227 December 2, 1968 REGULAR MEETING CALL TO ORDER READING OF MINUTES MENTAL HEALTH PROGRAM HEALTH PLANNING PROGRAM AUDIT OF TWO CLERKS' OFFICES (Superior Court & Recorders Court) WELFARE PROGRAM APPRECIATION TO MR. WOMBLE REQUEST FOR RELEASE FROM PENALTY PAYMENT FOR ACCUMULATED LEAVE The riarnett County Board of Commissioners met in Regular Session on Monday, December 2, 1968, at 10:30 A.M. in the Commissioners Room at the Courthouse in Lillington attended as follows: Mr. M. H. Brock, Chairman; Mr. Gilbert Brown, Mr. W. J. Cotton, Jr. and Mr. C. E. McLamb, Commissioners; and Mr. H. D. Carson, Jr., County Auditor and Clerk to the Board. Mr. J. E. Womble was present until the swearing in of the new Board at 12:Od. The meeting was called to order by Mr. Brock, who presided, and the prayer was offered by Mr. J. E. Womble. The minutes of the Regular Meeting held in November were read and approved. Dr. Blackmon from Buies Creek appeared before the Board on behalf of the Mental Health Advisory Boardtheartily endorsed Dr. Mayberry for the top - flight job he is doing with the Mental Health Program in the County. Mr. Brock expressed the Board's appreciation to Dr. Blackmon for the efforts he had put forth the past year in the Mental Health Program, and that without pay. He furter stated that the program would not be to the point where it is now without the assistance that has been given by Dr. Blackmon. Dr. Blackbn stated that a comprehensive health planning program for cancer, heart and stroke presently stands where the Mental Health Program was in 1963. It is a different program, he stated, whereby the government is now saying the if a county has a problem in this area pertaining to health, the funds are available if the county can show the need and come up with a program. He stated that there would be another meeting regarding this with Lee and Cumberland Counties and asked the Board's opinion as to whether or not they would like to have this program pursued. Mr. Brock stated that the Board would like very much to know more about this and asked Dr. Blackmon to issue an invitation to the Commissioners to attend the next meeting. Mr. John E. Ingraham, C.P.A., appeared before the Board and presente his report of examination of accounts for five months period ending November 30, 1968 for the offices of the Clerk of Superior Court and the Clerk of Recorders Court. Mr. Ingraham stated that everything was in complete order, and that all funds were turned over to Mrs. Matthews, Clerk of Superior Court, for her new bank account and all outstanding checks turned over to Mr. Carson, County Auditor. Mr. Ingraham presented his bill for this report to the Board. Mr. Brock stated that Mr. Ingraham was under contract for $1600.00 for a complete audit of county records, and asked Mr. Ingraham if this amount would not be reduced since the county would no longer be responsible for the records of these two offices. Mr. Ingraham stated that this would make a difference of from five to seven hundred dollars. Mr. Brock stated that the bill presented would go through regular channels for payment. Mr. Hubbard, Director of Welfare Department, appeared before the Board and stated that he had written a letter tothe Health, Education and Welfare Department regarding the feeler they now have out relative to individuals being able to receive welfare aid by merely stating that they are in need. He stated that he very definitely is opposed to this and suggested that the Board might also like to write a letter expressing its opposition to this proposal. Action: Mr. Womble made a motion that a letter opposing this propositio be sent to H.E.W. from the Commissioners. The pp��pptifubb3 dseconded by Mr. McLamb and it carried. Mr. Brock directed / Wprepare the letter for the Board's signature. Mr. Hubbard expressed his appreciation to Mr. Womble for the work he had done while a Commissioner in connection with his Department. Mr. Frank Lewis appeared before the Board for his wife, Mary Lee H. Lewis, and requested that she be relieved of a penalty of '6.011 for failure to list one small parcel of land. He stated that it wss an oversite of the tax lister. Action: Mr. Brown made a motion that Mrs. Lewis be granted this release from penalty. The motion was seconded by Mr. Womble and it carried. Mr. H. D. Carson, County Auditor, appeared before the Board and stated that when the budget was prepared no elbcation was made for accumulated leave, and that since those employed in the Clerk of Recorde Court and Clerk of Superior Court would no longer be paid by the County and had accumulated leave he requested the Board to authorize payment for this accumulated leave and amend the budget to cover same. He stated that in the past a