The Board of Commissioners met in regular session on May 1, 1939 at 10:00
A.M. with Chairman J.B.Ennis and Commissioners R.L.Pate, Ferd D.Jackson,
L.R.Byrd and Angus A.Cameron present. H.C.Stridkland, County Attorney, was also
present.
The Board appointed Ferd D.Jackson as a committee of one to investigate with
the town Bbarrd of Dunn, the tax valuation of the property of Geo.W.Gardner in
the town of Dunn; and also the tax valuation of the property of Dr.Chas.Highsmith
Estate, also in the town of Dunn.
It is ordered that the County Attorney be instructed to petition the
Superior Court to rescind the order of sale entered in that action therein !'
pending entitled "County of Harnett -vs- J.F.McRae et al" it being judgment
No. A -1130, upon receipt by the County of $150.00 from J.Frank McRae within the
next ten days.
It is ordered that L.M.Chaffin be paid a partial payment of $1,000.00 on
account of cost accrued to him by reason of suits brought on behalf of the
County while he was Clerk of the Superior Court, a part of which costs has been
paid to the County through other offices; and that the correct balance due be
ascertained by having H.C.Northrop complete his audit of this particular account.
It is ordered that Joseph Thurman Lee of Grove Township be relieved of poll
tax for the years 1938 and 1939.
It is ordered that Bethune Brothers of Bunnlevel, N.C.,Stewart's Creek Twp.,
be granted beer license for the year 1939.
BE 1T RESOLVED that H.C.Cameron be and he is hereby appointed a member of
Harnett County Welfare Board to serve for a term of three years.
It is ordered that J.F.Motley of Fuquay Springs, N.C.R -1 be granted beer
license for the year 1939.
NORTH CAROLINA:
HARNETT COUNTY:
It is ordered that the 65 acres of land in Stewart's Creek Township, listed
in the name of Marvin Wade, Sr. for the year 1935 and subsequent years, and
formerly listed in the name of J.W.Wilson, be released of all taxes for the
years 1938 and prior years upon the payment of $278.46.
It is ordered that the lot on N.Fayetteville Street 50 x 140 feet, listed
in the name of Marvin Wade Co. for the years 1930 through 1932 in the name of
C.H.Jernigan for the year 1933 and to Marvin Wade, Sr. for the years 1934
through the year 1938, which was foreclosed by the County under Judgment No.A -857
be conveyed to Marvin Wade, Sr. upon the payment of $217.35 which is the amount
of taxes, costs and commissions that the County has invested in the above lot.
This conveyance is made subject to any right of the town of Dunn.
It is ordered that the lot on S.Clinton Avenue 140' x 150' and one lot
South Clinton Avenue, about three acres known as the Gerald property which was
listed for taxes for the years 1930 through 1932 in the name of Marvin Wade
Co. to C.H.Jernigan for the years 1933 through 1935 and to Marvin Wade for the
years 1936 through 1938, which was foreclosed by the County under Judgment
A -1161 be conveyed to 'ilarvin Wade, Sr. upon the payment of $296.80 subject to
any right of the Town of Dunn.
It is understood that the 1939 taxes on the property mentioned inthe above
three paragraphs are to be paid by Marvin Wade,Sr.

Harnett County: RESOLUTION
Whereas, at a meeting of this board on April 17, 1939, resolution was
passed authorizing sale of the J.M.Royal 4i acre tract of land in Averasboro
Township to Benjamin C.Schneider at the price of $246.78, the amount of taxes
and costs due on said land, and it appearing that taxes for the year 1928
were included in said amount of $246.78 by error, taxes for said year having
been paid, said taxes for said year being in the amount of $51.51:
It is therefore hereby ordered that said order passed by this board on
April 17, 1939, be and the same is hereby amended and the amount to be paid by
Benjamin C.Schneider hereby corrected and reduced from $246.78 to $195.27, and
upon payment of said amount of $195.27 on this date deed is to be delivered to
said Benjamin C.Schneider.
Duly passed, this 1st. day of May, 1939.

The Board appointed R.L.Pate, J.B.Ennis and Ferd D.Jackspn as a committee
to investigate the tax valuation of the property -of E.L.Parker in Averasboro
Township and Duke Township.
