Monday, December 5th. 1938
The Boara of Commissioners of Ilarnett County met in regular session in their
room at the Courthouse in Lillington, 1�.C., Konday, December 5, 1938. Present
were Chairman J.B.Ennis, Commissioners J.S.Earker, Geo.T.Noel, A.A.Cameron and
L.R.Byrd. The Clerk and County Attorney were also present.
The following business was transacted:
The report of the receipts of the office of

This represents all the funds for which I am chargeable and which are in my
hands to be now turned over to Mr.Howard Godwin, my successor in office.
I have not itemized these accounts to the parties entitled for the reason
that I have not had access to the books, due to the fact that H.C.Northrup & Co.
have been conducting an audit of this office and they have had the books of the
office for the past five weeks. At the first of November I began on my report
so that I might have it in regular itemized form for you but the day after I
started the auditors who are now checking my office came and they have had
constant and uninterrupted use of all my books and records ever since, to such
an extent that I have been unable to have the use of them for making a report.
Therefore, 'I respectfully submit this my report and ask that it be accepted.
For the past two weeks I -have been geeting up this data at night when I had
access to the books and I only completed. this Saturday night, after the most
arduous labor that I have ever done. You will observe on the first sheet that
there is in the Bank of Lillington and loans on real estate sufficient funds to
pay every cent the Clerk's office is due.

Harnett County:
To the Honorable Board of Commissioners of Harnett County:
I desire to call to the attention of your Honorable Board the amount of money
I have turned into the treasury of Harnett County since the last First Monday in
December 1937.
I have endeavored to collect all fees and funds coming through my office due
the County and I have remitted them to you monthly.
I am leaving office today with all work up to date and with all books intact.
However, the Cross Indexes to the Judgment Dockets are in bad, dilapidated
condition and their use is dangerous to the rights of the citizens of the County.
I have repeatedly asked for the re- indexing of the Judgments in order that we
might have a new, strong index and an index which could not be easily destroyed.
The present index is in such shape that the leaves therein can be easily torn
our and that the leaves themselves are rotten. As stated, they are now intact
and if any loss should arise from their condition this is notice to you that I
have given ample notice thereof.
The amount I have turned into the treasury of the County dnrigg the past
year and up to date is $9,621.97.
Kindly have this report recorded in your minutes.

NORTH CAROLINA:
HARNETT COUNTY: RESOLUTION
WHEREAS, Honorable Leonadis Martin Chaffin has served as Clerk of the Harnett
County Superior Court for sixteen years, and has brought distinction to that
office by maintaining its traditions in such a manner as to deserve the
commendation of Superior Court Judges, attorneys, county officials and the
public; and,
WHEREAS, the tenure of office of Honorable Leonadis Martin Chaffin expires
today; and,
WHEREAS, because of an audit being in progress to determine on the part of
the Board of Commissioners of Harnett County the liability of the said Clerk of
the Superior Court, it has been and now is impossible and impracticable for the
said Clerk of the Superior Court to itemize and show in detail each and every
item covered by the several funds to be turned over by said Clerk to his
successor, Honorable Howard Godwin,but that such a detailed and itemized statement
may be prepared and furnished to the Board of Commissioners of Harnett County and
Honorable Howard Godwin within the next sixty days; and,
WHEREAS, siad Clerk of the Superior Court now has on hand a total of
$13,379.45, representing the aggregate amount of the several funds under his
control, which said amount he has today turned over to his successor, Honorable
Howard Godwin, classified but not itemized, and which said sum is being accepted
by his said successor subject to itemization in detail within a period not
exceeding sixty days from the date hereof:
BE IT RESOLVED by the Board of Commissioners of Harnett County that a vote
of thanks be extended to Honorable Leonadis Martin Chaffin because of his long
and faithful service to the County of Harnett; and,
BE IT FURTHER RESOLVED by said Board that he be allowed until Feb. 3, 1939
within which time to file an itemized and detailed statement showing all items
covered by the aggregate sum of $13,379.45 turned over into the hands of his
successor, Honorable Howard Godwin, at which time a final accounting may be had
and acted upon.

