HomeMy WebLinkAbout100619473617 A regular meeting of the Board of Commissioners for the County of Harnett convened at the County courthouse in Lillington, North Carolina, the regular place of meeting, at 10;00 o'clock, A M, October 6, 1947. Present; Chairman Angus A Cameron, and Commissioners, L R Byrd, L A Tart, R L Pate and F D Jackson; Absent; None Commissioner F D Jackson, introduced the following resolution which was read; RESOLUTION FIXING THE DETAILS AND FORM AND MANNER OF EXECUTION OF $750,000 SCHOOL WTILDING BONDS. BE IT RESOLVED by the Board of Commissioners for the County of Harnett; Section 1, That the Board of Commissioners has determined and does hereby find and declare; (a) That an order authorizing $750,000 school building bonds of Harnett County was finally passed on July 1, 1946, which order was approved by the vote of a majority of the qualified voters of said County who voted at an election duly called and held on August 6, 1946. (b) That the period of the life of the school buildings to be erected, remodel ed and enlarged pursuant to said order, is estimated as a period of thirty years from July 1, 1947, being a date not later than one year after the final passage of said order, and that said period expires July 1, 1977. Section 2. That for the purpose of providing the school improvements pursuant to said order, such school improvements being necessary in order to maintain the constitutional six months' school term, the negotiable coupon bonds of Harnett County, shall be issued in the aggregate principal amount of $750,000, consisting of 750 bonds of the denomination of $1,000 each, dated November 1, 1947, maturing annually, May 1, in numerical order, lowest numbers first, $15,000 1949 to 1951 inclusive, $20,000 1952, .$30,000 1953, $26,000 1954, and $37,000 1955, to 1971, inclusive, without option of prior payment, and bearing interest at a rate or rates not exceeding 6% per annum to be determined by the Local Government Commission at the time the bonds are sold, which interest shall be payment semi- annually on the first days of May and November of each year, both the principal of and the interest on said bonds to be payable at The Chase National Bank of the City of New York in New York.Lity in any coin or currency of the United' States of American, which, at the respective dated of payment thereof, is legal tender for the payment of Public and private debts. Said bonds and coupons and the endorsements to be printed upon the reverse of said bonds shall be in substantially the following forms; No. United States of America State of North Carolina COUNTY OF HARNETT School Building Bond, Series - - -- $1,000 The County cf Harnett, in the State of North Carolina, is justly indebted and for Value received hereby promises to pay to the bearer or, if this bond be re- gistered as to principal, to the registered owner hereof, on the first day of May , 19 , the principal sum of ONE THOUSAND DOLLARS together with interest thereon at the rate of per centum per annum, payable semi - annually on the first days of May and Novenber in each year, upon the present - tation and surrender of the annexed coupons as they severally become due. Both the principal of and the interest on this bond are payable at The Chase National Bank of the City of New York in New York City in any coin or currency of the United States of American which, at the respective dated of payment thereof, is legal tender for the payment of public and private debts. For the prompt payment hereof, both principal and interest as the same shall become due, the full faith and credit -62 of said County are hereby irrevocably pledged. This bond is one of a series issued by said County, acting as an adminstrative agent of the State of North Carolina in providing a State system of public schools, for the purpose of erecting new school buildings, and remodeling and enlarging existing school buildings in order to maintain the constitutional six months' school term in said County, and this bond is issued under the pursuant to The County Finance Act, as amended, and the local Government Act, as amended, and an order which was submitted to and approved by the vote of a majority of the qualified voters of said County voting at an election duly called and held, and resolutions duly passed by the Board of Commissioners of said County. It is hereby certified and recited that all acts, conditions and things required to happen, exist and be performed precedent to and in the issuance of this bond by the Constitution and laws of North Carolina, have happened, exist and have been performed in regular and due form and time as so required; that provision has been made for the levy and collection of a direct annual tax upon all taxable property within said County sufficient to pay the principal of and the interest on this bond as the same shall fall due; and that the total indebtedness of said County including this bond, does not exceed any