HomeMy WebLinkAbout09081953258 SEPTEMBER 8th. 1953 'The Board of County Commissioners met in regular session on Tuesday, September 8th., 1953 at 10 «30 A.M., with all members present. Also present were the Clerk to the Board and the County Attorney, ,The report of Robert B. Morgan, Clerk Superior Court, was approved and ordered filed. The report of Inez Harrington, Register of Deeds, was approved and ordered filed. The report of D. P, Ray, Tax Collector, was. approved and ordered filed. •'The report of L. filed. B. McLean, Veteran;Sery ce Officer was approved and ordered - The report -of B. H. Sellers filed. Electrical Inspector, was approved and ordered Commissioner Lasater moved, seconded by Commissioner Ingram that no fees be paid to any constable for the capture of any still without the Condenser which part of the still. Motion carried. Commissioner Byrd moved, seconded by Commissioner Ingram, that Mr. L. A. Tart, Chairman be instructed to have D. P. Ray, Tax Collector, get extra help in collect- ing taxes. Motion carried. -Upon' motion of Commissioner Lasater, seconded by Commissioner Mangum, the Board ordered ,the - Auditor, H. D. Carson, Jr. to discontinue the issuance of any checks for partial payments of salary or wages to Harnett County employees. Motion carried. -Upon motion of Commissioner Lasater, seconded by Commission Ingram, the Auditor was ordered to deposit daily in the First Citizens Bank & Trust Company of Dunn, the official depository for Harnett County all funds belonging to Harnett County which s al1:.c_ome into-his hands for pre - payments of taxes.. Motion carried. is a Commissioner Ingram introduced the following Resolution which was read: WHEREAS, W. W. Elliott and wife, Casie Elliott entered into a contract on December 30, *1944, with Harnett County to purchase from the County its interest in a certain house and lot on East Edgerton Street in the Town of Dunn, the same be- ing the property acquired by Harnett County under Tax Foreclosure Judgment A -928, and under the terms of said contract said purchasers agreed to pay therefor the sum of $350, said purchase price payable $50 in cash and the balance in monthly installments of 10 per month beginning on January 25, 1945; And, WHEREAS' said contract provided, among other things, that in the event said purchasers should fail to comply with the terms thereof, Harnett County could cancel the same and retain as liquidated damages all amounts theretofore paid under the terms of said contracts; And, WHEREAS, the said W. W. Elliott and wife shade total payments of only $63 under the terms of said contract, and have not made any payments on the same since Nov. 18, 1946, notwithstanding the fact that the County has made repeated demands for compliance withthe terms of such contract; And, WHEREAS, the said W. W. Elliott and wife have breached said contract by failing to comply with the terms thereof, and by reason of such breach Harnett County is entitled to cancel the same, and does now desire to make such cancellation. BE IT RESOLVED that said contracts be and the same is hereby declared canceled and the same W. W. Elliott and wife have no further rights thereunder, and the Tax Collector of Harnett County is hereby ainthorized,: to retain as liquidated damages for the breach of said contract the sum of $63 heretofore paid to him by W.. W. Elliott and wife, and to pay over the same to the Harnett County Auditor to be placed in the general fund of said County. Profitt, Secretary Harnett County Board of Education After the filing of the description of the Lillington School District as above set out, Commissioner Byrd.introduced the following Resolution, which was read: 263 WHEREAS, More than the required number of qualified voters who have resid- ed in the Lillington School District for more than twelve (12) months have in writing petitioned the Harnett County Board of Education for an election in said District to ascertain whether there would be levied in said District a local annual tax not to exceed fifteen (15) cents on the One Hundred Dollars ($100) valuation of all property, real and personal, to supplement the funds for the nine (9) months public school term for said district; And, WHEREAS on the 4 day of May, 1953, said Petition was considered and approved by the Harnett County Board of Education, and said Petition was thereupon en- dorsed by the Chairman and Secretary of said Board of Education and a record of the Endorsement made upon the Minutes of that meeting of the Harnett County Board of Education, &nd said Petition was then presented by the Harnett County Board of Education to the Board of Commissioners at the regular meeting of said Board held on the first Monday in May, 1953, with the request that said election be called and held as provided by law; And, WHEREAS, at the regular meeting of the Harnett County Board of Commissioners held on September 8, 1953, the Board of Education of Harnett County presented to the Board of Commissioners a written description of the physical boundaries of the Lillington School District as theretofore established and determined by the said Harnett County Board of Education; NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMi,ISSIONERS, in compliance with Article 22 of Chapter 115 of the General Statutes of North Carolina as follows: 1. That an election be held, and the same is hereby called to be held in the Lillington School District of Harnett County, North Carolina, for the purpose of enabling the qualified voters in said Lillington School District to determine whether there shall be levied in said District a local annual tax not to exceed fifteen (15) cents eon the One Hundred Dollars ($100) valuation of all property, real and person .1, to supplement the funds for the nine (9) months public school term for said district, and said election in hereby ordered to be held and conducted at the Courthouse in the Town of Lillington, North Carolina, on Saturday October 17, 1953, between the hours of 6:30 A.M. and 6 :30 P.M. 2. That for the purpose of conducting the registration of voters, and likewise for the purpose of holding and conducting said election, Marjorie Taylor, a qualified elector residing in the Lillington School District, be and she is hereby appointed Registrar, and that Virginia R. Johnson and Venable S. Baggett, each being qualified electors residing in the Lillington School District be and they are hereby appointed as Judges of said election. 