April 3, 1939
The Board of Commissioners of Harnett County met in regular session Monday,
April 3, 1939, at 10;00 A.M. with Chairman J.B.Ennis, and Commissioners Angus A.
Cameron, Lonnie R.Byrd, R.L.Pate and Ferd D.Jackson present. Also County
Attorney H.C.Strickland present.
It is ordered that the County Auditor pay on behalf of the County, its
pro -rata part of the cost incurred to April 1, 1939, of the services of
Mr.A.L.Newberry, appraiser, and printing and stenographic hire, according to
statement presented this date, the bill for such services having been presented
but County's part to be ascertained therefrom.
Be it resolved, that the tract of land formerly listed to Mrs.R.L.Byrd, in
Averasboro Township, containing 41 acres, more or less, and acquired by the
County of Harnett under tax foreclosure judgment No. A -825, be conveyed to
Mrs. Ruth Jernigan Byrd and husband R.L.Byrd, upon payment by them to the County
of $103.65; and upon such payment being made, J.B.Ennis, Chairman of the Board
of Commisdoners, is hereby authorized and directed to execute proper deed to
the purchasers on behalf of the County of Harnett, and the Clerk to the Board
will attest the same as provided by law.
Be it resolved, that the 2 acre tract of land formerly listed to Wm.H.Cutts
(colored) in Black River Township, Harnett County, and acquired by the County
of Harnett and Town of Angier, under tax foreclosure judgment No. A -875, be
conveyed to M.D.Ragland (colored) the brother-in-law of Wm.H.Cutts, upon payment
being made to the County of $92.14, without prejudice to the rights of the
Tewn of Angier, co -owner of the said land; and upon receipt of said purchase
price the Chairman of the Board of Commissioners is hereby authorized and
directed to execute proper deed on behalf of the County of Harnett, and the Clerk
will attest same as provided by law.
Be it resolved, that the property formerly listed to G.H.Jernigan, in
Averasboro Township, Harnett County, an interest in which was acquired by the
County of Harnett under tax foreclosure judgment No. A -1008, be conveyed to
George H.Jernigan, without prejudice to the rights of the Town of Dunn, upon
payment to the County of $123.16; and upon such payment being made, the Chairman
of the Board of Commissioners is hereby authorized and directed to execute on
behalf of the County of Harnett a proper deed to said purchaser and the Clerk to
the Board will attest same, as provided by law.
Be it further resolved that the resolution of the Board of Commissioners
appearing in Minute Book No. 7, page 29, directing deed to the aforesaid property
to be made to R.F.Jernigan, be and the same is hereby rescinded in toto.
It is ordered that the 29 acres of land in Johnsonville Township, listed in
the name of Abe Gilchrist Estate, which was foreclosed by the County, be
transferred to Alfred Fuller upon payment of $70.00 down and $35.00 plus interest
and 1939 taxes on November 1, 1939 conditioned upon the approval of the majority
of the heirs of Abe Gilchrist.
It having been conclusively shown to the Board of Commissioners that the
listing of the stocks of merchandise of Erwin Department Store and Leader Store,
Incorporated, Erwin, N.C., for the years 1937 and 1938, was based upon a boosted
inventory of goods, the valuation of which was fictitious, and that the sum of
$598.93 is 100% of the taxes on the true value of said stocks at the times they
were listed in 1937 and 1938, it is ordered:
That the County Auditor and the County Tax Collector accept $309.24 in full
aettlement`-of the taxes for 1937 on said stocks, including penalties, and that
they accept $289.69 in full settlement of taxes on said stocks for the year 1938;
and that upon receipt of the total sum of $598.93, the official tax receipts be
released to the proper parties.

