March 21, 1939.
The Board of Commissioners of Harnett County met in their room at the
courthouse in Lillington, N.C., at 2:00 F.M. Tuesday, March 21st. 1939, upon
expiration of a recess taken March 15th. 1939, to conclude the business of the
regular meeting of said Board which remained unfinished at the meeting of said
Board held on Monday, March 6th. 1939, and to let contracts for furnishings and
equipment to be installed in the County Hospital at Dunn, N.C.
Present were: Chairman J.B.hnnis, and Commissim ers Angus A.Cameron, L.R.Byrd,
R.L.Pate, and nerd D.Jackson, constituting the full membership of the Board of
Harnett County Commissioners.
Bids of contractors for the furnishings and equipment of the CountyHosp,ital
at Dunn, N.C., having been filed, by unanimous vote of all members of the hoard,
Mr.Eric G.Flannagan, Architect, Mr. Colin F.Churchill, PWA representative, were
ordered to tabulate the several bids and report to the Board according to the
followinz resolution:

WHEREAS, pursuant to advertisement, bids for furnishings and equipment for
Harnett County Hospital at Dunn, N.C., have been filed by the following bidders:

Ezekiel & Wellman Company, Inc., Richmond, Va.;

that said bids have been duly received, opened and publicly read:
NOW, THEREFORE, BE IT RESOLVED, that the bids listed in the preamble hereof
be filed and presented. to Eric G.Flannagan, Consulting Architect, and that the
said architect is hereby directed forthwith to tabulate said bids, and at the
earliest practicable moment, report to this Board of Co*missioners his findings
as to the best and lowest bids for the respective furnishings and articles of
equipment.

NORTH CAROLINA: RESOLUTION AWARDING CONTRACTS FOR FURNISHINGS AND
HARNETT COUNTY: EQUIPMENT IN HARNETT COUNTY HOSPITAL AT DUNN, N.C.
INCLUDING DEDUCTIVE ALTERNATES.
WHEREAS, Hric G.Flannagan,
Consulting Architect, pursuant to a Resolution heretofore adopted, has tabulated
and considered all bids heretofore received for furnishings and equipment of the
Harnett County Hospital, at Dunn, N.C., and has made his recommendations to the
Board of Commissioners of Harnett County, N.C., and it appearing from said
recommendations and report that Ezekiel and Wellman Company, Incorporated, of
Richmond, Va., is the lowest and best bidder for the furnishing of equipment
detailed in Section One (1) of the specifications in the sum of ONE THOUSAND,
FIVE HUNDRED AND TEN ($1,510.00) DOLLARS, it being the base bid, and that this
Board of Commissioners, after considering said report and recommendations, and
all bids heretofore filed, finds that the bid of Ezekiel & Weilman, Company, Inc.,
is the lowest and best bid; aryl,

