HomeMy WebLinkAbout0306193926 March 6, 1939 The Board of Commissioners of Harnett County met in regular session on Monday, March 6, 1939, at 10:00 A.M.with Chairman J.B.Ennis, and Commissioners Lonnie R.Byld, A.A.Cameron, R.L.Pate and Ferd D.Jackson present; also County Attorney H.C.Strickland. It is ordered that C.H.Avery of Duke Township, be allowed $40.00 for patrolling Highway in town of Erwin for the year 1939. It is ordered that the land listed as 29 acres to John Swann in Barbecue Township, be referred to County Tax Supervisor for investigation, and if there be an error, that same be released and adjusted. It is ordered that 11 acres of land in Bar becu.e'Township, listed to Alice Douglads (colored) and sold to County of 1-srnett, under tax foreclosure Judgment No. 2311 -A -1298, be conveyed to W.D.Harrington upon receipt of $67.20 the purchase price in full, and "the Chairman and Clerk of the Board are authorized to execute deed to W.D.Harrington. The Board of Commissioners expressed its willingness to provide sufficient funds in its 1939 -1940 Budget to meet the budget - requirements of` the Board of Education in respect to providing George -Reed Home Economic teachers at Angier and at other schools in the County. It is ordered that the one -third interest of John Darroch Estate in Barbecue Township willed to the Trustees of Barbecue Presbyterian Church, be released frommall taxes for the years 1930 through 1933 upon the payment. of *257.56. BE IT RESOLVED by the Board of Commissioners of Halflett County, that it shall be unlawful for my person to hunt fox,in Harnett County between the 15th. day of March and the 15th. day of. August. This resolution shall be in full force and effect after its adoption. . BE IT RESOLVED by the Board of Commissioners of Harnett County in regular session, on Monday, i'arch 6, 1939, that Lots £Jos. 22, 23; and 24 shown on map recorded in Map Book No. 4, page 25, office of :Register of Deeds of rarnett County, which lots are listed by J.G.Gattis for taxes for the year 1938 and included in that 52 acres listed by said J.G.Gattis and which lots are now owned by M.Eugene Gatt -is, be and they are hereby segregated from the other part of said 5* acres for the purpose of taxation, and that the value of said three lots be fixed at *30.00 for the years 1938 and 1939. It is ordered that the tax valuation of *3,000.00 on the property listed td Mrs. Alma Fuquay Estate in Averasboro Township be reduced to $1750.00. It is ordered that the Auditor pay to T.B.Young, Sr. the sum of *5.00 received by the County as marriage license fees for license issued to Troy Benton Young, Jr., and which license was issued upon misrepresentation of facts, and were returned unused to the Register of Deeds Office. BE IT RESOLVED that the 47.64 acres of land listed to D.D.Overby, Black River Township, and purchased by Harnett County under Tax Foreclosure Judgment No. A -1026, upon payment to the County of the sum of *196.83, be sold and conveyed to Eliza J.Surles, she being a sister of the former owner and having held a lien on the subject land; and upon receipt by the County of the purchase price, the Chairman and Clerk of the Board are authorized to execute and deliver proper deed to Eliza J.Surles. . BE IT RESOLVED that the 16 3/4 acres of property listed to B.J.Burnett in Stewart's Creek Township, and purchased by County at Tax Foreclosure sale under Judgment Ho. A 942, be sold to William H.Elliott(colored), upon payment to County of $90.80. The Deed to be held by County Auditor until April 6th. awaiting advice from J.A.McLeod, Attorney for Mrs. Augusta Manning. The report of W.D.Harrington, Tax Collector, was approved and ordered filed. The report of Howard Godwin, C.S.C. was approved and ordered filed. The report of Inez Harrington, Reg. of Deeds was approved and ordered filed. RESOLVED, that the 64 acres of land listed to John D.Cameron estate and sold to the County of Harnett under Tax Foreclosure Judgment No. A -607, be sold to • Lillim Cameron upon payment to the County of *150.00 before March 16th. 1939, and upon payment being made, the Chairman and Clerk of the Board are authorized to execute deed to the purchaser free of taxes through 1938. 