It is ordered that H.C.Strickland, County Attorney, be paid $200.00 upon
recommendation of Judge Clawson L.Williams, from the proceeds of $1,232.25
he succeeded in recovering in the litigation by R.L.Cromartie, Jr., Admr. and
Commissioner against the County of Harnett and others.
It is ordered that Mr.Venable Haggett be, and he is hereby employed, to
appraise and submit offers of prospective tenants and purchasers, for the
properties acquired by the County, and which are situated in the County on the
South and West sides of the Cape Fear River, such employment to be on the same
basis of compensation as that of Mr. A.L.Newberry, who is doing such work
involving properties located on the North and East sides of the River.
It is ordered that Eugene Edgar Aikens, of Duke Township, be relieved of
poll tax for the year 1938 on account of being a disabled war veteran.
It is ordered that Erwin Patterson of Upper Little River Township, be
relieved of poll tax for the year 1938 on account of physical disability.
It is ordered that Roy Allen of Grove Township, be granted free pedier's
license for the year 1939 on account of physical disability.
It is ordered that Roy Allen of Grove Township, be relieved of poll tax
for the year 1938 on account of physical disability.
It is ordered that William Alvin Stone of Grove Township, be relieved of
poll tax for the year 1938 on account of physical disability.
It is ordered that J.J.Cook, Averasboro Township, be and he is hereby
allowed a credit of $35.64 on 1931 taxes assessed against his lot on
North McKay Avenue, Dunn, N.G., on account -of same having been double listed
for said year, said taxes having been paid by Charles Watkins.
It is ordered that the interest of the County-of Harnett in property
acquired by it under tax foreclosure judgment No. A -900, formerly listed to
John Merritt in Averasboro Township, Harnett County, N.G., be conveyed to
John Merritt upon ayment to the County of Harnett of its investment in said
property, to -wit: $175.68, plus 5% selling expense; the purchase price to be
paid as follows: 550.00 cash, and balance at $10.00 per month, until one -third
of total sale price shall have been paid; and balance to be paid in two equal
annual payments, due one and two years respectively, from date, deferred
payments to bear interest at e% per annum, payable annually; conveyance to be
made when property shall have been fully paid for, and taxes for 1939 and
thereafter to be paid by purchaser.
It is ordered that the 8 acres of land in Stewart's Creek Township,
formerly listed in the name of Betty Taylor and Maggie H.McNeill, forclosed for
taxes under judgment No. 2257- A1274, be transferred to George McNeill, upon the
payment of $13.00 April 3, 1939, and $57.63 plus 6% interest and the 1939 taxes
on or before November 1, 1939.
The Board appointed R.L.Pate, Fend D.Jackson, J.B.Ennis and J.S.McLean
as a committee to investigate the tax Valuation on the property listed to
Hugh W.Prince and mother, Mrs. Geo.E.Prince, in the town of Dunn. This
committee to co- operate with the Town of Dunn Board in the valuation of the
property.
The following road petition was approved and ordered forwarded to State
Highway and Public Works Commission:
Beginning at a point in the Highway leading from Angier to Benson and where
said old Cornwallis road intersects said Highway about 1/4 mile east of
E.O.Adams residence; thence northerly and along the old Cornwallis road over
the lands.of E.o.Adams, Florence Adams, Mrs.Betty J.Stephenson and Dan Johnson
to a point where old said Cornwallis road crosses the Johnston - Harnett line
near the residence of Dan Johnson, it being a distance of about 3/4 miles.
This road lies in Grove Township.
Be it resolved by unanimous vote of all Commissioners, that the County of
Harnett, convey the 54 acres of land in Lillington Township, listed to
John S.Yarborough, to Ralph Lane Yarborough on the following terms:
100.00 cash April 3, 1939; $127.10 on November 1, 1939 at 6% interest;
129.60 on November 1, 1940 at 6% interest; 5129.60 on Nov. 1, 1941 at 6% interest
The Chairman of the Board and the Clerk to the Board are authorized to execute
upon the payment of the full purchase price together with the interest and the
1939, 1940 and 1941 taxes, to Ralph Lane Yarborough.

