HomeMy WebLinkAbout10021950OCTOBER 1950: The Board of Commissioners met on Monday October 2, 1950 at 10:00 A. M. with L. A. Tart, Chairman, C. G. Fields, Paul Tysinger, Carson Gregory & J. A. Senter also present were County Attorney the Auditor and Clerk to the Boo rd. The report of L. M. Chaffin, C. S. C. was approved and placed on file. The report of Inez Harrington, Register of Deeds, was approved and placed on file. The report of D. P. Ray, Tax Collector was approved and placed on file. The report of L. B. McLean Vet. Service Officer was approved and placed on file. Bond in amount of $1000.00 with Maryland Casualty Co. with R. C. Monday Constable in Black River Township principal was approved and ordered filed. MARYLAND CASUALTY COMPANY BALTIMORE KNOW ALL MEN BY THESE FESENTS, That R. C. Monday, Angier, N. C. as Principal (hereinafter called Principal), and the Maryland Casualty Company, a corporation of the State of Maryland, having its principal office in the City of Baltimore, Maryland, as Surety (hereinafter called Surety), are held and firmly bound unto the State of North Carolina (hereinafter celled Obligee) in the penalty of One Thousand and 00 /100 Dollars ($1000.00); to the payment whereof, well and truly to be made and done, the said Frincipal binds himself, his heirs, executors and administrators, and the said Surety binds itself, its successors and assigns, jointly and several -y, firmly by these presents: THE CONDITION OF THE AFOREGOING OBLIGATION IS SUCH, that WHEREAS, the said Principal was appointed Constable for the term beginning on the 12th day of Sept. 1950, and ending on the 12th day of September 1951. NOW, THEREFORE, if the said Principal shall, during the term of this bond, well and faithfully perform all and singular the duties incumbent upon him by reason of his election or appointment to said office, except as hereinafter limited, and honestly account for all moneys coming into his hand, according to law, then this obligation shall be null and void; it is otherwise to be and remain in full force and virtue. This Bond is executed -by the Surety upon the following express cord ition, which shall be a condition precedent to the right of recovery hereunder; It is mutually understood and agreed between all parties hereto that if the Surety shall so elect, this bond may be cancelled by giving thirty (30) days' notice in writing to the said Obligee and this bond shall be deemed cancelled at the expiration of said thirty (30) days, the said Su -ety remaining liable for all or any act or acts covered by this bond, which may have been committed by the Principal upnto the date of such cancellation, under the terms, conditions and provisions of this bond, and the Surety shall, upon surrender of this bond and its release from all liability ther under, refund the premium paid, less a pro rata part thereof, for the time this bond shall have been in force. Brawley, Atty. in Fact Carson Gregory moved seconded by J. A. Senter that all scrap copper from stills be sold to Willie Moff at price of 15¢ per pound. Motion carried. The Board ordered that H. S. McLeod, be refunded $10. for double payment of Schedule license B on music machine in his place of business known as Mac's Place Coats's #1. C. G. Fields moved, seconded by 3. A. adopted. Fields that $6,500. be allowed to Board of Education to provide wells in certain schools in the County. Voting for: Gregory, Fields, Sysinger voting against: Senter J. A. Senter, moved, seconded by Carson Gregory that there be invested in direct obligations to the U. S. Treasury Dept for a term of 90 or 91 days the sum of $200,000.u0 in County Funds. The same to be purchased and held by the First Citizens Bank & Trust Company for safe keeping and receipt therefore issued to Harnett County. Motion carried unanimously. Carson Gregory moved seconded by Paul Tysinger, that E. W. Powers Erwin,N.C. be and he is hereby granted free pedlers license for the year 1950 and 51 for Harnett County on account of his physical disabilities. Motion carried. A. Senter, moved, seconded by Paul Tysinger, that the following items be passed. The Board of Commissioners met in the office of the County Attorney on Monday Sept. 11, at 7 :30 P. M. Commissioners Tart, Gregory, Senter, Tysinger, and Fields were present along with the Auditor and County Attorney. Whereas AW)n_Cob 1u1-y elected qualified and acting Constable for Black River "township'has"nothfied th& BBard of Commissi8ner§ that_he' has- "accepted a position as a policeman with the Town of Dunn and is no longer able to serve as a constable, and he tendered to the Board of Commissioners his resignation as constable for Black River, which resignation has been accepted; and Whereas there now exists a vacancy in the office of Constable for Black