The following road petition was presented to the Board aid ordered forwarded
to State Highway and Public Works Commission: .
That the road leading from M.G.Pilson's residence to the intersection of the
Vass - Johnsonville road at J.Mack D.Cameron's residence be graded and constructed.
The report of W.D.Harrington, Tax Collector for the month of April was
presented, approved and ordered filed.
The report of Howard Godwin, Clerk of Superior Court, was presented,
approved and ordered filed.
The report of Inez Harrington, Reg. of Deeds, for the month of April was
presented, approved and ordered filed.
It having been made to appear to the Board, and being so found as a fact,
that the property listed as one lot on West Broad Street in the town of Dunn
to Wake Forest College for the purpose of taxation for the year 1933, was at
the date on which said taxes became a lien that year owned by Wake Forest College,
an eleemosynary institution, the property of which under the law is non taxable,
but that deed therefor to said College was not recorded until after the taxes
for said year became a lien, altho title to said property of record at the time
mentioned was held by T.W.Brwer, under a parol trust for the benefit of said
institution:
It is, therefore, ordered that the aforementioned property be and the same is
hereby relieved -and released of any tax lien otherwise existing in favor of the
County of Harnett on account of taxes assessed for the year 1933.
BE IT RESOLVED by the Board of Commissioners of Harnett County that the two
acres of land in Duke Township, formerly listed to J.P.Jackson estate through
1936, and to Clyde Weaver since, and acquired as a part of a 5acre tract by
the County of Harnett under tax foreclosure judgment No. A -1185, be conveyed to
Clyde Weaver upon payment to the County of $24.00; and that upon receipt of said
sum by the County the Chairman of the Board is hereby directed to execute deed
on behalf of the county to purchaser, and the Clerk will attest the same.
It is ordered that L.L.Brown of Upper Little River Township be relieved of
$1.00 dog tax for the year 1938.
tO The Board was requested by the State Extension Department to elect a
successor to Miss Naomi Carr as County Home Demonstration Agent, whose term is
to expire June 31, 1939. The Board having been informed.by Extension Department
through County Agent C.R.Ammons that a successor is available now, IT IS ORDERED
that Miss Isabella Moseley of Lenoir County, be elected. Miss Carr is to serve
until September 1, 1939. Mr.Ammons stated that no Harnett County woman is
available for the position.t"

Harnett County Home.
Pursuant to Resolutions adopted by the Board of Commissioners on April 3,1939
and after due notice to complainants and Mr. E.W.Bradley, Respondent, and their
attorneys, a hearing was had on the charges lodged against Mr. Bradley
April 17, 1939, as will appear by reference to a transcript of the proceedings
on file with the Clerk to the Board of Commissioners.
All members of the Board having been present and having heard the sworn
testimony of complainants and their witnesses, and of the respondent and his
witnesses, upon such hearing, and the transcript of the proceedings and testimony,
the Board finds the following facts:
1. That the circumstances and acts complained of were largely produced
because of practice which has obtained in the County of permitting prisoners at
times to be detained at the County Home, rather than incarcerated in the County
Jail, and particularly has this been true with respect to women prisoners.
2. That there has not been established any intentional misfeasance or
malfeasance in office by Mr.E.W.Bradley to justify the Board of Commissioners to
take any further action in the matter.
And it is, therefore, ordered that the original transcript of the testimony
of all witnesses be kept on file by the Clerk to the Board, so that it may be made
avaialble to the public.
It is further ordered that no prisoners be admitted hereafter to the County
Home, and that the County Home be visited monthly by a Committee of this Board.

BE IT RESOLVED by the Board of Commissioners of Harnett County that the
25 acres of land in Barbecue Township, formerly owned by Geo.H.White, and
acquired by the County under Tax Foreclosure Judgment No. A -1252, be conveyed to
Geo.H.White upon payment of the amount of taxes, interest and costs in the amount
of $192.81, on or before June 1, 1939, and upon receipt of the above amount the
Chairman of the Board is hereby directed to execute deed on behalf of the County
and the Clerk to the Board will attest the same.