It is ordered that the 256 acres of land listed to Carrie Green Estate in
Lillington Township be released of the lien of County Taxes for the year 1938
and prior years upon payment of $250.00 plus Court Costs.
It is ordered that the lien of the County of Harnett for unpaid taxes on the
property in the town of Dunn, listed in the name of Dunn Hotel Company for the
year 1938 and prior years, be released upon payment to the County of Harnett of
the sum of $2,000.00 plus accrued Clerk of Superior Court and Sheriff costs
and that the tax valuation of this property be reduced to $25,000.00 for the
years 1939.
It is ordered that 125 acres of land listed to D.A.McNeill(colored) in
Barbecue Township, be released of the lien of County taxes for the year 1938 and
all prior years upon payment to the County of taxes, penalties, interest and cost
including accrued Court cost for the years 1938, 1937, 1936, 1935 and 1934.
It is ordered that A.L.Clifton, Grove Township, be released of $140.00
valuation for the years 1937 and 1938 on account of error in revaluing property.
( A house valued at $140.00 listed, for there appeared to be no building on
property.)
The Board appointed J.S.McLean and A.A.Cameron as a committee to,determine
whether the building on the property of L.L.Laton in Barbecue Township, should
be taxed in Harnett County or Lee County.
It is ordered that 135 acres of land listed to Hugh,Malcom and Daniel Ray
In Anderson Creek Township, be released of the lien of County taxes for the year
1938 and all prier years upon payment to the County of the aggregate amount of
$278.23 before December 10, 1938.
It is ordered that the two (2) lots on'Broad Street in the town of Dunn and
listed to Baer & Son, be reduced in,tax valuation to U300.00 each ($600.00).
It is ordered that the property listed to Mrs. J.L.Hudson and Mrs. Irene Tart
in the town of Dunn, on South Layton Avenue, be reduced in tax valuation from
$1965.00 to $1600.00.
The Board appepted with regrets the resignation of Neill McK.Ross as Vice
Recorder of Harnett County.
The report of the committee appointed by the Board to investigate the tax
valuation of property in the County is as follows:
"The committee appointed to make an investigation on property in Averasboro
Township, wishes to- subrfit the following report and recommendations:
(1) That the valuation of improvements on Mrs.Mattie A.Byrd's property b
placed at $150.00 and that.ne change be made in the value of the lot. --
(2) That no change be made in the valuation of the property of ::Mrs.Chas.Highsmith.
(3) That no change be made in the valuation of the property of S.D.Stone estate.
(4) That the valuation of the house of Mrs.J.W.V9hitehead be reduced from
$5950.00 to $5400:00

The following road petitions were approved by the Board and, ordered forwarded
to the State Highway and Public Works Commission:
(1) Road beginning at J.W.Mason's on the McDougald Road, about nine miles south -
west of the town of Lillington, and runs in the direction of Spring Hill
Church intersecting the Mamers Road at A.L.Stricklandts about one mile long.
(2) That public road leading from the town of Coats, at a point at the home of
Mrs.T.V.Stewart, on Highway No. 55 to a point near the home and filling
station of M.E.Byrd on N.C.Highway No. 60 be surfaced and treated.
This date being Monday, December 5, 1938, and the First Monday the attention
of the members of the Board were directed by law that the newly elected Board
of County Commissioners should be inducted into office. WHEREUPON, the Board
adjourned its session and the following elected Commissioners were inducted into
office of Commissioner: J.B.Ennis, L.R.Byrd, A.A.Cameron, Ferd Jackson, and '
R.L.Pate.
Thereafter, the newly inducted Board of Commissioners approved the proposed
induction into office of the other elected officers of the County who were to
begin their respective terms this date and accordingly said officers were
administered their respective oaths of office and susbscribed to the same.
The newly elected Commissioners then went into session, and the Board was
organized as follows: Chairman: J.B.Ennis; Vice - Chairman: A.A.Cameron. The
following were present and voted: J.B.Ennis, L.R.Byrd, A.A.Cameron, Ferd Jackson
and R.L.Pate
By unanimous vote of all the Commissioners, Hon. Walter Lee Johnson, was
appointed as Vice - Recorder of the County Recorder's Court.
By unanimous vote of all the Commissioners, Hon. M.O.Lee was appointed to
the office of Solicitor of the County Recorder's Court to serve during the
pleasure of the Board.