Resolution:
It having been made to appear to the board of Commissioners of the County of
Harnett that for reasons beyond the control of byrd Bros.& Shaw, Incorporated,
contractors on the County Hospital at Dunn, N.C., the work may not be completed
within the time prescribed by the contract heretofore executed by the County of
Harnett and said contractors:
Be it resolved by the Board of Commissioners of the County of Harnett that
subject to the approval of PWA, Byrd Bros. & Shaw, Incorporated contractors,
be and they are hereby allowed an extension of ninety (90) days' time in
addition to the period prescribed by the contract between the County and the
said parties within which to complete the work on the County Hospital at Dunn, N.C.
88 it further resolved that the County of Harnett does hereby waive any
penalties prescribed in said contract because of the failure of the contractors
to complete the work within the time prescribed in the original contract, but
penalties shall apply if the work be not completed within the period of extension
granted by this Resolution.
Be it further resolved that on behalf of the County of Harnett,
h.C.Strickland, County Attorney, shall execute the formal request for the
approval of said extension to PWA.
Unanimously adopted, this 3 day of April, 1939, all members of the Board
being present and voting for its adoption.
Be it resolved that Tracts Nos. 1 and 2, containing respectively 1924 acres
and 185 acres, of the land in Johnsonville Township, Harnett County, N.C.,
formerly listed to A.J.Johnson's state but actually owned on July 15, 1938 by
Margaret Etheleen Johnson, a minor, and Daniel S.Johnson, respectively, which
the County of Harnett acquired at Tax Foreclosure sale under Judgment No. A -1115,
be sold and conveyed as follows:
Tract No. 1 to Margaret Etheleen Johnson; and
Tract No. 2 to the heirs -at -law of Daniel S.Johnson, he having died intestate
within the last few weeks.
Upon receipt by the County of $25.00 this date, and balance of $275.00
within 60 days from this date and that upon receipt by the County of said sum
in full, the Chairman of the board of Commissioners is authorized and directed
to execute and deliver proper deed conveying said property to the said parties,
and the Clerk to the board will attest same as provided by law.
It is ordered that the Purchasing Agent purchase the necessary cards and
supplies incident to re- indexing the judgments in the office of the Clerk of the
Superior Court, and that he engage clerical help to make up the cards preparatory
to checking and verifying such indexing before entering same on a new and
modern index system.
Be it resolved that the 67 acres of land in Johnsonville Township, listed
to Mrs. Isabella barefoot acquired by the County of Harnett under tax foreclosure
Judgment No. 2124 -A1160 be conveyed to Mrs. Isabella Barefoot upon the cash
payment of $35.00 today, and the balance of $103.70 plus interest on or before
November13t.1939. The Chairman of the Board and Clerk to the Board are
authorized to execute deed to Mrs. Isabblla Barefoot.
The report of the Register of Deeds for the month of March was approved
and ordered filed.
The report of the Clerk of Court for the month of March was approved and
ordered filed.
The report of the Tax Collector for the month of March was approved and

To His Honor, Judge G.V.Cowper, Judge Presiding:
W9, the Grand Jury at this Term of Harnett Superior Court, do respectfully
submit the following Report of our findings and recommendations:
1. We have carefully considered and passed all bills of indictment sent by
the Solicitor and have returned them in to the Court after having carefully
considered and passed upon them.
2. We have visited the State Highway and Public Works Commission Camp near
Lillington and find same in excellent condition, and we wish to commend the
authorities for the very able and efficient manner in which the Camp is being
conducted. We were especially impressed with the cleanliness of the Camp.
3. We have visited the County Home and find it kept in excellent condition
and the inmates satisfied. We wish to commend Mr.Bradley, the Superintendent,
for the able manner in which he has conducted same.
4. We inspected the several offices in the Courthouse and find that the
work of the officers is highly satisfactory and we wish to commend them for their
efficiency.
5. We inspected the Jail and find that in excellent shape. We have never
found any jail anywhere any cleaner than our jail, and we wish to commend
Mr. and Mrs. Matthews for their services.
6. We wish to make the following recommendations and direct that they be

carried out at once:
1. That the back stairway leading up to the offices and court -room be
re- covered.
We wish to thank the Court, the Solicitor and other officers for their
co- operation and assistance given us during our term of service.

Be it resolved, that the property listed to J.T.Smith in Johnsonville Twp.
and acquired by the County of Harnett in tax foreclosure, judgment No. 2315 -A1299
be conveyed to J.T.Smith upon payment of $50.00 cash and the balance plus
interest on or before November 1, 1939.
The Chairman of Board and the Clerk to Board are authorized to execute
deed to same.
It is ordered that the respective Commissioners of the Court,who have been
or may be authorized to convey properties involved in or to be involved in
county tax foreclosure proceedings, withhold delivery of deeds to town of Dunn
until the Town of Dunn shall have paid its pro -rata part of the Court cost and
one -half of the fees for recording the several deeds.
It is ordered that J.W.`reague of Upper Little River Township, be granted
free pedler's license for the year 1939.
It is ordered that all statement of bills presented to the County for
payment shall be itemized as to the article purchased, the number of articles,
and the amount of purchase, before the same shall be approved and ordered paid.