constitutional or statutory limitation thereon. This bond may be registered as to principal alone in accordance with the provisions endorsed hereon. IN WITNESS WHEREOF said county of Harnett, by order of its Board of Commission /rs, has caused this bond to'be signed by the Chairman of said Board and by the Register of Deeds and ex officio Clerk of said Board, under the corporate seal of said Board, and has caused the annexed interest coupons to be executed with the facsimile signature of said Register of Deeds and ex officio Clerk, all as of the first day of November, 147. Bond of Register of the County of Harnett by the Register of Deeds and ex officio Clerk of the Board of Commissioners as Bond Registrar, or by such other Bond Registrar as may be legally appointed by the governing body of said county, upon presentation hereof to the Bond Registrar who shall make notation of such registration in the registrati n black below, and this bond may thereafter be transferred only upon a duly execubd assignment of the registered owner of his attorney, such transfer to be made on such Bond Register and endorsed hereon by the Bond Registrar. Such transfer may be to bearer and thereby transferability by deliver shall be restored, but this bond shall again be subject to successive registrations and transfers as before. The principal of this bond, if registered, unless registered to bearer, shall be payable only to or upon the order of the registered owner or his legal. represent- ative. Notwithstanding the registration of this bond as to principal alone, the coupons shall remain payable to bearer and shall continue to be transferable by delivery. That said bonds shall be registerable as to principal alone in accordance with the provisions for registeration hereinabove in this resolution provided to be endorsed upon said bonds, and the Register of Deeds and ex officio Clerk of the Board of Commissioners, is hereby designated Bond Registrar for the purpose of such registration, subject to the right of this body hereafter to designate another regiatrar. No charge shall be made to any bondholder for the privilege of registeration herein granted. TJpon motion of Commissioner F D Jackson seconded by Commissioner R L Pate the foregoing resolution entitled R'r esolution fixing the details and form and manner of execution of $750,000 school building bonds ". was passed by the following vote; Ayes; Commissioners L R Byrd, L A Tart R L Pate and F D Jackson Noes; None And thereupon Commissioner F D Jackson introduced the following resolution which was read; RESOL'TTION PROVIDING FOR THE ISSUANCE OF $231,000 SCHOOL BUILDING BONDS SERIES A. 9E IT RESOLVED by the Board of Commissioners for the County of Harnett; Section 1, That the Board of Commissioners has determined and does hereby find and declare; (a) That on October 6, 1947, the Board of Commissioners of the County of Harnett County, passed on resolution fixing the details and form and manner of execution of $750,000 school building bonds authorized by an order finally passed on July 1, 1946. (b) That no bonds have been issued pursuant to said resolution or order, and that it is necessary that Harnett County, acting as an administrative agent of the State in providing a State system of public schools, issue at this time $231,000 of said $750,000 school building bonds, Section 2. That there shall be issued $231,000 of said $750,000 building bonds, which $231,000 bonds shall be designated "School Building Bonds, Seriet A ", shall consist of 231 bonds of the denomination of $1,000 each, numbered 1 to 231, inclusive, and said bonds shall mature annually, May 1, in numerical order, lowest numbers first, $7,000 1949, to 1951, inclusive, $9,000 1952, $13,000 1953, 512,000 1954, $10,000 1955 to 1968 , inclusive, and $12,000 1969 to 1971, inclusive without option of prior payment. Section 3. That the County Accountant be and he is hereby directed to request the Local Government Commission to advertise and sell said $231,000 School BuilIng Bonds, Series A. Upon motion of Commissioner R L Pate seconded by Commissioner L R Byrd, th e foregoing resolution entitled "Resolution providing for the issuance of $231,000 School Building Bonds, Series A ", was passed by the following vote; Ayes; Commissioners L R Byrd, L A Tart, R L Pate, and F D Jackson Noes; None 64 The Board ordered that penalty of $5.71 be released on the property listed to A C Grimes in Grove Township, for the year 1946, on account of error made by list takers. THE BOARD voted in favor of appropriating of $2500.00 in 1948 budget for a TB Clinic in Harnett County. The Board allowed $10.00 per month to John Clark, Erwin for a period of one year because of physical disability, to begin October 1st, 1947. • It is ordered Harvey Deal, Angier, be granted free pedler license for year 1947. It is ordered that 410.00 be allowed for Mrs Maude Dail BuiesT Creek to begin October 1st, on account of physical'disability.
