to
Mr. Chaffin of $1,000.00, which was ordered paid bythe Board at its meeting on
Monday, May 1, 1939, the balance owing to the former Clerk by the County would
be $7,735.13. Mr. Chaffin offered to accept $6,500.00 in full settlement for
all fees due him in connection with the suits mentioned, the Board having
heretofore ordered the payment of $1,000.00 on the account as of May 1, 1939.
By unanimous vote of all Commissioners the following order was adopted to
the end that Mr. Chaffin receive the total sum of $6,500.00:
That L.M.Chaffin be paid by the County Auditor, on or before Dec. 1, 1939
$1000.00; that he be paid on or before June 1, 1940 $1000.00; that he be paid
on or before December 1, 1940 $1000.00; that he be paid on or before
Junel, 1941 $1000.00; that he be paid on or before Dec. 1, 1941 $1500.00.
It was explained to the Board that much of the funds due Mr. Chaffin were
collected by the County and used by it which, had they been paid to Mr. Chaffin
at the time they were collected, would have considerably reduced the balance due
the former clerk.
It is ordered that beer license be granted to the following applicants:
1. Howard Barnes at Gulf Service Station in the town of Coats, N.C.
2. C.H.Bethune (beer and wine) at Bethune's Cafe in Bunnlevel, N.C.
3. W.T.Peed at Fidelity Service Station in Angier, N.C.
4. R.L.Bradsher at Lillington Lunch Room in Lillington, N.C.
5. R.G.Smith and L.B.Matthews at Matthews & Smith filling station in Chalybeate .

BE IT RESOLVED by the Board of Commissioners of Harnett County that such
prisoners as may be sentenced to the common jail of said County by the several
courts for criminal offenses, may be hired out by Board of Commissioners;
provided, that the sentence of the Court embody therein that said prisoners are
to be so hired out by said Commissioners; and further provided that no such
prisoner be hired out for the payment of ny fine or costs assessed.
The following rules, in so far as they may be applicable, are hereby
promulgated for the hiring out of such prisoners:
1. The Chairman of the Board of Commissioners together the Commissioner
F.D.Jackson are hereby appointed as a committee of the Board of Commissioners
to act in respect of hiring out prisoners.
2. The terms and conditions on which prisoners may be hired out shall be
fixed by the aforesaid committe, and approved by the Board.
3. In all cases sufficient and acceptable security shall be given to the
County of Harnett guaranteeing the payment to the County of the sums for which
said prisoners may be so hired out.
4. Such prisoners as may be hired out shall be under the control and
supervision as to their government and discipline, of the Sheriff of Harnett
County or his deputies.
5. No prisoner hired out by the Commissioners shall be so hired for a
longer period than the sentence imposed is to run.
It is ordered that upon payment of $100.00 cash on or before June 10, 1939
that the 50 acres of land in Anderson Creek Township now listed to Bessie Lee
McLean, be released of all taxes, interest and cost through the year 1938 and
the Auditor is directed to issue receipts for the above.
It is ordered that all taxes on two vacant lots in the town of Angier,
Black River Township, listed in the name of J.W.Gilli9,be released of 1938 taxes
and all prior years upon payment of $20.00, and the Auditor is directed to issue
receipts for the above upon payment of $20.00.

