The Board of Commissioners met in regular session on Monday, April lst.,
1957, at 10:00 A, M. with all members present, also present were the County
Attorney,,the Clerk to Board and the Auditor.
The report of Elizabeth F. Matthews, Clerk Superior Court, was approved and
filed.
The report of D. P. Ray, Tax Collector, was approved and filed.
'The report of Inez Harrington, Register of Deeds, was approved and filed.
The report of Kyle Harrington, Clerk Recorders Court, was approved and
filed.
The report of-L. B. McLean, Veteran's Service Oi'fiee +,wa0 approved and
filed.
The report of Earl Wells, Dog Warden, was approved and filed.
The reports of 'Roy Godwin and. B. H. Sellars, Electrical Inspectors,
were approved and filed.
The report of the Grand Jury for March Term was read and filed.
The Board ordered the County Offices closed for the Easter Holiday Saturday
April 20th. through Monday April 22nd.
Commissioner Womble moved, seconded by Commissioner Currin, that the In-
surance on the equipment in the Welfare Office be raised from $2,000.00 to
$4,000.00. Motion carried.
Commissioner Cameron moved, seconded by Commissioner Womble,'that'Harnett
County pay 4100.00 per month rent on the A S C Office beginning July lst, 1957,
Motion carried.
The following Road Petition was approved:
1. To pull up arld scrape that road in Duke Township running f rom U. S.
Highway #)421, a distance of 1000 feet and known as the Avery Road.
Commissioner Currin moved, seconded by Commissioner Womble, that fees fov
vaccinationobfcdogs _ in Harnett County be set at 50' per dog. Motion carried.

Attorney Robert B. Morgan appeared before the Board and presented the offer
of Harold Jernigan to purchase the County's interest in all property acquired by
Harnett County by reason of that certain tax foreclosure proceeding entitled
"County of Harnett vs Harold Jernigan, Lois Rernigan, etals," the same being
S. D. # 26155 and bearing tax foreclosure Judgment No. A -1666. The County
Attorney advised the Board of Commissioners that said proceeding was instituted for
the purpose of foreclosing said lands by reason of the non - payment of the taxes due
thereon and that taxes for the years 1945 -1955, inclusive, were sued upon in said
action, the same being the only years for which the County could bring suit by
reason of the Statute barring actions to recover taxes more than ten years de-
linquent. TheCounty Attorney further advised the Board of County Commissioners
that no County taxes had been paid on said property since 1934, that a proceeding
was instituted in 1938 to recover the taxes due from 1934 -1935 and further advised
said Board that said proceeding was, in his opinion, defective by reason of the
fact that said taxes had not been properly listed for several years during the
period involved in said former suit and by reason of the further fact that proper
service was not obtained upon the said Harold Jernigan ins aid former suit.
Said County Attorney further advised the Board of Commissioners that the taxes
involved in the last suit amounted to 4 3264.58, plus penalties in the amount
of 41095.62 and that certain :taxes and penalties due the Town of Dunn were also ,
involved insaid second suit.
Mr. Morgan and the County' Attorney also advised theBoard that the ,taxes in-
volved in said suit and due the -Town of Dunn had recently been paid by the said
Harold Jernigan and Mr. Morgan stated that the said Harold Jernigan would pay to,
Harnett County the sum of 47662.38 for the County's interest, said sum represent-
&ng all taxes; penalties and ;court costs due on said lands for the years 1939-
1956, inclusive, and that the said Harold Jernigan sould likewise list said lands
for taxes with Harnett County for the year 1957 and would pay said taxes for said
year of 1957.
Thereupon, upon motion duly made and seconded, the following resolution was
adopted:
WHEREAS, Harnett County has heretofore foreclosed for the non - payment of
taxes certain lands owned by Harold Jernigan, Lois Hernigan and Helen Jernigan,
all as will appear upon reference to tax foreclosure suit No. 2688, Judgment No.
A -1666, and
WHEREAS' the Harnett County Attorney has advised the 'Board that the, total
amount of taxes involved in said suit is 43264.58, plus penalties in the amount
of 41095.62, and has likewise advised the Board that in addition taxes on said
lands for the years 1934 -1944, inclusive, have not been paid, and that a portion,,
if not all of said. taxes for said ,years prior to 1945 are not collectible by
reason of the Statute of Limitations and the improper listing of said lands for
most of the years during'said period; and
WHEREAS, the said - Harold Jernigan has offered Harnett County the sum of
`47662.38 for its interest insaid lands, which amount represents all taxes and
penalties due on said lands for the years 1939 -1956, as well as all Court costs,
and it is the opinion of the Harnett County,Board of Commissioners that it is far
the best interest of said County to accept said offer and convey to the said Harold
Jernigan, atone of . the former owners; its interest insaid lands upon the payment
of said amount; and
WHEREAS,s aid -sum of 47662.38 represents more than the amount of taxes, pen-
alties and Court costs which, in the opinion of this Board, the County is lawfully
entitled to collect on said lands, according to the advice and opinion of the
County Attorney;
NOW, THEREFORE be it resolved ty the Board of Commissioners of Harnett
County that saidCSunty convey to Harold Jernigan its interest in the lands in-
volved in the hereinabove mentioned tax foreclosure suit upon the payment to said
County ;by Harold Jernigan of. the sum of 47662.38 provided, however, that said
sum is paid in full by Noon, April 6, 1957.