3. That a new resistration of thequalified voters in the Lillington School District be and the sane is hereby called in and for said District, and that the registration Books shall open at 9:00 A.M. on Saturday, 19 day of September, 1953, and close at Sunset on Saturday the 3rd. day of October, 1953, 4. Upon Motion of Commissioner Byrd, seconded by Commissioner Ingr going Resolution was unanimously adopted. NOTICE OF ELECTION IN THE LILLINGTON SCHOOL DISTRICT AND NOTICE OF. REGISTRATION . Notice is hereby given that a Special Election has been-called by the Board of Commissioners of Harnett County, North Carolina, to be held in the Lillington School District for the purpose of enabling the qualified voters therein to de termine whether there shall be levied in said District a local annual tax not to exceed fifteen (15), cents on the One Hundred Dollars (0100) calculation -of all property, real and personal, to supplement the funds for the nine 09) months public °slchool term for said District. Said election shall be held and conducted at the Courthouse in the Town of Lillington, Harnett County, North Carolina, on Saturday, the 17 day of October, 1953, between the. hours of 6x30 A.M. and 6 :30 P.M. Marjorie Taylor has been appointed as Registrar for said election, and Virginia R. Johnson/and Venable -S. Baggett have been appointed as the Judges thereof. Persons otherwise qualified to vote who have- resided within North Carolina for one year and within the boundaries of the Lillington School District for four (4) months next preceding said election shall be entitled to register and vote therein. Notice is hereby further given that for said election a new registration has been called in the Lillington School District. Tart, Chairman Harnett County Board of Commissioners 166 WHEREAS, the voters of North Carolina will have submitted to them on October 3, 1953, the question of whether or -not the State of North Carolina shall issue its bonds in the amount of 050 for the construction and improvement of s'chool plant facilities and $22,000,000 to provide permanent improvements at the State's mental institutions, And, WHEREAS the issuance of such bonds would make available funds with which to meet some �f the pressing public school plant facility needs and also to meet the need for permanent improvements at the State's mental institutions, which needs cannot otherwise be met; And, WHEREAS, THE ISSUANCE OF SUCH BONDS FOR THE IMPROVEMENT OF SCHOOL PLANT FACILI- TIES would make available for use in Harnett County a large sum of money that will not otherwise be available, and such funds will enable the County to make badly needed improvements in the physical assets 'of the Harnett County Public School System; And, WHEREAS, theBoard of Commissioners of Harnett County is of the unanimous opinion that the issuance of such bonds would be of great benefit to Harnett County and the entire State of North Carolina; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett County that the issuance of such bonds be and the same is hereby heartily endorsed and improved; AND BE IT FURTHER RESOLVED that the voters of Harnett County be and they are . hereby urged to vote in favor of the issuance of said bonds at the election there - on to be held on October 31-1953. WHEREAS, Harnett County proposes to.build --a Health Center in Lillington, North Carolina, and has appropriated its portion of the funds to be used along with State and Federal funds for the erection of said Health Center; And, WHEREAS,'it is necessary that some qualified person be appointed as Treasurer for said project to receive and disburse all funds in - connection therewith; IT NOW, - THEREFORE, BE//RESOLVED by the Board of Commissioners of Harnett County that H. D. Carson, .Jr., Harnett County Auditor be and he is hereby appointed as Treasurer to receive and disburse all funds in connection with the proposed Lill -' ington Health Center. Upon motion of Commissioner Byrd, seconded by Commissioner Lasater, the fore going Resolution was unanimously adopted. WHEREAS, D,P. Ray, Jr., was appointed and duly qualified as Harnett County Tax Collector for the 1952 levy of County taxes and was charged with the duty of collecting all current and delinquent taxes and revenues due the County of Harnett for the period beginning July 1, 1952 and ending June 30, 1953; And, WHEREAS' the said D. P. Ray, Jr., Harnett County Tax Collector for the 1952 levy has submitted his list of insolvents who were charged with the payment of taxes due Harnett County under said 1952 levy, and has made settlement .as provid- ed by law for all items with which he was charged in connection with the said 1952 levy; And, WHEREAS' The records of the said D. P. Ray, Jr., Harnett County Tax Collector, covering the m llection of all taxes and revenues he was charged with the duty of collecting during said term have been- audited by Thurman C. Ennis, and Company, Certified Public Accountants and found to be correct; NOW, THEREFORE, BE IT RESOLVED by the Board of'County Commissioners of Harnett County that the final settlement of D. P. Ray, Jr., Tax Collector for the 1952 County levy be, and the same is hereby accepted and approved and the said D. P. Tay, Jr., Tax Collector, together with the surety on his official bond covering _tie 1952 levy and the collection of delinquent taxes for the period between July 1, 1952. and June 30, 1953, be, and they are, subject to the provisions of law, here- by relieved of liability during said period.
