HomeMy WebLinkAbout0603195745\ JUNE 3rd. 1957 The Board of Commissioners met in regular session on Monday June 3rd., 1957 at 10 A.M. with all members present. Also present were the County Attorney, the Auditor and the Clerk to the Board. The report of Elizabeth F. Matthews, Clerk Superior Court, was approved and filed. The report of D. P. Ray, Tax Collector,was approved and filed. The report of Kyle Harrington, Clerk Recorders Court, was approved and filed. The report of L. B. McLean, Veterans Service Officer, was approved and filed. The report of Earl Wells, Dog Warden, was approved and filed. The report of B. H. Sellars, Electrical Inspector, was approved and filed. The report of Grand Jury was read and approved. WHEREAS, Coll Sexton, duly elected constable for Neills Creek Township, has resigned as such constable and is no longer performing and discharging the duties of said office; and WHEREAS, Sherwood Gregory, a citizen and resident of Neills Creek Township, has applied to the Board for appointment as constable to fill the vacancy created by the resignation of the said Coll Sexton and various citizens of said township have requested and recorrurended the appointment of the said Sherwood Gregory; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY THAT Sherwood Gregory be and he is hereby appointed as constable for Neills Creek Township to fill the vacancy created by the resignation of Coll Sexton and to serve for the unexpired portion of the term for which the said Coll Sexton was elected; provided, however, that the said Sherwood Gregory shall not enter upon the performance of any of the duties of constable until after having filed with the Clerk to this Board the bond required by law and after having taken the oath prescribed by law. Upon motion of Commissioner Curran, seconded by Commissioner Womble, the foregoing resolution was adopted by unanimous vote. The resignation of Hal Brown, Constable in Upper Little River Township is accepted as of May 7th. 1957. Commissioner J. E. Womble moved, seconded by Commissioner J. M. Pleasant, that Herbert Matthews, Janitor, at A.S.C. office be raised to $25.00, per week, effec- tive June 3rd. Motion carried. Commissioner J. E. Womble moved, seconded by Commissioner Joe Curran, that C. R. Ammons, County Agent, be appointed to set up committee to make a study of the water resources in Harnett County as recommended by the Board of Water Commissioners of State of North Carolina. Motion carried. Commissioner Joe Curran , moved, seconded by Commissioner J. M. Pleasant, that the contract for Auditing the County Offices be given to Thurman C. Ennis Co. for the sum of $1600.00. Motion carried. Commissioner Joe Curran moved, seconded by Commissioner J. E. Womble, that Thelma Cannady be allowed to purchase from the county that house and lot in Lillington for the sum of $70.35. Motion carried. The following Road Petition was approved: That road in Duke Township which runs from the beginning at Hwy. # 27 3/10 of mile which is part of Hwy # 82 and leads back to Hwy # 217 known as part route # 82 a distance of 3/10 mile. (Petition given to Kenneth R. Deck to be presented to Highwa y Com.) The Board granted free pedlets License to Floyd W. Jernigan Dunn, N. C. on account of total and permanent disability. Commissioner J. E. Womble moved, seconded by Alex Cameron, that the statement presented by Robert Morgan, Attorney, for professional service to the Board of Health not be paid. Motion carried. 4f D. P. Ray was appointed Tax Collector for a term of One Year. \Berles Johnson was appointed Tax Supervisor for a term of Two years. Mr. M. 0. Lee, Attorney for Thelma Cannady, appeared before the'YCoutty Board of Commissioners and requested that the Board permit Thelma Cannady to redeem and purchase from Harnett County the lot in Lillington Township formerly owned by the said Thelma Cannady and recently acquired by Harnett Clunty in Tax Foreclosure suit S. D. No. 2790, Tax Foreclosure Judgment No. A -17L1. After some discussion upon motion of Commissioner Womble, seconded by Commissioner Pleasant, the Board by unanimous vote adopted the following resolution: WHEREAB, Harnett County did heretofore acquire, uner Tax Foreclosure Judgment No. A -1741, a lot of land situate in Lillington Township, Ham ett County and owned by Thelma Cannady by reason of the foreclosure of said lot for the non- payment of taxes; and WHEREAS, the aaid Thelma Cannady now desires to re- acquire said lands from Harnett County and has offered to pay to the County all sums due on said lands, including Court costs and accrued penalities, said total amount being 570.56, which sum is to be paid at the rate of S12 per month commencing June 10, 1957, and has likewise offered and agreed that she will pay the 1957 taxes on said Tanis, and the Board of Commissioners is.of the opinion that skid offer should be accepted. BE IT RESOLVED by the Board of Commissioners of Harnett County that the County shall reconvey to Thelma Cannady the lot formerly owned by her and acquired under Tax Foreclosure Judgment No. A1741 upon the payment by her of the sum of $70.56, which sum, together with interest thereon from June 1, 1957 'at the rate of six per cent per annum shall be paid at the rate of $12 per month, the first payment to be made on June 10, 1957, and the chairman of this Board is hereby authorizedaand directed to enter into a written contract with the said Thelma Cannady to so pro- vide for the sale of said lands. And be it further resolved that in the event the said Thelma Cannady shall fail to make any monthly payment when the same shall become due then all of the rights granted to hereunder the terms of this resolution and the contract to be entered into pursuant to this resolution shall be forfeited and the said Thelma Cannady shall likeside forfeit all sums paid by her upcto the time of such default and shall have no further rights to purchase said lot under this resolution or sais contract; And be it further resolved that upon the 'payment in full of said sum, to- gether with the interest which shall accrue thereon, and the payment of the 1957, taxes on said lands, Harnett County shall execute and deliver to the said Thelma Cannady a good and sufficient quitclaim deed for its interest in said land and the Chairman is now authorized to execute and deliver said deed, to be attested by the Clerk upon the said Thelma Cannady complying with this resolution and said contract. Commissioner Womble introduced the following resolution which was read: WHEREAS, the Tax Collector has advised the Board that he has in hand the sum :of $166.75 and also the sum of 834.31, in the real' estate sale's contract fund, both of which sums have been on hand and in said fund for more than eighteen years; and WHEREAS, said sums, by reason of being in said real estate sale's contract fund cannot be distributed as taxes and cannot be used as long as they remain in said fund, and by reason thereof said sum should now be paid into the general fund of Harnett County to the end that the same may be used for general fund purposes; NOW, THEREFORE, BE IT RESOLVED THAT said sums, and each of them, be paid by the Harnett County Tax Collector into the general fund of Harett County, to be there held and used by the County for general fund purposes. Upon motion of Commissioner Womble, seconded by Commissioner Cameron, the fore- going resolution was adopted by unanimous vote, Upon motion of Commissioner Womble, seconded by Commissioner Pleasant, the Board voted unanimously to request Representative Carson Gregory to kill the Bill heretofore introduced in the Legislature which provides for jury trials in the Harnett County Recorder's Court.
