Also present were the County Auditor and hhe Clerk to the Board. The Chairman called the meeting to order and offered the invocation. Minutes were read and approved. Mr. Goff, Assistant Farm Agent, appeared before the Board and requested funds for 12 weeks space program for the Space Age Group which will be given during the summer months. No action was taken. M. H. Brock, Chairman, called a meeting of the Board of Commissioners on March 20th. at 7:30 P.M., and requested Neill McKay Ross, County Attorney, to appear before the Board and tender his resignation as County Attorney effective as of this date. Present at this meeting were Commissioner Brock, Commissioner Womble and Commissioner Cotten who aooepted his resignation as of March 20th. The resignation reads as follows: March 20th. 1967 Mr. M. H. Brock, Chairman Harnett County Board of Commissioners Erwin, North Carolina Dear Mr. Brock: I hereby tender my resignation as County Attorney, effective at the pleasure of the Board. It has been a pleasure to serve with you, as Chairman, and the other members of the Board during my tenure of office. Attached hereto is a statement for $6,949.62 for services rendered to date for which I have not been paid. You will recall that at a meeting of the Board of County Commissioners on February 13, 1967, matters involving Welfare liens and tax foreclosures were discussed, and at the oonclusing of that discussion, the Board adopted, unanimously, a motion that I proceed with the cooperation of the Welfare Director, to bring my reports up to date. In furtherance of that understanding, I proceeded to comply with the orders of the Board. I have filed:: reports and paid the money to the Auditor according to the terms of our agreement relating to collections of these funds. There are a number of matters pending in my office on which I have done considerable work, and for ithich I have made no charge, I will be glad to furnish my successor with such information as he may need. If there are any further matters you desire discussed, I suggest that you have your attorney contact my attorney, Judge J.C. Pittman of Sanford. Thomas Allen, Tax Supervisor, appeared before the Board and discussed his progress in the preparation of Tax Scrolls and requested the Board to sit as a Board of Equalization and Review beginning at 9 :00 o'clock A.M. on April 20th. at 9:00 a.m. May 4th. and at 9:00 a.m. May 8th. 1967. Mr. Sam Wilson, District Engineer of the State Highway Commission appeared before the Board and discussed the Roads in the county. The Following Road Petitions were approved: (1) To add -to- theaState Maintained Secondary Road System and improve that road (15119 from 1550 to 1552) which is .9 miles in length and has 11 occupied homes located on road. (Petition mailed to M. H. Brock) (2) A request that SR 1269 -from SR 1282 to SR 1274 be abandoned this is 1.1 miles in length and is in Upper Little River Township (Petition mailed to Sam Wilson) (3) A request that SR 1408 from N C.42 westwardly 0.2 miles be abandoned -that road 1s .2 miles in length and is in Buckhorn twp. (mailed to Mr /. Sam Wilson) (4) To add to the State Maintained secondary road System that road which will be an extnesion on 1408 in Buckhorn Township which is 1 /10 mile in length. R E S O L U T I O N OF THE BENHAVEN RURI'i'AN CLUB Whereas, Members of the Benhaven Ruritan Club are interested in the scenic beauty of Harnett County, and, Whereas, unsightly trash is being disposed of on and near the Highways and roads in the western part of Harnett County,_ and, Whereas, members of the Benhaven Ruritan Club feel that measures should be taken to correct this situation; Now, Therefore, It Is Resolved by the Benhaven Ruritan Club: 1. That the Club favors and recommends a law providing that trash shall not be disposed of on any highway or highway right of way or on any property within 150 feet of the center line of any road or highway in Harnett County. 2. That the Club favors and recommends a law providing for community dumps or disposal units to meet the needs of persons de- siring to dispose of trash. 3. That the foregoing recommendations be brought to the attention of the Board of County Commissioners to the end that they may study the legality of such a proposal and make recommendations to members of the legislature representing Harnett County. 4. That copies of this Resolution be sent to each member of the Board of County Commissioners, to the County Attorney, and to the members of the legislature representing. Wilson be increased to $360.00 per month as Rural Policemen in the Sheriffs Office Beginning April 1st. 1967. Motion carried The Board agrees to pay L.K. Boston, retired Negro Farm Agent, for 9z days terminal leave, of which he is entitled. Walter Lee Johnson, Attorney, appeared before the Board and presented his peition calling for a full audit of County Welfare and delinquent tax liens by foreclosure or otherwise, The Petition was filed. Commissioner Womble moved, seconded by Commissioner Brown, that the Board set 65% ratio for tax valuation in Harnett County for year 1967. the vote was unanimous and the motion was carried. The Board accepted an invitation by the Mayor of Dunn to be present at the Dedication of the new Municipal Building in the town of Dunn at 14. o'clock p.m. April 14th. 1967. April 3, 1967 Harnett County Board Of County Commissioners Meeting Attorney E. Marshall Woodall appeared before the Board on behalf of his clients for the purpose of requesting that certain tracts of real estate be released from under the