River Township and it is desirous and Expedient and necessary that someone be appointed as successor to Mr. Cobb; Now, therefore,-be it resolved that R. C. Monday be and he is hereby appointed as constable for Black River Township to fill the vacancy created by the resignation of Mr. Cobb said appointment to be contingent upon the said R. C. Monday giving the bond and meeting the other conditions required by law before entering upon his duties as constable. And be it further resolved that said appointment shall be and continue only until someone can be duly elected to said office as by law provided. J. A. Senter moved that there be invested with the approval of the Local Govt. Commission for a term of 90 or 91 days the sum of 8200,000.00 from the surplus in County Funds. Seconded by C. G. Fields unanimously adopted. J. A. Senter moved that Thurman C. be employed to audit books of County at end of Current fiscal. year at contract price of $1200.00 said employment being made in order that he may render such services in an advisory capacity, as the board may request from now until the end of said current fiscal year, and the above compensations shall be payment in full for such advisory interin services as well as making the annual audit. Seconded by Carson Gregory unanimously adopted. Provided, however, that in the event Thurman C. Ennis shall be unable at anytime. J A Senter moved that Mrs J P Parker serve as temporary Supt. of County Home to serve until Nov. 1, 1950 at salary of $165.00 per month said salary to be retroactive to Sept. 5, 1950. Seconded by Paul Tysinger, unanimously passed. The Board adjourned to reconvene on 1st Monday in October. Motion carried. C. Reid Ross, County Supt. and members of Board of Education of Harnett County appeared before the Board of Commissioners and the following- resolution was presented. On motion of Mr. Charles Skinner, seconded by Mr. W. E. Nichols and unanimously passed, the Board of Education adopted the following resolution: Whereas: A serious water shortage has developed at the Coats, LaFayette, and Shawtown Schools, and Whereas: The Board of Education -is of the opinion that unless steps are taken to remedy this emergency situation it will be impossible to operate the schools on a safe and sanitary manner, and Whereas; this need has arisen since the adoption of the school budget, which was kept at a minimum in order to provide for the new buildings, and therefore the budget is not sufficient to provide for the neeessary relief of this water shortage, and Whereas; The Board of Education estimates that $6,500.00 will be needed for this work and now therefore be it resolved that The Board of Education does hereby request that the Board of Commissioners of Harnett County make an emergency appropriation or loan of $6,500.00 to the Capital Outlay fund of the School Budget with the understanding that only an amount of the said $6,500.00 absolutely necessary to relieve the said shortage will be used. 62i tTpon motion of Commissioner Carson Gregory duly seconded by Commissioner C. G. Fields, the following resolution was adopted; WHEREAS, the Superintendent of Harnet County Schools and the entire member- ship of the 'Harnett County Board of Education has appeared before the Board of Commissioners and presented a unanimous resolution of said Board of Education requesting that the Board of Education authorize an emergency expenditure in order to eliminate the serious water shortage which exists at certain schools as named in said resolution; and • Whereas, it appears, and the board of Education is of the opinion, that unless funds are made available in order to remedy such water shortage that it will be impossible to operate the affected schools in a safe and sanitary manner, and no funds were appropriated for such purpose in the school budget for the reason that the need therefor was not known at the tire said budget was adopted, and there are insufficient funds in said budget to permit the improvement of said water situation; and Whereas, it appears that the elimination of said water shortage at the affected schools is imperative and necessary in order to enable said schools to be operated as by law required and it is the opinion of' the Board of Commissiore r that such an expenditure as may be necessary in order to eliminate said water shortage, not to exceed however, the sum of $6500. should be made for the purpose of remedying this emergency condition; NOW THEREFORE, BE IT RESOLVED that the Boa rd of Commis stoners of Herne tt County does hereby authorize the expenditure, from unappropriated County funds of such sum as may be necessary to properly eliminate the water shortage at the Coats, Lafayette and Shawtown Schools, said total expenditure, however, not to exceed the sum of $6500.