WHEREAS, said Eric G.Flannagan, Consulting Architect, pursuant to the
Resolution heretofore adopted, has tabulated and considered all bids heretofore
received for the furnishing of sterlizing equipment to be used in said Hospital,
and has duly made his recommendations to this Board of Commissioners, and it
appearing from said recommendations and report that American Sterilizer Company
of Erie, Pa., is the lowest and besttbidder for the furnishing of sterilizing
equipment as specified in Section Two (2) of the specifications, in the sum of
TWO THOUSAND SIX HUNDRED, TWENTY TWO ($2,622.00) DOLLARS, it being the base bid;
and that this Board of Commissioners, after considering said report and
recommendations and all bids heretofore filed, finds that the bid of American
Sterilizer Company, of Erie, Pa., is the lowest and best bid; and,
WHEREAS, Eric G.Flannagan, Consulting Architect, pursuant to the Resolution
heretofore adopted, has tabulated and considered all bids heretofore received,
for the furniture and equipment as specified in Section Three (3) of the
specifications, to be used in said Hospital, and has duly made his recommendations
to this Board of Commissioners, and it appearing from said report and
recommendations that the lowest and best base bid is in excess of the funds
available, and that the use of deductive alternates will be necessary in
connection with the letting of a contract for the furnishings and equipment
specified in this Section; and that Winchester Surgical Supply Company, of
Charlotte, N.C., is the lowest and best bidder within the amount of funds
available -for the furnishing of the furniture and equipment specified in
Section Three (3) of the specifications in the sum of THREE THOUSAND FIVE
HUNDRED SIXTY TWO AND 35/100 ($3,562.35) DOLLARS, after deducting alternates
numbered one to five (1 to 5), both inclusive, amounting to NINE HUNDRED THIRTY
SIX AND 15/100 (0936.15) DOLLARS; and that this Board of Commissioners, after
considering said report and recommendations, and all bids heretofore filed,
finds that the lowest and best base bid is in excess of the funds available for
the purchase of the furniture and equipment as called for in Section Three (3)
of the specifications, and that the use of the deductible alternates will be
necessary, and that the bid of Winchester Surgical Supply Company is the lowest
and best bid on said Section within the amount of funds available, after
deducting alternates numbered one to five (1 to 5) both inclusive, as specified
in the bid; and,
WHEREAS,. Eric G.Flannagan, Consulting Architect, pursuant to the Resolution
heretofore adopted, has tabulated and considered bids heretofore received for
the furniture and equipment specified in Section Four (4) of the specifications,
to be used in said Hospital, and has duly made his recommendations to this Board
of Commissioners, and it appearing from said recommendations and report that
Capital Printing Company, of Raleigh, N.C., is the lowest and best bidder for
the furnishing of the equipment called for in Section Four (4) of the
specifications inthe sum of EIGHT HUNDRED FIFTY THREE AND 99/100 (853.99)
DOLLARS, it being the base bid; and that this Board of Commissioners, after
considering said report and recommendations, and all bids heretofore filed,
finds that the bid of Capital Printing Company, of Raleigh, N.C. is the lowest
and best bid for the equipment specified in Section Four (4) of the
specifications; and,
WHEREAS, Eric G.Flannagan, Consulting Architect, pursuant to the Resolution
heretofore adopted, has tabulated and considered all bids heretofore received
for the £urnithing of miscellaneous equipment specified in Section Five (5) of
the, specifications to be used in said Hospital, and has duly made his
recommendations to this Board:.of Commissioners, and it appearing from said
recommendations and report that A.S.Aloe Company, of St. Louis, Mo., is the
lowest and best bidder for the furnishing of the miscellaneous equipment called
for in Section Five (5) of the specifications, in the sum of THREE THOUSAND
FOUR HUNDRED NINETY AND 08/100 (43,490.08) DOLLARS, it being the base bid; and
that this Board of Commissioners, after considering said report and
recommendations and all bids heretofore filed, finds that the bid of A.S.Aloe Co.
is the lowest and best bid; and,
WHEREAS, Eric G.Flanagan, Consulting Architect, pursuant to the Resolution
heretofore adopted, has tabulated and considered all bids heretofore received
for the furnishing of refrigeration equipment specified in Section Six (6) of
the specifications, to be used in said Hospital at Dunn, N.C., and has duly made
his recommendations to this Board of Commissioners; and it appearing from said
recommendations and report that 0.W.Holmes, trading as Holmes Electric, of
Fayetteville, N.C., is the lowest and best bidder for the furnishing of the
refrigeration equipment specified in Section Six (6) of the specifications to be
used in said Hospital, and that said bidder did fail to submit with his said bid
descriptions of the equipment on which he bid, and he also failed to submit cuts
or pictures of said proposed equipment, all of which was called for in the
specifications, and that his base bid was SEVENTEEN HUNDRED NINETY FIVE AND
68/100 01,795.68) DOLLARS, and that said bid should not be considered; and
that from said recommendations and report Oettinger Bros., of Kinston, N.C. is
the lowest bidder for the equipment specified in Section Six (6) of said
specifications, within the amount of funds available for the purchase of said
equipment, in the sum of ONE THOUSAND EIGHT HUNDRED FIFTY SIX (01,856.00) DOLLARS,
after deducting alternate numbered one (1) amounting to TWO HUNDRED NINETY FIVE
0295.00) DOLLARS, and that the said base bid is in excess of funds available
for the purchase of the equipment called for in Section Six (6) and that the use
of a deductive alternate will be necessary; and that this Board of Commissioners,
after considering said report and the recommensations and all bids heretofore