B$ IT RESOLVED by the Board of Commissioners of Harnett County that the 16}
acres of land in Upper Little River Township, Harnett County, N.C., formerly
listed to Ella Lockamy, and which was acquired by the County at tax foreclosure
sale under Judgment No. A -1081, be conveyed to O.C.T.McNeill, upon payment to
the County of $85.91; and upon receipt of said sum by the County, the Chairman
of the Board of Commissioners is hereby authorized and directed to execute deed
on behalf of the County conveying said land to the purchaser, and the Clerk to
the Board will attest the same.
BE IT RESOLVED that the 10 acres of land in Stewart's Creek township,
formerly listed and owned by Alex McKay (colored) and which was acquired by the
County of Harnett at tax foreclosure sale under Judgment No. A -1139, be sold to
Mrs. Bessie V.Adams for $100.00 cash; and upon receipt of said sum by the
County of Harnett, the Chairman of the Board of Commissioners is hereby
authorized and directed to execute deed on behalf of the County, conveying said
land to the purchaser, and the Clerk to the board will attest the same.
BE TT RESOLVED that the 10 acres of land in Stewart's Creek Township,
formerly listed by Mary Belle McDougald (colored) and which was acquired by the
County of Harnett at tax foreclosure sale under Judgment No. A -1126, be sold to
Mrs. Bessie V.Adams for $100.00 cash; and upon receipt of said sum by the County,
the Chairman of the Board of Commissioners is hereby authorized and directed to
execute deed on behalf of the County of Harnett, conveying said property to the
purchaser, and the Clerk to the Hoard will attest the same.
BE TT RESOLVED that the 7 acres of land in Anderson Creek Township, as
described id Judgment No. A -1131 of record in the office of the Clerk of
Superior Court of Harnett County, and which was acquired by the County of Harnett
at tax foreclosure sale held thereunder, be conveyed to Garvin West upon payment
to the County of Harnett of the sum of $148.12, payable $25.00 cash this date,
and balance on or before Nov. 1, 1939; and upon payment in full of the said
purchase price, to -wit: $148.12, the Chairman of the Board of Commissioners is
hereby authorized and directed to execute deed on behalf of the County of Harnett
to the purchaser for said land, and the Clerk to the Board will attest the same.
In making of said deed, a life estate to L.D.West will be granted to him
to include approximately one -half acre of land on which the dwelling on said
property is located, together with said dwelling, the remainder following said
life estate to belong to Marvin West.
BE TT RESOLVED that the 209 acres of land in Stewart's Creek township, as
described in Judgment No. A -1276, of record in the office of the Clerk of Superior
Court of Harnett County, and which was acquired by the County of Harnett at tax
foreclosure sale thereunder, be conveyed to Hanna Ferguson for the sum of $180.52;
and upon receipt of said sum in cash by the County, the Chairman of the Board of
Commissioners is hereby authorized and directed to execute deed to the purchaser
on behalf of the County of Harnett, and the Clerk to the Board will attest the
same.
BE IT RESOLVED that the 34 acres of land in Stewart's Creek township,
formerly owned by Doyle McDougald (colored) and which was acquired bythe County
of Harnett at tax foreclosure sale under Judgment No. A -939, be conveyed to
S.M.Byrd upon payment to the County of $130.80 in cash; and upon receipt of said
sum by the County, the Chairman of the Board of Commissioners is hereby
authorized and directed to execute deed on behalf of the County of Harnett to
the purchaser, and the Clerk to the Board will attest the same.
BE IT RESOLVED that the 2'i acres of land in Upper Little River Township
formerly owned by W.E.Nordan, and which was acquired by the County of Harnett
at tax foreclosure sale under Judgment No. A -1163, be conveyed to J.C.Moore
upon payment to the County of $111.60, plus taxes for the year 1939, said sum
to be payable as follows: $25.00 in cash this date, and balance of purchase
price, together with six per cent interest on deferred part thereof, and $939
taxes, on or before November 1,1239; and upon receipt of said sums in full the
Chairman of the Board of Commissioners is hereby authorized and directed to
execute deed on Behalf of the County of Ham ettto the purchaser, and the Clerk
to the Board will attest the same.