RESOLVED that the 35z acres, more or less, of land in Johnsonville Twp.
Harnett County, N.C., heretofore listed in the name of R.L.Poindexter, and
acquired by the County of Harnett under tax foreclosure Judgment No. A- 1159,
be conveyed to - - -- Thomas P.Smith upon the payment to the County,of X200.00
on the following terms and conditions: - X25.00 cash with this offer;. 310.00 on
the 20th. day of July 1939; and 310.00 on the 20th. of eachsuccessive month
until the full purchase price of 200.00 has been paid in full. It is agreed
that all deferred payments shall bear interest at the rate of six per cent.
per annum from date which will be computed and paid with the final payment of
this contract.
RESOLVED that the 6Q acres, more or less, of land in Lillington Twp.
Harnett County, N.G., formerly listed for taxation by Archie McLean, and
acquired by the County of Harnett under tax foreclosure Judgment`No. 2313 -A -1226
be rented to Hector McLean upon payment to the County of Harnett of
20.00 cash as rent for said tract of land for one year from Jan. 1, 1939, to
Dec. 31, 1939. Said land adjoining Geo.Wicker estate, et als. Rent to be paid
on or before November 1, 1939.
RESOLVED that the'7.2 acres of land, more or less, in Stewart's Creek Twp.
Harnett County, N.C. formerly listed by Alice Smith estate, be rented to
Arthur Smith for the term of one year from Jan. 1, 1939, to
Dec. 31, 1939, for the sum of 325.00 cash as rent, to be paid on or before
Nov. 1, 1939. Said land acquired by the County at tax foreclosure sale under
Judgment No. 2160 -A -810.
RESOLVED that the 17 acres of land more or less in Stewart's Creek Township,
Harnett County, N.C., formerly owned and listed by Henry Sultan, and acquired
by the County under tax foreclosure Judgment No. 2164 -A -994, be rented to
----Henry Sultan for the term of one year from Jan. 1, 1939, to
December 31, 1939, uponthe payment of *50.00 cash rent. Rent to be paidnon or
before November 1, 1939.
RESOLVED that the 25 acres more or less of lard situate in Stewart's -Creek
Township, Harnett County, N.C. formerly owned and listed by C.T.Temple, and
acquired by. the County under tax foreclosure judgment No.-.211L-A-1172, be
rented to Alton Adams - -- -for the term of one year from .Jan. 1, 1939 to
Dec. 31, 1939, upon the payment of 320.00 cash as rent, to be paid on or before
November 1, 1939.
RESOLVED that the 62 acres of land more or less in Lillington Township,
Harnett County, N.C. formerly listed for taxation by J.M.Withers, adjoining the
lands of George McLean, J.C.Byrd, et als, and acquired by the County under
tax foreclosure Judgment No. S.D. 1996 -A -1000, be leased and farm - let -to
---- C.L.Wilkins - -- -for one year from -Jan. 1, 1939, to Dec. 1, 1939, for the sum
of 327.50 rent, to be paid on or before November 1, 1939. No crops to be

RESOLVED that the property acquired under tax foreclosure Judgment No. 2099 -
A -868, be conveyed to Justicia McLean TLcker upon the following terms
and conditions: 525.00 cash with this offer, and 35.00 on the first of each
month until the full amount is paid, together with o% interest, and the 1939
taxes, All deferred payments to. bear 6% interest. Upon receipt of purchase
price in full to the County, the Chairman of the Board is directed to execute

Judgment No. 2115 -A -975, by the County, be conveyed to James Thomas--- -
upon the following terms and conditions: 33.00 cash with this offer, and
322.00 on the first of July 1939, and balance of 3215.75 on Nov. 1, 1939.

Stewart's Creek Township, be conveyed to Neill McLean, on the following terms
and conditions: $15.00 cash with this offer, and $65.00 on Oct. 1, 1939, with
6% interest on deferred payments. Purchaser to pay all taxes for the year 1939
and subsequent years. Upon payment of purchase price in full, the Board is

RESOLVED that the 25 acres of land, more or less, in Upper Little River -
Township,- Harnett County, N.C. fully described in a deed from A.R.Wilson to
Fessoso Mollie Jain Wilson, and acquired by the County at tax foreclosure sale
under Judgment No. 2117 -A -1070, be sold and conveyed to --- -H.M.& N.C.O'Quinn
trading as O'Quinn Bros. on the following terms and conditions: $50.00
Nov. 1, 1939, and $150.00 Nov. 1 1940, with interest from date, and to pay all
taxes for 1939 and subsequent years. Upon payment in full of purchase price,
the Chairman of the Board is directed to execute and deliver proper deed to
purchaser, and the Clerk will attest the same.
RESOLVED that the two lots of land in Buckhorn Township, formerly listed
to A.E.Garner, and acquired by the County of Harnett at tax foreclosure sale
under Judgment No. A -836, be sold and conveyed to Mrs.China Austin on
the following terms and conditions: $400.47 cash with this offer, and upon
receipt of said sum in full, the Chairman of the Board is directed to execute
and deliver proper deed to purchaser. Purchaser to pay 1939 taxes and all
subsequent years.
RESOLVED that the property acquired by the County of Harnett -at tax foreclosur
sale under Judgment No. A -978, be sold and conveyed to - - -- W.A.Johnson - -- -upon
the following terms and conditions: $50.00 cash with this offer; $50.00 on
acceptance ofctfer by Board of Commissioners; $100.00 Nov. 15, 1939;
$125.00 Nov. 15, 1940. Deferred payments to bear 6% interest from date.
Purchaser to pay 1939 taxes and all subsequent years. Upon receipt of purchase
price in full the Chairman of the Board is directed to execute and deliver
proper deed to purchaser, and the Clerk will attest the same.
RESOLVED that the property acquired by the County of Harnett at tax