filed, finds that the bid of O.W.Holmes, trading as Holmes Electric, should not
be considered for that he did not comply with the specifications in making his
bid, and that the lowest and best base bid of the next lowest bidder,
Oettinger Bros., in in excess of the funds available for the purchase of the
equipment specified in Section Six (6), and that the use of deductiable alternate
will be necessary, and that the bid of Oettinger Bros. disregarding the proposal
of Holmes Electric, is the lowest and best bid, within the amount of funds
available, after deducting alternate numbered one (1) as specified in the bid:
NOW THEREFORE, Be it resolved by the Board of Commissioners of Harnett
County, North Carolina, as follows:
Section One: That the bid of Ezekiel & Wellman Company, Incorporated, for
the furnishing of the articles called for in Section One (1) of the specifications,
in the sum of $1510.00, is hereby accepted, determined and declared to bb the
lowest and best bid.
Section Two: That the bid of American Sterilizer Company, of Erie, Pa. for
the furnishing of the articles tilled for in Section Two (2) of the
specifications, in the sum of $2622.00, is hereby accepted, determined aid
declared to be the lowest and best bid.
Section Three: That the bid of Winchester Surgical Supply Company, of
Charlotte, N.C., for the furnishing of the articles called for in Section Three(3)
of the specifications, in the sum of $3562.35, after deducting alternates
numbered one to five (1 to 5), both inclusive, as specified in said bid, is
hereby accepted, determined and declared to be the best bid within the amount of
funds available for the purchase of the equipment specified in said Section.
Section Four: That the bid of Capital Printing Company of Raleigh, N.C.
for the furnishing of the articles of equipment specified in Section Four (4) of
the specifications, in the sum of $853.99, is hereby accepted, determined and
declared to be the lowest and best bid.
Section Five: That the bid of A.S.Aloe Company of St. Louis, Mo. for the
furnishing of equipment called for in Section Five (5) of the specifications,
in the sum of $3,490.08, is hereby accepted, determined and declared to be the
lowest and best bid.
Section Six: That the bid of O.W.Holmes, trading as Holmes Electric, of
Fayetteville, N.C. on the articles called for in Section Six (6) of the
specifications, be not considered, for that he did not comply with instructions
to bidders and with the specifications; and that the bid of Oettinger Bros. of
Kinston, N.C. for the furnishing of the articles of equipment called for in
Section Six (6) of the specifications, in the sum of $1,856.00, after deducting
alternate numbered one, as specified in the bid, is hereby accepted, determined
and declared to be the lowest and best legitimate bid within the amount of the
funds available.
Section Seven: That the six awards above set forth in this Resolution shall
not be effective until the respective awardees shall have been notified in
writing by Henry C.Strickland, Counsel to the Board of Commissioners of Harnett
County, of such awards; and that upon the respective awardees being so nbtified
in writing, a contract for the furnishing of the several articles of equipment,
and the installation of same (if called for in the specifications) as heretofore
prescribed by the plans, specifications and contract documents, shall be
forthwith executed by the said respective awardeec for the furnishing and /or
installation of the said articles of equipment.
Section Eight: That J.B.Ennis, Chairman of the Board of Commissioners of
Harnett County, N.C. is hereby authorized and directed to execute the said
respective contracts in the name of, and for, and on behalf of the County of
Harnett.
Resolved, that the County sell to John Swann (colored) the twelve acres of
land in Barbecue Township, in Judgment A -1281 for the sum of $120.00 payable
$40.00 on or before the First Monday in April, 1939, and the balance Nov. 1,1939.
Deed to be made when payment is made in full.
Resolved, that the County sell to Dr. F.H.Fleming (Coats, N.C.), the 18 acres
of land in Neillts Creek Township, Judgment No. 1900 A 864, for the sum of
$150.00. The Chairman and Clerk to the Board are authorized to execute Deed to
Dr. Fleming upon payment to the County of $150.00.
It is ordered that the County purchase a farm level to be used in the
Soil Conservation program of the County.
It is ordered. that A.L.Newberry be notified to appear before the Board on
April 3, 1939 and give report of the progress he has made on the appraisal of
the property in the County.
There being no further business, the meeting adjourned.