month's salary was paid to a person have accumulated thirty days leave. He wanted the Board to clarify whether 228 TAX COLLECTOR'S REPORT BOARD MEMBERS' APPRECIATION TO MR. WOMBLE RECESS EXECUTIVE SESSION MR. RAY JOINS COMMISSIONERS RESIGN FROM WELFARE BOARD REORGANIZATION OF BOARD OF COMMISSIONERS APPOINTMENTS: COUNTY ATTORNEY VETERANS' SERVICE OFFICER AGRICULTURE DEPARTMENT DOG WARDEN COUNTY AUDITOR accumulated leave should be paid on the basis of a working day for each days accumulated leave or a month's pay. Action: Mr. Brown made a motion that accumulated leave be paid on the basis of a working day for each day of leave accumulated and that the budget be amended to provide paym;nt for same. Mr. McLamb seconded the motion and it carried. Mr. Earl 3 ©nes, Tax Collector, appeared before the Board and filed his report for the Months of October and November. Mr. Brock expressed his appreciation to Mr. J. E. Womble, Commission r, for the services he had rendered during the past two years. He stated that he counted it a high privilege to have worked with a man of honor and dignity, and he commended him on the job he had done in serving the county for the past two years. Mr. McLamb stated that hp was proud to have served with a man of such distinction and that Mr. omble's loyalty to county and the people had been an inspiration to him. Mr. Cotton and Mr. Brown stated that Mr. Brock and Mr. McLamb had stated -Tell their feelings. Mr. "omble expressedhis thanks to the Board members for their remarks and stated that he had enjoyed working with the Board and wished each one well and stated that he would remember them in his prayers. He further wished for the Board greater success in the future and stated tha with the able help joining the Board he felt sure this would be the case. The meeting was recessed at 11:45 for the swearing in of the Commissioners and lunch. The Board met in Executive session from 1:30 until 2:30. The Board reconvened at its regular session at 2:30 P.M. at which time Mr. D. P. Ray, Commissioner, joined Mr. Brock, Mr. Brown, Mr. Cotton and Mr. McLamb, Commissioners. Mr. W. J. Three persons were nominated to serve as dog warden. Mr. Herbert E. Hudson received the highest number of votes and will serve as dog warden for Harnett County at the pleasure of the Board. Upon motion of Mr. Ray andsecond by Mr. Cotton, Mr. H. D. Carson, was appointed to serve as County Auditor for a period of one year. The motion was seconded by Mr. Brown and it carried. Mr. Tom Allen, Tax Supervisor, presented the following request for refund to the Board: Payee: Daphine Matthews 311 East E St., Erwin, N. C. Refund on 1965 Buick not located in Harnett County as of January 1st 1968 Assessed Value 41030. Amount of refund #13.49 less Discount .13j Total Refund - 13.36 Mr. Allen stated that he had received a letter from Miss Matthews stating that she is serving with the armed forces in Japan and had paid taxes on the automobile in Japan. Action: Mr. McLamb made a motion that the refund be approved, secon ed by Mr. Ray and the motion carried. Mr. A. J. Stephenson,Jr., appeared before the Board, requesting the Board to make some immediate arrangements for office space for the Magistrates. He pointed out that the law provides that the county must provide such space. He suggested that the Commissioners room would seem ideal to him with a few alterations. Mr. Brock stated the Board would allow the Magistrates to use the Commissioner room as it is until the Board could make some other arrangements. Upon the recommendation of Mr. Frank Lewis, Mr. Brown made a motion that the following Resolution be adopted. The motion was seconded by Mr. McLamb and it carried: WHEREAS, certain resident freeholders living in Johnsonville, Barbecue and Anderson Creek Township!, Harnett County, North Carolina have presented to the Board of Commissioners of Harnett County a Petition requesting said Board of Commissioners to call an election, as provided in Article 3A of Chapter 69 of the General Statutes of North Carolina, as amended, for the purpose of submitting to the qualified voters living within the area described and defined in sai Petition the question of whether or not a special tax on all taxable in said district, of not exceeding Fifteen Cents (t.15) on the One Hundred Dollars ($10000) valuation of property, shall be levied for the purpose of providing fire protection in said district; and, WHEREAS, said Board of Commissioners of Harnett County has ex- amined said Petition and finds the same to be in due form and accord to law, and further finds as a fact that the same contains the signa of more than fifteen per cent (15 %) of the resident freeholders livi in the area described in said Petition; And, WHEREAS, the