By unanimous vote of all members OF THE Board, Hon.J.S.McLean was appointed
as County Auditor.
By unanimous vote of all members of the Board, Hon.H.S.Freeman was appointed
as Assistant County Auditor.
The Board unanimously approved the appointed of Miss Elsie Baggett as Deputy
Register of Deeds and the appointment of Ralvin McLeod as Deputy Clerk of
Superior Court.
Applications for appointment to the position of Superintendent of County
Home were considered. Of the seven applicants, five received nomination.
Commissioner Byrd nominating E.C.Byrd; Commissioner Cameron nominating
Mrs.J.W.Bain; Commissioner Jackson nominating L.B.Jackson; Commissioner Pate
nominating Mrs.T.R.Brown, and, with Vice - Chairman presiding, Commissioner Ennis
nominated E.W.Bradley. After further balloting, Commissioners Fate and Jackson
cast their votes for L.B.Jackson and the other Commissioners voted for
E.W.Bradley. Thereupon, the appointment of E.W.Bradley, for a term of one year,
was made by unanimous vote of all the Commissioners.
Henry C.Strickland, Esquire, was by unanimous vote of the Commissioners,
selected as County Attorney.
NORTH CAROLINA:
HARNETT COUNTY: RESOLUTION
WHEREAS, Honorable Geo.T.Noel and the Honorable J.S.Barker have served in
the high office of County Commissioner of Harnett County for several years with
distinction, and they have brought to that office a tenure of admirable service;
AND WHEREAS, the term of office of the said two Commissioners expires this
date; and
WHEREAS, said Commissioners are deserving of the commendation of the public
generally and the Board of Commissioners of Harnett County in particular:
BE IT RESOLVED by the Board of Commissioners of Harnett County that they
extend their unqualified thanks to the Honorable Geo.T.Noel and the Honorable
John S.Barker for the faithful and efficient manner in which they have
discharged their trusts as Commissioners of Harnett County.

The volume of business to be transacted by the Board being unusually large,
the Commissioners recessed their meeting to reconvene upon expiration of the
recess at 8 :30 A.M.Tuesday, December 6, 1938.

Tuesday, December 6, 1938.
The Board of Commissioners of Harnett County met in a call session Tuesday,
December 6, 1938 at 8 :30 A.M. with Chairman J.B.Ennis, and Commissioners
R.L.Pate, A.A.Cameron, L.R.Byrd and Ferd Jackson present. The Clerk to Board
and the County Attorney were also present.
It is ordered that the valuation of the four lots listed in the name of
S.D.Stone Estate, Averasboro Township, in the town of Dunn, be reductd to
$2170.00 for the years 1930 thru 1936 inclusive, and that the judgment against
S.D.Stone Estate be cancelled upon payment of $601.20 if paid on or before
December 10, 1938.
It is ordered that the 1927 taxes against McNeill & Company, Barbecue Twp.,
be released and the County Auditor is hereby ordered to cancel same, it appearing
to the Board that the taxes were paid to J.O.West, Attorney.
It is ordered that J.B.Bowden, Neill's Creek Township, be released of $1.00
tax on dog for year 1938 on account of error in listing.
It is ordered that C.T.Moore of Upper Litt River Township, be released of
poll tax for year 1938 on account of being o ld War Veteran.

It is ordered that tax lien held by the County of Harnett on 134 acres of
land, listed to Mrs.Mollie Stewart in Grove Township, be released upon payment
of $165.97.
The report of the Grand Jury for the November Term of Court was read before
the Board, approved and ordered filed. The Board ordered that, the Auditor be
authorized to make the necessary purchases for the supplies as recommended by
the Grand Jury on or before January 1, 1939.
"NORTH CAROLINA: IN THE SUPERIOR COURT
Harnett County: NOVEMBER TERM 1938.
TO HIS HONOR, Judge Clawson L.Williams, Judge Presiding:
We, the Grand Jury at this Term of Harnett Superior Court, do respectfully
submit the following Report of our findings and recommendations:
1. It have carefully considered and passed upon all Bills of Indictment sent
by the Solicitor and have returned them into the Court after having carefully
considered and passed upon them.
2. We have visited the Stat e Highway and Public Works Commission Camp near
Lillington and find same in excellent condition, and we wish to commend the
authorities for the very able and efficient manner in which the Camp is being
conducted. We were especially impressed with the cleanliness of the Camp.
3. We have visited the County Home and find it kept in excellent condition,
and the inmates satisfied. We wish to commend Mr.Bradley, the Superintendent,
for the able manner in which he has conducted same.
4. We inspected the several offices in the Courthouse and find that the work
of the officers is highly satisfactory and we wish to commend them for their
efficiency.
5. We inspected the jail and find that in excellent shape. We have never
found any jail any where any cleaner than our jail, and we wish to commend
Mr. and Mrs. Matthews for their services.
6. We inspected all the school busses in the County and find that all of them
except one appear to be in good running shape. During the supmer all of them were
repaired and they are now giving good service except one.
7. We wish to make the following recommendations and direct that they be
carried out at once:
1. That new Bibles be purchased at once for the use in the court room
and in the several offices of the Courthouse.
2. We recommend that the men's toilet in the courthouse be put in
first -class condition at once, and that all needed new material be put in them
at once.
3. We recommend that new steps be put at both front and rear of the
living quarters of the jail, because the old steps at both places are about to
fall down. We further recommend that certain of the rooms in the living quarters
of the jail be replastered at once.
8. We recommend that School Truck No. 57, which is a 1934 Chevrolet model,
now serving Lafayette School, be replaced at once, for we find that this truck
is practically worn out and that some days the children cannot be transported in it.
9. We recommend that mats be placed in all school busses. •
10. In our report to Your Honor at the First September Term 1938, we
recommended that the men's toilet in the courthouse be repaired, that mats be
placed in all school busses, and that the living quarters of the jail be repaired.
We find this has not been done and we are directing Your Honorts attention to
this fact, and ask that if these recommendations, together with the others made in
this report, are not carried out that some action be taken against the proper
authorities.
We wish to thank the court for its very able charge given us when we began
our labors for it was the finest charge we believe has ever been delivered to a
Grand Jury in this County. We also wish to thank the Solicitor and other officers
for their co- operation and assistance given us at this Terra.