And befit further resolved that upon the payment of said sum the Chairman
shall, and he is hereby authorized, to execute on behalf of the County a deed in
favor of the said Harold Jernigan conveying to him the County's interest in said.
lands ;'and the Clerk to this Board shall attest the execution of said deed by the
Chairman.
Andibe it further resolved that in the event the said sum of 47662.38 id not
paid in full by Noon, April 6, 1957, this resolution shall be null and void and
of no effect.
Upon motion duly made and seconded theBoard voted unanimously to request
Representative Gregory to introduce and cause to be enacted legislation:
1. Authorizing the Harnett County Board of Commissioners to pay to Jake
T. Lamm, Esq., such an amount as the Board in its discretion shall fix and
determine as compensation for services rendered by the said -Jake T. Lamm for
serving as Acting Solicitor of the Harnett County Recorder's Court during the
months of September, October, and November, 1955. -
2. Authorizing the Harnett County Board of Commissioners, to appoint; as
saidBoard may from time to time find necessary, a qualified member of the Harnett
county Bar to serve as Assistant Solicitor of the Harnett County Recorder's Court
with full power and authority to perform and discharge the duties of said- office
during the absence or disability of the Solicitor.
3. Requiring the Judge of the Harnett County Recorder's Court and the
Solicitor of the Harnett - County Recorder's Court, respectively, to pay with their
own funds any and all compensatmon which the Vice - Recorder and Assistant Solicitor
of said Court shall receive for discharging the duties of said offices during the
absence of the Recorder and Solicitor.

Upon Motion duly made and seconded the Board voted unanimously to request
representative Carson Gregory to introduce and cause to be enacted by the North
Carolina General Assembly legislation providing that all funds derived from the
levy of taxes for the payment of any county- bonded indebtedness and remaining
on hand or collected after the bonded indebtedness for wnich said taxes were
levied nas been paid in full shall be transferred to and become a part of the
General Fund of Harnett County to be held, used and disbursed as any other
funds contained in said General Fund.
Upon motion of Commissioner Currin, seconded by Commission Womble, the
Board voted unanimously to request Representative Gregory to introduce and cause
to be enacted by the North Carolina General Assembly legislation authorizing
the Board of County Commissioners to defer the acceptance of pre - payments of
taxes until the first day of August, and fixing the only discounts to be allowed
for the pre - payment of taxes in Harnett County as follows:
1. If paid prior to or during the monty of September, a deduction or dis-
count of one per cent (1 %); and
2. I£ paid during the month of October, a deduction or discount of one -
half of one per cent.
Upon motion duly made and seconded, theBoard voted unanimously to re-
quest Honorable Carson Gregory, Harnett County Representative in the General
Assembly, to introduce and cause to be enacted by the North Carolina General
Assembly such legislation as may be necessary to relieve Harnett County and
the Harnett County Board of Commissioners from the provisions of Section 67 -34
of the General Statutes of North Carolina relating to the appointment of a
Board of Appraisers to determine and assess the amount of damage inflicted by
dogs in Harnett County and to likewise provide that all proceeds now on hand
or hereafter derived by reason of the County Dog Tax shall be placed in the
general fund of Harnett County rather than being used for the payment of dog
damage as now provided by Section 67 -30 of the General Statutes of North
Carolina.
Upon motion of Commissioner Cameron, seconded by Commissioner Pleasants,
theBoard voted unanimously to request Representatives Gregory to introduce and
cause to be enacted by the North Carolina General Assembly legislation:
1. Providing that all delinquent taxes hereafter collected by Harnett
County shall go into a special fund to be used under the direction and in the
discretion of the Harnett County Board of Commissioners for the purpose of
erecting a new courthouse for Harnett County or for the purpose of adding to
and improving the existing courthouse; and
2. Authorizing the Harnett County Board of Commissioners to levy,
commencing with the 1°57 tax levy, a special tax not in excess of five per cent
(5 %) on eadh t100.u0 of property valuation to provide funds to be used in erect-
ing a new Harnett County courthouse or adding to and improving the existing
courthouse, as the Board of County Commissioners may direct.
3. Authorizing the board of County Commissioners, pending the use and
disbursement of all funds which may hereafter be received by reason of said
delinquent taxes and special levy, to invest such funds in such manner as will
meet the approval of the North Carolina Local Government Commission.
