HomeMy WebLinkAbout06051950JUNE 5, 1950: The Board of Commissioners of Harnett County met in regular session on Monday Jun8 5, at 10 A M with all members of the Board present. Also present were the County Attorney, the Addtor & Clerk to the Board. The report of L M Chaffin C S C was approved and ordered filed. The report of Inez Harrington Register of Deeds was approved and ordered faints The report of Inez Harrington Register of Deeds was approved and ordered filed. The report of D P Ray,Jr. Tax Collector, was approved and ordered filed. The report of L B McLean, Veteran's Service Officer was approved and ordered filed . The report of the Grand Jury in the Superior Court of May 22 was presented to the Board and filed (not read before the Board) L. E. Hicks District Forester, appeared before the Board and presented the 1950 51 Forest Fire Control for Harnett County. Jack H Daniel, District Officer of' the N C Veteran's Commission, appeared before the Board and explained the many benefits in the form of Federal Funds being brought into Harnett County each year by the local county Service _Officer. C. Reid Ross appeared before the Board and requested that a transfer of $12,500. from the Current Expense Code 652 1 to the Capital outlay budget C. G Fields moved seconded by Carson Gregory that $12,500.00 from the current expense fund be transferred to the 8apital Outlay as requested. Voting for Fields, Gregory and Tart. Voting against Senter and 4'ysinger. Shug Avery and Francis Duncan appeared before the Bpard in the interest of establishing a Sanitary District from Black River to the Erwin Cotton Mills line for `water and sewer. �� C G Fields moved seconded by Carson Gregor that the filing fees paid by L M Chaffin in the first primary in the amount of 49.50 be refunded to L M Chaffin due to his withdrawal from the ran , for Clerk of Court before the ballots were printed; Voting for Gregory Fields and 'ysinger not voting Senter C G Fields moved seconded by Carson Gregory that the registrars in each township be paid one dollar per hour for copying the names on the registration books. voting for: Fields, Gregory, and ysInger voting aga ins t Senter The Board agreed to sell the outdated safe formerly used in the Tax Collectors office to Duncan Ray for the sum of $50.00 Motion carried Commissioner rields introddced the following resolution, which was read: WHEREAS on March 7, 1938, suit was instituted by Harnett County against Alexander Burnett and his wife, the same being S D #1874 for the collection of the &axes allegedl due Harnett younty for the years 1927 1935 inclusive on the following described property Being that lot described in that deed of J M Altman and wife Bettie E Altman to Alexander Burnett, dated April 4, 1914, andrecorded in Book 182, page 301, in the Registry of Harnett County. WHEREAS, thereafter judgment by default was rendered by the defendants, the same being judgment #A 901, recorded in Judgment Docket #25, at Page 98, under the terms of which said proper tyw as .ordered and sold for taxes, and the same was thereafter sold to Harnett County and the Town of Dunn and deed conveying said lands to the purchasers was duly made, which deed is recorded in Book 247, at page 298, Harnett County Registry, with the result that the County of Harnett and the Town of Dunn now have a purported claim to said lands by reason of said f oreclosure proceeding and deed; and WHEREAS in truth and in fact the subject land was not owned by Alexander Burnett and wife Lula Burnett, either at the time said suit was instituted or during the term, or any part thereof, when said .taxes allegedly accrued, said lands having been sold by Alexander Burnett and wife one December 12, 1916, with the result that the ^aid Burnett and wife never had any further interest in said property; and Y- . 593 WHEREAS, the tax list records for was listed by J R Summerlin, the then by Thelma Summerlin, the record owner George A Lee for the years 1945 1949, property by Harnett County for the yea and Harnett County show that the subject property record owner for the yars 1926 -1938, was listed for the year 1939 1944, and was listed by and that all taxes assessed against said rs 1926 1949, inclusive, have been fully paid; WHEREAS, said foreclosure proceeding was improperly insitut4ted for the reason that no taxes were due on said lands and the further reason that said proceeding was not instituted against the owners, with thenesult that the same was and is null and void and of no effect, with the further result that Harnett County did not acquire any bona fide deed interest in said lands by reason of said foreclosure proceeding and the deed made pursuant