Resolution by the Board of Commissioners of Harnett County:
WHEREAS, affidavits and other written documents have been filed with the
Board of Commissioners of Harnett County wherein it is alleged that
Mr. E.W.Bradley, Supt. of the County Home, has committed acts in connection
with his management of the affairs of the County Home, which acts, if so
committed, are of such a nature as to merit some action by the Board of
Commissioners in respect thereto;
BE IT RESOLVED by the Board of Commissioners of Harnett Couhty that they
convene on Monday, April 17th. 1939, at the courthouse in Lillington, N.C. at
9:00 O'clock A.M., to then and there hear such testimony as may be adduced by
witnesses on behalf of the complainants and respondent bearing upon the
allegations as contained in the affidavits and other written documents heretofore
filed with the Board of Commissioners.
BE IP FURTHER RESOLVED that a copy of the said affidavits and other written
allegations on file with the Board of Commissioners be transcribed by the Clerk
to this Board and mailed to Hon.Claude Bell, Attorney for the complainants, and
to Supt. E.W.Bradley of the County Home; and also that a copy of these
resolutions be mailed to each of the said parties.
BE IT ALSO RESOLVED that it is the sense of the members of the Board of
Commissioners that the complainants should produce their own witnesses at said
hearing, and that the respondent, Mr.E.W.Bradley, should produce his witnesses
in his defense.
The Board recessed to reconvene April 17th. at 9:00 A.M.

Pursuant to the Resolution adopted by the Board of Commissioners on
April 3, 1939, said Board conveyed in its room at the Courthouse in Lillington,
N.C., at 9:00 O'clock A.M., Monday, April 17th. 1939, for the purpose of
conducting a hearing on certain charges lodged against Mr.E.W.Bradley, Supt.
of the County Home.
Present were Chairman J.B.Enni.s, and Commissioners Ferd Jackson, L.R.Byrd,
A.A.Cameron and R.L.Pate.
The complainants were represented by Messrs.John Hood and Claude Bell, Esqs.,
and respondent, Mr.E.W.Bradley, was represented by L.M.Chaffin, Esq.
Respondent, Mr.E.W.Bradley, present.
All members of the Board having been present and having heard the sworn
testimony of complainants and their witnesses, and of the respondent and his
witnesses, upon such hearing, and the transcript of the proceedings and
testimony, the Board ordered that the Clerk keep on file the original transcript
of the testimony of all witnesses so that it may be made available to the public.
At the close of this hearing, the following business was transacted:
BE IT RESOLVED that the 122 acre tract of land in Averasboro Township,
Harnett County, North Carolina, formerly listed in the name of B.G.Smith, and
which was more recently owned by Jesse Tart, and which was acquired by the
County of Harnett at tax foreclosure sale under Judgment No. A -914, be conveyed
to Jesse Tart upon receipt by the County of $221.57; and upon receipt by the
County of said sum, the Chairman of the Board of Commissioners is hereby
authorized to execute deed to the purchaser, and the Clerk to the Board will
attest the same.
BE IT RESOLVED that the lot in Grove Township, Harnett County, North
Carolina, last listed by Dirs. A.L.Johnson and which was acquired by the County
of Harnett at tax foreclosure sale under Judgement No. A -1302, be conveyed to
Mrs. Lela Johnson, upon payment to the county of the sum of $172.85; and upon
receipt of said sum by the County, the Chairman of the Board of Commissioners
is hereby authorized to execute deed to the purchasers, and the Clerk to the
Board will attest the same.
BE IT RESOLVED that the tract of land containing approximately 22 acres in
Barbecue Township, Harnett County, North Carolina, lately listed in the name
of H.J.Thomas, and which was acquired by the County of Harnett at tax foreclosure
sale under Judgment No. A -1253, be conveyed to R.N.Thomas, upon payment to the
County by him of the sum of $220.00; and upon receipt of said sum by the County,

to the purchaser, and the Clerk to the Board will attest the same.