2i WHEREAS, there was turned over to Harnett County :,833.02 in credits by John Green, former Harnett County Tax Collector, during his tenure of office 1924 -1928, which assets were in part represented by taxpayers' checks which proved uncollectible, and all right of recourse against any and all persons for the collection of said sum is barred by limitation; and WHEREAS, J.O.West, as County Attorney during the period 1928 -1930 was advanced 36,454.26 in connection with his court costs, said sum having been charged in bills of costs in suits involving tax suit foreclosures, and which appears as an asset of Harnett County, and which costs have not been collected because judgments entered in such suits were in most cases on a compromise basis of the matters in dispute; and WHEREAS, by virtue of Chapter 427 of the Public Laws of 1931, certain taxes were levied for State purposes, and thereafter by virtue of Chapter 397 of the Public Laws of 1935, the several counties of the State were authorized to make final settlement with the State, with the result that Harnett County has met all demands made upon it by the State in this connection and has the sum of 38,233.06 in its depositary and in uncollected taxes which is set up as a liability to the State, which sum should, in fact, be turned into the general fund of the County and charged off as a liability; and WHEREAS, for more than nine years there has appeared of record a liability of the general fund of Harnett County to the School Fund of $18,675.50, when as a matter of fact, the County of Harnett has each and every year levied sufficient taxes for school purposes and appropriated sufficient funds for such purposes, and the sum referred to should no longer be reflected as a liability of the County of Harnett, and within the 15¢limitation of levy cannot be paid from the general fund; and WHEREAS, for many years the aforementioned "assets" and "liabilities" have appeared in various accountings of the County of Harnett as reflected by the report on the audit of the County made by Walter Charnley & Company in 1931, and further reflected and confirmed by the audits of H.C.Northrop made of the affairs of the County in 1935 and 1938; and WHEREAS, the so- called assets are of no value apparently, and the so- called liabilities are the result of an interchange of the respective funds referred to, and to enable the County of Harnett to make a financial statement importing verity in fact as well as in form necessitates the adoption of this resolution and appropriate action by the General Assembly of North Carolina: BE IT, THEREFORE, RESOLVED by the Board of Commissioners of Harnett County: 1) That the sum of 833.02 represented by credits allowed John Green, former Harnett County Tax Collector, be and the same is hereby charged off as an asset of Harnett County. 2) That the sum of 36,454.26 represented by costs advanced to J.O.West, former County Attorney, be and the same is hereby charged off as an asset of the County of Harnett. 3) That the sum of $8,233.06 appearing as a liability of the County of Harnett to the State of North Carolina, together with any and all other taxes collected by the County of Harnett for the benefit of the State by virtue of Chapter 427 of the Public Laws of 1931, be and the same is hereby transferred from the status of a liability of the County to the State to the General County Fund. 4) That the sum of 318,675.50, set up as a liability of the general fund of Harnett County to the School Fund, be and the same is hereby transferred from its status as a special liability of the County of Harnett to the general fund of the County. 5) That the County Auditor be and he is hereby authorized and directed to correct the books of account of Harnett County to the end that said books may comport with the tenor of these resolutions, thereby lending verity to said books of account. 6) That Neill McK.Ross, member of the House of Representatives from Harnett County, and Fred Thomas, State Senator, be and they are hereby requested to introduce, sponsor and support to final enactment by the present General Assembly of North Carolina laws authorizing the legal accomplishment of the objects purporting to be done by this instrument, or to validate the acts of the Board of Commissioners of Harnett County in this regard. Attest: (signed) Inez Harrington Clerk to the Board. 27 WHEREAS, on the first Monday in February 1939, the Board of Commissioners of Harnett County passed a Resolution memorializing the State Highway and Public Works Commission to route the road from Lillington to Coats via the town of Buie's Creek; and WI-IEREAS, heretofore, and prior to January 19, 1937, the Board of Commissioners had, by resolution, requested the State Highway Commission to surface the road from Lillington to Coats via Spence's Cross Roads; and WHEREAS, the Board of Commissioners of Harnett County realize that the State Highway and Public Works Commission is amply equipped with the necessary information concerning the costs of erecting structures, grading and location of both of said routes, and is further in position to ascertain the best location therefor looking to the service of the communities through which both of said routes are proposed as well as the service of said route to the state generally: NOW, Therefore, without prejudice to e ither the Resolution adopted at the February meeting of said Board in February 1939, or the previous request hereto- fore made prior to January 19,. 