thereto; and WHEREAS, the deed recorded in Book 247, at Page 298, Harnett County Registry, constitutes a cloud upon the title to said land and the owner thereof has requested that said cloud on his title be removed, a nd it is the opinion of the Board of Commissioners that the same should be removed by reason of the facts hereinabove a to ted : IT IS THEREFORE RESOLVED AND ORDERED that the County of Harnett execute and deliver to George A Lee a quitclaim deed for said lands in order that the purported cloud upon said title may be cancelled and removed and the chairman is hereby authorized and directed to execute said deed, to be attested by the clerk, on behalf of the County; AND IT IS FURTHER RESOLVED AND ORDERED that the taxed charged to said lands in the name of Alexander Burnett for the years 1927 1935 inclusive be released and that{ Harnett County have no further interest in said property by reason of said foreclosure proceed ing. Upon motion of Commissioner Fields, seconded by Commissioner Gregory, the fore- going resolution was unanimously adopted. Commissioner Gregory introduced the following resolution, which was read: WHEREAS, heretofore and on April 3, 1950, the Board of Commissioners entered an order directing that the County convey to the Town of Dunn all of its interest in the hereinafter described property for an amount equal to the taxes and penalties due on the back one half of said lot, which amount is $65.18, and the Town of Dunn has heretofore paid the same to the County of Harnett; and WHEREAS, said amount is insuffient to pay all taxes due on said entire lot, and it is impossible to collect the remainder of said taxes by reason of the fact that said foreclosure proceeding was void as to one half of said lot and said proceeding has heretofore been set aside as to said one half by the Court; NOW, THEREFORE, BE IT RESOLVED that the remainder of said taxes due on said entire lot at the time of said foreclosure be and the same are hereby ordered released. Upon motion of Commissioner Fields, seconded by Commissioner Gregory, the foregoing resolution was unanimously adopted. BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUN TY: That there is hereby imposed as County license tax for the privilege of carrying on the business exercising the privilege, or doing the act named by any person or corporation, the license tor privilege tax pertaining to the several and respective business, professions and acts as enumerated in the revenue act of 1947, and the amendments thereto, the maximum amount of such tax lawfully permitted by said act to be charged by the county of Harnett in each instance, and is shown on the schedule on file in the office of the Tax Collector. Said license year shall run from June 1, 1950 to an including May 31, 1951. BE IT RESOLVED BY THE BOARD OF C0MPaiISSIONERS OF HARNETT COUNTY: That upon the request of C.Reid Ross, Supt. of Harnett County Schools for authority to transfer from the current expense fund established for the Harnett County Board. of Education for the year 1949 50 to the Capital out lay fund for said school budget for the fiscal year the sum of $12500. said request being made for the reason that there is a surplus in the said amount in the current expense awn_ a_ d.p1 t 41 the Capital out . lay, it i hereby ordered that said transfer be ni'de ad' rbquets' tce9,`and=tthe�:COUnty :Aiiditor its hereby-atthor3 to make such transfer upon the records in his office and to disburse said funds according. 594 The following road petitions were approved and placed on file. 1. To extend the road as it now runs from Buffalo out and to the Old Wire Road and where it connects with the Joe *Williams Road said road lying and being Stewarts Creek's Township, Harnett County. 2. That road from highway 310 to the forks of the road near Mingo Creek, a distance of 1 3/4 miles. 3. That road that runs from U S highway 421 beginning at Bill's place 230 yards to old Dunn Erwin County road. 4. That road that runs from Highway 301 to Jonesboro Road, a distance of' 1 mile. 5. That road that runs from Elmo Newton's ,Tobacco barn to Arnold Nordan's home and is known as Bayles and Nordan road, a distance of 3/4 mile. The following road petitions were approved. 1. to treat with an all weather suface that certain road leading off to N C• Highway No. 421 at 11 C Rogers' Store and running nottherly a distance of approximately four miles to its intersection with "N C` Highway No. 210 near Neills Creek. Baptist Church. (Petition returned to Berles Johnson) 2. That road in Johnsonville Township from road N C "27 at Johnsonville -Zee County line known as the Olivia Johnsonville road a distance of 6.8 miles.