Board of Commissioners of Harnett County desire, a required by law, to call an election in said Spout Springs Fire Dis- trict for the purpose of submitting to the qualified voters therein the question of whether or not a tax shall be levied upon the taxable property therein for the purpose of providing rural fire protection in said district as provided by law; NOW, THEREFORE, be it ordered and resolved by this Board of Commissioners for the County of Harnett: 1. That, pursuant to the provisions of Article 3A of Chapter 69 of the Cmeral Statutes of North Carolina, as amended,an election is hereby called to be held in that area designated and above des- cribed as "Spout Springs Fire District," for the purpose of sub- mitting to the qualified voters therein the question of levying and collecting a special tax on all taxable propety in said district, not exceeding Fifteen Cents ($.15) on the One Hundred Dollars (!100.00) valuation of property, for the purpose of providing fire protection in said district. 2. That said election is hereby called to be held on , 1969, between 6:30 A.M. and 6:30 P.M., Eastern standard imme,at which there shall be submitted to the oualified voters in said district the following questions: property ng urea 231 "In favor of tax for fire protection in Spout Springs FireDlstrict." SIGNE THOMAS ALLEN TAX SUPERVISOR, HARNETT COUNTY Mr. Frank Lewis advised the Board that the Town of Lillington would be happy to allow Mr. Porter's Department to occupy the space over City Hall which is now being used by the Chamber of Commerce. This would be provided rent free. By doing this Mr. Lewis suggested that the space now occupied by Mr. Porter could be used by the Magistrates and the Highway Department. He stated that if the County does not see fit to do this, the Town of Lillington will make the space available to Highway Department. Action: Mr. Brock directed the Building and Grounds Committee, Mr. Brown and Mr. Ray,to move Mr. Porter to the space provided by the Town and make his present space available to the Magistrates and the Highway Department if these facilities could be made workable for these different offices. Mr. Brock stated that the Board had decided earlier this year to appoint a recreational committee for the county and he suggested that Mr. James Goff be appointed to this Committee to do the leg work. Mr. McLamb requested that the Board not take action on this until Mr. Hodges, who has given much time to this program, be allowed to speak to the Board. He stated that Mr. Hodges had asked to come before the Board. The Board agreed to hear Mr. Hodges before making the appointment. Mr. Brock stated thathe had a reauest from the Sheriff to purchase a desk and chair for the lady recently hired in his office. The Board )directed Mr. Brown and Mr. Ray to purchase the proper chair and desk. The following road petition was presented to the Board by Mr. Brock: Road #125 1.9 miles 7 Homes on Road Hector's Creek Community. (Request that Road be added to Secondary Road System for Maintenance Action: Mr. McLamb made a motion that the Board approve the petition, seconded by Mr.Bown and it carried. ATTY FEES Mr. Brock presented the following letter to the Board from Mr. Welfare Liens) Marshall Woodall for its consideration. Mr. Jack Brock, Chairman Harnett County Board of Commissioners Erwin,North Carolina August 2q, 194,8 Re: Fees - Collection of Welfare Lien Dear Mr. Brock: Sometime ago, a state welfare auditor requested that we send a re- vised notice of the fees paid to me for my services in collecting welfare lien amounts. As you will recall, it was agreed that my fee would be as follows: (1) Lien amounts collected without necessity of suit - five per cent (5 %) of the amount collected. (2) Lien amounts collected when suit has been commenced to recover collections or when county has been made a party in a proceediig which results in a collection - twenty per cent (20%) of the 233 COURT COSTS (Filing Tax Suits TAX & WEL- FARE LIEN REPORT first $500.00 of the lien amount collected, plus ten per cent (10%) of the excess over $500.00 of the lien amount collected. It has been my experience that the fees previously agreed upon are in- sufficient to adequately compensate for services performed in filing the necessary reports of collection or non - collection with the various offices, conferring with individuals concerning liens, and pursuing other various work-in running down the liens to determine collectabiiity. With the above in mind, I request that the Board of C ommissioners re- consider the fee arrangement with me. I would suggest, at least, the following: (1) Lien amounts collected without necessity of suit - fifteen per cent (15 %) of the first $500.00 of