The Board of Commissioners of Harnett County met in regular session Monday,
April 3, 1939, at 10;00 A.M. with Chairman J.B.Ennis, and Commissioners Angus A.
Cameron, Lonnie R.Byrd, R.L.Pate and Ferd D.Jackson present. Also County
Attorney H.C.Strickland present.
It is ordered that the County Auditor pay on behalf of the County, its
pro -rata part of the cost incurred to April 1, 1939, of the services of
Mr.A.L.Newberry, appraiser, and printing and stenographic hire, according to
statement presented this date, the bill for such services having been presented
but County's part to be ascertained therefrom.
Be it resolved, that the tract of land formerly listed to Mrs.R.L.Byrd, in
Averasboro Township, containing 41 acres, more or less, and acquired by the
County of Harnett under tax foreclosure judgment No. A -825, be conveyed to
Mrs. Ruth Jernigan Byrd and husband R.L.Byrd, upon payment by them to the County
of $103.65; and upon such payment being made, J.B.Ennis, Chairman of the Board
of Commisdoners, is hereby authorized and directed to execute proper deed to
the purchasers on behalf of the County of Harnett, and the Clerk to the Board
will attest the same as provided by law.
Be it resolved, that the 2 acre tract of land formerly listed to Wm.H.Cutts
(colored) in Black River Township, Harnett County, and acquired by the County
of Harnett and Town of Angier, under tax foreclosure judgment No. A -875, be
conveyed to M.D.Ragland (colored) the brother-in-law of Wm.H.Cutts, upon payment
being made to the County of $92.14, without prejudice to the rights of the
Tewn of Angier, co -owner of the said land; and upon receipt of said purchase
price the Chairman of the Board of Commissioners is hereby authorized and
directed to execute proper deed on behalf of the County of Harnett, and the Clerk
will attest same as provided by law.
Be it resolved, that the property formerly listed to G.H.Jernigan, in
Averasboro Township, Harnett County, an interest in which was acquired by the
County of Harnett under tax foreclosure judgment No. A -1008, be conveyed to
George H.Jernigan, without prejudice to the rights of the Town of Dunn, upon
payment to the County of $123.16; and upon such payment being made, the Chairman
of the Board of Commissioners is hereby authorized and directed to execute on
behalf of the County of Harnett a proper deed to said purchaser and the Clerk to
the Board will attest same, as provided by law.
Be it further resolved that the resolution of the Board of Commissioners
appearing in Minute Book No. 7, page 29, directing deed to the aforesaid property
to be made to R.F.Jernigan, be and the same is hereby rescinded in toto.
It is ordered that the 29 acres of land in Johnsonville Township, listed in
the name of Abe Gilchrist Estate, which was foreclosed by the County, be
transferred to Alfred Fuller upon payment of $70.00 down and $35.00 plus interest
and 1939 taxes on November 1, 1939 conditioned upon the approval of the majority
of the heirs of Abe Gilchrist.
It having been conclusively shown to the Board of Commissioners that the
listing of the stocks of merchandise of Erwin Department Store and Leader Store,
Incorporated, Erwin, N.C., for the years 1937 and 1938, was based upon a boosted
inventory of goods, the valuation of which was fictitious, and that the sum of
$598.93 is 100% of the taxes on the true value of said stocks at the times they
were listed in 1937 and 1938, it is ordered:
That the County Auditor and the County Tax Collector accept $309.24 in full
aettlement`-of the taxes for 1937 on said stocks, including penalties, and that
they accept $289.69 in full settlement of taxes on said stocks for the year 1938;
and that upon receipt of the total sum of $598.93, the official tax receipts be
released to the proper parties.