1937, respecting the treatment of said road from Lillington to Coats, be it resolved: 1. That the matter of locating the said route be left entirely with the State Highway and Public Works Commision to the end that said road may be built for the best interests of the communities through which said road would pass, the costs thereof and the service said road would render to the State generally; and, 2. That said Highway and Public Works Commission proceed as early as possible to locate and construct the said road; and 3. That a copy of this Resolution be sent to the State Highway and Public Works Commission, a copy to the Highway Commissioner of this district, and a copy spread upon the minutes of this Board. BE IT RESOLVED by the Board of County Commissioners of Harnett County, N.C. that this Board does hereby approve a certain renewal agreement for payments in lieu of taxes between the United State of America and the Board of Education of Harnett County, North Carolina, dated July 1, 1938, a copy of which was presented at this meeting, and made a part of the minutes thereof; and does hereby agree, in consideration of the making of such payments by the United States, that it will provide for all inhabitants of the Project of school age such school services a5 it provides for all persons of school age not inhabiting the Project. BE IT RESOLVED that the 18 acres of land in Neill's Creek Township, listed to T.L.Reardon, and acquired by County of Harnett under Tax Foreclosure Judgment No. A -684, be conveyed to ---- Mrs.Azube Matthews Lee - - -- upon payment to the County of Harnett of $150.00, it being the amount of all taxes, penalties, interest and cost and upon receipt of said sum by the County, the 0 airman of the Board and the Clerk to the Board are authorized to execute proper deed to purchaser. BE IT RESOLVW) that the lots in the town of Dunn, listed to Arthur McKay (col) in Averasboro Township, acquired by Harnett County and Town of Dunn, under Tax Foreclosure Judgment No. A -865, be conveyed to - - -- Arthur McKay upon payment to the County of $213.95 before March 21, 1939, and that upon receipt of said sum the Chairman of the Board and the Clerk to the Board are authorized to. execute proper deed to said purchaser. It is ordered that beer license be granted to Mickey OtQuinn to sell beer at Mickey's Place on Highway between Dunn and Erwin. 28 BE IT RESOLVED that 27 acres of land listed to C.C.Jordan in Black River Township and purchased by County of Harnett under tax foreclosure judgment No. A -850, be sold to - -- Leonie Blalock - -- -upon payment to the County of $170.37 at direction of S.H.Blalock, a lien holder, and to this end, the Chairman and Clerk of the Board are authorized to execute proper deed to the purchaser. BE IT RESOLEVED that the 130 acres of property listed to A.M.Shaw, in Lillington Township, and purchased by County of Harnett, under tax foreclosure judgment No. A -1036, be conveyed to - - -- W.E.Nichols - -- -upon payment to the County of all taxes, penalties, interests and costs through 1938, he being a lien holder, and to this end, the Chairman and Clerk to the Board are authorized to execute proper deed to the purchaser. BE IT RESOLVED that the land listed to Corrinna McNeill (widow) in Lillington Township, and acquired by the County under tax foreclosure judgment No. A -1025, be sold and conveyed to - - -- Corrinna McNeill - -- -upon payment to the County of $50.00, $25.00 of which is to be paid this date, and the other $25.00 on or before October 1, 1939, and upon receipt of the purchase price in full, the Chairman and the Clerk to the Board, are authorized to execute and deliver proper deed to purchaser free of all taxes through 1938. BE IT RESOLVED that the two tracts of land containing in aggregate 25 acres, in Lillington Township, listed to Flora L.Smith, and purchased by Harnett County at the foreclosure sale under Judgment No. A -1228, be sold and conveyed to - - -- Douglad McRae - -- -upon payment to the County of the sum of $226.00, it being all taxes, penalties, interests and costs through the year 1938, and upon payment of said sum, the Chairman and Clerk to the Board are authorized to execute and deliver proper deed to the purchaser. The adoption of this resolution was requested by Lawrence Smith, an interested former owner, who appeared before the Board. The following road petition was approved and ordered forwarded to the State Highway and Public Works Commission: The road that branches off from Highway No. 421 at D.P.Cameron's place and runs southwest 2.7 miles, and intersects with the Mt.Pisgah- Leaflet road. The point of intersection is 1.1 miles from the east end of this road. BE IT RESOLVED by the Board of Commissioners of Harnett County, that Honorable Neill McK.Ross and Honorable Fred Thomas, members of the General Assembly, be memorialized to sponsor such local legislation to final enactment as will permit all municipalities in Harnett County to sell property acquired or which they may acquire, by tax foreclosure sales, either at public or private sale, for cash or on deferred payment plan.