operation of four welfare liens in favor of Harnett County. James F. Penny, Jr., staff Attorney for the Welfare Board, appeared with Mr. Woodall for the purpose of representing the County's interest. It was pointed out to the Board that the requests had already been presented to the Harnett County Board of Public Welfare and approved by that Board. It was suggested that all the requests be presented before any action be taken by the Board of Commissioners. Mr. Woodall presented each request, including the determination of the Welfare recipient's interest, as follows: FIRST REQUEST: Vida W. Pope, a welfare recipient under G.S. 108 -30.1, owns a dower interest in a 13 acre tract of farmland located in Grove Township. Under authority of G.S. 108 -30.1, a wel- fare lien filed at 11:15 a.m., October 18, 1963, and recorded in lien Docket Book 5, page 41, Clerk of Superior Court office, constitutes a valid lien against said tract of land in favor of' Harnett County. James Sexton Pope, remainderman, requests that the County release a part of said tract, 7/10 acre vacant lot, upon payment by him of the value of the welfare recipient's interest in said 7/10 acre vacant lot. The appraised value of said 13 acre tract by the Harnett County's Tax Supervisor's Office is $2,381.00 or $183.15 per acre. James Sexton Pope contends to the County that the value per acre should be no great- er than $500.00, considering that no farming allotments are involved. Therefore, the fair market value of said 7/10 acre vacant lot is $350.00. Based upon this valuation, the value of Vida W. Pope's dower interest in said 7/10 acre vacant lot is $77.70, computed as follows: 1/3 of $350.00 ( dower interest being a 1/3 life interest) x 66.1412 % (value of Vida W. Pope's life interest as determined by tables used by the N. C. Dept. of nevenue for inheritance tax purposes) (Vida W. Pope is 56 years of age.). SECOND REQUEST: Della J. Barber, a welfare recipient under G.S. 108 -30.1, owns a life estate in a 50 foot lot located in the Town of Angier, Black River 'Township. Under authority of G. S. 108 -30.1, wel- fare liens in favor of the County were filed October 1, 1951, and Sept. 15, 1966, respectfully and recorded in lien Docket Books 3, page 311, and Book 4, page 398, respectfully, Clerk of Superior Court Office. Wesley McLeod, remainderman, requests that the county release said 584 50 foot lot from under the operation of the welfare liens upon payment by him of the value of the welfare recipient's interest in said 50 foot lot. There is an old dilapidated, vacant house situate on said lot. The appraised value of said lot is $1 ;094.00, However, Mr. McLeod contends that the fair market value of said lot should be no greater than $420.00. Based upon this valuation , the value of Della J. Barber's interest in said lot is $88.45, computed as follows: $420.00 (fair market value) x 21,.059 % .( value of recipient's life interest as determined by tables used by the N. C. Dept. of Revenue for inheritance tax purposes) (Della J. Barber's age is 85 years.) THIRD REQUEST Lillar R. Alien, a welfare recipient under G.S. 108- 30.1., owns a dower interest in a 50 foot lot located in the Town of Coats, Grove Township. Under authority of G. S. 108 -30.1, a welfare lien in favor of the County was filed at 9 a.m., June 4, 1958, and recorded in lien docket book 4, page 107, Clerk of Superior Court Office. Z. Nassie Dorman and wife, and Carson Gregory and wife, owners of said 50 foot lot, request that the County release said 50 foot lot from under the operation of said welfare lien upon payment by them of the value of the welfare recipient's interest in said 50 foot lot. The appraised value of said lot, which is vacant, is $315.00. The owners contend that they purchased the lot for $300.00 and; therefore, the fair market value of said lot should be no greater than the tax valuation of $315.00. Based upon the valuation, the value of Lillar R. Allen's dower interest in said 50 foot vacent lot is $26.30, computed as follows: 1/3 of $315.00 )Dower interest being a 1/3 life interest) x 25.048% (value of recipient's life interest as determined by tables Usedby the N. C. Department of Revenue for inheritance tax purposes) (Lillar R. Allen is 52 years of age.) FOURTH REQUEST': Roy Allen, a welfare recipient under G. S. 108- 73. 12.1, owns a. 1.8 undivided remainder interest in the real estate described in request Three above. Based upon the valuation determinded in request Three above, the value of Roy Allen's interest in said 50 . foot vacant lot is $29.98., computed as follows: $315.00 x 1/8 (undivided interest) x 74.952% (value recipient's remainder interest as determinded by tables used by the N. C. Department of Revenue for inheritance tax purposes). A welfare lien in favor of the County was filed at 10:45 a.m., October 21, 1963, and recorded in lien Docket Book 5, page 58, Clerk of Superior Court Office under authority of G.S. 108 - 73.12.1. Womble; the motion was NORTH CAROLINA RESOLUTION HARNETT COUNTY The Harnett:.County Board of Public Welfare and the Harnett County Board of Commissioners acting jointly and after investigation, make the following findings of fact and resolve as follows: THAT WHEREAS, Vida W. Pope, is a recipient of Old Age Assistance authorized under N. C. General Stature 108 -30 and that a lien was filed by the Director of Pubin Welfare of Harnett County against the real property owned by the said Vida W. Pope on the 18th day of October, 1963, at 11:15 a.m.; AND WHEREAS, it has been made to appear that the said Vida W.