BE IT RESOLVED that the 10 acre tract of land in Barbecue; Township,
Harnett County, North Carolina, lately listed to Fred J.lNhite, and which was
acquired by the County of Harnett at tax foreclosure sale under Judgment
No. A- 1128, be conveyed to Fred J.White, upon payment to the County of all taxes
for the year 1939, together with the sum of $108.17, said sum to be paid as
follows: 525.00 cash this date, and balance in full on or before Nov. 1, 1939;
and upon receipt by the County of the full sum as stipulated, on or before
Nov. 1, 1939, the Chairman of the Board of Commissioners is hereby authorized
to sign a deed to purchaser, and the Clerk to the Board will attest the same.
BE IT RESOLVED that the 35 acre tract of land in Averasboro Township,
Harnett County, North Carolina, formerly owned and listed by Oscar Strickland,
and more recently owned by Jesse B.Lee, Sr., and which was acquired by the
County of Harnett at tax foreclosure sale under Judgment No. A-1027, "be
conveyed to Jesse B.Lee, Sr. upon payment to the County of $247.76; and the
Chairman of the Board of Commissioners is hereby authorized to execute proper
deed to said purchaser upon receipt by the county of said sum, and the Clerk to
the Board will attest the same.
BE IT RESOLVED that the 11 acre tract of land in Lillington Township,
Harnett County, North Carolina formerly owned and listed by Fannie Morgan, and
which was acquired by the County of Harnett at tax foreclosure sale under
Judgment No. A -963, be conveyed to Fannie Morgan upon payment to the County of
$82.12; and upon receipt of said sum by the County of Harnett, the Chairman of
the Board of Commissioners is hereby authorized to execute deed conveying said
property to the purchaser, and the Clerk to the Board will attest the same.
BE IT RESOLVED that the tract of 6 acres of land in Lillington Township,
Harnett County, North Carolina, formerly owned by Hector McLean, and which was
acquired by the County of Harnett at tax foreclosure sale under Judgment
No. A -1225, be conveyed to E.E.Parker, who held a first mortgage on same, upon
payment to the County of $56.92; and the Chairman of the Board of Commissioners
is hereby authorized to execute deed conveying said land to the purchaser upon
receipt by the County of said sum, and the Clerk to the Board will attest same.

To the Honorable. Board of Commissioners of Harnett County:
Benjamin C.Schneider and wife Mary L.Schneider, respectfully showeth:
That they have purchased from J.M.Royal and wife{ that certain tract of land
in Averasboro Township, Harnett County, containing 44 acres, and received deed
for same from J.M.Royal and wife, which deed is recorded in Book 271., page 66,
office of Register of Deeds for Harnett County; that under tax foreclosure suit
the County of Harnett has received deed for said tract of land from Henry C.
Strickland Commissioner; that the amount invested in said tract of land by the
County is $246.78, and the said Benjamin C.Schneider and wife Mary L.Schneider,
desire to purchase said tract of land from the County:
They, therefore, hereby offer the sum of.$246.78, the amount of the Countyts
investment in said tract of land, and upon acceptance of this offer to pay said
amount upon delivery of proper deed from the County, not later than May 1, 1939.

Session, duly called, this 17th. day of April, 1939, that the offer of
Benjamin C.Schneider and wife Mary L.Schneider, for the 44 acre tract of land,
known as the J.M.Royal land in Averasboro Township, at the price of $246.78, .
the amount of the investment of the county in said tract of land, be and the
same is hereby accepted, since the said Ben C.Schneider have purchased said
tract of land from J.M.Royal and received deed for same from said J.M.Royal and
wife, and it is ordered that proper deed be executed to said Benjamin C.Schneider
and Wife L.Schneider, by the proper officials of this Board, and delivered
upon payment of the amount of $246.78, and the said Benjamim C.Schneider and
wife Mary L.Schneider, are given until May 1, 1939 to pay said amount.

HARNEI'T COUNTY: RESOLUTION
BE IT RESOLVED by the Board of Commissioners of the County of Harnett:
1. That PWA be, and said agency is hereby requested to lend its approval
to an extension of time of ninety (90) days within which Byrd Bros. & Shaw, Inc.
General Contractors, may complete the work required under the general contract
now existing between the County of Harnett and said Contractors, in addition
to the time prescribed by the original contract between said parties; and
to that end
2. BE IT FURTHER RESOLVED that PWA lend its approval to the extension of
the present Docket Completion Date, so that the said Docket Completion Date may
comport with the 90 -day extension referred to herein.
And be it known that the aforesaid resolution has to do with PWA Docket
No. N.C. 1344F, as it relates to the construction of the Harnett County
Hospital at Dunn, N.C.
Unanimously adopted this 17 day of April 1939 at a meeting
Commissioners of Harnett County, N.C. all members of the Board
and voting for its adoption.
