March 4, 1968 PUBLIC HEARING
After due publication of Notice of Public Hearning, ie Harnett County Board
of Commissioners held a public hearing at the County Courthouse in Lillingtn, N. C.,
on March 4, 1968, at 1:30 P.M. All the Commissioners were in attendance together
with the County Attorney, Wiley F. Bowen.
Mr. M. H. Brock, Chairman of the Board, called the meeting to order and stated
that the purpose of the meeting was to determine whether the exercise of the powers
enumerated in North Carolina General Statute 153 -9 Sub - paragraph 58, is necessary to
assure adequate and continuing ambulance service in this county.
Mr. Robert C. Bryan, Attorney, representing Mr. W. D. Whittenton of Whittenton
Ambulance Service, who had petitioned the Board for a franchise to operate in a certain
portion of the County and for subsidy to operate this service, and which petition
caused this public hearing to come about, appeared before the Bard and presented
evidence and testimony. Mr. W. A. Johnson, Attorney, representing O'Quinn & O'Quinn,
also appeared before the Board.
After discussion of the evidence and testimony presented, upon motion of
Gilbert Brown and second of J. E. Womble, the following resolution was unanimously
adopted by the Board: Be it resolved that the petition filed on behalf of William
Delmas Whittenton for an exclusive franchise to operate ambulances within an area
of Harnett County bounded on the West by U. S. Highway 401, on the North by N. C.
Highway 27, and on the East by Johnston and Sampson County lines and on the South
by Cumberland and Sampson County lines, and excluding the Town of Lill ngton, be and
the same is hereby denied. The petitioners request for a subsidy to operate said
proposed ambulance service is also hereby denied. It appearing to the Board after
public hearing that the exercise of the powers provided in G.S. 153 -9 sub- paragraph 58, is
not necessary at this time to preserve, protect and promote the public health, safety, and
general welfare of the people of Harnett County.