BE TT RESOLVED that the interest acquired by the County of Harnett in and to t
land in Averasboro Twp. Dunn, N.C.being house and lot on .Mcx Ave., formerly
owned by Daniel Small, being described in Judgme t No. 1885 -A -908 be conveyed to
---Daniel Small -- -upon payment to the County of O. cash with this offer, and

BE IT RESOLVED that the 95 acres of land in Johnsonville Township,
described in Judgment No. A -1181 as appears of record in the office of the Clerk
of Superior Court of Harnett County, and which was acquired by the County of
Harnett at tax foreclosure sale pursuant to said Judgment, be conveyed to
D.J. and C.H.Mallette, upon payment to the County of Harnett of $317.38, said
sum to be paid as follows: $100.00 cash this date, and the balance on or before
Nov. 1, 1939; and upon receipt of said sum in full by the County, the Chairman
of the Board of Commissioners is hereby authorized and directed to execute deed
to the purchasers on behalf of the County of Ham ett, and the Clerk to the
Board will attest the same. Deed to be made to former owners of record.)
BE IT RESOLVED that the 2 tracts of land consisting of 65 acres and 84j
acres respectively, in Upper Little River Township, described in Judgment
No. A -1245, of record in the office of the Clerk of Superior Court of Harnett
County, and which was acquired by the County of Harnett at tax foreclosure sale
pursuant to said judgnent, be conveyed to J.J.Kelly for the sum of $302.54,
and upon receipt of said sum )by the County of Harnett, the Chairman of the Board
of Commissioners is hereby authorized and directed to execute deed on behalf of
the County of Harnett to the purchaser, and the Clerk to the Board will attest
the same.
BE IT RESOLVED that the interest acquired by the County of Harnett in and to
the land in Barbecue Township, formerly owned by I.L.McNeill in part, as
described inJudgment No. A -1278, of record in the office of the Clerk of
Superior Court of Harnett County, which said interest was acquired by the County
pursuant to said judgment, be conveyed to I.L.McNeill for the sum of $127.46,
together with an amount equal to the 1939 taxes on same, said purchase money
to be paid as follows: $20.00 cash this date, and balance on or before
Sept. 1, 1939, with interest from date, together with 1939 taxes; and upon
receipt by the County of Harnett of said sums in full, the Chairman of the
Board of Commissioners is hereby authorized and directed to execute deed on
behalf of the County of Harnett to the purchaser, and the Clerk to the Board
will attest the same.
BE IT RESOLVED by the Harnett County Board of Commissioners that the 70 acres
of land in Black River Township formerly listed to Mary Reade McDonald an d
acquired by the County under tax foreclosure judgment No. A -847, be conveyed to
J.Henry Williams upon payment to the County of Harnett of 15243.25; and upon
receipt by the County of said sum the Chairman of the Board is directed to execute
proper deed to purchaser and the Clerk to the Board will attest the same.
BE IT RESOLVED that the sale of tax liens, as provided by the Machinery Act
of the General Assembly of North Carolina, held by the County of Harnett, be
held on the first Monday in September 1939 after due advertisement immediately
preceding said sale date as provided bylaw.
BE IT RESOLVED that the period within which taxes for the year 1939 shall
be listed in Harnett County be extended to May 15, 1939.
BE IT RESOLVED that Lot No. 6, in Anderson Creek Township, formerly listed
to J.P.Darroch estate, acquired by County of Harnett under Tax Foreclosure
Judgment No. A -1140, be conveyed to Ezra & Ruth Darroch upon payment tothe
County of $30.00; purchasers to assume payment of taxes for 1939; and upon
receipt of said sum by the County, the Chairman of the Board of Commissioners
is hereby directed to execute proper deed to purchasers and the Clerk to the
Board will attest the same.