the lien amount collected plus five per cent (5 %) of the excess over $500.00 of the lien amount collected. (2) Fees for collections involving suits - same as at present. I am sending a letter to each Commissioner and a copy of one letter to Mr. Carson, Clerk to the Board, Col. Alexander, County Manager, and Mr. Bowen, County Attorney,for the purpose of your consideration of the matter before the next board meeting and for the further purpose of saving you time-at the meeting. Marshall Woodall scussed this with Mr. Bowen, former had stated that this schedule for Action: Mr. Cotton made a motion that the Board approve this request of Mr. Woodall. Mr. McLamb seconded the motion and it carried. Mr. Woodall appeared before the Board and stated that it might possibly be that advance payment of court costs will be necessary when the suits are filed since payment will now be made to the State and not the County. The cost to file a Suit in Superior Court will be $27.00 he stated, and he recuested the Board to authorize the Auditor to write checks to cover these court costs if it is necessary to make advance paymen Action: Mr. Cotton made a motion that Mr. Carson be given the authority to write checks to cover these court costs upon approval of Mr. Woodall. The motion was seconded by Mr. Ray and it carried. Action: Mr. Cotton made a motion that the Board authorize payment of salaries to County personnel on the 20th of December instead of the 24th. Motion was seconded by Mr. Brown and it carried. salaries to 0 BOARD OF Mr. Carson stated that the Board had amended the budget £nr the Board of ELECTIONS Election$7500.00, but that the Board of Elections presently was $10.00 over the amount allegated. Mr. Carson requested the Board authority to continue paying the bills of the Board of Elections. Action: Mr. Ray was directed to check and see how much longer it will take to complete this work and wbrk with Mr. Carson and bring the matter back to the Board. Wednesday at the Lee County Hospital and also with Dr. Stratus from Raleigh to form new organization of Mental Health Program. Following is a copy of two letters sent to the Highway Department by Mr. Brock: December 4, 1968 HARNETT Mr. Carl Meares, Commissioner COUNTY State of North Carolina (Highway State Highway Commission Maintenance Fair Bluff, North Carolina 28439 Supervisor) ERWIN BRIDGE (Cape Fear River) Dear Mr.Meares: It has come to my attention that Mr. Roger Weaver will be retiring from his post as the Maintenance Supervisor of Harnett County, in January 1969. We believe that he has served this county and its people with distinction and honor. It is hoped that he will be appropriately recogniz ed for the many years of faithful service which he has rendered. Needless to say, the Board of Commissioners of Harnett County has been pleased with its relationship to the State Highway Commission through Mr. Weaver's office. It is with these thoughts in mind that the Board asked that I contact you relative to the appointment of a new supervisor. We do not wish to impinge upon your prerogative, but it is our feeling, all things being equal, that eligible loyal candidates should be given priority consideration for the appointment. We believe that several men, now employed in the Lillington Office, have the background, qualifications and ability to assume the responsibilities of the supervisor's position. Ithas been our experience that locally oriented personnel are often in an excellent position to better serve their home communities than those from without. The Board of Commissioners shall be grateful for your consideration of this matter. Regardless of who is appointed as the supervisor, we shall respect that decision. BROCK, Chairman Board of County Commissioners November 26, 1968 Mr. Carl Meares, Commissioner State of North Carolina State Highway Commission Fair Bluff, North Carolina 28439 Dear Mr. Meares: I am becoming increasingly concerned about the structural soundness of the bridge over the Cape Fear River at Erwin, North Carolina. The safety of the people who use this bridge is uppermost in my mind. Extensive repairs have been made to the bridge during the past few years, yet it appears that the bridge presents a safety hazard. I have stood on it, as light traffic progressed across it, and felt the shaking and quivering which occurred. I, along with many other people inthe area avoid using this bridge due to its hazardous condition. `J36 F I respectfully request tha %immediate steps be taken to evaluate the Erwin bridge from an engineering standpoint. Should this evaluation indicate the wisdom of restricting heavy traffic or theimposition of other safety measures, I would encourage you to take such measures as quickly as possible.