It is ordered that the property described in Judgment No. A -828, County -vs-
Carlyle Core et als, be re -sold by the County to Carlyle Core upon payment to the
County of the amount of the judgment, together with interest, penalties and all
court costs, said payment to be made as follows: 4100.00 on or before May 10,1939;
and the balance in full on or before Novembers 10, 1939; and upon such payments.
in full being made as aforesaid, the County will execute proper quit -claim deed
to said purchaser.

It is ordered that J.Newell Patterson be released of dog tax for year 1938
on account of error in listing.
The Board ordered that no change be made in the tax valuation on the personal
property listed to W.A.Weston, in Lillington Township.
The bond of Hon.Howard G.Godwin, Clerk of Superior Court, with the Maryland
Casualty Company as surety in the sum of $10,000.00 was presented to Board.
Upon motion of Commissioner Cameron, seconded by Commissioner Pate, the bond
was approved and accepted and ordered recorded by the Register of Deeds.
Those voting for its approval and acceptance were J.B.Ennis, L.R.Byrd,
A.A.Cameron, R.L.Pate and Ferd Jackson.

Harnett County;
KNOW ALL MEN BY THESE PRESENTS, that we, Howard G.Godwin and /or The Maryland
Casualty Company of Baltimore, Maryland, are held and firmly bound unto the State
of North Carolina, in the sum of TEN THOUSAND DOLLARS (10,000.00) to the payment
of which we bind ourselves, our heirs, executors and administrators firmly by
these presents.
Signed and sealed this 2 day of December, 1938.
The condition of the above obligation is such, that whereas, the above
bounden Howard G.Godwin has been elected Clerk of the Superior Court of Harnett
County for the term of four (4) years from and after the 5th. day of December,1938:
Now, if the said Howard G.Godwin shall account for and pay over according to
law all moneys and effects which have come or may come into his hands by virtue
or color of his office, or under an order or decree of a judge, even though such
order or decree be void for want of jurisdiction or other irregularities, and
shall diligently preserve and take care of all books, records, papers, and other
property which have come or may come into his possession by virtue or color of
his office, and shall in all things faithfully perform the duties of his office
as they are or hereafter shall be prescribed by law, then this obligation is to
be void; otherwise to remain in full force and effect.