RESOLVED that the 41 acres of land more or less in Stewart's Creek Trip.
in town of Bunnlevel, be conveyed to Geo.McD.Bailey. Being the land acquired by
the County of Harnett at tax foreclosure sale under Judgment No. A -937, and
to be conveyed'to Geo.McD.Bailey upon the following terms and conditions:
$10.00 cash with this offer, and $10.00 on the first of each successive month
until the sum of $95.30 and interest is paid in full. Upon receipt of purchase
money in full the Chairman of the Board is directed to execute and deliver
proper deed to purchaser, and the Clerk will attest the same.

land, and acquired by the County of Harnett at tax - foreclosure sale under
Judgment No. 2254 -A -1111, be conveyed to J.C.Thomson on the following terms and
conditions:. $185.03 cash with this offer, and upon receipt of -said sum within
thirty days hereafter, the Chairman of the Board is directed to execute and
deliver proper deed to purchaser, and the Clerk will attest same. Purehaserto
pay 1939 taxes.
RESOLVED that the property acquired by the County of Harnett at tax
foreclosure sale under Judgment No. 2186-A-11381 be conveyed to
----James L.McNeill upon,the following terms and conditions: 025.00 cash
with this offer, and 015.00 on July 1, 1939; $5.00 on August 1, 1939;
$5.00 Sept. 1, 1939; $5.00 Oct. 1, 1939; and balance of 093.10 on Nov.. -1, 1939.
Upon payment to the County of the purchase price in full the- Chairman of the
Board of Commissioners is directed to execute and deliver proper deed to
purchase, and the Clerk will attest same. Purchaser to pay 1939 taxes and
subsequent years. Deferred payments to bear 6% interest from date.
RESOLVED that the property formerly owned by J.W.Hodges, deceased, and -

- -- -Jesse B.Lee and J.H.Ballance - -- -for the sum of $155.79 paid to the County
and upon receipt of said sum within thirty days hereafter, the Chairman of the
Board is directed to execute and deliver proper deed to purchaser, and the Clerk

ORDINANCE IMPOSING SCHEDULE "B" LICENSE TAXES
Pursuant to and in conformity with Article 2 of Chapter 158 of the Public
Laws of North Carolina, Session of 1939, the Board of Commissioners of Harnett
County do hereby impose and levy the following taxes for the privilege of
carrying on the businesses, exercising the privileges or doing the acts named,
as hereinafter respectively set out, for the license tax year beginning
June 1, 1939, and ending May 31, 1940, and for the license tax year beginning
June 1, 1940 and ending May 31, 1941.
(References hereinafter appearing relate to the several respective sections and
paragraphs of the Revenue Act of 1939, and the language therein appearing
describing the several businesses, occupations and privileges, is by reference
made a part hereof as if the pertient verbiage were fully incorporated herein.)
Sec. 103. Amusements: traveling theatrical companies, etc.
For each day or part of a day's exhibits or performances,

Sec.
And it is hereby ordained that the amount of taxes hereinbefore set forth
relating to the respective businesses and privileges taxed, shall be applicable
to each tax-payer, and shall be callectednannually by a Harnett County Tax
Collector, June 1st. of each tax -year, or as soon thereafter as may be
reasonably possible in the circumstances; and that no privilege license shall be
Issued by the Tax Collector of Harnett County for the carrying on, or engaging
in, any business herein taxed until the applicant for such privilege license
shall have presented to the County Tax Collector such evidence as he may require
to satisfy himself that such applicant has paid to the State of North Carolina
all taxes imposed by it to entitle such applicant to privilege license from the
State of North Carolina.
Any person, firm or corporation who or which shall undertake to engage in
any of the businesses, occupations or privileges taxed as hereinbefore provided
before having first procured the prescribed license pertinent to such undertaking,
shall be guilty of a misdemeanor, and upon conviction shall be fines not less
than 310.00 nor more than .200.00 in the discretion of the Court.