RESOLUTION:
WHEREAS, the United States of America has acquired and is acquiring real
property for and is operating (a) raral rehabilitation project for resettlement
purposes, (as defined in 49 Stat. 2035, hereinafter called the "Act ") located
within the jurisdictional limits of the local public taxing unit hereinafter
set forth; and
WHEREAS, the aforesaid project and the persons now and hereafter residing
on or occupying such premises will be supplied with public or municipal
services by the local public taxing unit hereinafter set forth;
NOW, THEREFORE, be it resolved by the Board of County Commissioners of the
County of Harnett, North Carolina, that this resolution shall constitute the
Request to the United States of America by and on behalf of said local public
taxing unit (pursuant to the provisions of Section 2 of the Act) to enter into
an Agreement for the payment by the United States of sums in lieu of taxes;
and
BE IT FURTHER RESOLVED that this body does hereby authorize and approve the
execution by its Chairman of said Agreement with the United States of America,
for and on behalf of said local public taxing unit.

NORTH CAROLINA; Resolution
Harnett County:
WHEREAS, the County of Harnett by resolution adopted, by its Board of
Commissioners on March 21, 1939, awarded to bidders contracts for the furnishing
of equipment to be used in the Harnett County Hospital at Dunn, N.C. known as
PWA Project No. N.C. 1344 -F; and
WHEREAS, O.W.Holmes, trading as Holmes Electric, of Fayetteville, N.C. was
the lowest and best bidder for the furnishing of the refrigeration equipment
specified in Section Six of the specifications, his base bid being $1795.68, but
that said bid was not considered by the Board of Commissioners of Harnett County
for that it was the sense of said Board that his said bid did not fully comply
with the specifications and requirements promulgated for the guidance of bidders;
and
Whereas, the Board of Commissioners of Harnett County thereupon considered
the bid of Oettinger Bros. of Kinston, N.C. in the sum of $1856.00, after
deducting alternate numbered one, it being the next best bid on the refrigeration
equipment specified in Section Six of the specifications; and subject to the
approval of PWA, awarded the contract on Section Six to said Oettinger Bros; and
WHEREAS, the Harnett County Hospital, at Dunn N.C. is being constructed in
part by the use of a grant made to the County of $arnett by the Federal Emergency
Administration of Public Works, and that as an inducement to said Public Works
Administration to make the grant, the County of Harnett agreed, among other
things, to comply with the rules and regulations adopted by said Administration
in respect Of the letting of contracts; and
WHEREAS, the Federal Emergency Administration of Public Works has indicated
that it is of opinion Holmes Electric substantially complied with the regulations
and specifications promulgated for the guidance of bidders in respect of the bid
on Section Six of the specifications, and that in justice to said Holmes Electric
and to conform to the rules of the Public Works Administration, the County of
Harnett should award the contract for the furnishing of the equipment called for
in Section Six of the specifications to Holmes Electric, and not to Oettinger Bros.;
BE 1T RESOLVED, therefore, that upon reconsideration of the base bid of
O.W.Holmes, trading as Holmes Electric, for the furnishing of the refrigeration
equipment specified in Section Six of the specifications to be used in the Harnett
County Hospital, at Dunn, N.C. in the sum of $1795.68, said bid is determined to
be the lowest bid for the said equipment, without deducting any alternates, as
specified in said bid, and it is hereby accepted and declared to be the best bid,
no alternates to be deducted.
BE IT RESOLVED FURTHER that the bid of Oettinger Bros., of Kinston, N.C. for
the furnishing of the refrigeration egsuipment called for in Section Six of the
specifications mentioned, in the amount of $1856.00, after deducting alternate
Number One, be and the same is determined to be the second lowest and best bid for
said equipment, and the said is hereby rejected.
BE IT FURTHER RESOLVED that the Resolutions awarding contracts adopted by
the Board of Commissioners of the County of Harnett on March 21, 1939, be and they
are hereby modified and amended to the end that the Resolutions hereby adopted
may prevail in respect of the awarding of a contract for the furnishing of the
equipment called for in Section Six of the aforesaid specifications.
BE IT FURTHER RESOLVED that the award of the contract under Section Six,
as aforesaid, with O.W.Holmes, trading as Holmes Electric, shall not be effective
until said bidder shall be notified by the owner, and that a contract on behalf
of the County of Harnett be then executed by J.B.Ennis, Chairman of the Board of
Commissioners of said County.