of Minutes of County Commissioners No. 7, page 7, the 15 day of December, 1938.
Upon motion by Commissioner Byrd, seconded by Commissioner Cameron, the
following resolution was unanimously adopted:
" A RESOLUTION DESIGNATING DEPOSITORIES TO BE USED BY HOWARD G.GODWIN, CLERK OF
THE SUPERIOR COURT OF HARNETT COUNTY, NORTH CAROLINA
WHEREAS, Howard G.Godwin has been duly elected and qualified as Clerk of the
Superior Court of Harnett County, North Carolina, and;
WHEREAS, Howard G.Godwin as such officer will have coming into his custody,
control and possession funds and securities belonging to the State of North
Carolina, Harnett County, and the general public, and;
WHEREAS, this Board has been requested to designate the banks to be used as
depositories for all funds and securities that may come into the hands of Howard
G.Godwin by virtue of his office as Clerk of the Superior Court for Harnett
County, North Carolina.
NOW, THEREFORE, be it resolved: -
1. That Howard G.Godwin, Clerk of the Superior Court of Harnett County,
North Carolina, be, and he is hereby directed to deposit and keep all funds and
securities of whatever nature, that may come into his custody, control and
possession by virtue of his office, in the Bank of Lillington, Lillington, North
Carolina, and in the First - Citizens Bank and Trust Company, Dunn, North Carolina.
2. That before depositing any funds or securities with the Bank of Lillington,
Lillington, N.C., and/or the First Citizens Bank and Trust Company, Dunn, North
Carolina, the said Howard G.Godwin is hereby directed and required to take from
the Bank of Lillington, Lillington, North Carolina, collateral approved by
Section 1334 (70) of the North Carolina Consolidated Statutes, in an amount
sufficient to protect and guarantee the payment of all funds and securities that
may be deposited by him as Clerk of the Superior Court of Harnett County, in the
Bank of Lillington, Lillington, N.C., and the said Howard G.Godwin is hereby
further directed and required to take from the First- Citizens Bank and Trust Co.
Dunn, N.C. collateral approved by the Section 1334 (70) of the N.C.Consolidated
Statutes, in an amount sufficient to protect and guarantee the payment of all
funds and securities that may be deposited by him as Clerk of the Superior Court
of Harnett County in the First Citizens Bank and Trust Co. Dunn, North Carolina,
but in no event shall the total collateral required by Howard G.Godwin from all
banks be less than the sum of Fifteen Thousand Dollars ($15,000.00) nor shall the
amount of collateral required from any bank herein designated as a depository
at any time be allowed to become less than the amounts of funds or securities on
deposit with that Bank by Howard G.Godwin as Clerk of the Superior Court of
Harnett County.
3. This resolution shall be effective from and after its ratification.
Adopted and ratified by the Board of Commissioners for Harnett County,
North Carolina, this the 5th. day of December, 1938.

TO THE .HONORABTE BOARD OF COMMISSIONERS, of Harnett County, Lillington, N.C.:
The audit which I am making of the office of the Clerk of Superior Court
according to contract, has progressed sufficiently to enable me to point out to
you two matters of interest whictsi ;;,'as an Auditor, I should not ignore. On the
other hand, they pertain to matters entirely within the knowledge of Hon.
L.M.Chaffin, if in fact he should have personal knowledge of them; and his
statements in reference to these matters may not be impeached, as a result
of the audit.
The matters to which I have reference are the following:
(1) In our audit of June 30, 1935, there was charged against Hon.L.M.Chaffin
Clerk of Superior Court, interest accounts in the sum of $982.08. Mr.Chaffin
represented then, as he now dos', ,that he inherited a shortage from the former
Clerk, Mr.A.A.McDonald; that he was on a fee basis, and that to build upoa
reserve to cover a part of the shortage, he withdrew from the fees to which he
was entitled only such a reduced amount as his necessities then required, thus
leaving much of his fees on interest, and that these fees were his individual
property and, therefore, he was entitled to the interest on same. There is no
means of determining the eaaot?aamount of the individual fees of Mr.Chaffin
which were left on interest as distinguished from some of the other amounts which
may have been on interest. It is apparent, however, that Mr.Chaffin did not
withdraw all of the fees to which he was entitled, and that some of his fees
did remain -in the bank on interest.
(2) In our audit of June 30, 1935, we showed outstanding checks to the
amount of $1134.35. The entries on the books show that each of these items had
been paid by check, and each of the items were shown marked "paid by check" on
the books of Mr.Chaffin's office. We set this up as a liability for the reason
that we were unable to locate the paid checks.
Mr.Chaffin explained then, as he does now, that several of the checks were
not paid by the bank for the reason that the bank closed, and that he, as the
checks were presented to him paid them, thereby saving the necessity of second
entrie on his books showing the issuance of further checks coverin the same
items.) Mr.Chaffin further explains that some of the checks were returned to
him by ;mail for that the addresses of some of the persons to whom they were
mailed were incorrect and could not be determined. He estimates that of the
total checks aggregating $1134.35 outstanding on June 30, 1935, and which are

now outstanding, that $200.00 to $300.00 of said amount is still outstanding,
and checks representing same have never been paid by him. Therefore, he suggests
that he be allowed to pay $250.00 and clear up this old item.
This information is given to you for such action as you may deem proper
and necessary under the circumstances.
